The .public safety director, planning director,.. and park- and recreation director also represented the city at the .bid opening... The bid opening minutes and the tabulation of the bids are attached for city council review. The specifications included a base bid for a three year contract and an alternate bid for aone-year contract, Only one bid was received from Casey and 'Casey,, Inc.', representing the U.S. Fidelity and Guarantee Company. The bidder submitted a bid for the alternate, one-year contract'. The standard premium, including the city's current modification factor of 1.10, .i s in the amount of $121, 475. The premium discount, to be deducted at the time of invoicing,: is guaranteed in the amount of $17, 857, The total. net estimated premium is $103, 618. - The city has! paid $96, 369 for .vuorker's compensation insurance coverage during 1976. This premium will be adjusted, after the end of the year, based on the -actual loss ratio during the year.. License Renewals for Niel~'Minotte's, Inc. At the November 22 , 1976. city council meeting, the city councia set December 3, 1976 as the date for a public hearing on the re uest for the on- sale and Sunday. liquor licenses for Nick Minotte's, Inc.. 7,00 West 6.6th S,treet,~ $ecause the applicant was unable. to complete all of the application requiremezlts by that date, the public hearing on the liquor license was continued to December-- - 27,.1976. The application for this license was submitted by Mr. Nick. Minotte and Nlr. Matthew Bohar. Although the application was not completely submitted within. the. prescribed. time limit, all of the required information, including a surety bond, insurance certification, political contribution certification, and license fees have now been filed. The present on-sale and Sunday liquor license for Minotte's, Inc. will expire December 31, -1976. The renewal .application is for the second full year renewal by the present owners. ~,ppliration Inve~t3:gation In accordance with city ordinance,. the public safety department did make ari investigation of information required by Section 11 .06, subdivision 4 of the on-sale liquor. ordinance, The public safety department report indicates that there has been no change in the corporate structure in the past year. During the year; there were three reported police incidents indicating that the request for police service is clearly not excess- ive . Accountant's Report The on-s~lc liquor ordinance requires that the applicant file .with the city clerk a statement made by a certified public accountant which shows t;e total gross sales and the total food sales of the restaurant for the pre- ceding 12 month period. The application shows 'the follciwng information for the l? months.~nd:inc; August, 1.976, which was;the applicant's first fu1T year operation of the establishment. Total .Sales $996_, 531.96 Food Sales 404,098.69 Percent of Food Sales 40.5 ' _ to Total Percent of Liquor Sales 49.5 • to Tot~1 The purpose for obtaining this information is that state statutes requires the serving of food to be a principal part of the business of a restaurant which • has an on-sale liquor license. Council members will recall that originally the ` city ordinance included a definition of the phrase "principal part of 'the business" stating that more than 50% of the gross retail sales of licensed premuses must be derived from the sale of food. That definition was deleted in 1911 leaving only the statutory requirement which does not incluae a definition of the phrase. l The city attorney has advised that "principal part of the business" may be interpreted to refer to percent of gross sales, but also to such things as the amount of investment necessary to serve food compared to the serving of - beverages; or the number of employees engaged in the preparation and serving of foods compared with beverages; or the amount of space provided for the preparation and serving of food as compared with beverages. In short, the state statute could be defined in a number of ways and in no way infers that the defin- ition must be limited to percent of gross retail, sales. Flealth and Safety Regulations I The Environmental Health_Department has inspected the applicant's premises ,~ several times over the past year and one-half. The applicant has completed some ~~. Council Letter No. 409 -3- December 27, 1976 ;_ , major improvements during that 'time although there still exist on-going. ~~ problems with housekeeping,. storage of materials, lighting and building maintenance. The most recent inspection of the property on December 22, I, 1976, revealed numerous, violations of environmental health and -safety codes. In addition,' the applicant was issued a citation during 1976 for not properly handling garbage. Outside property maintenance- has also been inadequate: and the `health department has cut the weeds on the property .twice and assessed the cost against the property. Off-Street Parking Contract Provisions . T'he original off-street .parking :contract for the Heidelberg"Dining Lounge, Inc, i:hen 1QCatcd at 708 W. 66th Street; was approved by the city council on July 2~, 1;970. The performance bond required as a condition of the off-street - }parking contract req~.iired nurrierous improvements, `most of which have been completed. As the council will recall, the stipulations for iandscapin~g and; sidewalk improvernents~were waived due to the fact that the Lyndale/Hub/ _ Nicollet project could require changes. The final council required improvement which was not completed was the removal of the roof billboard.. The following items are attached to this council letter and will be referred to .throughout: Exhibit A -- current zoning Exhibit B -current land use Exhibit C -proposed site plan Background -The property at 1302 East 66th Street presently contains a Minneapolis Star and Tribune paper shelter and a gravel parking area. The applicant is proposing f:o construct a one •and one-half story office building. The Maurer Construction ~~ firm will .utilize approximately one-quarter of the space, with the remainder being yenta 1 space . The .side and setback is required by Section 3.39, subdivision 2, paragraph Y 3 ("...this regulation shall not reduce the buildable width of the lot to less than 30 feet."). It is the opinion of the staff that a special condition does exist. There are nine intersections, with a tofal of 36-.corner lots on 66th Street from 12th Avenue o Cedar Avenue. Only five of these have frontages which are less than Z5 feet. Of the five corner lots which have' commercial buildings, all are constructed. less than 30 feet. from their sideyard property line, abutting the street. The existzng setbacks on these five narrow lots range from one foot to twenty=five 'feet. ~' 2. That the granting of applications. is necessary for the preservation and enjoyment. of substantial property rights.. It is the opinion of staff that the granting of this variance is necessary for the. preservation of substantial property :rights. The setback requirements-.for a corner lot -zoned for commercial use are realistic and conducive to quality developments when there is sufficient frontage on the street serving the Comm- ercial traffic.. However,. when this same requirement is applied to a commercially zoned corner lot the width of this one , the requirements -often prevent the construction of a building of a size sufficent to serve as anything more than -some type of drive-in establishment. Therefore, this requirement would pro- . -hibit .the applicant from constructing a building compatible with the use of the adjacent commercial building and conducive to the type of commercial activity located on the east end of 66th Street. 3. The purpose of the public hearings i.s to consider the amended housi.n; assistance plan and the amended rommur~ity development plan, Roth of t"2se plans were adopted by the city council ir_ 1975 ai>ci thc: amended plans gererallX~ follow the original plans adopted- in 1975. In the case of the communiay development plan, of which a copy is attached, fhez~e are the following changes: 1. - Community development funds for the L/H/N commercial i.mprovomPnt ' project have been deleted from the Year III applicatior_. Use of these monies for tree L/H/N project is being discontinued because. caf more costly i Federal relocation requirements tuhirh the city would be required to pay through. the i,/I~/N project i.f the community development; fu.,ds were used . for the project. 2 , Prior to this arnendment, $90, 500 iii community development funds were to be used in park development in 1977. Because the community development funds which were to be used in the L/H/N have .been shiated' to parks development, a total of $198., 000 will be available for parks development in the Year III Grant, 3 . Comrriunity development funds for housing rehabilitation remain uncharrgeu . I ~~ ~. Council Letter No. 403 -2- December`27, 1976 I ' The amended housing assistance plan. is also attached. The changes in hat- plan are' as follows; f; 1. The. current yearprogram goal for leased housing was .reduced from 52 to 30 units. to reflect the actual allocation of units . The sp it between.. elderly and non-elderly units is changed..accordngly. 2: The third year prograan goal -for leased housing was reduced from i43 u:~?its to'13.2'units. This amendment is necessary so'that uve do'not jeopardize the use of community development funding. Iri the first year of community development block grant funding, the city . r~c~vedapproximately $99,000 as its share of the Urbana Hennepin County Entitlarnent: In 1976 this amount was'' $204, 000'. Leiters Have been sent to all citizen advisory corzlmissions offering ~n opportunity for suggestions from those groups. It is the opinion of the st~ffthat these and other efforts made by the city meet:the require- ~`~ meats of the federal. regulations for .participation in the development_of the community development block .grant application. - Since the first public hearing on December 13, 1976 individual members. of the planning commission and the park and recreation advisory commission have reviewed the community development plan. Members of the park. an:d recreation advisory commission concurred- with the proposed-communitydeveloiiment plan. Members of the planning commission have indicated a desire that an amendment be lidded to the plan to eliminate architectural barriers in the city. Although the- elimination of architectural barriers is an eligible community development activity, it is the recommendation of the staff that the council policy ._ ~to eliminate barriers as part of various city projects, i.e. , permanent street imipravement project, sidewalk repair project, is sufficient to eliminate architectural barriers , Thus , it would not be necessary to earmark comrriunity development funds solely for the elimination of barriers. The staff al o received a request from a member of the senior citizen and handicapped commissicn to purchase a handicap van with community development funds . Projects directed to. the removal of material and architectural barriers which restrict the mobility and accessiblity of. elderly and handicapped persons. (I was quite distressed at the last Planning Com*nission meeting when the commissioners gave no concern at all.for the accessi- bility to our people. It took me G years and 2 mayors: to get a- ramp into City Hall .and I sincerely feel that our City is derelict in its consideration of the physically handicapped. In magazines I gets mayors and .councilmen of other communities have confined themselves to wheelchairs for up to a week just to realize how many barriers they must overcome. I have sat back for years and not fought the battle for anyone else and. I thintc itts time for me to says laughingly "stand up and fight." Letts make our city a city that cares.) 2. I sincerely think and hope that the members used in the commu- nity block used for health services will be used in a productive way and not just as a show case.? 3. One of my pet peeves has always been the lack of taking car e of our present trees in the park system and T think that this along with the fighting of Dutch Elm diseases demands our immediate attention.' There are many other fine priorities that others will haves but T justwanted to get across these three as my personal,viewpoint. It irtcl'udes all renter households (1,103.) within income limits and living in "inadequate conditions" except for non--elderly one-person households , vrho vroul d not be :cli;gible. It also inclades 20 elderly owner households haying low or very low income and- living iti •iriadequate living conditions. Larger families (families with 4 or more m•i-nor children) are separated out to deter~.~iine the number of units needed with 3 or snore bedrooms. This number was reached by counting half of all income-eligiblejinadequately-housed 5-person households, and all 6 or more person households in the same category. This totally 31 large families. These grants were to support implement- ation of the Team Policing project. This project has achieved several of i.ts stated goals and objectives ahead of schedule:. 'two of the most-significant accomplishments have been an actual reduction in the number of crimes known • to`the Malice; anc; an increase ir: the number-and percentage of known crimes that are solved by the arrest of the criminal. The Team Policing project is eligible for three full years of LEAA funding. The third year application must be submitted to the Governor's Crime Commission by January 3, 1977. If this application is approved, funding will be received for the period September 1, 1977 through August 31, 1978. In the first year, LEAA supported our project with approximately.$35,000. In the second year, nearly $S0, 000 was received. For the third year, the Public Safety Department proposes applying for federal support of approximately $60,000. Most of the federal funds .requested will .be .for either-one time capital outlay costs, not requiring continuing city funding after expiration: of the LEAA funds, or a continuation of personnel-costs funded in the first two years of the project. OF MINNESOTA DEPARTMENT' Of l"RANS~ORI'A710N TECHNICAL P,ND ENGINEERING ASSISTANCE AGREEMENT THIS RGREEMENT made and entered into by and between fhe Stafie of Minnesota acting through i_ts CommissFoner of Transportation, hereinafter referred to as the "State", end the County or City of , hereinafter referred to as the "User", WITNESSETH: WHEREAS, the User, as evidenced by Resolution, a copy of which is attached hereto and made a part hereof as Exhibit A, does hereby request the State.. to furnish from time to time as needed and specifically requested, technical a-id eng.ineering assistance pursuant to M.S. 161.39; and WHEREAS, The State 1s authorized to provide technical and engineering assistance to other road authorities by M.S. 161.39, and is willing to do so; NOW, 1"HEREFORE, it is mutually agreed by the parties hereto that: I. The State shah , upon written request by the User, provide technical and engineering assistance and such other services as authorized by M.S. 1&1.39. 2. The State shall keep a record of its costs and expenses, including overhead costs, in providing assistance and services to the User pursuant to Paragraph i above, and shall prepare an itemized statement thereof showing the amount due hereunder and submit the same to the User on a (monthly) (annual) basis. 3. The User agrees to pay to the Trunk Highway Fund of the State of Minnesota ail monies duce hereunder and as shown by the invoices or statements submitted to if~e lfser, within 30 days after such submission.
