Dear Sirs: Since I am moving out of Richfield, it is necessary for me to resign from the Senior Citizen Handicapped Commission, effective today. I wish to thank you for the privilege of serving on the Commission. Though we have been operating for a short period of time, it seems to me that a lot has been acomplished by the Council, for the Seniors. - My reason for leaving the city is that no apartments are available here which are suitable for old ladies. By that I mean underground garages, elevators, and security systems. Perhaps some developer could be encouraged to produce such apartments so that it wouldn't be necessary for us to move .away. Eventually, most. seniors get to the stage where keeping a house and yard is just •to much, and hiring everything done (if you can find the help) is more expensive than renting. - Again my thanks. City Charter Amendments by Ordinance_ First Reading Mr.-Gordon $. Sanders, chairman of the Richfield. Charter Commission, has requested to be placed on thee. city council agenda of May 12 , 1975 , in order to present proposed amendments. to the city charter. The charter commission is pro- posing to amend Sections 4.02 and. 4.07 of the city charter. The charter commission is proposing to amend Section 4.02 bf the city charter in order. to provide that a municipal primary. election would be head,. on the first Tuesday after- the second Monday in September, rather than on Tuesday, four weeks in advance o£ the regular election. In effect., this would .provide that the municipal primary election would be held on the same date as the state primary. election. The • proposed amendment to SECtlon 4.07 of the city charter would provide that the council would. meet to canvass the election returns at the next regulator special council meeting immediately following a regular primary_ar special election, .but in no event later than the Monday next. following. Currently, the city. council has to meet within- five days after an election to canvass the election returns, and this proposed amend- ment could eliminate the necessity of having a specialcouncil meeting for the purpose of the canvass . The proposed. ordinance outlining these changes has been drafted and is attached for city council review. Minnesota state law proscribes two methods of amending a home rule charter. First, Minnesota Statute 410.12 provides that -the- charter may be amended by a petition of voters equal in number of five percent (5%) of the total votes cast at the last state general election in the city. The petition is then submitted to the charter`com- mission of the city for its approval as to form and substance. Within .ten (10) days, the charter. commission must either forward.. the petition to the city council or return it to the petitioners for changes to comply with any requirements of the state law Within' ten (10) days after the petition: is submitted to the city council, the .city. clerk shall determine the validity of -the signers. of the petition.. The state statute also provides for the proper format of the petition., the wording of the petition, .and the opportunity for the petitioners to correct errors in an original petition. The. public safety department-has inspected this location and found' that an obstruction problem does exist, The bus shelter in conjunction with the tree plented just north of it Gause some vision problems for drivers approaching Portland Ayenue frQrrr the east on .73rd Street: The public safety department has found that three accidents have occurred at this intersection during-.the course of oneyear: Each of these accidents occurxed during the winter months. To determine the alternatives availably to the city in .this matter., the public wgrk:~ department' contacted repre .entatives of the' Metropolitan Transit Comm- ssion. Foxlowin,g are the three Qptions available to the city on this matter: 1 . The agreement between the Clay of Richfield and the MTC stipulates .that "The MTC shall remove any shelter upon 90' days-nptice give`ri by the city." This removal procedure'would be done at the cost of the IvITC. The problerri with removing the shelter is that an esta.mated 30 pegple or more use this shelter during;:-the course of a normal workday. V1~ithout the shelter 50; people" per week would be without the protection it affords them from the eler~rents; Tn addition; the tree to the north would have to be re- moved to completely erase any vision problem in this area. 2 It would be possible to relocaae the bus shelter to minimize. the vision problems. Relocation could be accorriplished by the MTC in early fall of this yeah. The move would ciansi.st of removing: the shelter from the' exist- ing location, removing a'll concrete and wiring, together with resodding" the area. The shelter would then be installed in .the new location. There are ~• some problerr}s with this proposal. The MTC feels that if relocation is desired than- the city should. bear 50% of the. cost or $650. Second, the Council Zetter No. 1S1 -2- May 12, 1975 • new location will require a determination o~ whether adequate public right-of-way exists and a lease agreement with two property owners in the area may have to be negotiated. Finally, such a relocation .could not be accomplished until early fa 11 of this year because the - MTC is currently involved with a major effort in the installation of bus shelters in the metropolitan area. 3. There`is also evidence suggesting the bus shelter should remain in its current location. First, although some vision problems exist in this area, it appears i;hat this does not cause a significant hazard to motorists. As suggested before, only three accidents have occurred at this intersection ,n one year's time, These; accidents have occurred during winter months suggesting that the weather may have had some effect on: the situation. Therefore, removing this shelter would not significantly reduce accidents. Second, the removal of the shelter will inconvenience the 1S0 commuters which this stop serves each' week. .Finally;: the.-relocation of .the shelter wall involve a Tong delay.. in construction, costs in-construction and land rental, arzd no guarantee that property owners in -the area will agree to lease portions of> their property for thi purpose. While it is agreed that some vision obstruction results from the location of the bus shelter and the tree located just north of it; it is felt-;that the advantages of .retaining the she ter at its existing location outweigh he disadvantages of removing or relocating the shelter. " Those memorandums provided information on the advantages of such:a system, the history and development, information on the planning and evaluation of a county-wide communication system and a ..summary. of the 911 system, and recommendations submitted to the Hennepin County board of commissioners by the Hennepin County Criminal Jus ice Council.. There has .bean substantial study .:.made on the 911 emergency communica- tion system, .although there has' been no commitment to the details 'of how the system would be implemented'or utilized in Hennepin County or in the various municipal jurisdictions within the county. We have, therefore, reached the: point in the planning process for the: implementation of a 911 system where it is desirable to establish an interim user-board. Honorable Mayor.. and Members of -the'-City Council City of Richfield' 'Gentlemen: SubTect: Speed Limits on Streets Adjacent to Richfield Schools Some time ago, the city council requested that a study be conducted by the Public Safety Department to determine whether the speed limits on streets adjacent =to Richfield schools were appropriate.. In particular, the council expressed concern about the speed limits on the streets. in the area of East Junior High School and Elliot'Elementary School. The Public Safety Department did: survey the speed limits in this area and found that the currently posted speed limit of thirty .miles per hour is :appropriate. To date, 'no .problem. has been detected on streets bounding these two. schools . In facf, there does not seem to be any significant public safety problem on streets surrounding ~., Richfield schools , There area ,number of forces that tend to minimize the safety problems on these streets,. First, the Richfield school system has a very progressive school. patrol program which insures that all children walking. to or from school are protected at major intersections . This program also has the effect of identifying major traffic flow on residential streets. near the schools to iprovide .pedestrian. patrols where needed. Second., the traffic signs and signals posted in the vicinity of Richfield's schools tend to slow traffic to minimize hazards encountered by pedestrians. Third:, the Public Safety Department is `conducting an ongoing monitoring program headed by a Richfield :police officer. This program allows the department ~to maintain a clear , picture of the potential hazards and insure that prompt and appropriate action is taken in he event that hazard are discovered. Some time ago, Hennepin County representatives surveyed county streets in Richfield. It was. their recommendation that the speed limits should remain as hey are currently posted. Their findings indicated little, if any,. justification for speed reduction while in one case, an increase in speed was suggested. To change the speed limit of a state or county road, the city would have to petition the appropriate government unit. 2 .: .~ -~ '. CITY OF RICHFIELD, MINNESOTA . Office of City Manager Council Letter No . 148 .Agenda May 12, 1975.. The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: ~~ Subject: Resolution Establishing. Parking Prohibitions at Senior Citizens/Community Center Building. During the past few months there have been a number of complaints con- cerning the inability to find adequate :parking. space at the Senior Citizen/ Community Center .Building. One of-the major problems seems to be that a number of students who attend the local high'school have been using this park- ing facility beta-use of the various.. types of parking"restrictions that have been placed on the streets surrounding the high school. • o us possible The city staff has reviewed this situation and of the vari solutions we feel that'a workable approach would be to restrict parking in this lot to before 8:45 a . m . on weekdays . The students and others who park in the lot earlier than 8:45 a . m , would have to park elsewhere . Of course, students whose. classes start before- 8:45 a.m. would not be able to park there at all. This approach would give individuals. who attend activities at the center,. an opportunity to find parking between 8:45 a.m. and 9:00 a.m. Many activities apparently begin at 9:00 a . m. at the center. This approach has two obvious drawbacks. First, anyone .parking before 8:45 a.m. would be in violation and would receive a citation. Second, students.. .who do not have to be in school before 8:45 a.m. would still be able to compete for the spares. It is recommended that the city council approve the attached resolution which provides. for the parking restrictions indicated in this council letter: It would'be Council Letter No. 148 -2- `May 12, 1975 .appropriate to .erect the type of signing suggested immediately on an experimental basis for the remainder of the school year. If this type of parking prohibieion does :not seem to work, then other al erna ive approaches could be considered- before- the school session begins in the fall. However, in de- veloping the 1975 budget, it appeared desirable to create one additional budget activity to account for' administrative services. The purpo e of this additional divisio~_ ~ ~.•: t., make it possible to more closely define the area of accountability • of civilian public safety. employees and to emphasize the fact that this admin- istrative division provides support services to all three operating divisions within the public safety department. While the city council approved the change in the operating budget, we have .not as yet proposed the corresponding- amendment to the city ordinance to increase the divisions in the public safety department from three to four. The purpose of this council-letter is to recommend that change through adoption of the attached ordinance amendment. In addition to the accounting and management reasons for making this organi- national change there has been-some confusion concerning which public safety employees are covered by civil service and which are not. At a recent meeting _ the civil service commission discussed this problem with the city attorney and the commission agreed that employees who should be covered.by civil service were those assigned to actual firefighting duties and sworn police officers. However, to clarify this. matter the -civil service commission requested the city. attorney to prepare an ordinance amendment which would formally establish an administrative division within the public safety department. Such an ordinance amendment would clearly. define those employees who fell under the jurisdiction of the civil service commission. Council Letter No. 126 -2- April 28, 1975 In summary, the change made in the. 1975 budget and. the request of the civil service commission resulted in the preparation, of the same ordinance amendment. Board Re Installation of Sprinkler System At the April 28, 1975 city council meeting the city council served as and was constituted as the Board of Bulding,_Health and Fire Code Appeals. The- board subsequently heard an appeal from Mr. Jack Langer and Korner Plaza, the tenant of the property located at 410 West 65th Street and 6453 Lyndale Avenue in Richfield, Minnesota. The tenant has appealed a notice issued by the fire division of the public safety department requiring the in- stallation of a sprinkler protection system.. The board was presented evidence as to the code violations-by city staff members and they also heard a presentation by legal counsel representing the tenant. A photocopy of Council Letter No. 127 which outlines the code defic- iencies at this location as well as photocopies of the specific codes being violated is attached for city council review. The appeals board deferred taking definitive .action on the- appeal by the tenant until they had individually been able to view the premises. in-question. All the members of the board should have had the opportunity to view these premises prior to this meeting. The board specifically closed the hearing and therefore no further evidence can be heard nor submitted prior to the decision of the board . It is the conclusion of the fire. chief and the public safety director that the property discussed herein has violated the previously cited codes, is an eminent hazard to the adjacent structures, to the persons working in the proximity of .this area, and to the city fire personnel who may be required to extinguish a .fire at this location. , ~ .
