.Gentlemen:
Subject: Request for Approval of Off=Street Parking Layout
and Contract - 221 West 76th Street
Mr..-James Martinson of Oakwood Builc~~rs, Inc, has requested that the
off-sheet parks contract be placed on the March 10 city council agenda so
that in the event the city council acted to approve the- special use permit and
variance consideration could also be given to the offmstreet parking contract.
The attached sketch indicates the layout for the proposed building and
offmstreet parking, The development provides for 12 enclosed parking spaces
and 9:off-street parking spaces, which is within the ordinance provisions.
In the event the city council wishes to consider this off-street parking
contract, it is recommended that approval be subject to the following stipu-
lations•`
1. Evidence of a purchase of land to provide access from 76th Street
into. the property, to be filed with the city as part of the off-street
contract
2. Final building plans to be approved by the department. of public works
3: Grading and drainage plan to be approved by city staff.
4;. Landscaping and lighting plans to be approved by city staff.
5 . Secure. necessary permits .

Tax Forfeited Land
Each year the city receives from Hennepin County a list of tax forfeited land
located in the City of Richfield. 'There is one such parcel on the current lista
located at 76th Street and Humboldt Avenue: alongthe service road bordering 3SW.
This parcel is shown in'red on the. attached mapo - ,`
The Hennepin County Board. has classified this parcel a5 non-.conservation
. land and authorized its, sale. However, Minnesota Statutes require that. the city
council approve the non-conservation classification in order to make the land
available for public sale.
This parcel has_been reviewed by members of the city staff and it is rec-
ommended that the .city c®uiicil adopt the. attached resolution- approving the class-~
ification of this parcel as non-conservation land and approving its sale.

Frennepin County has informed-the City .of Richfield that they wish to
replace the existing traffic semaphores-at 76th Street and Penn Avenue'
and 75th Street and Penn Avenue with modern seanaphores that will meet
the Minnesota Standards required under the Minnesota Manual on Traffic
Control Devices: The work will be completed sometime during the current
'year.
Since there :will be no cost to .the Cfty of Richfield, it is not necessary
for the city council to authorize the execution of any agreement.

RESOLUTION ESTABLISHING SEASONAL LOAD
RESTRICTIONS ON CITY STREETS
BE IT RESOLVED by the City Council of the City of Richfield, as follows:
Seasonal load restrictions are hereby adopted, .prohibiting the ope:r^ation of
any vehicles upon any street or highway of the city, if such vehicles have an
axle weight in excess of ~+ tons.
1. "Street or Highway" means the entire width between the boundary lines of
any road, street, highway, alley, or any other place open for-the operation of
motor vehicles by the public.
2. Such restrictions shall be for the period from March 20th to May 15th,
1875.
3, The city administration is authorized and directed to post such load
• restrictions as required by the provisions of Section x.06 of the Ordinance Code
of the city,
~+. This resolution is adopted pursuant to Section x+.06 of the Ordinance Code
of the city. In addition to the exceptions provided for in said section, such load
restrictions shall not be applicable to school buses and buses operated by the
Metropolitan Transit Commission.

improvement construction in Districts Nos. 7 and,9, City Project No. 667, in
accordance with p~eviaus city council authorization. The city clerk; public
works director, planning director, administrative assistant and two members of
the consulting. engineer''s office also represented the city at the bid opening.
DistrictNo. 7 includes that area bounded on the-north by 74th Street,. ..the
• east by Portland Avenue, the south by 78th Street and the west by Fast Pleasant<
Avenue. District No. 9 includes that area bounded on the north by 66th Street,
the east by 35W, the south by 76th :Street and the. west by Penn Avenue.
The attached bid tabulation indicates the amount bid by each of the ten
bidderG for the proposed project. The minutes: of the bid opening are also
attached, the consulting engineer's cost estimate for the construction of this
project was $2 ,3.00,OOC1.. The .loW bid of Lundin Construction Co. Inc. - Riegger .
Roadways., Inc. at $1, 9~d, 226.25 is 13% below this .estimate.
It is the recommendation of the consulting engineer, the public works director

Riegger Roadways, Inc., 920 West 122nd .Street, Burnsville, Minnesota, is the
lowest bid by a responsible bidder for the construction of City Project No. 667,
Areas Nos. 7 and g, pemanent street surfacing.
2. That the bid of Lundin Constr.. Co. Inca, - Riegger Roadways, Inc., for
the construction of the .above referenced project on a unit price basis, at the
price contained in their proposal of March 7, 1975,, with an estimated con-
• struction cost of $1,898,226.25 is hereby accepted.

Roadways, Tnc. and the. City of Richfield be given Clerk's File No. and
be placed on file. That .said proposed contract for the construction of said
city project is hereby approved and adopted and the Mayor and Manager are

structed the city staff to prepare a preliminary report on this subject for:'discussic~n

• Attached to this council letter is a staff report on Community Gardens prepared
by the parks superintendent and the manager of Wood Lake Nature Center. .This
report contains a survey of other communities which have implemented Community-
- Gardens, the advantages grid disadvantages of this type of program as experienced.
by'other communities, possible locations within the City of Richfield, and certain
recommendatiens for the possible implementation of this type of project. -
It should be noted that this is only a preliminary report and there are possibly.
other items that the city council may wish to have investigated further. It is
recommended that before this type of project is implemented by .the city council.,

In an effort to resolve the issue of pedestrian safety, the Parks & Recreation

After much discussion with the abutting property owners and neighborhood ,
representatives , the-.Parks & Recreation Commission unanimously: approved alternative
number five>as the°best solution.<:In .addition, the~city•staff:was able to contact
the abutting property owners who were~not at. this meeting, with one exception,
and they concurred' in this .recommendation
The.city council, at its meeting on :January 27, 1975, requested that the
Fuhlic'Safet~'~•~artment provide:an additional ~~w=~f the~pedestrian.acees to
Roosevelt: Park as it relates to 76th Street. The Public Sa#ety~~Department has noted
that the.araffc volume:on 76th' Street between~Portl_and.::.:and-Glint®n•Avenues is
relatively low. ~ However, they also noted that there has already-been one pedestrian
personal injury- accident: at theintersection of 76th Street and= CLinton'sAvenue this
year. ,Presently, there is an existing. sidewalk only along the north side of 76th
Street.
The: Public- Safety Department- points out that. from the pedestrian safety stand-
point, it wou d.seem:;that the best approach to~this problem would°be~to install a
three-way stop sign with marked crosswalks; at the intersection of Fourth Avenue and
76,th'Street.,!"~A.ccessao~ he north sde:of Roosevelt:Park~would then,be:limited to~a
walkway,between~ahe park~and~76th Street constructed~along.a.portion~of the vacated
FourthAvenue. •,;Should ths:course:of action-be:followed, it wou d probably~be'
• necessary to install fencing along the north s:ide~of the:park to~ir~sure access limited
to the.~Fourth Avenuearltrance. • This alternative was .the first one considered by

the:Parks & Re'creation'Commission and the abutting property owrieT~. It was rejected
by~these two-groups-because of -the excessive•amount of pedestrian. raf£ic affecting
the abutting property owners. -
The second option proposed by the~Public Safety`Departmentwould be to provide
thewalkways between 76th' Street: and,the north side •of the park along the portions
- of the'wacated Clinton, Fourth'and'Fifth'Avenues. This use of a:multiplea•ccess
- approach would be, in the opinion of the Public`Safety'Department less desirable
from the pec~~trian ~ safety point of .view . • However., if this option: is chosen, it is
suggested that. the walkways bo marked at the- intersections of Clinton, • Fourth and
Fifth'Av.enues:a<long 76th`Streetand the installation of pedestrian .crossing: signs in
both •directions'-along: 76th' Street. This -second option is essentially'the same gas the

Chapter 6, _Section 6.15 of the City Charter stipulates that the city council
must approve the :purchase of merchandise, .:materials and general construction when
the amount exceeds $l, 000. This letter contains a number of items--which fall under
that category .
At the city council meeting on February 24, 1975 the council deferred action
• on approving expenditures: for a` scheduled maintenance contract, the Worthington
Ch~i]aer repair and the temperature control maintenance contract. This item.. was de-
ferred because' one of the firms-that provided a price quotation for this work had in-
dicated .that there wa s a misunderstanding concerning the' price that they. had .given.
the city for the proposed maintenance work. On March 7, 19:75 city staff members,
Councilman Lue finger, and a representative of Advanced Engineering met to. discuss
that firms proposal. _
Scheduled Maintenance. Contract ~ `
This annual service contract provides for the regular inspection and adjustment
.of :heating and air'condtioning controls a city hall,. the; community building,, the Cedar
and Zyndale Avenue liquor stores, and Fire Sta ion No. 2. Quotations have been
solicitated and received from three can_panies for this contract. It is recommended
that the city council approve a price quotation from Advanced Engineering in the
amount of $4, 406.88
Worthington Chiller Repair
When regular maintenance inspections revealed that the Worthington Chiller
was in need of overhaul,' competitive quotations were solicited. It is recommended
that the city council. approve'`-the low quotation of Advanced- Engineering in the

amount of $1, 000.. This contract will provide for the estimated cost of the
replacement parts to.repair this chiller.. The' cost..: of labor. to provide for this
.repair is included in the price quotation of Advanced Engineering in the previously
discussed scheduled maintenance contract.
Temperature Control Maintenance Contract
The city has annually had preventative maintenance contracts for the pneumatic-
control devices. in the city hall-building.` This agreement provides for a wide range
of services on the controls that regulate the heating and air conditioning system
within this building. The contract contains a schedule far preventative maintenance,
-parts replacement and emergency service.. In effect, this is a contract which guar-
antees the: city that the air conditioning. and heating control devices for'the city hall
will operate at peak efficiency the-year around.
This contract> in the past few .years"has been held by the Hone ywell Corporation.
When this contract came up for approval.at the' city council meeting in January of this
year, council"members ird icated that they would like to have another firm contacted
to see if they were capable of doing ,the work. We have contacted Advance Engineering
Inc, and received a dower price. quotation than was-offered by Honeywell. This price
quotation is .below $1, 000 and, therefore, specific council approval is not required.
The contract with Advance Engineering Inc. for this temperature .control maintenance
.will be implemented 'by the city.
It is recommended that the city council approve these three price quotations
..for which adequate funds have been provided in the:1975 budget.

Subject: Apartment Use Permit for I2 Unit Apartment at 221 W. 76th Street -
`Belmar Builders. request approval of an apartment use permit to construct a 12
unit apartment building at 221 W, 76th Street. A sketch plan showing the location
of the proposed apartment building_is attached hereto.
The subject property is currently zoned "MR" multiple residential and had prey--
iously (2968} been approved for the .construction of a similar twelve unit apartment -
project which would have been developed by a different sponsor. However, because
• the developer of the project could-not successfully obtain aprivate-easement providing
access to this. land locked piece of property from West 76th Street,. the proposed apart-
ment has never been constructed. A sketch plan showing the site development
characteristics of this. (1968) project as well as the council letter explaining the
circumstances under which the previously approved project request was withdrawn are
attached hereto .
The .proposal calls for the construction of a twelve unit apartment building :similar
to the one approved on this property in-1968 with some modification. The building
will be three stories rather than two and one-half stories, and the garages and
.parking .areas will be oriented to the rear of the lot, rather than to the side along the
railroad tracks and front of the building as previously approved. The twelve apartments
will be divided into six one bedroom and six two bedroom units . A negotiated auto-
mobile easement providing access from 76th Street onto this property has been secured
from the owner of the property north of this site. Automobile access will be provided
by way of a two lane private driveway. Pedestrian access will be provided for in the
form of a private sidewalk onto the project.
The project shall provide 2.0 parking spaces for each unit. One of these spaces
mush be in a covered garage. Therefore, the project easily satisfies the standards
o£ the city code which require 1 .5 spaces for each unit. As far as can be determined,
all other aspects of the city code relative to apartment projects, -with one exception.
of the height restriction, have been satisfied by this proposed project..
. The planning commission considered this request at its meeting of December 19,
1972. and recommended approval of the apartment use permit subject to the fallowing
stipulations:

I. A variance from the two and one-half story height restriction be approved
for this project bythe planning commission and city council..
2. Off-Street parking contract for this project be approved by the city council.
3. Evidence of the private easement providing. access from 76th Street into the
property-be reviewed by the city attorney and filed with the city as part of
'the off-street parking contract.
4 . Landscape and lighting plan be approved by the planning director.
5 . Building plans be approved by the .chief inspector and fire marshall.
6. Drainage and grading plan be approved by the city engineer.
7, All electrical and telephone service into the project be installed underground.
8, The two parcels be combined for tax puranses.
9. The builders use. masonry construction.
10. That elevators be installed if necessary.
• Staff is of the opinion that the site and building plans prepared for this project
are improvements over those formerly approved for this property in 1968. Unfortunately,
because of its proximity to the. THIN and S railroad and the city's municipal garage,
there is only so much that can be done in terms of enhancing the appearance_ and
functional aspects of the project. Nevertheless, this proposal should be one of the
better projects approved for this area. Therefore, staff concurs with the recommendation
of the planning commission that the apartment use permit for this project be approved,

-Dear Mr. Krier:
We recently received a notice of a variance request relative
to the construction of a twelve unit, three-story apartment
building at 221 West 76th Street in the City of Richfield.
Upon inspecting the site, it was found to abut the property
and trackage of the Minneapolis,. Northfield and Southern
Railway. While it is not our position to object to the con-
• struction at the above location, it is our concern that the
Planning Commission and the Council, along with the proponents
of the proposed building be very aware of the close proximity
to railroad trackage.
Although the railroad usage is not considered high density in
description, any rail. use could possibly be disturbing to
nearby residential occupants. This may be more especially true
on upper floors as noaae travels upward.
We believe it is appropriate to voice our concern at this time
- in the planning of the proposed building so that all possible
measures can be taken in terms of design, etc, to reduce to a
minimum the conflict. in usage.
