At the`September 27, 1976 city council meeting the city council deferred action on adoption of the proposed assessment for Programmed Land, Inc., Plat 44834, Parcel 0715 until conclusion of a discussion regarding driveway open- ings from the Programmed Land, Inc. property onto 77th Street,. This discussion was scheduled for October 8, 1976 at 7:00 p.m. As members of the council will recall, it was the position of Programmed Land, 'nc.'thatthe -proposed assessment on their property should be reduced if the' property continued to be denied access onto 77th Street. The city council initially deferred action on this assessment so that the city could ob- tain an independent appraisal of the benefits to the property. At the Septem- ber 27, .1976 city council meeting this appraisal was submitted to the city council. It.was the opinion of the appraiser that the property was benefitted by approximately $7, 300. This amount is equal to about one-third of the proposed front street and street lighting assessment, plus the full side street and driveway assessment. The appraiser's opinion was based on the evaluation that the proposed assessment should be reduced since there was no access from the property onio 77th Street. 'If Programmed Land, Inc. 'is denied access onto' 77th Street, the citycouncil might wish to consider adjusting the proposed assessment of $12,634.92 to $7,300 -as recommended by the city's appraiser. Programmed Land, Inc. has requested that permission be granted to have curb cuts.on 77th Street as shown on the attached sketch. At the direction of the city council letters have been sent to residents between 76th and 77-th Streets on the East side of Nicollet Avenue; First Avenue, Stevens Avenue and Second Avenue. A total of 52 residents were notified. A copy of the letter is attached. The off-street parking contract on this property was first issued in 1959 to Atlantic Mills. 'The city council meeting minutes, of which a copy is - attached, indicate that curb cuts on 77th Street were specifically prohibited. Since 1959 owners of this property have inquired periodically as to the possibility of providing curb cuts on 77th Street. While inquiries have been made at the staff level, this matter has never been considered by the city council although a similar request did appear on the August 28, 1972 city council agenda: However, Programmed Land, Inc. withdrew that request be- fore it was considered by the city council. Approval of this. request would, have the effect of encouraging use of 77th Street by shoppers going to and from the LaBelles and Lee Ward'stores. Denial would 'reinforce the earlier 1959 decision to minimize commercial traffic on 77th Street by not permitting such curb cuts Respectfully submitted, Wayne S.
