~- ., CITY .OF RICHF?ELD, MINNESOTA • Office of City Manager Council Letter No. 209 \ ~ Agenda June 27, 1977 ~~ The Honorable Mayor and Members ~.of the City Council City of Richfield Gentlemen: • Subject: Approval of Bid for City Project 705, .First Stage L/H/N Public Improvements On Tuesday, June 21 , 1977, bids for the first stage of the L/H/N project (City Project 705) were received by Hennepin County. The agreement between the city and county provides for the county to receive bids and award contracts after approval of the award of such contracts by the city council. Two bids were received with the iow bid submitted by Schafer Contracting Company, Inc. in a base amount of $1,175, 556.25. The next lowest bidder was Hardrives, Inc. ($1,298,809.54). The county engineers estimate is $1,194,954.89, according to the cost sharing agreement between the city and county. A copy of the bids " is attached. The county base_bid amount is shared as follows: Bidders County Share City Share Total Shaer Construction $225,165.72 $ 950, 390.53 $1,175.556.25 Hardrives _271,618.85 1,027,090.69 1,298,709.54 The construction schedule is as follows: This bid 1977 - All roadway work on Nicollet Avenue from 64th Street to a point just north of 67th Street - All roadway work First Avenue from 65th Street to 66th Street - All roadway work 66th Street from First Avenue to Lyndale Avenue 1978 - Ail roadway work, utility and pedestrian improvements on 65th Street from First Avenue to Rae Drive - All pedestrian improvements to Nicollet Avenue - All pedestrian improvements on 66th Street = All screening improvements on First Avenue All roadway and pedestrian improvements on 66th Street .from Lynda.le Avenue to Graham Avenue ' Council Letter No. 209 -2- June 27, 1977 Additional Bid in 1978 1978 - All roadway and pedestrian improvements on 66th Street from Lyndale Avenue to I35W . - All roadway and pedestrian improvements on Lyndale Avenue from 64th Street to Lakeshore Drive. Although the staff is recommending that the contract be awarded on- the base bid, six alternatives were bid. In most cases, the alternatives were bid to keep the specified items of the base bid more competitive. The alternatives which were bid include: 1'. Alternative pedestrian benches are more expensive than the base bid benches. 2. Alternative bollards and bike racks which were slightly less expensive. than base bid bollards and bike rack. Even though less expensive, the alternate bid is less durable and requires more maintenance. 3. The base bid for the pavers is less expensive than the alternate pavers . 4. and 5. These are tree size. alternatives.. Remembering that the theme of the shopping center is established by the unique landscaping, it is the opinion of the staff that the larger trees should be planted as long as the budget is maintained. Thus, the base bid of five-inch caliber tree or the 4.0 inch caliber trees . 6. Alternative six is the extra large pedestrian way in front of Holy Angels Academy. The alternative provides fora 12-foot wide ped- estrian way, a retaining wall on Holy Angels property and additional landscaping to blend-the wall with the Holy Angels property. Total cost above the base bid amount of this alternative would be $40, 810.60. Holy Angels has .not favored construction of this larger pedestrian w~ y on 66th Street: because it would be necessary to obtain land from Holy Angels to construct the alternative. By comparison, the base bid provides fora 10-foot walk and 8- foot walk along 66th Street. Where there is an 8-foot walk provided, 4-foot land- scaped area is provided between the curb and walk. Where the 10-foot walk is provided,. the walk extends to the curb. Recommendation The staff recommends that the city council approve the base bid as submitted by Shafer Contracting Company, Inc. by adopting the attached resolution. . Respectfully s~ubmi , Wayne S. RESOLUTION NO. -RESOLUTION ACCEPTING BID AND APPROVING CONTRACT BETWEEN THE COUNTY OF HENNEPIN AND SHAFTER CONTRACTING COMPANY, INC. FOR LYNDALE/HUB/NICOLLET IMPROVEMENTS -CITY PROJECT NO. 705 BE IT RESOLVED BY the City Council of the City of Richfield, Minnesota as follows: 1.. That it is hereby determined that the bid of Shafer Contracting, Company, Inc, , is the lowest bid by a responsible bidder for the construction of City.Project No. 705, Lyndale/Hub/Nicollet public improvements . 2. That the bid of Shafer Contracting Company, Inc. , for the construction of the above referenced project on a unit price basis, at the prices contained in their proposal of June 21, 1977 with an estimated construction cost of $1,175, 556.25 is hereby approved for award by Hennepin County as provided in the agreement between the County and the City of Richfield. 3. This approval is for award of the contract on the basis of construction to be performed inaccordance with the base bid. 4. That payments to be made under the terms of said contract shall be charged against the Construction Fund for City Project No. 705. Funds for Experimental Meter Reading% Public Safety Monitoring Program Mikro Tel, Irrc. has approached the City of Richfield to request our participation in an experimental meter reading,lpublic safety monitoring program. Attached is a letter' explaining their proposal. Basically, they are proposing to install 200 "mini-computer" type units in selected structures within the city. These units would be hooked by telephone. to the water plant and to police and fire facilities . The main unit to read and receive communications from these units would be a computer terminal. The City of Richfield has been selected as an experimental site, -along with the Cities of Fairmont and Mankato. Implementation of this program is contingent upon receipt of a federal Law Enforcement Assistance Administration grant to finance .purchase of the computer and related hardware.. Mikro-Tel will install and maintain the 200 mini-units . The cost to tree city would be approximately $9, 000 in matching funds. This match can be money, or services, and it appears that the city's acquisition of a new data processing system would qualify as our portion of tyre rr~atr_h requirement. Wl SUBJECT Meter Reading Experimental Program Over the.-past several months, Ken Conway has been talking to representatives of Mikro-Tel, regarding an experimental program which that company has proposed. As I understand it, the program involves the placing of 200 mini-computer: in selected residences, for an undetermined time period. These units are designed to link up with fire and police protection, as well as provide for remote reading of water meters . ~I know that Paul Linnee met with the people from Mikro-Tel on one occasion to explore how their proposal might fit with public safety needs. Anyway, this company now wants our permission to use 200 Richfield sites as an experiment to see if their units can, in fact, provide for efficient public safety controls and water meter reading. Their proposal is as follows: - 3 random sites within the state will be selected .for this experiment: the City of Fairmount, the City of Mankato, and the City of Richfield (small rural community, large rural community, large metropolitan community) • - a grant proposal will be submitted, on behalf of all three cities, to L.E,A,A, to fund the computer system and related hardware that will provide for the remote meter reading, burglar and fire alarms, etc. The City of Mankato has agreed to prepare and submit this application. - The only possible cost to us will be approximately .$9,000 for our share of the required L.E,A,A. match -- which I understand can be cash, or a soft match. Ken feels that any new computer equipment which we acquire through our current bidding process will qualify for our share of the match; of course, we would retain the equipment long after this experiment is over. Mikro-Tel wants a letter'of intent from us, indicating our willingness to participate in the grant application. Our participation at this point vwuld be contingent upon receipt of the grant, and we could specify that in our letter. Council Letter No. 203 Agenda June 27, 1977 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: /o Subject: Authorization to Apply to the State of Minnesota to Participate in the Minnesota Shade Tree Disease Control Program and Continuation of the City's Grant-In-Aid Program for Private Property Tree Removal The 1977 Legislature amended the Minnesota.Shade Tree Disease Control Law to provide reimbursement to municipalities for a portion of their costs for shade tree disease control programs and reforestation. The purpose of this council letter is to request council authorization to submit a shade tree program application to the State of Minnesota, and to enter into an agreement for re- imbursement through this program. The amended Minnesota shade tree disease control iaw provides municipalities with two kinds of grants: one for sanitation, which inc~udes~ tree inspection, tree trimming, tree removal and tree disposal on public and private lands. The other grant provides reimbursement for planting new shade trees The state law requires that we apply for participation in the program for the full year of 1977 by July 1, 1977. The law has provided funding to reimburse the city up to 45% of the cost of sanitation efforts, and 50% for replanting costs. It is possible that the reimbursement for sanitation could be less than 45%, if the total amount requested by municipalities exceeds the appropriation. However, the staff has prepared an application which reflects our expected cost for 1977, assuming a 45% reimbursement. Included in the sanitation portion of the grant application is the cost of subsidizing private property tree removal. The city's shade tree disease program in 1977 provides fora total sanitation expenditure of $167, 500. Forty-five percent, or $75, 375, of this amount is being requested as a state grant. The city's planting program provides for an expend- iture of $8, 000 of which fifty percent or $4, 000 is being requested as a state grant: The amount requested for replanting is based on the number of. public trees lost to disease the preceding year; to be replaced at an estimated cost of $80 per tree. In Richfield, 100 public trees were lost last year. The sanitation grant reimbursement is based on our estimated costs for tree inspections, trimming,. Council Letter No. 203 -2- July 27, 1977 .removal and disposal, as well as the costs of subsidizing tree removal on~ private property . For the past two years, the city has had a pol-icy of subsidizing. tree removal on private property. This subsidy program has provided for 25% of the removal cost to be paid by the state, and 25% by the city, at a maximum per tree subsidy of $100, or 50% of the cost of tree removal, whichever is .less. Under the new law, the- city would be reimbursed 45% of the private subsidy. This means that, if the $100 maximum reimbursement . is retained, the city's per tree share of the subsidy would increase by $5.00. It is proposed that the maximum reimbursement per tree be established at $100 again. A resolution authorizing continuation of the city's grant-in-aid program for tree removal on private property is attached. It is recommended that the city council adopt this resolution, authorizing cpntinuation of the grant program. It is also recommended that the council authorize the city manager to submit a shade tree program application ~o the State of Minnesota, and that the May or and City Manager be authorized to execute an agreement with the State Depart- ment of Agriculture to participate in the state grant program for shade tree disease control. I. The original Intent of Survey - two goals: First: To identify the handicapped and their needs. Second: To assess the existing programs on all levels - local, county, state and federal. II. Results of Survey/Needs: There were 90 responses with those ranging in age from 4 to 86 years. The response from persons in their middle-years 36-59) was greater than any other-age. We had expected seniors 60 & over) to express more problems. The problems of the middle-years people need attention. °irJe think we will see an increasing need to supply services to persons t11at will enable them to stay in their own homes. ° The No. 1 "need" most often checked was Transportation. The LWV Handicapped Committee felt the other greatest needs people expressed were tiomemakin~ Assistance & Yard fork, Housing, Employment and Recreation. III. Recommendations: Transportation/Mobility! That's where it all begins! As indicated by the study, it's the greatest-unmet need. In line with LWV state and national positions on equality of opportunity on public accommodations for all persons, and because of the results of the local Survey, the League recommends that the City look into ways of improving public transportation for the handicapped. yJe recommend, too, that the City take strong measures to enforce Handicapped Parking areas. Some persons with a wheelchair need more space than is allowed for one car, in~order to transfer from car to wheelchair. There is a need to acquaint people with existing programs such as Project Checkpoint, Meals on ~dheels, Congregate Dining, Health Care and Recreation. irle would encourage the City to start an Outreach Program, 20-25 hrs. a week even; or Special Services office with a Co-ordinator for Handicapped. Someone is needed to go out to the homes and talk to the individuals. The agreement provides for the county to award a construction contract, but only upon prior written concurrence from the city for such an award . Bids were opened on this project June 21, 1977. We are trying to accelerate the pru~edure of processing these bids as much as possible. If we can complete our staff review this week, our goal. is to obtain approval from the Richfield City Council at the council meeting Monday night and for the Hennepin County Board to award the contract at their meeting on Tuesday. Therefore, the purpose of this council letter is to recommend that the Richfield City Council approve the award of this construction contract. Inform- ation on the bids, the selection of alternates and the division of costs will not be available until Monday night. However, inasmuch as -the city council has previously approved the final plans and specifications and an agreement covering the division of costs, it is our hope that this item can be handled as a procedural matter so that Hennepin County will have the opportunity to consider action on awarding bids on Tuesday. Lyndale/Hub/Nicollet Redevelopment Bond Issue On the HRA agenda. for the June 27, 1977 meeting, there is a resolution re- questing the city council to issue $4, 700,-000 in redevelopment bonds for the Lyndale/Hub/Nicollet redevelopment project. The proposed bond issue will provide funds primarily for the K-Mart project and other related L/H/N acquisition costs. While the tax increment bonds will _ be a general obligation issue, it is anticipated that there will not be a need for the use of ad valorem tax to provide debt service on this bond issue. Pro- jections indicate that increment to be received from the K-Mart Project together . with increment to be received from the general appreciation of property values in the tax increment area will be adequate to cover debt. service requirements for this bond issue. Other proceeds from the tax increment project will also be available in the remote possibility the anticipated tax increment does not prove to be adequate. Public Improvement Bond Issue Council members will recall that the 1976 street improvements were financed by a temporary internal bond issue and that it is ultimately necessary to sub- stitute apermanent issue for such an arrangement. In addition, the city has .awarded contracts for the 1977 street improvements which a re currently underway. ' It is anticipated that the contract for the L/rI'/N public improvements will be awarded this coming week with actual construction to occur during 1977 and 1978. Council Letter No. 197 -2- Agenda June 27, 1y77 It has been determined necessary and desirable for the city to issue a permanent public improvement bond issue at this time to cover the-1976 improvements and those currently underway this year. The sale of this bond issue in the amount of $4, 500, 000 would make it possible for the city to finance the Lynda le/Hub/ Nicollet public. improvements which will occur over a period of years by temporary bond issues which would ultimately have to be replaced by a permanent issue. The permanent street improvement project was originally planned to be implem- ented over aseven=year period and was subsequently reduced to a six-year pro- gram. The city policy on assessments indicated that the assessment policy would remain unchanged over the period of the program even though the cost could be expected to increase and the amount of state aid reimbursement decrease.. .The net effect of this policy has been that the cost of these street improvements not covered by state aid reimbursement or assessments has gradually increased each year. This was anticipated when the program was- initiated and there have been debt service levies for the last two years to support these public improvement bond issues. Since the project was initiated, prepayments have come- in at the rate of 34.5%, 27.2%, 40%, and 35.5% for the years 1973 through 1976. There- fore, -the assumption. of 33% prepayment seems reasonable and reduces the amount of principal which must be included in the bond issue. In 1977 the debt service levy for the various street improvement bond issue amounted to $422, 400. The design of the proposed issue together with a combin- ation of the debt service for the other street improvement issues, is expected to make it possible for us to stabilize the debt service levy for the next ten years at approximately $300, 000 per year. It should be emphasized, however, that the ability to accomplish this .objective is contingent on the interest rate received for the current issue; prepayments actually received for 1976 and 1977 projects and the amount of special assessments that are paid up each year. Bond Issue Schedule Adoption of the attached resolution will permit adequate advertising and receipt of bids .for the $9,200,000 redevelopment and improvement bond issue on July 27, 1977. Bids would be opened at 11:30 a.m. and awarded at a special city council meeting at 12:15 p.m. on the same day. It is recommended that the city council take the following actions: ~1. Hearing for Oak Grove Lutheran Church Property Attached is a letter from Oak Grove Lutheran Church requesting consider- ation by the city of a street improvement assessment against a triangular piece of property owned by the church. The property is shown on the attached sketch and has limited use potential. The current assessment against this property is $3, 348.12. This assess- ment was made in accordance with the city's policy of assessing full costs against all frontage of tax exempt property. The church appealed the assess- ment at the September 13, 1976 assessment hearing, but at that time the assess- ment was sustained by the city council. If the city council wishes to reconsider the assessment against this property, it will be necessary to establish a hearing date for considering such. a supple- mental assessment. It appears this should be a workable possibility but the amount of the adjustment should be logically determined. Perhaps property valuation might be a basis for such an adjustment, if it were possible to calculate the value of a valueless piece of ground. However, if there is any basis for figuring its value, certainly square feet of area is a logical basis to use. The remainder of this discussion is based on a "per square foot" analysis. The piece of property is approximately 300' long by 50' on list street and coming to a point at the South end. Thus this property has about 30Ox~0/2 = 7500 square feet. It is assumed that approximately 300' of paving 'on Augsburg Avenue has been assessed against the property to date to arrive at the figure of $3,343.12. Eventually, of course, there will be another approximately 300' assessed against the property when Lyndale Avenue is resurfaced, making a total of 600' of paving assessed against the property. if we assuta~e for the moment that a normal pity lot is 50' wide by 124' long, and having b250 square feet of area, this lot will have assessed against it only 50' of paving. On an equitable basis the triangle of property in question should have (750U/6250)50 = 60' of paving assessed against it. This is just 10% of the 600' that will eventually be assessed against our hapless piece of property. This being the case it would seem justified to request that the assessment of $3,34$.12 be reduced to $334.31 and that a similar multiplier of (0.1) be applied to the normal costs for the future paving of Lyndale Avenue. Richardson, j. Wilde. The Committee considered the following items: 1-. "No Parking Anytime; North side of 77th Street, Stevens to 2nd Avenue• J. Wilde reported that this request was received from a resident at the intersection of 77th Street and Stevens Avenue, adjacent to the spot where present parking restrictions end. The request was initiated because of congestion resulting from parking for patrons of businesses in the area. M . Raaen observed that this area did have parking restrictions prior to • completion of the street paving project. The committee recommends extension of the "No Parking Anytime" res- triction on the North side of 77th Street from Stevens Avenue east to 2nd Avenue. 2. Oakland Terrace at Lakeview Avenue; j. Wilde reported that this request was fora sign to stop Oakland Terrace traffic, at Lakeview Avenue. R. Richardson reported that no accidents have occurred at this intersection within the last 5 years. M. Raaen reported that traffic counts were very low. Committee members observed that the intersection is adjacent to a city park area . The committee recommends that the warrants ..for installation of a one- way stop sign are not met, but that the proximity of the park could be considered in evaluating this request. 3. 68th at Xerxes Avenue: J. Wilde noted that this request had also been submitted to the City of Edina, since the west side of Xerxes Avenue is in the Edina city limits. The Edina Traffic Control Committee has rec- ommended that this request be denied, in that the warrants for installation of a two-way stop sign are not met, x. Richardson reported that Public Safety Department records indicate one accident at this intersection in the past 5 years. The committee voted to recommend denial of this request. 4. Survey of 68th Street: This request was received from the R.I.N.G. committee in the L/I~I/N area, and is based on a change in the project plan which would leave 68th Street open. The committee tabled this request pending completion of the public improvements in the project area . 5. "No Parking Anytime, " 68th - 69th on Xerxes Avenue; J. Wilde reported that neighbors were concerned .with parking by employees and customers of businesses on York Avenue. It is the committee's determination that no~ specific problems exist on the Richfield side of Xerxes Avenue to warrant establishment of parking prohibitions . 6 "No Parking Anytime'; W. Pleasant Avenue, 62nd - 65th Streets• The Public Safety Department has requested consideration of parking restrictions on this area of West Pleasant because of concern that parking narrows the street in such a way that travel of emergency vehicles would be hindered. T. Morgan noted that parking is prohibited on West Pleasant south of 65th St. The committee recommends establishment of "No Parking Anytime" on W. Council members might recall that those plans provided for the barrier to sto at a the east side of Aldrich Avenue, and be continued eaptward aga n fromy a point just slightly west of Garfield Avenue. In response to a request from a resident at that meeting, the council did ask the staff to contact the Department of Transportation and request them to consider extending the wall east of Aldrich to approximately the west edge of Lyndale Avenue. Attached is the response received from the highway division. It is their conclusion ,that extension of the wall would not be feasible, for the several reasons noted in their letter. It is recommended that the council accept and file this report. Letter No. 190 Agenda June 13, 1977 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: Subject; Request for City Reaction to Deeding of Land to City Attached is a letter from Oak Grove Lutheran Church concerning the possibility of deeding certain land now- o-r~ned by the church to the city. Mayor Law has asked that this matter be considered as an extra item at the June 13, .1977 city council meeting. The land referred to by the church in their letter consists of approximately 10, 666 square feet. It is in the form of a long narrow .triangle as shown on the attached sketch. Oak Grove Lutheran Church is considering the possibility of offering to deed this triangular piece of land to the City of Richfield. At the September 13, 1.976 city council meeting, the city council held an assessment hearing on the 1975 street improvements. At that meeting Oak Grove Lutheran Church asked that the assessment on this triangular piece of property either be reduced or deleted. The action of the city council was to sustain the special assessment in accordance with the city's assessment policy for street :improvements. A copy of the pertinent page .from the September 13, 1976 city council meeting minutes is attached. It ~is the concensus of the city staff that there is no practical city purpose for which this parcel of land could be used. The net effect" of accepting a deed for this land would b~ fQr the city to acquire another piece of property which would have.=to be_maintained at~he.citX.'.s_.expense, but be of no general benefit to the .city. The public works director indicated that this area would be included in the city wide street lighting on east-west streets. Piarvin [dolfenson of. the Century Court Apartments at 7437 Lyridale, protested his assessment because he felt he did not receive any benefit from the street im- provement, He also stated that the development had been prevented access from certain streets and some adjustment should be made because of it. The council considered Mr. Wolfenson's request and decided to .sustain the assessment policy but advised that if a different decision were made on another commercial property which is under investigation, they would agree to reconsider this assessment. Motion by Ludeman, seconded by Anderson that no adjustment be made on this assessment with the stipulation that this assessment may be reviewed further in light of the pending case from a previous hearing.
