City of Richfield Gentlemen: :.Subject: Minutes, Tabulation of Bids and Award of Contract, Tennis Court Lighting Earlier this year, the city council approved transitory ordinance transfers of $20, 000 for tennis court lighting at Donaldson Park and $ZO , 000 for tennis court lighting at Washington Park. In August, 1977, the city council approved an ar- chitertural agreement with Brauer and Associates for services related to these tennis court lighting projects and on September 26, 1977, the council approved plans and specifications and authorized the call for bids . Bids were opened by the administrative assistant, Joyce Wilde, on October 11, 1977, in accordance with this previous city council authorization. The acting park and recreation director, the acting public works director, the deputy city clerk and representatives of the consulting firms and several bidding firms were also present for the bid opening. The bid minutes and tabulations are attached far .city council review, The low bidder for the tennis court lighting at Donaldson Park and Washington Park, is Electric Repair and Construction, Inc, with a combined total bid in the amount of $35,800. It is the recommendation of the Acting Parks and Recreation Director and the Park•and Recreation Advisory Commission, in which I concur, that the city council take fihe following actions: 1, Approve the bi.d minutes and tabulations for tennis court lighting at Donaldson and Washington Parks , 2. Adopt the attached .resolution awarding the contract for tennis court lighting to Electric Repair and Construction, Inc. , in the amount of $35, 800. That it is hereby determined that the bid of Electric Repair and Construction Company, Inc. is the lowest bid by a responsible bidder for the tennis court lighting at Donaldson Park, City Project No. 703, and for the tennis court lighting at Washington Park, City Project No. 704. 2. That the bid of Electric Repair and Construction Company, Inc. for the above referenced projects, at the price contained in their proposal of October 11, 1977, with an estimated cost of $35,800 as a combined bid is hereby accepted. 3. That the proposed contract between Electric Repair and Construction Company, Inc. and the City of Richfield be given clerk's file No. and be placed on file. 4. That said proposed contract for the lighting of tennis court facilities as referenced above is hereby approved and adopted and the Mayor and City~Manager are hereby authorized and directed to execute said contract for or on behalf of the City of Richfield and the City Clerk is hereby authorized and directed to affix the city seal thereto. 5. That payments to be made under the terms of said contract shall be charged against the project funds. 6. Moran City Clerk // CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No'. 321 Agenda October 11, 1977 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: Subject: Rejection of Bids , Boulevard Tree Planting At the September 12, 1977 city council meeting, the city council authorized advertisement for bids to replace boulevard trees lost to Dutch Elm disease. These bids were opened on October 5, 1977. Bids were received tram three bidders: Natural Green, Inc. , Arteka and Midland Nursery, Inc. The bids received w-ere considerably above the estimate and exceed the amount budgeted for this project. Therefore, it is recommended that the city council reject all bids , and authorize the staff to amend the specifications and readvertise for bids for replace- ment boulevard trees. J ~s CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 320 Agenda October 11, 1977 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: Subject: Undergrounding of Electric Utilities in L/H/N Project Area As council members are aware, Northern States Power Company has agreed to underground their electric utility lines in the Lyndale/Hub/Nicollet project area. The agreement with NSP provides that the utility company will bear the expense of undergrounding the primary lines along 6.6th Street and that the cost of underground- ing the secondary lines along First Avenue and 65th Street will be borne by the L/H/N project. An agreement with the businessmen provides that the L,~H/N project will also pay tl~ie cost af. extending the secondary electrical connections to the businesses adjacent to First. Avenue. Since it will be least expeizsive to accomplish the undar- groundinq before the street separation medians are constructed, NSP has completed cost estimates and is proposing to begin work on the 66th Street and First Avenue lines this fall. Northern States Power Company has estimated that the cost of undergrounding the service lines along First Avenue will be approximately $28,050, and the cost of extending the service connections to the businesses will be $20, OOG, making the total cost to the L/H/N project equal to about $48, 050. This will will be financed through City Project 705, the L/H/N Public Irnproverrients Project. It is requested that the city council aui.iorize execution of a work agreement with Northern States I'awer Company to complete undergrounding of utility lines in the redevelopment project area, in the amount af. $~18, 050. Minutes of that committee meeting, and petitions initiating several of the requests, are attached for city council review. It is recommended that the city council authorize the fallowing changes in traffic control devices: 1. -12th Avelzue and 62nd Street: Authorize removal of the one-way stop sign located at this intersection, stopping 1`Lth Avenue traffic at 62nd Street, 2. E. Pleasant Avenue, 73rd Street to 76th Street: Establish East Pleasant Avenue between. 73rd Street and "16th Street for one-way traffic only, northbound , 3. 68th Street ar~d Sheridan Avenue: Authorize installation of a two-way stop sign at t'nis intersection, stopping 68th Street traffic at Sheridan Avenue . 4, 76th Street, Xerxes Avenue to Washburn Avenu_e___Authorize "Nc Parking Anytime" regulations for the southside of 76th Street between Yerxes Avenue and Washburn Avenue. TRAFFIC CONTROL COMMITTEE MINUTES September 26, 1977 The traffic control committee convened at 2:00 p.m. , September 26, 1977. Members present were: Tom Morgan, Marshall Raaen, Lt. Bob• Stevens (representating Captain Richardson), Joyce Wilde. The traffic control committee met on Monday, September 26, 1977 to consider several pending matters relating to traffic controls within the city. The committee evaluated the following specific requests for removal or installation of traffic control devices: 1. 12th Avenue and 62nd Street: Joyce Wilde indicated that Councilman Ludeman had requested the committee to csonsider removal of this stop sign, It was the concensus of the committee that this stop sign served no effective function, and should be removed. The committee voted to recommend removal of this stop sign to the city council. 2. East Pleasant Avenue, 73rd Street to 76th Street: Joyce Wilde reported that a petition had been received from neighbors in this area requesting that E. Pleasant Avenue between 73rd Street and 76th Street be designated for one-way traffic only, northbound, Marshall Raaen observed that the staff had previously recommended establishing this area of East Pleasant Avenue as a one-way street, but that no action was taken pending completion of the street im- provement program. The committee voted to recommend to the city council that E. Pleasant Avenue from 73rd Street to 76th. Street be designated as a one-way street, traveling northbound . 3. 68th Street and Sheridan Avenue: Joyce Wilde reported that a petition had been received requesting a two way stop at this inter- section to stop 68th Street traffic. Tom Morgan reported that there did appear to be visibility problems at this intersection, and other committee members who visited the intersection concurred. Lt. Stevens observed that four accidents have occurred since January 1976 at this intersection, indicating a higher than usual accident incidence for a residential intersection. The committee voted to recommend that the city council authorize installation of two way stop signs at the intersection of 68th Street and Sheridan Avenue, 4. Emerson, 65th to 66th Street: Tom Morgan observed that there v~~ere still signs on the east side of this section of Emerson Avenue noting "No Parking During School Hours", and that several residents had indicated an interest in removing the signs since the Woodlake School has been closed. The committee voted to recommend that i ~~ ~ - ~ the city council authorize removal of these signs. 5. 76th Street, Xerxes Avenue to Washburn Avenue• Joyce Wilde reported that Mayor Law and Councilman Luettinger had re- quested the committee to evaluate the desirability of parking prohibitions in this area . Marshall Raaen observed that parking on 76th Street is prohibited throughout the city from Cedar Avenue to Penn Avenue, and that add itional parking regulations do exist on some sections of 76th Street between Penn Avenue and Xerxes Avenue. Tom Morgan observed that, although public safety records indicate no reported accidents involving cars parked in this area, visibility is limited to traffic traveling eastward into Richfield from Edina on 76th Street. The committee voted to recommend that the city council authorize "No Parking Anytime" signs on the south side of 76th Street from Xer~:es Avenue to Washburn Avenue . The committee also discussed two other• items, but made no recommendations. Joyce Wilde reported that a resident had recently visited her to express concerns with safety in the vicinity of the Century Court Apartments at 73rd and Lyndale Avenue. The resident feels that the brick walls adjacent to the driveway leading out of the apartments could be a safety hazard. Committee members agreed that cars exiting from the apartment complex do ne•~d to use care, although Lt. Stevens observed that public safety department records indicate no recurring safety or accident problems iri this area . Marshall Raaen reported that the property owner was required to install the brick walls as part of the off-street parking contract . Joyce Wilde also reported that several residents of the 6800 block of Xerxes Avenue have asked the committee to review parking problems in that area. The Donaldson Park construction budget includes funds for landscaping. Quotations have been obtained for the purchase and planting of 3 inch trees, to include two roneylocust, tv~yo sugar maple and five American Linden. Quotations have also been received for materials to be placed in the planter boxes around the Donaldson Park shelter building. The number of square feet in the proposed building and the type of use requires that the building have 9off-street parking spaces, and 9 spaces will be provided. This includes parking spaces for two employees and six ,customers, as well as a handicapped customer parking space. The staff has reviewed the off-street parking application and recommends council approval subject to the following stipulations: 1. Council Letter No. 314 -2- October 11; 1977 1. That there are special circumstances or conditions affecting the Particular land, building or use referred to in the application, not common to other properties in this or similar districts . It is the opinion of the staff that a special condition does exist. On 66th Street from 12th Avenue to Cedar Avenue, there are nine intersections with a total of thirty-six corner lots. Only five of these lots have frontages less than 75 feet. Of the five corner lots which have commercial buildings , all are constructed to within less than 30 feet from their sideyard property line abutting the street. The setbacks for these five narrow lots range from one foot to twenty-five feet. 2 . -That the grantina of the application is necessary for the preservation and enjoyment of substantial property rights. It is the opinion of the staff that the granting of this variance is necessary for the preservation of substantial property rights. The setback requirements for a corner lot zoned for commercial use are realistic when there is sufficient frontage on the street serving the commercial traffic. However, when this same require- ment is applied to a commercially zoned corner lot the width of this one, the requirements often prevent construction of a building of a size sufficient to serve as anything more than some type of drive-in establishment. Therefore, this re- quirement would prohibit the applicant from constructing a building compatible with adjacent commercial buildings and conducive to the type of commercial activity located on the east end of 66th Street. 3. That the granting of the application will not materially and adversely affect the health or safety of persons residing or working in the neighborhood of the pro erty of the applicant and will nct be materially detrimental to the public welfare or injurious to property or improve- ments in the neighborhood. It is the opinion of the staff that granting of the variance will not materially and adversely affect the health and safety of the neighborhood. The structure in the proposed location could serve as a buffer between the single family homes to the north of the site and the commercial and vehicle activity along 66th Street. It is the recommendation of the staff that the request for variance be granted as all three conditions which must be met are present on this property. Planning Commission Recommendation The planning commission heard this request for variance at their September 27, 1977 meeting. The applicant appeared before the commission and stated that Council Letter No. 314 -3- October 11, 1977 the proposed building will be the first headquarters for a national company. They also indicated interest in working with local police departments in crime deterrence. No residents appeared before the planning commission to speak for or against the proposal. John Allers, 7501 Second Avenue, has requested two variances to permit construction of an accessory roof structure over an existing swimming pool. City ordinances (Chapter III, Part IV, Division 3.39, subdivision 3) require that the structures not exceed 30 percent of the area of the rear yard, and that an accessory structure not exceed 12 feet in height. Section 3.40, subdivision 6 of the Richfield city code describes three criteria which must be satisfied before the variance can be granted. If the criteria are not present on the property, the variance must be denied. Background The applicant would like to build an 18 foot high peaked roof over an existing swimming pool in his rear yard. The variance is requested~to permit enclosure of the existing pool. Richfield ordinance allows accessory buildings only if they do not exceed 30 percent of the rear yard. An existing double garage occupies 13.6 percent of the rear yard, making total coverage of the rear yard 37.1 percent. The adjacent land use is single family residential. The building is proposed to be built within 44 feet of the residential lot immediately to the rear. Chapter III, part II, section 3.15, subdivision 3 of the city code states that no portion of a swimming pool or appurtenances thereto shall be located at a distance less than ten feet from any side or rear property line, nor in front of the building line. The pool walls are proposed to be located 44 feet from the rear property line, and 6 feet, 10 and one-half inches from the interior lot property line . Staff Review and Findings The city staff has reviewed the application based on the criteria set forth f in Section 3.40, subdivision 6 and finds the following: Council Letter No, 313 -2- Agenda October 11, 1977. 1. That there are special circumstances or conditions affecting the particular land, building or use referred to in the application, not common to other properties in this or similar districts . It is the opinion of the staff that there are no special circumstances .or conditions affecting this property not common to other surrounding properties. The .lot is similar in size to all other corner lots in the subdivision, and three feet smaller than interior lots . The house is similar to other houses in the district and the land is flat. There are no special physical circumstances. necess- itating granting of this variance . 2. That the granting of the application is necessary for preservation and enjoyment of substantial property rights . The denial of this variance does not preclude the applicant from using the existing pool or his single family residence. 3. That the granting of the application will not materially end adversel affect the health or safety of persons resin ing or working in the neighborhood of the the property of the applicant and will not be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood. It is the opinion of the staff that the roof structure addition will materially and adversely affect the health and safety of persons residing in the neighborhood. By allowing accessory structures to exceed the 30 percent building area limit in the rear yard, the amount of air circulation and sunlight at this location and the ad- jacent properties will be limited . Open space is an important factor affecting the health of persons residing in the neighborhood and in maintaining property values of surrounding residences . If this variance were to be granted, allowing the structure to be built, it v~ould also set a precedent in the community to allow partial filling of yard open spaces with structures . The long range effect of such incremental filling of open space would be detrimental to the residential character of Richfield, since partial filling of rear yards with structures i.s contrary to the goal of maintaining a suburban residential environment in Richfield. If we set a precedent in this case, it will appear to be arbitrary in the future to deny someone who wishes to build an oversized garage or other accessory structure which would cover more than one-third of the rear yard . Staff Recommendation Since all the conditions described in Section 3.40, subdivision 6 do not exist on the applicant's property, it is the opinion of the staff that the request for variance should be denied . The Christian Park project is scheduled for construction in 1978 in accordance v,Tith the adopted 1977/83 Capital Improvements Program . VGThile construction is not scheduled until next year, it is necessary that planning begin very shortly and an initial meeting with residents in the neighborhood of the park is scheduled for Tuesday, October 18, 1977. Law Mayor ATTEST: Tom Moran, City Clerk CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 308 Agenda October 11, 1977 The Honorable Mayor and ' Members of the City Council City of Richfield Gentlemen; Subject: Authorization to Enter into Agreement for Professional Services The Public Safety Department's team policing grant provides funding for a final evaluation of the experimental team policing project, This evaluation process is to include a community survey, designed to assess public opinion regarding the police effort in our community, as well as to assess any changes in public opinio:~ that might be related to the new police service delivery system developed through the team policing reorganization. At the time the team policing project began in the fall of 1975, a mail survey of selected residents and businessmen was taken to provide a beginning data base from which a final evaluation could be made . Because of the success of. Richfield's team policing project, the Minnesota Crime Control Planning Board has asked that the final community survey be handled by a professional survey firm and include personal interviews with approximately three hundred and fifty Richfield residents and business-men. The Minnesota Crime Control Planning Board has awarded the City of Richfield an additional $6, 000 grant to provide for completion of this professional survey. The Board has also assisted Public Safety Department staff to begin developing a potential survey instrument, The Public Safety Department has sent out 18 requests for proposals for under- taking this survey to professio:~a1 market research and survey firms in the Twin City Metropolitan Area. Eight of these firms submitted proposals in response to this request. These proposals were subsequently reviewed by the professional research staff at the Crime Control Planning Board for compliance with the original specifications, as well as for the accuracy and completeness of the research designs upon which the proposals were made. It is the conclusion of the Public Safety Director, based oz this review of the proposals, that a proposal submitted by the Winona Corporation of Bloomington, Minnesota, in the amount of $5,500, best meets the evaluation needs to be addressed by the survey. This proposal provides that the Winona Corporation would conduct a personal in- terview with three hundred and fifty randomly selected residents and businessmen within the city. The results obtained in these interviews would be correlated with the Council Letter No. 308 -2- October 11, 1977 results of the original survey conducted in 1975. This information will enable us to evaluate any differences in community attitudes and opinions regarding the delivery of police service in the City of Richfield. . The proposal of the Winona Corporation is within the $6, 000 allotted for this project by the State of Minnesota. It is the recommendation of-the Public Safety Director, in which I concur, that the city council authorize execution of a professional service contract with the Winona Corporation in the a;~nount of $5 , 500 for completion of a public opinion survey. The bid opening has been scheduled for Tuesday, October 11, 1977 which is the earliest possible time that bids could be opened. Bids .are being opened on that day with the intent of providing a recommendation to the city council at the council meeting that evening in an effort to initiate and complete this lighting project yet this year. This amount, together with the funds received from the sale of the ladder truck, will be put in a special account and used for the acquisition of a new fire pumper apparatus . The. city staff is in the process of calling for bids on a new pumper in accordance with city council authorization. A copy of transitory ordinance No, 16.42 is attached.
