School Site At the September 26, 1977 city council meeting the city council approved a preliminary plat and gave first reading consideration to a planned multiple family residential zoning district for the Wood Lake School site. The city council also gave first reading consideration to a transitory ordinance providing for a land exchange at this site. Second reading of the rezoning ordinance and transitory ordinance were scheduled for the October 24, 1977 city council meet- ing . A comprehensive staff report on this project was contained in Council Letter No. 301 submitted for the September 26 city council meeting. The actions being requested of the city council at the October 24 meeting are second reading and adoption of the rezoning ordinance and second reading and adoption of the trans- itory ordinance . Following action on these two matters , it will be necessary for the developer, Architectural Alliance, Inc. , to complete a final development plan and to make application for a special use permit for the development. The final development plan must be consistent with the planned unit multi-family residential rezoning and approved by the city council. The special use permit application must be in conformance with the final development plan and must be issued by atwo-thirds vote of the city council. It is anticipated that the final development plan and the special use permit application both of which deal with the design and details of the development. will be submitted to the city council in late December or early January subject to favorable action an the land use changes at the October 24, 1977 city council meeting . It is recommended that the city council give second reading consideration and Council Letter No. 331 -2- October 24, 1977 ~. ,- adopt -the following tow ordinance amendments: 1. This program is to provide funds to local units of government for development of bikeways along existing road right-of-ways, The grant allocation within. the seven-county Metropolitan area is $700,000, The Richfield Eikeway Plan includes three multi-use bridges, one at East 63rd Street crossing Cedar Avenue, one at East 68th Street, crossing I35W, and the updating of the existing. bridge at West 73rd Street, crossing I35W. The staff is proposing to submit grant applications for the following three projects: 1. -The bikeway/pedestrian .multi-use bridge proposed to cross Cedar Avenue at East 63rd Street would connect East Richfield with the Taft Perk multi-use trail system. This project would request a grant of $225, 000. 2, The multi-use bridge proposed to go over I35W at West 68th Street would connect the Wood Lake , L,/H/N bikeway/pedestrian multi-use trail with the West Richfield trail system. This grant application would also request funding of $225,000. 3. There is now a pedestrian bridge at West 73rd Street crossing I35W. This project would provide for modification to the bridge for use by bicyclists. I I I j _ ~ I I ~ ~ I CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No, 329 Agenda October 24, 1977 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: Subject; Purchases in Excess of $1,000 Chapter 6, Section 6.05 of the City Charter stipulates that the city council must approve the purchase of merchandise, materials, equipment or construction when the amount exceeds $1, 000. There are two such purchases for the public works department on the city council agenda of October 24, 1977, Second Exit, Cedar Liquor Store The State Fire Code and Uniform Building Code require that a second exit be provided from the basement of the Cedar Avenue liquor store, The Penn Avenue liquor store was constructed with a second exit, and although modifica- tions will also be necessary to the Lyndale Store , it is proposed that the work at that store be undertaken ~•~hen the new commercial building is constructed north of that store (L/H/N Project). The lowest quotation obtained for install- ation of a second exit at the Cedar Store was submitted by Earl Weikle & Sons, Inc, in the amount of $3,865, It is recommended that the city council authorize wok to be completed by Earl. Weikle and Sons iri the amount of $3 , 865 for completing a second exit from the Cedar Avenue liquor store basement, Survey Truck Funds are budgeted in the 1977 central garage budget to replace a fully de- preciated club wagon which is used by the public works department for survey work , 6 Since the vehicle bids solicited through the Iiennepin County Cooperative Purchasing Organization did not include a comparable replacement vehicle, the Council Letter No. 329 -2- October 24, 1977 city staff has requested quotations, using the existing 1971 club wagon for trade-in. The lowest net quotation was submitted by Harold. Chevrolet in the amount of $4,479. There is a provision for placing two judges in each precinct to handle voter registration on the day of the election. State law requires that polling places be designated before the election. There is a public hearing scheduled on the October 24, 1977 city council agenda regarding the revocation of a sauna license issued to Sauna City, Inc. A hearing was held earlier this. year regarding revo~~atian of .~this~'~license, based upon a March 3, 1977 arrest of a Sauna City, Inc, employee who did offer herself for the purpose of prostitution contrary to Richfield City Ordinance Code Section 10.16 , subd . 10 . At the conclusion of that hearing on April 11, 1977, the council took action to suspend the sauna license issued to Sauna City, Inc. for a period of four (4j days. The employee arrested during the in- cident, Ms , Jacquelyn Nuno, .has since appeared in court and the disposition of the charges against her have been continued for a period of six months to allow Ms .Nuno an opportunity to enter the DeNovo Project, an offender rehabilitation program . The hearing scheduled o'7 the October 24, 1977 agenda relates to a second incident involving this license, and is completely separate from the council's previous action suspending the sauna license. On September 12, 1977, the sole stockholder and president of Sauna City, Inc, , Mr. James S, Jones, was named in a felony complaint issued by the Hennepin County Attorneys Office. Specif- ically, two charges are named in the complaint against Mr. Jones, for keeping a place of prostitution and for pLrmittinq a place of prostitution. As a result of this felony complaint, I notified Mr, Jones on September 20, 1977 that the license issued to his business by the City of Richfield was being revoked in accordance with Section 5.25, subd, 9 of the Richfield City Ordinance Code, in that employees or agents of said licensee did engage in conduct inimical to the interest of the public health, welfare, safety or morals; did engage in conduct involving moral turpitude; or that such employee or agent is a person of bad repute. Council Letter No. 327 -2- October 24, 1977 s My revocation action was specifically based on the following grounds: That on September 12, 1977 Mr.james S. Jones was named in a felony complaint-warrant charging him with criminal violations in accordance. with Minnesota State Statute- Chapter 609.32, subd. 3 (1) and 609.32 subd. 3 (2). Both of these criminal charges also-imply a violation of Minnesota Statute 609.05. On September 21, 1977, Mr, Jones met with me and indicated that he had arranged to sell his interest in Sauna City, Inc, to one of his employees, Ms. Kay Annette Meyer, Mr, Jones feels that Ms . Meyer should be able to continue to operate the business under the existing license since the sauna license is issued to the corporation. However, since my revocation of the sauna license took place prior to the city receiving any notification regarding the sale of Mr. Jones's stock in-this business, it appears that there is not. currently any valid license under which the business may continue to operate, Mr, Ellis Olkon, the attorney representing Ms . Meyer, has -filed notice with the city clerk that he wishes to appeal this license revocation. Supermarket/drug store complex The PUD is proposed to be redesigned as follows: Phase I -New Construction and Property Improvement United National is proposing to construct a 5,000 square foot restaurant at the corner of 66th Street and Pillsbury Avenue, and to improve the rear parking lot. The parking lot improvements are dependent on the vacation of 65th Street and Pillsbury Avenue. The new 65th Street will be constructed by the city on the north perimeter of the new parking lot. Penny's Superrriarket is also planning to add space to the parking lot. Clark Oil Station is proposing to add adrive-up photo shop. The Summit Bank will make Council Letter No. 326 -2- ~ October 24, 1977 parking lot improvements -both south of the bank and on the vacated 65th Street as .well as improve the drive-in teller ingress and egress , Phase I is proposed to be accomplished within the next two years. Phase II -Construction and Property Improvements In Phase II, United National Corporation is proposing to add 55,000 square feet to the south portion of the existing shopping center. This addition will create a double loaded mall and add 36, 000 square feet of gross retail space... During this development phase, the south Hub parking lot is proposed to be im- proved. The Phase II plan. also shows the addition at some future date of 11, 800 square feet to the north portion of the existing Hub. Center, The parking lot will also be landscaped and median parking lanes provided . Site Relationships The applicant's proposal provides for a commercial superblock bounded by Nicollet Avenue, a relocated 65th Street, 66th Street and the railroad tracks. The new 65th Street and L/H/N Public Improvement project landscaping will provide separation between the commercial superblock and the single family residential area to the north. Public landscape. improvements will be used to soften the land use relationships between Holy Angels on the south side of 66th Street and the commercial superblock on the north side of 66th Street. Internal relationships provide for joint use of parking facilities and cross-driveway access.. Traffic Access and Parking Pillsbury Avenue from 66th Street to 6-5th Street will be vacated as a public street, but will be redesigned to provide access from 66th Street. Besides the Pillsbury Avenue access, the main entrances to the Hub will be from mid-block. on 66th Street. Left-hand turning lanes will be provided to the mid-block and Pillsbury Avenue access points. Nicollet Avenue access will be provided at the vacated 65th Street with the provision of a left-hand turn lane. Right turn access is also provided to the front east of the Hub and at a combined mid-block Hub-Summit Bank driveway access. Access to 65th Street will be provided at two locations to the north of Penny's lot and at two locations to the north Hub lot. One 65th Street access point and one Nicollet Avenue- access point is provided for the Summit Bank drive-through teller location. The L/H/N Redevelopment Plan provides for a development similar to that proposed by the applicant. It is the opinion of the staff that the proposal generally conforms to the comprehensive plan and the L/H/N Redevelopment Plan. Differences between the proposal and otherwise applicable provisions of the zoning ordinance are reasonable provision of parking spaces, parking lot circulation, sight distances for businesses, conformance to the parking design standards of the city and goals of the L/H/N Redevelopment Plan. Although the overall project is designed in a way to conform to adopted plans, the detail design (parking aisles, access, lighting, landscaping, pedestrian crossings, powerpole removal} does not conform to city ordinances for parking lot design nor to the adopted Urban Design Guidelines for the L/H/N Redevelopment Project. One of the primary goals of the L/H/N project depends on using urban design as a means to create a unique shopping environment; a departure from the urban design element would not be in the public interest and would not comple- ment the public expenditure which is underway at the present time. Project Provision for Adequate Public Services -Vehicular Traffic Control..... . Visual Enhancement (3.34, Subd. 4) Traffic and Parking The proposed project was designed to provide improved access from both 66th and 65th Street, and from Nicollet Avenue. The projected traffic volumes on the surrounding streets are as follows: New 65th Street - 8,100 ADT Nicollet Avenue -- 13 , 600 ADT 66th Street - 16,400 ADT The proposed commercial superblock will generate approximately 8, 000 trips per day in Phase I (present) and 9, 660 trips in Phase II. .After reviewing the .parking provisions and parking lot circulation, the staff has made the following findings: 1. The Pillsbury Avenue entrance is designed with 20 foot ingress, a four-foot median and 20 foot egress. T~iventy feet is not a sufficient width to allow turning movements in both an easterly and westerly direction, and truck turning movements will be limited if a four-foot median is constructed. Since the 20 toot egress will not function for both left and right turns with the four foot median, the city staff and the Hennepin County traffic engineer recommend a 22 foot ingress and 22 foot egress without a median. . Council Letter No. 326 -5- October 24, 1977 2. .The mid-block 66th Street access provides fora 22 foot ingress lane, four foot median and 22-foot egress lane. This access will function adequately for traffic from both east and .west. 3. The Nicollet Avenue access is for right turns only and will function adequately. The north Nicollet Avenue access to the medical offices and bank provides for both left and right turns , and will function adequately, 4. The three 65th Street. accesses provide separate ingress and egress to key land uses.. The center 65th Street access will provide combination access to both Penny's and the Hub. The east 65th Street access will .provide access to the Hub, and, the bank's drive-through tellers, and the west entrance will provide access directly to Penny's . The internal parking lot circulation is adequately designed-for the medical offices, bank, Penny's and, with one exception, the north Hub parking lot. The design of the Phase. II front parking lot will create the following problems; 1. The driving aisles for 90 degree parking are only 22 feet. This will not Permit adequate back-around space and could result in traffic lot congestion,. reduction in usable parking spaces and minor traffic accidents. 2. The parking area is not designed with the required three-foot concrete end markers which are required by the planning commission and the city council in the Urban Design Guidelines. These end markers were designed to protect the parking area, define the parking area from the circulation area, and alloweasy snow removal.. In Minnesota winters, parking in areas without markers becomes confused and haphazard and reduces available spaces when the parking is most rieeded. 3. The pedestrian crosswalks have. not been designated as required by the Urban Design Guidelines. Pedestrian access to the shopping area is an important component of the mid-block pedestrian way, and the L/H/N Redevelopment Plan. Substantial pedestrian improvements are being made to the area surrounding the Hub, and it is important that the Hub carry the pedestrian theme to the door to make it effective for the entire area . The sidewalk east of the proposed restaurant is six feet wide, with only four feet of usable sidewalk, if a two-foot overhang from parked cars is considered. Such a narrow sidewalk will limit pedestrian movement on the east side. of the proposed restaurant; the sidewalk should be widened to eight feet. After completion of Phase II, 1,111 parking stalls will be provided . This repre- sents an overall parking ratio of 3.66 spaces per 1, 000 square feet of floor area . The supermarket which is-the most intensive use, will have direct access to 250 Council Letter No. 32 6, -6- October 24., 1977 spaces or a ratio of 7,43 spaces per 1, 000- square. feet. .The parking. near the major department store (Korner Plaza) is marginally adequate. A solution to this problem would be to locate the proposed restaurant further southwest on the lot, although this could create severe commercial visibility problems from 66th Street to Penny's Supermarket. The applicant is still working. on legal provisions for the joint use of parking access, The PUD, as proposed, will not provide- adequate parking without the ability of a shopper to park at one .location, shop fn the entire area, and return to the original parking location (joint use. of parking) , which is a goal of the L/H/N Redevelopment Plan. The joint use of parking and driveways should help resolve the current parking problems in the area of the medical office. Public Utilities Public utilities (gas., water and sewer) can be provided to the project. Water is now available in Pillsbury Avenue and 65th Street, When these streets are vacated, utility easements will be maintained to service the utilities, Electric utility poles are present behind the Hub.- Adequate stor;n water drainage is provided in the rear and west side parking lots, and the storm water drainage for the front parking lot is shown on the plans. Roof storm water drainage is provided on the new structures. The Hub is proposing to continue using the power poles on the north side of the building which is in direct opposition to the adopted L/H/N Redevelopment Plan and Urban Design Guidelines, The new 65th Street will be a major commer- cial street, with substantial public improvements being made along. 65th Street, It is reasonable to expect the Hub and Northern States Power Company to improve the visual appearance of the north side of the shopping center. Improvements in aesthetic appear- ance of the area, if accomplished by the developer, will improve the visual impact of the site . Staff Recommendation In judging this proposal against applicable ordinances and adopted plans, it is the opinion of the staff that the concept of the- proposal generally confcrms to the Comprehensive Plan, L/H/N Redevelopment Plan and the PUD Ordinance and subdivision regulations. However, the design detail does not conform to the Urban Design Guidelines for the L/H/N area, or to the parking lot requirements of the city. Thus, it is recommended that city council approval of the prelimin- ary PUD plan contain the following stipulations: 1. That the plan be brought into conformance with the Urban Design Guidelines of tl~ Lyndale/Hub/Nicollet area 2. That the parking lot be re-designed to effectively park and move traffic in accordance with traffic design standards of the city 3. That mutual shared parking agreements be established between ' the parties involved in this PUD 4. That a mutually agreeable development schedule be submitted by the parties involved in the PUD. Preliminary Plat It is the recommendation of the staff that the preliminary plat be approved with the following stipulations: Council Letter No. 326 -8- October 24, 197.7 1. That storm water drainage be shown on the plan, and if a problem exists, be resolved. 2 , That the power services to the building be undergrounded and power poles removed. 3. That the vacation of both Pillsbury Avenue between 66th Street and 68th Street, and 65th Street between Pillsbury Avenue and Nicollet Avenue, be initiated by the applicants . 4, That the dedication of a new 65th Street be accomplished by the applicants prior to the time the zoning di strict change becomes effective . Planning Commission Recommendation At their regular meeting of September 27, 1977, the planning commission re- viewed the request .for the Hub/Penny/Summit Superblock PUD. The architect for the applicants appeared before the commission. The commission questioned whether the design for this project would be comparable to that of the department store development, whether there would be adequate parking for the medical offices, whether the service areas would be screened, and whether the existing heating. system in the Hub would be adequate for the proposed additions. The staff and the architect indicated that designs would be compatible, the parking would be adequate, the service areas would not be screened on the 65th Street side, but would be screened on the 66th Street side, Richard Naiman, United National Corporation, and Ralph Bruins, Summit Bank, appeared on behalf of the applicants and expressed their commitment to the project. One resident appeared at the meeting and suggested a change in the pedestrian system. The planning commission recommended that the city council approve the preliminary PUD plan with the following stipulations: 1. That the plan be brought into conformance with the Urban Design Guidelines of the Lyndale/Hub/Nicollet area, 2.. That the parking lot be re-designed to effectively park and move traffic in accord with traffic design standards of the city. 3. That mutual shared parking and maintenance agreements be established between the parties involved in this PUD. 4. That a mutually agreeable development schedule be submitted by the parties involved in this PUD. The planning commission also recommended that the city council exercise sound and reasonable judgment in setting the development schedule for the Hub PUD, and that the city council approve of the zoning district change from C-2. to PC-2. Council Letter No. 326 -9- October 24, 1977 The planning commission recommended that the city council approve the preliminary plat with the following stipulations: 1. That storm water drainage be shown on the plan, and if a problem exists, be resolved, 2. That the power services to the building be undergrounded and power poles removed. 3. That the Hub hook up to city water and abandon the existing well. The .planning commission also recommended that the city council approve the special use permit for this PUD. These easements were necessary for storm sewer extensions on MAC property. It is now nec- essary for the council to formally accept these easements before they are recorded.
