City of Richfield Gentlemen: Subject: Tentative 1975 Contract with Richfield Police Supervisory Bargaining Unit. The purpose of this council letter is to_recfomrnend :approval of a tentative .1975 .contract which has` been negotiated~.with the Richfield Police Supervisory Bargaining Unit. Background • As council members are- aware, all :management employees. of the city may, under the provisions of the State. Public Employee Bargaining Legislation, organize into bargaining units for the purpose of negotiating wages, .hours, and conditions of employment with the city. However, the only group-of management or supervs- ory employees which has, thus .far elected~to do, so,is the Richfield Police Super- visory Unit. This unite consists of Sergeants, Lieutenants, and one Police Captain. ~atlier this year council members will recall that there was a dispute between the .city and the Richfield. police officers. bargaining unit concerning a matter of bar- gaining unit determination (which. job classes would be represented by the unit). The police bargaining unit, requested the Bureau of Mediation Serv~:ces to mace a bar- gaining unit determination. The histoay of ahese determinations has :been that police "supervisory employees have ~nequently been included with 'thE employee bargaining .unit. Inasmuch as such. a determination would not-be in the best interests of the city, the city, did agree prior to a Bureau of:.j~iediaton Services determination to recognize supervisory employees as aseparate. unit. Tentative Settlement. A number' of meetings have been held with- phis new bargaining unit for the -pur- pose of negotiating not only salaries and fringe benefits for 1.975, but :also for the purpose of writing a new contract covering all matters required by state law. A tentative one year contract has .now been agreed upon with representatives of .the supervisory unit. In addition; we have been advised thaw this tentative agreement has been approved by the membership of this _bargaini~ng unit. `~ ,. ,., ,, ~ ' ~~ ; Council Letter No.` 13 -2~ January 13, 1975 The contract generally follows where applicalale, the .provisions of the prev~ iously existing contract with the police unit repres8nting dispatchers, pblice off= cers, detectives and juvenile officers. The tentative agreement also .provides for a 10.3 percent salary increase, a first time maximum contribution of $16 per month for dependent health insurance, and an increase in the annual clothing allowance from $150 to $200. The tentative settlement also provides for two additional ho}days so that all members of this unit will have 11 holidays on the same number of holidays as members of the police;°employees unit. The total compensation pacleage for this unit, which represents approximately 5 percent of city employees, amounts on ,the average.,to,a 11.90-percent increase. This tentative settlement compares favorably with'the 12°; 14 percent package negotia- ted with the other police unit. a '':,, • Recommendation Tt is recommended ghat the. city council; adopt•_the attached resolution approving this tentative 1975 :contract for the Police Supervisory Unit. An equivalency table showing rates of pay- for the positions repre ented by this unit is also attached. RESOLUTION AUTHORIZING TRANSFER OF APPROPRIATIONS FROM THE 1975 CONTINGENCY TO PUBLIC SAFETY DEPARTMENT WHEREAS, Resolution No. 5249 appropriated funds for each department of the city for the year 19759 and WHEREAS, a contingency appropriation was. made in the General Fund for various purposes, including. the 1975 salary adjustments and the related fringe benefit contributions; and ~-~ WHEREAS, Resolution No. approved the labor contract between the City of Richfield and the Richfield Police Supervisory Employees for 1975, providing for a pay plan and certain supplemental fringe benefits; and WHEREAS, it is hereby determined necessary to adjust the 1975 Budget appropriation of the Police Division of the Public Safety Department $17,552 to reflect such adjustments. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield that the sum of $17,552 be transferred from the contingency • appropriation of the General Fund to the Public Safety Department. LABOR CONTRACT BETWEEN THE .CITY OF RICHFIELD AND THE RICHFIELD POLICE SUPERVISORY'EMPLOYEES FOR .1975 WHEREAS ,.the Cty'Manager and the Richfield' Police Supervisory, Employees have reached a complete understanding. concerning. rates of pay, hours and .other conditions of employment for the year 1975, and :WHEREAS, the Personnel Ordinance requires that contracts between the city and. the exclusive :representative of employees in an appropriate bargaining. unit. shall be implemented by council resolution NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby approve the Labor Contract between the City of Richfield and the Richfield Police Supervisory Employees for the year 1975 and orders the provisions of the labor contract to be implemented effective on the first day of the pay period closest to January. 1, 1975 . Quick Lime • There is only one bidder offering to supply Quick Lime and that is the .Cutler. Magner Company: This company has -been the only bidder for this item.in the past few years making the supply of Quick Lime anon-competitive item. The Cutler-Magner Company qualified their bid subject to transportation cosk adjust.- ments and fuel availability. This type of qualification was allowed under the spec- ifications> Therefore, the Cutler-Magner Company bid should be acceptedbe- cause it doe's meet the specifications. Liquid Aluminum Sulfate ..There were wo bads received to supply Liquid A~utminum Sulfate. The bid of the Aanerican'Cyanamid. Co. `was qualified with a firm price for only the first quarter. ~' ~~ The bid" of. Hawkins Chemical, Inc. was qualified with a firm price for only 30 days . ~ Sim, a these two bids did not meet specifications it is recommended that the two `bids bexejected. The city has requested quotations for the supplying of Liquid Aluminum Sulfate for a ninety day period and it is recommended that a purchase order in excess of $1,000 be approved. This council letter contains a number of items which fall .under this category. Temperature Control Maintenance Contract • The first -item for approval is for the renewal of our annual preventative main- tenance contract for the pneumatic control devices at the- city hall building. - This agreement provides fora wide. range of services on the controls that regu- late the heating and air cord itioning system within this building. The contract con- tams a schedule for preventative- maintenance, parts replacement, and emergency services. In -effect this is a contract which guarantees the city that the air condit- inning and heating control devices for city hall will operate at peak efficiency year around . ~,~`~ ~ - ~ The cost of this preventative maintenance contract for 1975 is $2,-058, only $98; more than the 1974 contract. Funds are provided in the 1975 .budget. 'Rods for..Sewer. Cleaning Machine New "rods".,are needed regularly to replace those damaged or broken in rodding - ; efforts by the sewer rodding machine. .Previous to this time, rods have been ordered as need'ed:. ,However,` because of our possible inability to obtain these items in the future, it is proposed to purchase an inventory expected to last approximately one ' year.: In this way we can be guaranteed effective sewer cleaning services. The cost of one year's supply is $3, 305 with funds available for this purpose in the ,19.75..• budget. Truck Purchases -The 1975 budget calls for'-the purchase of a 3/4 ton pickup txuck. Shortly after the October council meeting a letter inviting residents to attend a November 20, 1974 meeting to discuss Roosevelt Park was distributed by a scout troop. to .approximately 440 homes -and 170 business and apartment units in an area between Nicollet Avenue on the west,. Park Avenue on the east,. 74th:. Street on the north, and 78th Street on the south. Letters were also sent to special interest groups currently using the park facilities and to special interest groups -using the facilities in the past. On'Wednesday, November 20, 1974, at 7:30 p.m., .approximately 8 persons representing special interest groups such as girls. softball and Assumption Church, sixteen park neighbors, and eighteen persons representing -the city council, park. end recreation department, .park and recreation commission, and.-the architects met• at "city hall in the council chambers to discuss the proposed: redesign of Roosevelt Park. Mr. Harvey Feldman, Director of Parks and Recreation, br.~efly discussed the purposes of the meeting, gave a description of the total city park system, and made a slide presentation depicting Roosevelt Park features at pres- ent, a ong with slides of development of other. 'Richfield parks and how these same features were handled in those parks. On December 10, 1974, a second .meeting of Roosevelt Park neighbors was held to review the concept plans for Roosevelt Park redevelopment as prepared. hy_ the architects . The current 1974/79 capi#al improvements program apprQVed by the park and recreation advisory commission, the planning commission and the city council • includes $3.50, 000 for park development work at Roosevelt Park in 1975. The prop- osed 1975/$0 capital -improvements program, already approved by the park and recre- aton advisory commission -and the planning commission, and to be reviewed by the city council early next month, also includes a budget of $350, 000 for park develop- ment work at' Roosevelt Park in I975 . The' .planning commission did,- however, ;pass a motion at the November 7, 1974 planning commission meeting to postpone the scheduling of Roosevelt Park if necessary to allow public safety improvements to be scheduled in 1975. Inasmuch as the public safety improvements. cannot be completed until after a detailed space utilization study, the staff has recommended,. and the city council concurred, that the city prooeed with the development of Roosevelt Park in 19 75 e Therefore it is recommended that the city council take the following action on this project's 1. AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF MONEY FROM THE SPECIAL REVENUE FUND FOR PARK ACQUISITION AND BETTERMENT City of Richfield does ordain: Section 1. It is found and determined to be necessary and expedient for the city to expend money from the special revenue fund for the acquisition and betterment of public parks and playground, including Roosevelt Park, in addition to funds. otherwise available for that purpose, such improvements being capital improvements for which the city would be authorized to issue general obligation bonds. Section 2. The sum of ~1-T5,000 is hereby authorized to be paid from the special revenue fund for such purposes. Section 3. This will acknowledge receipt of your letter of March 12, 1974, to the Richfield Fire Department Relief Association regarding Injured on Duty Pay. .However, in reviewing Article XV of the By-LaV;s, it is not clear that the Richfield Fire Department Relief Association can suspend ..payment of disability benefits for a period of ninety (90} calendar days and then reinstate it after payment of injured on duty leave fora period of ninety (90 } calendar days retroactively. Consequently, the City Council should ask the.City Attorney to request an Attorney General's Opir_ion on the following points of. Article XV of the Richfield Fire Depart- ment Relief Association By-Laws (copy enclosed): 1. Article XV, Section 1, in the first part speaks about "has been separated from the payroll of the fire department." If a member is now entitled to Injured on Duty Pay, Yas he been separated from the payroll of the fire department? 2. The last part of Article XV, Section 1, speaks about "expiration of any sick leave benefits." ~, pursuant to City Ordinance, Section 2.34, Subdivision 7; that on August 31, 1973, following a Hearing, you issued a 'final opinion denying the grievance. That thereafter,-the Richfield-Fire Department Relief Association commenced- disability payments to this employee. You now claim in your letter to the Richfield.Fire Department Relief Association of March 12, 1974, that you are prepared to grant a payment of :Injured on Duty Leave for a period of 90 calendar. days retroactively, and request that the Richfield Fire Department Relief Association suspend payment of disability benefits to this employee for the period of 90 days... Is Injured on Duty Leave synonymous with "expiratian cf any sick .leave benefits"? As you know, Insured ~. on Duty ..Leave is negotiated in the Union Contract. . T•iay the Richfield Fire Department Relief Association amend Ey-Law., Article XV, Section 1, sous to read "expiration of any sick. leave .and injured on duty benefits received from the, pensioner from the City of Richfield, whichever is the later date"? As previously indicated to you, this matter no doubt will come up again in future cases and therefore should be decided ..now so that they. will know what action to take. They are afraid that they would jeopardize pension rights if they sus-- Pend payment of disability benefits for. a period of ninety (90) calendar days while a person receives~irijured on duty pay and thereafter attempt to reinstate payment of a person's disability benefits--or in the alternative, a person could - start a lawsuit against the Richfield Fire Department Relief Association on the theory that they have jeopardized the person's pension rights as to reinstatement, and. that the person is now also entitled to payment of both benefits, that is, Disability Payments and Injured. on Duty Pay. It seems to ine the ultimate question to be decided is whether the Richfield Fire Department P.elief Association can terminate a person's disability pension under Article XV of the By-Laws--have a person collect Injured on Duty Leave for ninety (90) calendar days--and. then reinstate the person's disability pension under Article XV without jeopardizing the person's rights. You will recall that on July 20, 1973, one of the employees filed a Grievance Claim for Injured on Duty Leave It could well be that Minnesota Statute 424.02, 424.19 and 424.20, plus the theory of "unjust er_richment" if that employee receives a.duplication of benefites--applies to these situations--but an Attorney General's Opinion should be abtair_ed: so that the Fichfield Fire Department Relief ~.ssociation will have at least some protection as to their potential exposureon this question. I seems to me, that . the questions, could be.cor_densed down to simply three as follows: 1. Is an employee entitled to be paid double, that is, Disability Pension payment under Article- XV .from the Relief Association and Injury-on-Duty Leave payment under the Union Contract from the City, for the same 90 day period that he is incapacitated as a result of injury or occupational disease incurred while in the actual performance of his assigned duties? 2. If rot, does the employee have to pay buck to"the i~i,~hfield Fire Departxn.>vnt Relief Association the money he previously received from them when he is paid Injury-on-Duty Leave by the City for the same 90 day period of time? 3. (a) Ntay the City deduct as a credit from .their Ir_jury-on-Duty Leave payment, the amount paid to .the fireman by the Relief Association under 'the .following. provision in the. Union Contract (Article IX, Section 2): "Section 2: If the employee is .found to be eligible for injury-on-duty leave, he shall receive supplementary payments from the. Employer equal to the. difference between the total amount of all Employer injury related benefits, i.e. Workmen.'s Coripensatan, and his normal rate of pay for a maximum of ninety (90) consecutive calendar days. Such .supplementary payments shall not be charged against the employee's accrued sick leave." (Emphasis Added). (b) If so, must the City then pay over this money • deducted as a credit from the Injury--on-Duty Leave.. payment by the City, to the Relief Association Special Fund, from .whence it ~,ras paid--or may the City keep said money in it's own Treasury? If the above questions do not help. to simplify the situation, I would be willir_g to work with the City Attorney to rephrase them or in some wav resolve the matter. The. home.occupaton ordinance indicates that'a .sign of 2a0 square inches • may be displayed in an "R" district. The part of the ordinance regarding. signs.. in an "R" -and- "M12" district states that signs not exceeding two square feet may be displayed. To resolve this conflict it is recommended that tMe city council amend the home occupation ordinance by striking the. "2OO square inches" and inserting "2 square feet" . For consistency with the home- occupation ordinance, the portion of the ordinance dealing .with signs in an "R" and "MR" .district should also be-amended by reference to the home occupation ordinance. .~ The planning commission considered this matter and recommended approval of the zoning ordinance amendment at its November 1.9, 1974`meeting. After the installation of these signs a number of residents request- ed the removal of they signs, The city staff met with the residents on 18th Avenue • between 63rd and 64th Street to determine whether an alternate- type of parking re- striction would be acceptable to .the- residents on 18th Avenue... After considerable discussion it was the consensus of the residents on .this .portion of 18th Avenue that 38th Avenue between 63rd and 64th Street be posted as follows: 18th Avenue from' 64th Street to a point 225 feet north of 64th. The first bond is for the Richfield .Bank & Trust. Co. for the parking lot located just north of `the bank building. The secend bond is for Crosstown' Marine for 'the parking lot formerly owned by them at 6425 Lyndale Avenue. The public works department has inspected the property and confirmed that-the requirements of the off-street parking contract for the Richfield Bank Trust Co. have been met. All requirements of the.°ciff-street parking contract for. Crosstown Marine have been met except the installation of a- low hedge along . the east side of'the' property. WHEREAS, the Richfield Bank & Trust Co., 6625 Lyndale Avenue South, Richfield, Minnesota, had an off-street parking agreement with the City of Richfield, relating to Lot 1, Block 3, J. N. Hauser's Addition (Parcel 6800) which contract bears the designation of Contract No. 2178 and which contract was guaranteed by a bond of AID Insurance Company, Des Moines, Iowa, in the amount of $10,000.00, and WHEREAS, the Richfield Bank & Trust Co., has complied with the provisions of said agreement and the AID Insurance Company now seeks to be relieved of any further obligation under'°said bond, and • WHEREAS, there appears to be no justification for requiring the Richfield Bank & Trust Coe to continue to provde~~a bond for security on the performance of said agreement. Construction and `Ornamental Street Lighting Scheduled: for L975 At the city' council`meetng of October 28,' 1974, the city council received a petition from the residents in .the area bounded by 68th Street, Lynda le Avenue,. 66th Street and West Pleasant Avenue indicating their desire. to have that area included im the 1975 pavng'program. At the city council meeting of December-9 1974, the city council received the preliminary engineering report for this addi- tion of approximately .9 miles of permanent street impro~errients'and street lighting` and set the date for a'hearing to determine whether or not-this additional work would be authorized. 'the date for'this hearing was scheduled for January .13.,..1.975. The city staff has sent out notices and held an information meeting. prior to he council hearing. The current construction work scheduled for 1.975 and the proposed additional work is shown on the. attached sketch. If the city council approves this additional work, the total project scheduled for 1~9T5,,would include approximately 31 street miles,` A total of 28.38 parcels' would be assessed in accordance with the city's assassment policy for street and-lighting improvements. The area under consideration at this hearing is that portion of .Area No. 12 bounded on the north by 66th Street, on the east by-West Pleasant Avenue, on the south by .6,8th Street and. the- west by Lynda le Avenue, excluding 66th Street, Lynd-ale Avenue, 67th Street between Lyndale Avenue and Harriet Avenue and Harriet Avenue from 67th to 66th. Street. The area contains 98 parcels to be assessed.
