Gentlemen; Subject: Resolution Regarding County Support for Human Services Councils The South Hennepin Human Services Council, since its inception in 1971, has been supported by Hennepin County., through the county's Community Planning budget. Recently, however, the county has expressed an interest in withdrawing some of its support and forcing cities to share in the direct cost of supporting the la.uman services councils . The Ways and Means Committee of the Hennepin County Board. will be considering this matter at a hearing on April 17 , I9~ 8 . On March 28, 1978, the Board of Directors of the South Hennepin Human Services Council approved a position statement supporting continuation of full county funding for the human services councils. The board also developed a resolution for consideration by the city councils of the four south Hennepin communities, supporting continued. county funding for the SHHSC. That this Council urges the County Board to continue funding as they have in the past. 7 1 ~- CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No, 109 Agenda April 10, 1978 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen: Subject: Proposal for Golf Course Site Architect On January 23, 1978 the city council authorized the city manager to interview golf course architects and to make a recommendation on the selection of a qualified architect. The city manager indicated that such a recommendation would be made late in March or early in April which would. be consistent with the golf course project schedule, The firm proposed for golf course site architect is Brauer & Associates. This firm has been involved in the design of a large number of golf courses and has the capability of providing a very high level of service to the City of Richfield on this project. Brauer & Associates is amulti-disciplinary firm with previous experience in working for private clients as well as all levels of gov- ernment. Brauer & Associates has previously worked for the City of Richfield in providing design and construction management services for the Wood Lake Nature Center and park projects within the city. A list of golf courses designed by Brauer & Associates in recent years is attached. The following four projects .ire the most recent courses for which this firm has provided services: 1, Pokegama Golf Course at Grand Rapids, MN. This is an 18 hole golf course to be opened. for the first time in 1978, 2. Brook Time Galf Course in Owatonna, MN. This involves the addition of nine new holes to an existing nine hole course, This project will be open as an 18 hole course for the first time in 1978, 3. A municipal golf course at Moorhead, MN. This is a new nine hole course currently under construction, 4. Floyd. This firm is capable of providing a number of services including site analysis and sel- ection, interior planning and design, construction management and inspection services, energy use analysis, and architecture. The firm has provided significant architectural services for the City of Richfield at Roosevelt Park, Christian Park, and the Community Center. The firm has been extremely responsive to the needs and concerns of the city as cited by various neighborhood. groups and. committees, the staff, commissions and. council. Other recreational projects designed by this firm have included the Moir Park shelter for the City of Bloomington, Sumner Field recreation building for the Minneapolis Housing and Redevelopment Authority, a number of planned unit de- velopment residential developments, and other projects in the Midwest. The firm has provided architectural services for a new clubhouse for the Alexandria Golf Club. The firm is also providing architectural services for the private Maple Greens golf club in Maplewood, Minnesota. Responses from clients have rer inforced the firm's competence and responsiveness. Because the total program for the proposed club house cannot be finally determined until preliminary use proposals are considered, the staff has approached the various firms under consideration with estimated project expenditures. The staff is presently estimating the cost of a club house to be approximately $250, 000. Generally, fees for architectural services provided either on a lump sum basis, on a percentage of actual construction expenditures or on an hourly basis would be in the vicinity of $20, 000 for a project of this size. ~ti ~ Council Letter No. 108 -2- April 10, 1978 It is recommended that the city council approve the selection of this firm and authorize the city manager to negotiate an agreement with Richard Schwarz/ Neil Weber, Inc, The agreement would contain at least two parts,. The Honb~'able Mayor and Members of the City Council City of Richfield Gentlemen: Subject: Request for Authorization to Purchase Property at 6244 16th Avenue Several weeks ago, I advised council members that the city may have an opportunity to purchase property located. at 6244 16th Avenue, for park pur- poses., This property juts into Taft Park and the city has been interested for some time in purchasing the property if it should become available. The city approached the owner of this property during the planning and development of Taft Park to inquire about the possibility of the city acquiring the property. This parcel abuts park property on two sides and is bounded by 16th Avenue on the third side. City ownership of this lot could provide a better park boundary line and eventually allow for enlargement, At that time, the owner was not interested in selling. During periods of spring thaw and heavy summer rains there have been instances of water converging in this general area and in the 16th Avenue parking lot. While the storm sewer system is adequate to handle this water under normal conditions, on occasion water has overflowed the parking lot and ponded in and. around the tot lot, coming within 15 feet of the house at 6244 16th Avenue. The present property owner has indicated that he has experienced some water seepage in the basement of his homt. It is the opinion of the staff that acquis- ition of this parcel for park purposes would not only enhance the park itself, but would, at such time as the house is removed, eliminate the potential storm water problem, An appraisal of this property completed by O. J. Janski indicated a market value of $38,000. The house is a single family story dwelling constructed in 1941, with a finished expansion area, The house has a front entryway, living room, two bedrooms and. bathroom, for a total of 1,055 square feet. A purchase agreement has been negotiated with the property owners in the amount of $38, 000. This purchase agreement provides that the seller will pay one half of the 1978 taxes, with the city paying the remaining one-half, in the amount of $229.55. The seller is also to pay outstanding special assess- ments in the amount of $732.64. •' . It is anticipated that the house will be re-rented until such time as it may be necessary to use the land. for park purposes. Award of Contracts, Christian Park Improvement Project On April 5, 1978, bids were opened by the city manager in accordance with previous city council authorization for site and building work related to the Christian Park improvement project. The city clerk, park and recreation director, planning director, assistant park and recreation director, site and building architects, and representatives from various bidding firms were also present at the bid opening. The bid. minutes and tabulations are attached. for city council review, The bids for this project included. the items contained in the plans approved by the city council, as well as a number of alternates, including tennis court lighting. The bids were divided into four major categories: site construction, building construction, site lighting, and lawns and plantings , Two firms entered. bids for the site construction work, The lowest respons- ible bidder for site construction is Fischer Construction, Inc. , with a base bid of $208, 000. The staff would. recommend. inclusion of an alternate providing for a maintenance curb for the hockey rink; this alternate bid. was in the amount of $1, 100. The low bid for the site construction total contract then, would be $209,200, submitted by Fischer Construction, Inc, Eight bids were submitted for building construction. It is the recommendation of the staff, supported by the park and recreation commission, that the award of contract for the building construction be based. on the base bid plus three alternates. In this case, the lowest responsible bidder for building construction is Henry O. Mikkelson, who submitted a base bid of $82, 000. The staff recommends the inclusion of the alternate for one open shelter structure, bid in the amount of $4,900, the alternate to provide aluminum windows (thereby allowing improved summer air circulation) bid in the amount of $1 , 200 , and the alternate to provide skate the flooring, bid. in the amount of $5, 500. The total contract amount for Council Letter No. 106 -2- April 10, 1978 building construction by Henry O. Mikkelson would. be $93 , 600. The five plan holders for site lighting all submitted bids. These b ids included alternates for tennis court lighting, in accordance with the council's previously expressed interest in providing lighting of the tennis courts. Al- though we have had some experience with tennis court lighting at Augsburg Park, (six courts), we have not yet gained any experience with the newly lighted tennis courts at Donaldson Park and Washington Park, However, the alternate bid for tennis court lighting of four courts at Christian Park is an excellent one and the staff recommendation for site lighting is therefore made on the assumption of the contract including tennis court lighting. The lowest responsible bidder for site lighting, including tennis courts, is Killmer Electric Company, Inc. , with a base bid of $42, 900 and a bid. on the alternate of $11, 700. The total contract amount would be $54, 600. Six bids were submitted for la°rvns and plantings . One of the. concerns expressed. by the park and recreatiol commission and the Christian Park neigh- bors has been that as many plantings be provided as possible, Therefore, it is the staff's recommendation to include several alternates in the award of contract for lawn and plantings, The lowest responsible bidder is Seefert's Hudson Road Nursery, with a base bid in the amount of $40, 428, It is further recommended that the following alternates be provided: additional tree plantings, bid in the amount of $4,655, additional sod, bid in the amount of $5,940, and a one year maintenance of all plant materials for the g~ara_ntee period , bid in the amount of $755, The total contract amount for lawn and plantings from Seefert's Hudson Road Nursery would be $51, 778, The low bidders have been investigated by the city staff and found to be responsible bidders, The ow bidders have also received clearance from the Department of Housing and. Urban Development, in accordance with require- ments of the Community Development Block Grant Program, The recommended total contract awards to the four contractors for the four work categories is in the amount of $409,178. This figure falls within the construction cost project budget and allows an adequate amount for contingencies . The bids have been reviewed by the Park and Recreation Commission, who support the staff recommendations. In summary, it is recommended that the city council take the following actions: 1. Accept the bid minutes and tabulations on the Christian Park Improvement Project; 2 , Adopt the attached resolution approving the low bid of Fischer Construction, Inca in the amount of $209,200 for site construction and authorize the mayor and city manager to execute the contract doc,t~,ments , Council Letter No. 106 -3- April 10, 1978 3. RESOLUTION ACCEPTING BID AND AWARDING CONTRACT TO FISCHER CONSTRUCTION, INC., FOR SITE CONSTRUCTION FOR THE CHRISTIAN PARK IMPROVEMENT PROJECT CITY PROJECT N0. 719 BE IT RESOLVED by the City Council of the City of Richfield, Minnesota, as follows: 1. That it is hereby determined that the bid of Fischer Construction, Inc., is the lowest bid, including base bid and the selected alternate to provide maintenance curbing to the hockey rink, by a responsible bidder meeting specifications for site construction at Christian Park. 2. That the bid of Fischer Construction, Inc., at the price contained in their proposal of April 5, 1978, with an estimated construction cost of $209,200 is hereby accepted. 3. That the proposed contract between Fischer Construction, Inc., and the City of Richfield is hereby approved and adopted and the Mayor and Manager are hereby authorized and directed to execute said contract for or on behalf of the City of Richfield and the City Clerk is authorized and directed to affix the city seal thereto. That payments to be made under the terms of said contract shall be charged against the Project Fund. 5. That the Corporate Surety Bond in the sum of the estimated contract price which accompanies said proposed contract is hereby accepted and approved. 6. That the City Clerk is authorized and directed to return the security documents to the unsuccessful bidders upon the execution of said proposed contract. The city manager was requested to prepare a tentative implementation plan based on the report recommendations and to submit this material for consid- eration at the April 10, 1978 city council meeting. The purpose of this council letter is to provide information requested by the city council on the tentative implementation plan. A summary of the recommendations submitted by the committee is attached and marked Exhibit A. These recommendations have been reviewed by the public safety department management staff and by the city manager. We concur in the recommendations and. believe they should. be approved in concept by the city council. This procedure will provide major policy direction to the city staff and yet allow for future consideration of implementation details, priority designations and careful scheduling of productivity and. service improvements within estab- lished operating budget perimeters. Our staff review supports the committee conclusion that the report recommend- ations are interrelated and, therefore, must be considered as a single comprehen- sive proposal. The substantive extent of the recommendations, however, make it necessary to establish a priority system for their implementation. Our proposed schedule has been prioritized over atwenty-month period with an objective of substantial accomplishment by December, 1979, It is significant to note that improvements tentatively scheduled for 1978 are planned to be implemented within the current public safety department budget appropriation. The tentative implementation plan is attached and marked as Exhibit B. Following city council consideration, it is recommended that the following ' Council Letter No, 105 -2- April 10, 1978 actions be taken: 1. Initially twenty-five volunteer members are proposed to be phased in over a period of twelve to fifteen months . Approximately one-half of these individuals would be appointed. during 1978. 2.Initiate an effort to explore and experiment with limited work schedule revisions and. objectives, together with possible reorganization of positions and functioris- -This endeavor would. occur during the summer and fall of 1978 with any significant changes tentatively scheduled for implementation in late 1978 or early 1979. Facilities, Equipment, and O eration 1. Over the past few years, the city has gradually been able to ad.d fire vehicles to the central garage revolving replacement fund.. Of the three remaining vehicles which are not yet assigned to that fund, ane will be added in July, 1978, one will be traded or sold in 1979 and. an effort will be made to add the last vehicle to the fund before the end of 1979. 2. Recommendations concerning use of mutual aid, joint station operation with Edina and medical emergency services all involve some degree of cooperation and. work with other jurisdictions. These efforts will be pursued as possible during the twenty month implementation period. Firefighter Training Activities 1. Appointment of "volunteer" personnel will require a number of sub- stantial changes in the fire division training program, especially as it relates to new volunteer personnel and coordinated work activities for volunteers and full-time personnel. 2 . A comprehensive review of in-service training will be condugted in 1979. TENTATIVE IMPLEMENTATION PLAN (Contd.) Fire Prevention Activities 1. Voluntary residential home fire prevention inspections can be offered this spring as part of the city-wide spring cleanup program. The commercial inspection program will be reviewed for possible improvements later this year . 2. A bill relating to a state fire prevention code and its application to municipalities was passed by both houses of the legislature this year . This new legislation will be reviewed to determine its application to Richfield and. possible impact on our code enforcement programs. 3. The purpose of this council letter is to propose a consultant to conduct a feasibility study for this project. Preliminary work done by the city staff in the form of research, questionn- aires and other activities, indicate a substantial market for a municipally operated golf course on the MAC slte.. However, it is important that a firm qualified to research and document market and economic feasibility be retained to substantiate the work done by the city staff. The report made by the feasibility consultant will be important in the development of a financing plan and in determining the extent of the golf course project. It is important that the feasibility consultant be selected at this time so that this firm can work with the site planner, the building architect, she golf course citizen committee and other city personnel during the. preliminary phase of golf course design ._ Development Concept Corporation is the firm tieing proposed to conduct the feasibility study. Development Concept Corporation (DCC) is an independent economic consulting, market research and planning firm which specializes in real estate planning, landscape architecture and feasibility analysis . Although the firm has had clients throughout the United States, it is based in Bloomington, Minnesota. The firm is thoroughly familiar with economic and market trends in the Midwest. The city staff has received very favorable reports from the firm's clients. The staff of the Development Concept Corporation includes professionals with backgrounds in financial analysis, market research, feasibility analysis, community planning, design, landscape architecture, rnarketi:Yg and graphics. Staff of DCC, responsible for conducting the Richfield feasibility studies, would be available for the April 10, 1978 city council meeting. It is recommended that the city council approve the selection of this firm ` Council Utter No. 104 -2- April 10, 1978 and authorize the city manager to prepare an agreement with Development Concept Corporation for the purpose of providing services related to feasi- bility of the proposed Richfield Municipal Golf Course. The average frontyard setback in the 6700 block of Lyndale Avenue is 53.4 feet, with the smallest frontyard setback on the block being 35 feet and the largest 61.5 feet. There are two houses with frontyard setbacks of less than 50 feet, and seven with frontyard setbacks greater than 50 feet. Because the house in question is located on a block where the average frontyard setback is greater than 50 feet, the required setback for this house would be 50 feet. The applicant's house with the proposed addition would have a front yard setback of 47 feet, thus, a three foot variance is required. Requirements for Issuing a Variance A request for a variance must be judged in accordance with the conditions for issuing a variance which are set forth in Section 3.40, subdivision 6 of the city code, The city council should grant the variance only if all three of the conditions are present on the property. Staff Review The staff has reviewed the request for variance against these three condi- tions and made the following findings: 1. That there are special circumstances or conditions affecting the ,particular land, building or use referred to in the application, not common to other properties in this district or similar districts. It is the opinion of the staff that there are no special conditions affecting this property which are not common to other properties in the district. The 50 foot setback is common along Lyndale Avenue, and is not peculiar to this block only. 2. That the granting of the application is necessary for the preservation and enjoyment of substantial property rights. Council Letter No. 102 -3- April 10, 1978 It is the opinion of the staff that the frontyard variance is not necessary for the preservation of substantial property rights. Denial of the variance would not preclude the applicant from using the property for single family residential purposes. 3. That the ranting of the application will not materially or adversely affect the health and safety of persons residing or working in the neighborhood of the property of the applicant and willnot_be_ materially detrimental to the public welfare or injurious to property or improvements in the neighborhood. The proposal does represent an improvement to the property and an invest- ment in the neighborhood. This, therefore, would continue the residential character of the neighborhood and not be detrimental to the public welfare. Staff Recommendation While the staff feels that the proposed addition would not be detrimental to the neighborhood, it is recommended that the re guest for variance be denied, in that all three conditions do -not exist on this property for a variance to be granted . Planning Commission Recommendation The planning commission considered this matter at their March ?8, 1978 meeting. Four area residents appeared in favor of the variance with no residents appearing in opposition. The planning commission voted to recommend that the city council approve a three foot variance to the front yard setback requirement at 6749 Lyndale Avenue, on a 6 to 1 vote. Ruckes, 6700 Chicago Avenue, have requested a variance to the interior sideyard setback requirements in a residence (R) district to allow them to add a second story on their existing house. The following items are attached to this letter and will be referred to through- out: Exhibit A - proposed site plan Exhibit B - proposed elevation Exhibit C - current area land use Exhibit D - current area zoning. Exhibit E - petition Exhibit F - letter from applicant Background Parcel Size:. __ 61.94 x 129.72 (8, 034, 86 sq. ft. ) Existing Structures: One story dwelling (1,19,2 square feet)`-- and attached garage (440 sq, ft.), built in 1951 Proposed Structures; The existing structures will remain and a 22 foot by 26 foot second story (572 square feet) will be added over a portion of-the existing dwelling. Existing Setbacks; Front; ~5 feet Rear: 25 feet Int. Sideyd; 5 feet St. Sideyard; 33 feet r Council Letter No. 101 -2- April 10, 1978 Required Setbacks; Front: 35 feet Rear; 25 feet Int. Sideyd, 10 feet St. Sideyard: 30 feet Section 3,30, subdivision 4.3 of the zoning ordinance requires that buildings of two or more stories in a residence (R) district have interior sideyards of not less than 10 feet in width. The applicant proposes to add a second story over a portion of the existing house. Because this existing building has a sideyard setback of only five feet, afive-foot variance would be necessary to permit con- struction of a second story. Requirements for Issuing a Variance A request for a variance must be judged in accordance with the conditions for granting a variance which are set forth in Section 3.40, subdivision 6 of the city code. The city council should grant the variance only if all three of the conditions are present on the property. Staff Review The staff has reviewed the request for variance against these three conditions and made the following findings: 1. That there are special circumstances or conditions affecting the particular land, building or use referred to in the applications not common to other roperties in this district or similar districts. It is the opinion of the s-taff that there are no special conditions affecting this property which are not common to other properties in the district. The lot is similar in size to other lots in the area , and the existing dwelling is similar in size and style to neighboring dwellings. 2 , That the grantin of the application is necessary for the preservation of substantial property ri hts . It is the opinion of the staff that the sideyard variance is not necessary for the preservation of substantial property rights. .Denial of the variance would not preclude the applicant from using the property for the existing single family residential purpose. 3. That the grantin~of the application will not materially or-adversely affect the health and safety of persons residing or working in the neighborhood of the property of the applicant and will not be mater- ially detrimental to the public welfare or injurious to property or improvements in the neighborhood The proposal does represent an improvement to the property and an investment in the neighborhood. The proposed project improves and continues the residential character of the neighborhood and, therefore, would not be detrimental to the public welfare. Council Letter No. 101 -3- April 10, 1978 Staff Recommendation Because the ordinance requires that all three criteria must be satisfied before a variance may be granted, and because the staff has found that all three criteria have not been satisfied, it is the recommendation of the staff that the request for variance be denied. Planning Commission Recommendation The planning commission considered this request at their March 28, 1978 meeting. No residents appeared before. the commission either in support or opposition to the request. The planning commission voted to recommend that the city council approve a five foot variance to the sideyard setback at 6700 Chicago Avenue, on a 5-2 vote. A copy of this agreement is attached. The agreement provides for the .Bloomington Health .Department to make screening services available to all pre-school age children in Richfield. These pre-school ' screenings are required by state law. The school district will reimburse .the Bloom- ington Health Department at a rate of $6.50 per child .screened, and there will be no cost to the city. However, since this screening provides additional services not detailed in the basic agreement for health services which the city has with Bloomington, the attached agreement has been prepared. DEFINITIONS As used in this Agreement, the following, words and terms shall mean: A. MDH Approved Program--a screening program which offers regularly scheduled comprehensive health screening for children from birth through 20 years of age in accordance with EPS Rules. B. Diagnosis/Evaluation--the systematic classification of the nature or the cause of physical or mental disease or abnormality through the combined use of health history; physical, developmental, and psychological assessments; and laboratory tests and x-rays. C. Screening--the use of those simple and quick procedures as outlined in the plan to sort out apparently well chil- dren Erom those in need of more definitive study of phy- sical or developmental problems. D. Screening and referral form--a report which when completed by approved programs and submitted to MD1I provides a summary of the results of screening for each child and contains data which can be used for biDH and local program analysis and evaluation. E. Tracking--documenting the results of diagnosis and treat- ment resulting from the screening of a child. This data may be used to evaluate the type and appropriateness of the referral. F. Treatment--medical, dental, nursing, preventive, rehabili- tative, or other relevant services to prevent, correct, or ameliorate disease or disability detected by screening and diagnostic services. G. Outreach--efforts by an agency through professionals or volunteers to assist parents to avail themselves of pre- school screening services. H. FoZZom-up--includes an organized system for securing infor- mation on children who are referred to another resource for evaluation, diagnosis, and treatment. Follow-up efforts are to assure that the needed services were made available and to evaluate the effectiveness of the screening program. 3. SCHOOL RESPONSIBILITIES A. To assure that School Preschool Screening Program meets all the requirements as defined in Department of Education Rules. B. To write and submit a Preschool Screening Plan to the Department of Education for reviewal by the Department of Education and Health. C. To select developmental screening instrument in accordance with standards of the Department of Health and Education. D. To train or arrange for training of appropriate individuals to utilize the selected screening instrument. E. To provide ongoing supervision of personnel performing de- velopmental screening. F. To provide clerical assistance. G. To supervise follow-up of children who are referred to as- sure appropriate evaluation/diagnosis and treatment. H. To pay to Health Agency a sum not to exceed $6.50 per child screened for services performed under the terms of this Agreement. 4. HEALTH AGENCY RESPONSIBILITIES A. To provide trained EPS or preschool-trained nurses who shall be responsible for: 1. f~ealth history interpretation. 2. Immunizations and dental inspection and education. 3. Laboratory tests: Ua and Hgb. 4. Nutrition education. B. To recruit and arrange for training of individuals respon- sible for vision and hearing screening. C. To provide supervision of vision and hearing screening. D. To train and supervise appropriate individuals to perform height and weight measurements. -2- CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 99 Agenda April 10, 1978 The Honorable Mayor and Members of the City Council City of Richfield Gentlemen:. __, __ _ -, Subject: Conveyance of Highway Residue Land to Hennepin County At the February 13, 1978 city council meeting, the council considered a re- quest from Hennepin County to convey three parcels of highway residue land owned by the city back to Hennepin: County. At that time, the city council referred this request to the planning commission for its review and recommendation. , In 1960-61, Hennepin County acquired property for the Crosstown Highway construction project. This acquisition included three parcels in Richfield which were acquired for a total of $71 , 000. These parcels are located at: 6204 Morgan Avenue 6209 12th Avenue 6204 Vincent Avenue In each instance, part of the land ;.vas used for highway right-of-way and the remainder was conveyed to the City of Richfield in the early 1960's, primarily for utility purposes. A full description of each parcel is attached, Hennepin County has been pursuing a policy of selling unneeded highway land adjacant to the county right-of-way. As part of this effort, bids were taken on the three parcels of land listed above. It was not until bids were actually received that it was discovered that title was held by the City of Richfield rather than Hennepin County, It was at that time that Hennepin County inquired whether the City of Richfield would be willing to deed this land back to the county so that the county could proceed with the sale of these three parcels, The staff determined that, except for the need to retain utility easements, the city has no need to continue holding the property, Each lot contains fewer than the minimum 8, 000 square feet required for buildable lots in Richfield. Since the lots are all zoned for single family residential use, development alternatives are limited. If a party wished to construct a house on any of the sites, it would be necessary to obtain a variance to the minimum lot size requirements, Sideyard setback variances could also be required to build because of the irregular shape Council Letter No. 99 of the lots. -2- April 10, 1978 The alternative of rezoning the land for commercial development is not feasible because the lots are in residential neighborhoods and commercial de- velopment would be incompatible with the surrounding residential uses. A third possible land use would be to maintain the areas as open space or small neighborhood parks, acting as buffers to the negative impact of the Crosstown Highway. however, the lots are too small to be versatile enough to use for such a purpose. A fourth alternative would be to sell the lots to adjacent property owners who .:urrently benefit the most from the buffer space between the residential areas and the Crosstown Highway. The .three parcels were conveyed to the city for one dollar. The total amount of the bids received by Hennepin County for purchase of these three parcels totaled $10, 015. Hennepin County individually contacted all adjacent property owners to advise them of the proposed sale, so that these adjacent property owners did have the opportunity to submit bids . Hennepin County has received the high bid on these three parcels from the following people : 6204 Morgan Avenue South -John R. Paulson, $3, 606 320 North Edgewood Golden Valley, MN. 6209 12th Avenue 6204 Vincent Avenue John R. Paulson, - $3,608 320 North Edgewood Golden Valley, MN. J. B. Press - $2,801 1421 Park Avenue Minneapolis, MN. None of these three high bidders are adjacent property owners. In two cases the adjacent property owners submitted bids, but the bids they submitted were consid- erably lower than the high bid . Planning Commission Recommendation The planning commission considered this matter at their February 21, 1978 and March 28, 1978 meetings. The commission voted 6 to 1 to recommend that the city council not convey the three parcels of land to Hennepin County. Commissioner Anderson cast the negative vote. The planning commission felt that the city should maintain ownership of the parcels for several reasons: Council Letter No. 99 -3- April 10, 1978 1. The lots are not buildable without variances because of their small sizes, irregular shapes and because of the utility easements, which are needed on them. The planning commission felt that any development which could take -place on the lots would be undesir- able, since it would necessarily have to be limited to small single family residential structures squeezed in between existing homes and the Crosstown Highway. 2. The planning commission felt that it would be best to maintain the land in its present form, since trees on the Vincent Avenue and Morgan Avenue lots serve as a buffer for the existing residential structures from the Crosstown Highway and also present a pleasant aesthetic appearance, which provide the neighborhood and the commun- ity with a positive image. Staff Recommendation The staff does not disagree with the recommendation submitted by the planning commission. However, approval of that recommendation will mean that the City of Richfield will have to assume the maintenance responsibility for these lots which was formerly provided by Hennepin County. Mr. Bill Baden has requested that the city issue a building permit to allow him to reconstruct the bowling alley and restaurant which were located on the site. The original building permit for Baden's Bowling Alley was issued in 1955. Apparently this bowling. alley was constructed before the city initiated the practice of issuing special use permits for such facilities. i The Baden Bowling Alley is currently anon-conforming use. It is located in a C-2 zoning district where bowling alleys are not a permitted use. Moreover, a special use permit was never issued for the facility. Prior to the time that a building permit can be issued for the reconstruction of anon-conforming use facility, it is necessary that a decision be made as to whether more than 50 percent of the structure was destroyed by fire. If less than 50 percent of the structure was destroyed by fire, the facility retains the non-conforming use des- ignation and it is possible to issue a building permit upon receipt of an adequate application. If it is determined that more than 50% of the structure was destroyed by fire, the municipal code requires that the building and land must be brought into conformance with all current provisions of the zoning on~linance. The city assessor has determined that the building was more than 50 percent damaged by fire, in terms of the fair market value. The fire chief has also stated that the property was more than 50 percent damaged by fire, We have not received from Mr. Baden the amount of insurance coverage or the insurance ad- juster's opinion of the damage by fire. However, based on the city assessor's opin- ion; and ~khe city fire chief's opinion and observation, it is recommended that the city council determine that more than 50 percent of the fair market value of the building was damaged by fire, Inasmuch as more than 50 percent of the structure was destroyed by fire, a building permit cannot be issued until the building and. land has been determined to be in conformance with the current regulations .nf the zoning ordinance. There Council Letter No. 98 -2- April 10, 1978 are two alternative courses of action which can be followed and. which could result in permitting Mr. Baden to rebuild. the bowling alley. The first alternative would. be for Mr. Baden to submit an application fora special use permit for a bowling alley in a C-2 district. Past history of city council actions indicates that the city has previously made use of this procedure for bowling alleys. Examples are as follows; 1. A special use permit for a bowling alley at 6727 Portland Avenue was denied in 1957. 2 . A special use permit for Luxury Lanes Bowling Alley, 7715 14th Avenue was approved in 19 5 8 . _ 3. A special use permit for Lariat Lanes Bowling Alley, 6320 Penn Avenue __ --was approved in 1958. 4. A special use permit application for a bowling alley at 901 E. 66th Street was withdrawn in 1957; the withdrawal was accepted by the city council, 5. A special use permit for a bowling alley at 7244 Portland Avenue was cancelled in _1958. 6. A special .use permit for a bowling alley at 1101 East 66th Street was denied by the city council in 1958. The second. alternative course of action would be for the city council to go through •~a public hearing process to determine whether bowling alleys are a permitted use in commercial districts. Although bowling alleys are not specifically allowed in a C-1 zoning district, the city council does have the authority (Section 3.32 , subdivision 1, paragraph 7) to determine that. a bo~n~ling alley is permitted in either a C-1 or C-2 district. To make such a decision, the council must hold. a public hearing and. find. that the use is of the same general character as other permitted uses in a C-1 district, The commercial uses permitted in a C-1 district are uses which provide a limited variety of commodities or service, primarily for' the benefit of residents of the immediate neighborhor'~ood, such as a grocery store, meat market, barber shop, business or professional offices, etc. Restaurants, cafes and soda fountains are permitted only with special use permits. If the council feels that a bowling alley is of the same general character as the a1loJaed uses, the council should set a date of hearing, refer the question to the planning commission for its review, hold. the public hearing, and then make a determination. r Council Letter No. 98 -3- April 10, 1978 Given the past actions taken by the city council with regard to bowling alleys, it would appear that precedent supports the use of the special use permit alternative. This conclusion can be further substantiated by the fact that this bowling alley included a restaurant which does require a special use permit in a C 2 zoning district. In summary, it is recommended. tl-:at the city council take the following actions; 1. Make a determination that mare than 50 percent of the fair market value of the bowling alley located at 801 West 77 1/2 Street, was destroyed in the fire of March 15, 1978; 2. The council stipulations on the special use permit required the parking lot to be upgraded to standards required by city ordinances and. that an off-street parking contract be executed. On March 16, 1978 Progress Valley, Inc, submitted a site plan and application for an off-street parking contract for their proposed facility. In re- viewing the site plan, the staff noted. that the information presented was in- . sufficient to enable the staff to determine whether the proposed parking lot would. meet city ordinance requirements , In a March 31, 1978 letter to Mr. Donald Stuhlman, the planning director requested additional information and described the deficiencies in the plan that needed correction. In a letter dated April 3, 1978, Mr. Stuhlman noted. that a new site plan would be submitted, showing the additional information and correcting the noted deficiencies. Copies of both of these letters are attached. Section 3.37, subdivision 3.11 of the city code requires that any un-enclosed. off-street parking area used to meet the parking requirements of a group housing development must be located at least 20 feet from the travelled roadway of any public street. Progress Valley, Inc. is proposing to improve and use an existing parking area adjacent to the building. This existing lot is approximately five feet from the traveled roadway of the 78th Street frontage road and, therefore, would be in violation of this ordinance requirement. The staff has asked that the applicants enter into an agreement with the city that would. permit use of the parking area in its existing location if the applicant agrees to hold the city harmless from any possible damages which the applicant could incur if at some future date the city or the state requires additional right-of-way or easements necessitating moving of the parking lot. The applicant has submitted a draft of such an agreement to the city. The Richfield Environmental Health Department has determined that the Ericksen's swimming lesson operation violates the requirements for home occupations found in Section 3 , 29 , subdivision 14 in that it is a noticeable activity, it involves a nonresident employee, and it has potential adverse effects on the neighborhood. Because it involves teaching children, the proposed use constitutes a school; a school is permitted in an "R" (Residence} zone upon the procurement of a special use permit. Therefore, a special use permit is necessary if the pool is to be used for the purpose of providing swimming lessons. The request for a special use permit should be reviewed against the following criteria: 1 . Comprehensive plan 2, Conditions for issuance of a special use permit (Section 3.44,__,... __,_ ____ -- ._ Subdivision 5}, Comprehensive Plan - - - ---~-- The comprehensive plan indicates that the site should be developed for single or two family use, and accessory uses compatible with single and two family residential use. The proposed use would be in compliance with the comprehensive plan. The primary use of the site is single family, the pool is a permitted accessory use. The applicants indicate that their primary purpose of the swimming pool is to provide ~ recreation and service to the community, rather than a s a commercia 1 venture . Special Use Permit Issuance Conditions The zoning ordinance (3.41, subdivision 5) states that a special use permit shall not be issued if the proposed use would be detrimental: Council Letter No. 96 -3- April 10, 1978 "1. to the health, safety, morals, comfort, convenience or welfare of the persons residing or working in the neighborhood of such use, or 2. to the public welfare or injurious to the property or improvements in the neighborhood . " There would appear to be three potential detrimental effects to the public welfare. The first would be increased traffic. resulting from the increased number of people using the pool. The increase in traffic should be minimal because the classes serve neighborhood children and would only involve a maximum of ten students at a time. Since parents are not. allowed in the pool area during classes, children would be dropped off or would walk to their classes which would further minimize parking problems . The second potential detrimental effect would be the inconvenience to neigh- boring property owners caused by noisy children. Noise could be kept to a minimum by the seven-foot privacy fence surrounding the pool and by the fact that children would be involved in structured lessons rather than in open swimming. However, the Environmental Health Department has received complaints in the past about noise caused by the swimming lessons from two property owners to the southeast of the pool operation. The third potential detrimental effect could be that the safety of the students would be threatened. However, the pool has been .constructed and is operated in compliance with all city ordinances and health standards. The classes will be taught by Mrs. Ericksen and one outside employee, both of whom are exper- ienced, and certified Water Safety Instructors. Mr. Ericksen is also experienced in teaching. swimming, and coaches the University of Minnesota swim team. According to the health department the capacity of the pool would not be sup- passed during the lessons if the class size is limited to 10 people. Staff Recommendation The staff has found that the proposed use would have minimal effect on the neighborhood and the public welfare and, therefore, recommends that the city council approve issuance of the special use permit. However, since the special use permit is issued to the property, if the. Ericksen's should sell the property, the special use permit would still be valid, and it is important to .take pre- cautions to insure that the swimming pool iESSO ~s are run as the Ericksen's plan to operate. It is recommended that the city council issue the special use permit with the following stipulations: 1. The classes be taught only by American Red Cross Cdrtified Water Safety Instructors 2. Attached to this council letter is a resolution incorporating the guidelines adopted by the council at the March 27, 1978 meeting. The differences occurred be- cause the city staff determined that the monies allocated to administrative costs would be better accounted for within the various projects, and allocated the admin- stration monies to these projects rather than to a separate administrative fund. However, Hennepin County has recently informed us that, while the allocation of administrative monies between approved projects could previously be done at the staff level, regulations now require the city council to approve any reallocation of monies between projects. The proposed adjustments have no effect on the total amount of Year II CD funding Council Letter No. 94 _2_ April 10, 1978 the city receives, but are only necessary to reflect the actual distribution of monies among the various activities funded by the Year II CD grant. The records show an additional $2 , 610 in Year II funds available to spend on the approved projects as a result of the differing allocations between the county's budget figures and our CD budget records. It is, therefore, recommended that the council adopt a motion authorizing the transfer to $3, 085 from Year II Community Development Block Grant admin- istration funds to CD project 25 (housing rehabilitation) and the transfer of $6, 165 of administrative funds to CD project ~7 (New Home Program). Stone. The public safety department award program also includes presentation of commendation awards to public safety employees. Presentation of these awards is scheduled - for the April 10, 1978 city council meeting. Two employees of the public safety department have been nominated as re- cipients of the commendation awards for the period from July through December, `- ~ 1977. The first of these awards is to be presented to Police Officer Kenneth Pilcher for the personal courage and professio al ability he demonstrated in a robbery incicent,on..August 25, 1977. This incident involved a shooting at the Short estop uperette located at Cedar Avenue and Diagonal Boulevard. Officer Pilcher' ctions were instrumental in saving both his own life and the lives of ~' bery victims. For his demonstrated courage and professional ability, the ublic safety department has nominated Officer Pilcher for a distinguished service .ward. The second award is a special commendation award to be presented to former ~hfield Police Officer Ronald Holt.. Officer Holt left the Richfield Public fety Department in February to assume the position of Chief of police in rose, Minnesota. Officer Holt served with the Richfield Public Safety rtment for more than ten years; during the past four years Officer Holt responsibility for development and management of our crime prevention ram. Officer Holt's efforts in the area of crime prevention, pedestrian and cle safety have won the City of Richfield national recognition for innovation effectiveness. Officer Holt also served as Coordinator of Richfield's fifty .,safety volunteer reserve officers and established a program which has e a model statewide. For his contribution to these public safety efforts, public safety department has nominated Officer Holt for a distinguished ice award .
