Item # I PRESENTATION FROM YOUTH ACTION COUNCIL Representatives from the Youth Action Council presented and discussed their video "SEE us, HEAR us, ENGAGE us." The City Council provided comments and ideas on finding a location for teens to gather in the City and various possible funding options through grants. Item #2 UPDATE REGARDING EMERALD ASH TREE BORER (COUNCIL MEMO NO. 152) Street Maintenance Supervisor Link discussed a PowerPoint presentation regarding policy direction on handling oak wilt and emerald ash borer impacts on Richfield's trees and potential funding sources. Council Member Sandahl stated the City's boulevard trees should be considered as an infrastructure investment. Item #1 PRESENTATION BY THE WEIDT GROUP REGARDING ENERGY ANALYSIS RESULTS FOR NEW POLICE/FIRE/CITY HALL FACILITY (COUNCIL MEMO NO. 153) Kris Leaf, The Weidt Group, made a presentation about the energy analysis as part of the Xcel Energy's Energy Design Assistance Program. He discussed the process used by the Weidt Group to determine energy bundling strategies, key results of the analysis, and summary of the components of the bundle selected by the City Hall design team. Item #2 COUNCIL DISCUSSION • DESIGNATION OF COUNCIL MEMBER(S) TO ATTEND NATIONAL LEAGUE OF CITIES, CONGRESS OF CITIES AND EXPOSITION (DEFERRED FROM AUGUST 11, 2009) (COUNCIL MEMO NO. 154) • HATS OFF TO HOMETOWN HITS Council Member Elliott introduced O'Neal Hampton and his daughter, Sunshine, Richfield residents, who will be participating in the reality show, "The Biggest Loser." The City Council consensus was to designate Council Member Sandahl to attend the National League of Cities Congress of Cities and Exposition in November 2009. Council Member Sandahl stated the Minneapolis-St. Paul Business Journal included Richfield businesses, Best Buy and Carrousel Travel, as best places to work. Council Member Fitzhenry discussed the Metropolitan Airports Commission interactive flight map. Mayor Goettel acknowledged the participants in the recent Cattail Days event. Mayor Goettel requested staff consider repositioning the traffic barriers recently installed near Cedar Point for easier bicycle access. Mayor Goettel requested the neighbors along the Crosstown be contacted regarding the placement of streetlights when construction is finished. Mayor Goettel reported on the CHAT III open houses, including requests for tree dedications in the park and gardens. Mayor Goettel requested recycling containers be placed in the parks. Mayor Goettel discussed the recent editorial in the Star Tribune regarding the new City Hall. Council Meeting Minutes -4- September 22, 2009 Item #5 CONSIDERATION OF ITEMS, IF ANY, REMOVED FROM CONSENT CALENDAR None. Item #6 CONTINUED PUBLIC HEARING AND CONSIDERATION OF RESOLUTION ESTABLISHING STREET LIGHT USER FEE TO BE CHARGED TO RESIDENTIAL AND COMMERCIAL PROPERTY IN CITY OF RICHFIELD FOR OPERATION OF STREET LIGHTING SYSTEM (PUBLIC HEARING CONTINUED FROM SEPTEMBER 8, 2009) S.R. NO. 191 Mayor Goettel presented Staff Report No. 191. M/Goettel, S/Wroge to close public hearing. Motion carried 5-0. Council Member Wroge expressed his support because the sunset clause is included and levy limits are currently in place, but when levy limits are removed, the fee should go back on property taxes. He added the definition of property taxes should be discussed. Council Member Sandahl stated support because of the current budget resulting from reductions in Local Government Aid (LGA). City Manager Devich explained the current and expected LGA reductions from the State. Council Member Elliott agreed with supporting the fee as a temporary. solution with a sunset date so the fee could go back on taxes. Council Member Fitzhenry agreed with supporting the fee because the best crime prevention is lighting. Item #7 CITY MANAGER'S REPORT • POLICE/FIRE/CITY HALL FACILITY GROUNDBREAKING CEREMONY • DECEMBER 22 REGULAR CITY COUNCIL MEETING Council Meeting Minutes -5- September 22, 2009 City Manager Devich announced the following items: • The Police/Fire/City Hall Facility groundbreaking ceremony is on October 31, 2009 from 11 a.m. - 12 p.m. • The Lyndale Avenue bridge ribbon-cutting is on October 29, 2009 at 10 a.m. with the official opening on October 30, 2009, which is approximately one month earlier than anticipated. • A second City Council Meeting in December will be necessary to stay on schedule with construction bids for the new City Hall. • A Special City Council Worksession may need to be scheduled very soon to make decisions on the Council Chambers design; including a rear projector system. Council Member Elliott requested the Orfield and Associates proposal include definitive cost projections and WOLD provide budget adjustment options. Council Member Wroge requested the City Council be provided the names of other City Halls with rear projectors. Mayor Goettel added that comparative experiences with or without that system be provided. City Manager Devich stated the rear projector system could require the Chambers to be lengthened further into the Heredia Park. City Manager Devich said independent sources will be contacted to provide audio visual , equipment comparisons. Devich City Manager CITY OF RICHFIELD, MINNESOTA Office of City Manager October 8, 2009 Council Memorandum No. 166 The Honorable Mayor and Members of the City Council Subject: MAC Update (Council Agenda Item No. ~ ) Council Members: Staff from the Metropolitan Airports Commission (MAC) will be making a brief presentation at the October 13, 2009 City Council meeting on the status of the MAC's Long Term Comprehensive Plan (LTCP) Update. The original LTCP was completed in 1996. The 2009 update will be the first revision to the LTCP in over 13 years. The plan will serve as a guide to the MAC through the year 2030. A summary of the plan update is attached for your reference. esp tfu submi d, Ste is Manager SLD:cak Attachment Email: Department Directors Assistant to the City Manager Minneapolis - St. Paul International Airport (MSP) Long Term Comprehensive Plan Update Purpose of the Plan The Metropolitan Council adopted guidelines to integrate information pertinent to planning, developing, and operating the region's airports in a manner compatible with their surrounding environs. The process to ensure this orderly development is to be documented in a Long Term Comprehensive Plan (LTCP) for each airport. Recognizing the dynamic nature of the aviation industry, the plans are to be updated regularly. The original LTCP for MSP was completed in 1996. The 2009 update will be the first revision to the LTCP and will reflect substantial changes to MSP and the aviation industry over the previous 13 years. Forecast ,~ . ~l o T 0 -- -o ~r z .o Forecasts of annual passenger boardings and aircraft operations (take-offs and landings) were completed in June 2009. They show that passenger boardings are expected to increase by over 73% by 2030, growing from 16.4 million to 28.4 million. Total aircraft operations at MSP are expected to grow by about 40% from 450,000 to 630,000 by 2030. The current economic recession has resulted in declines in both boardings and operations at MSP since 2006. Passenger boardings are expected to return to previous levels in 201 3, while operations are expected to return to previous levels in 2019. Contents of the Plan The LTCP identifies the type and location of facility improvements needed to safely and efficiently accommodate aviation demand through the year 2030. The LTCP also provides guidance for phasing airport improvements during the development period. Process The LTCP is developed in five steps: 1. Inventory existing facilities and assess their condition and capacity 2. Prepare a forecast of aviation demand for the next 20 years 3. Determine required facility improvements to meet the demand 4. Develop concepts for facility improvements 5. The inventory shows that future plans for MSP will require careful consideration of balancing airfield capacity, terminal capacity, and landside capacity. PAUL INTERNATIONAL AIRPORT Facility Requirements Growth in the number of passengers and aircraft operations will require airport facilities to be improved in order to keep operating in a safe and efficient manner. The existing passenger terminal complexes and their landside facilities are not able to accommodate forecast growth without expansion. Growth in passenger boardings will prompt additional aircraft gates, additional parking, more roads and terminal space to allow passengers to enjoy a safe and comfortable airport environment. Balancing passenger demand between the Lindbergh and Humphrey terminals will result in improved efficiency of both facilities. This balance can best be achieved by utilizing the Lindbergh Terminal to accommodate Delta Air Lines and its partner airlines while relocating all other airlines to Humphrey Terminal. The aviation activity forecast determines that this move should occur by 2015. The charts below illustrate The requirements of key facilities such as aircraft boarding gates, automobile parking, and terminal curbfront lengths. The charts show the effects of relocating airlines from the Lindbergh Terminal to the Humphrey Terminal in 2015. Though aircraft operations will be growing as well, the existing four-runway airfield is expected to be able to continue operating in a safe and efficient manner without the need for additional runways. Some improvements to taxiways may be required to help aircraft move around the airfield as they taxi between the runways and the terminal complexes. Balancing passenger loads between the two terminals is essential; initial development is expected to focus on an expansion of the Humphrey Terminal to accommodate growing demand and the relocation of some airlines from the Lindbergh Terminal. A second phase of development would further improve and expand the Lindbergh Terminal. A final phase of development would see both facilities improved to meet full potential for meeting forecast demand in 2030. Schedule Development of the LTCP includes five steps as presented on Page 1. Steps 1 through 4 have been completed as of July 31, 2009. POLICY • Public Safety does not accept financial support unless it is designated for a specific program that will affect the department as a whole. • The grant money anrill be used by Public Safety/Police for training and purchasing of equipment. • Minnesota Statute 465.03 requires every acceptance of a grant or devise of real or personal property on terms prescribed by the donor be made by resolution of more than two-thirds majority of the City Council. • The Administrative Services Department issued a memo on November 9, 2004 requiring that all grants and restricted donations to Departments be received by resolution and by more than two-thirds - majority of the City Council in accordance with Minnesota Statute 465.03. B. CRITICAL ISSUES • The grant money will be used by Public Safety/Police for purchasing equipment. • Due to budget restraints for the past several years, the Police Division has not purchased many needed equipment items. C. FINANCIAL • Five percent (5%) or $1,209 of the total $24,173 has been removed as approved by the administrator of the grant for administrative costs. Public Safety will receive $22,964. D. Staff is recommending Council approve Contract Change Orders #5, #6, #9 and #10: 1013 Lincoln Athletic Complex Change Order 5, 6, 9&10 Change Order #5 -All ballfields were specified to include drain the to facilitate efficient rainwater runoff. The Architect recommends installing pea gravel around the drain the so that it guards against the build-up of silt over time. The cost to replace the sand with pea gravel for all the fields is $2,035.00. Change Order #6 -The 6-inch water line was specified to be converted to a smaller diameter line just before it enters the concessions building. Staff recommends continuing the 6-inch line into the concession building along with the required stainless steel components and connectors to offer more flexibility to modify the irrigation system and other uses if needed in the future. The cost to provide additional stainless steel components to extend the 6-inch water line into the concession building is $1,513.60. Change Order #9 -Paper towel dispensers were specified in the restrooms of the concession building. Conduit is recommended to be installed to the dispenser locations to accommodate electric hand dryers~in the future to reduce maintenance and the cost of paper products. The cost to provide conduit to both locations is $990.00. Change Order #10 -The concrete bleacher pad for each field was specified to accommodate athree-row bleacher. The City currently has enough available 5- row bleachers for all four fields, which would accommodate more spectators. The bleacher pads would need to be expanded to a dimension of 9 feet by 16 feet to accommodate the five-row bleachers at a cost of $1,146.20. III. BASIS OF RECOMMENDATION A. POLICY • It is appropriate for City Council to review and approve contract change orders which are additions to the project contract. B. CxITICAL ISStTES • The Contractor is under a time constraint to complete the project on a timely basis in order to accommodate use as soon as possible for the next season. C. POLICY • Chief s notified the City that they wish to renew the contract for 2010. • The Public Safety Department wishes to renew the contract with Chief's Towing, lnc. • Contracts for services need not be competitively bid. • The contract has numerous conditions that must be met. Chief's Towing, Inc. is a reputable, established towing business that meets all contract requirements. • A six-month notice must be given by either party in writing to terminate the contract. • ~ On December 1, 2009, Public Safety must have towing services. This is particularly important with the possibility of snow emergencies occurring at any time. • Chiefs is a large towing company that can handle the needs of Public Safety regarding seizure/impound vehicles and comply with City ordinances that a smaller company could not handle effectively. • The current contract with Chiefs reflects rates from 2009. FOR TOWING, IMPOUNDING AND STORAGE OF MOTOR VEHICLES THIS AGREEMENT is made this 30th day of November, 2009, between the City of Richfield, a Minnesota municipal corporation located at 6700 Portland Avenue South, Richfield, Minnesota 55423 (hereinafter referred to as the "City"), and Chief's Towing, Inc., located at 8610 Harriet Avenue South (hereinafter referred to as the "Contractor"). WITNESSETH WHEREAS, the City has a need to contract for the towing, impounding and storage of motor vehicles; and WHEREAS, the City requires that the towing operators are located within three (3) miles of the City limits; and WHEREAS, the Contractor is the operator of a towing and storage facility within three (3) miles of the City limits and has the expertise and capabilities to provide the required services; NOW THEREFORE, in consideration of the terms and conditions expressed herein, the parties agree as follows: I. TERM OF AGREEMENT The term of this Agreement shall be from December 1, 2009, to November 30, 2010, subject to termination as provided in Subdivision V. II. DUTIES OF CONTRACTOR A. The Contractor shall tow, impound, and store all motor vehicles, which are ordered removed under the direction of the police chief, or the fire chief, of the City of Richfield or their authorized and legal representatives. The Contractor shall be entitled to a charge for its towing and storage services pursuant to those fees specified in the ~~3 Contractor's Proposal (Exhibit B). It is agreed that neither the City nor the Richfield Police Department is responsible for any charges as a result of towing and/or storage, with the exception of those vehicles identified by the Police as subject to forfeiture, and that the Contractor assumes liability for any unpaid charges. B. The Contractor agrees to provide the services, as proposed, and perform all other terms and conditions according to the City's Specifications and the Contractor's Proposal, incorporated by reference herein as Exhibit A and Exhibit B. C. The Contractor shall defend, indemnify and hold harmless, the City of Richfield, its officials, employees and agents, from any and all claims, causes of action, lawsuits, damages, losses, or expenses, including attorney fees, arising out of or resulting from the Contractor's (including its officials, agents or employees), performance of the duties required under this Agreement, provided that any such claim, damages, loss or expense is attributable to bodily injury, sickness, diseases or death or to injury to or destruction of property including the loss of use resulting therefrom and is caused in whole or in part by any negligent act or omission or willful misconduct of Contractor. D. It is agreed that nothing herein contained is intended or should be construed in any manner as creating or establishing the relationship of copartners between the parties hereto or as constituting the Contractor's staff as the agents, representatives or employees of the City for any purpose in any manner whatsoever. The Contractor and its staff are to be and shall remain an independent contractor with respect to all services performed under this Agreement. The Contractor represents that it has, or will secure at its own expense, all personnel required in performing services under this Agreement. Any and all personnel of the Contractor or other persons, while engaged in the performance of any work or services required by the Contractor under this Agreement, shall have no contractual relationship with the City and shall not be considered ~E-y employees of the City, and any and all claims that may or might arise under the Workers' Compensation Act of the State of Minnesota on behalf of said personnel or other persons while so engaged, and any and all claims whatsoever on behalf of any such person or personnel arising out of employment or alleged employment including, without limitation, claims of discrimination against the Contractor, its officers, agents, contractors or employees shall in no way be the responsibility of the City; and the Contractor shall defend, indemnify and hold the City, its officers, agents and employees harmless from any and all such claims regardless of any determination of any pertinent tribunal, agency, board, commission or court. Such personnel or other persons shall not require nor be entitled to any compensation, rights or benefits of any kind whatsoever from the City, including, without limitation, tenure rights, medical and hospital care, sick and vacation leave, Workers' Compensation, Unemployment Compensation, disability, severance pay and PERA. E. The parties agree to comply with the Minnesota State Human Rights Act, Minnesota Statutes, Section 363. F. The Contractor agrees to maintain for the full term of this Agreement, the following minimum insurance coverage: a) $1,000,000.00 Comprehensive General Liability insurance, Business Auto Policy with $1,000,000.00 limits and Garage Keeper's Legal Liability. b) Workers' Compensation insurance covering all employees of the Contractor, or his agents, in accordance with the Minnesota Workers' Compensation Law. Certifications of insurance must be filed with the City and shall include a provision that states the insurance company shall give the City at least 25 days written notice prior to cancellation, non-renewal, or any material change in the policy. The Contractor further W ~ / agrees to name the City of Richfield as additional insured on said comprehensive general liability policy. G. The Contractor agrees to furnish on or before the date this Agreement becomes effective, an acceptable corporate surety bond in the amount of $10,000, payable to the City of Richfield and subject to approval by the Richfield City Attorney, for the faithful performance of all duties and obligations imposed under the terms and conditions of the Agreement. III. DUTIES OF THE CITY The City agrees to pay the Contractor the flat rate charge of $152.00 per vehicle for the towing and storage of vehicles identified by the Police Department as subject to forfeiture and which are subsequently released to the Police Department. IV. MISCELLANEOUS A. This agreement represents the entire Agreement between the Contractor and the City and supersedes and cancels any and all prior agreements or proposals, written or oral, between the parties relating to the subject matter hereof; and amendments, addenda, alterations, or modifications to the terms and conditions of this Agreement shall be in writing and signed by both parties. B. The Contractor agrees to comply with the Americans With Disabilities Act (ADA), Section 504 of the Rehabilitation Act of 1973, and not discriminate on the basis of disability in the admission or access to, or treatment of employment in its services, programs, or activities. The Contractor agrees to hold harmless and indemnify the City from costs, including but not limited to damages, attorney's fees and staff time, in any action or proceeding brought, alleging a violation of ADA and/or Section 504 caused by the Contractor. Upon request, accommodation will be provided to allow individuals with disabilities to participate in all services, programs and activities. The City has designated coordinators to facilitate ~P G (D compliance with the Americans with Disabilities Act of 1990, as required by Section 35.107 of the U.S. Department of Justice regulations, and to coordinate compliance with Section 504 of the Rehabilitation Act of 1973, as mandated by Section 8.53 of the U.S. Department of Housing and Urban Development regulations. C. The Contractor will comply with all applicable provisions of the Minnesota Government Data Practices Act, Chapter 13 of the Minnesota Statutes. The Contractor agrees to comply with all applicable local, state and federal laws, rules and regulations in the performance of the duties of this contract. D. This Agreement shall not be assignable except at the written consent of the City. E. The books, records, documents, and accounting procedures of the Contractor, relevant to this Agreement, are subject to examination by the City, and either the legislative or state auditor as appropriate, pursuant to Minnesota Statutes, Section 168.06, Subdivision 4. F. The City and the Contractor agree to submit all claims, disputes and other matters in question between the parties arising out of or relating to this Agreement to mediation. The mediation shall be conducted through the Mediation Center, 1821 University Avenue, St. Paul, Minnesota. The parties hereto shall decide whether mediation shall be binding or non-binding. If the parties cannot reach agreement, mediation shall be non-binding. In the event mediation is unsuccessful, either party may exercise its legal or equitable remedies and commence such action .prior to the expiration of the applicable statute of limitations. V. TERMINATION Either party may terminate this Agreement for any reason upon giving six (6) months advanced written notice to the other party. The City reserves the right to extend the contract for additional (1) one year periods if such an extension is permitted by the Contractor, the standard of service is satisfactory, and, has the approval of the Richfield City Council. At the time of contract extension, the contractor may request a price increase for all categories to be effective during the contract extension period. Any requested increase shall not exceed the Consumer Price Index for the Minneapolis/St Paul urban area and have the approval of the Richfield City Council. Application for extension and price increases or decreases shall be initiated by the performing contractor, must be submitted in writing and be in the hands of the proper Director of Public Safety at least sixty (60) days prior to the date of contract expiration. All of the towing, impounding and storage of motor vehicles under this contract shall be in accordance with Minnesota Chapter 1688 and any section of the Richfield City Code related thereto. SPECIAL PROVISIONS: The contractor must own or have direct access to satisfactory equipment and trained, available personnel, in order to provide immediate and prompt service as ordered and requested by the authorized City officials. 2. The contractor must own or have available within (3) miles of Richfield's city limits the following equipment as a minimum: A. Two trucks having a manufacturer's gross vehicle weight rating of 4 ton or more, to be equipped with a crane and winch, and further equipped to control the movement of the towed vehicle, and B. Equipment sufficient and designed to move a completely demolished vehicle by means of dollies or low-bed trailers. A listing of all equipment to be utilized shall be submitted to the City. Such listing shall show the make and model of all equipment available for use under this contract, along with size and all other pertinent information, such as specialized equipment not necessarily herein specified, but which may be a factor in performing effectively and efficiently. ~~^~ All equipment to be used by the contractor under this contract shall be maintained in good repair and condition. The City reserves the right to inspect the equipment from time to time for the purpose of determining that equipment condition is in conformance with the terms and conditions of the specifications and the contract. 3. All storage and parking lot facilities and all equipment to be used by the contractor under this contract must be located within (3) miles of Richfield's city limits. The storage and parking lot facilities must meet all of the applicable State building code standard and municipal license and zoning requirements, including those relating to screening and landscaping of the City in which the facility is located. 4. The facilities proposed to be utilized under this contract must have the capability of storing a minimum of one (1) vehicle inside and a further capability of providing storage for a minimum of (25) twenty-five vehicles outside. Inside storage will be necessary only when so requested or directed by an authorized official of the City of Richfield as identified in these specifications. When a direction is given to store a unit inside, such directions may be accompanied by certain instructions for security measures to be employed. The security responsibilities become the responsibility of the storing agent while the unit is in their keeping. 5. The Contractor performing under this contract shall assume all and full responsibility for the conduct of his/her employees. The Contractor guarantees that all of the employees performing under this contract will be adequately trained in their profession, will respond promptly to all calls, will provide safe and adequate equipment (as herein specified), be clean and neat in appearance, use decent language, free of profanity, and treat the public courteously at all times. Reauest, for service from the Richfield Police Department must be given priority by all dispatchers. Failing to meet any or all of the requirements of this section may result in cause for terminating the contract at any time as per the conditions specified for contract termination. 6. The Contractor will be solely responsible for loss or damage to any vehicle, including all equipment and contents, from the time direction is given by the authorized City representative turning the vehicle over to the Contractor or his Agency and until such time as the vehicle is legally released to the registered or actual owner or legal agent thereof. 7. The performing contractor must agree to maintain proper records of all vehicles received. The record keeping system shall meet the approval of the Richfield Public Safety Director and records are to be available at all times for inspection by authorized City officials. The records must include a copy of the police impounding report. A report shall be submitted monthly to the Richfield Public Safety Director detailing all vehicles stored or released during that current month. All contents of such reports shall meet the approval of the Richfield Public Safety Director. 8. All vehicles towed or impounded are to be released only upon proper authority of the Richfield Public Safety Director, except for private tows. 9. While performing under ,this contract and under these specifications, the Contractor or their designated representative(s) must be present at the storage facility six (6) days a week, Monday through Saturday, between the hours of 8:00 a.m. and 6:00 p.m. (excluding legal holidays), and from 12:00 p.m. (noon) to 1:00 p.m. each Sunday and all legal holidays, for the purpose of releasing vehicles to authorized claimants. Police requested releases will be handled anytime. (~ E- f0 10. It shall be agreed under this. contract that motor vehicles will not be driven at anytime during the towing procedure. In the event that the vehicle is without tires or has flat tires, the performing Contractor agrees to tow the vehicle without damaging the wheels and further agrees not to tow any vehicle on its rims, on wheels without tires, or on flat tires. 11. Upon arrival at the scene of a tow where a vehicle accident has occurred, the performing Contractor, in addition to the physical removal of the vehicle, assumes full responsibility for removing any vehicular parts or other debris, excluding liquids and other commercial .cargo, resulting from the accident. This clean-up is to be completed without any additional compensation. 12. The performing Contractor shall be entitled to a charge for his/her towing and storage services pursuant to the fees submitted in the accompanying bid proposal. The Contractor shall agree that neither the City nor any Department thereof is responsible for any charges as a result of towing and/or storage and that the Contractor assumes all liability for any and all unpaid charges. NOTE: This Provision and these Specifications are in no way a law or regulation relating to "price, route, or service of any motor carrier with respect to the transportation of property," under 49 U.S.C. Sec. 14501(c)(1)(1997). 13.If an involved private owner/operator makes a timely request for a tow by other than our Contractor, such request shall be honored by the Police Department. In either instance, the owner/operator is solely responsible for all associated charges. 14. For vehicles identified by the Police Department as subject to forfeiture, and subsequently released to the Police Department pending the outcome of forfeiture proceedings, the performing contractor shall indicate a flat rate charge per forfeited vehicle. The flat rate shall include the towing, storage on the date of the tow, and three days of storage after the date of the tow. The flat rate applies to all cars, vans, small trucks, 4-wheel drive vehicles, utility vehicles, and motorcycles identified by the Police Department as subject to forfeiture to the City. 15. Should the Contractor fail to appear at a designated tow point within twenty (20) minutes after receiving a call for a tow, the City reserves the right to call another towing service to perform the work. If the Contractor is called and is unable to respond due to conditions beyond their control, the authorized City officials shall be immediately so informed, and the right is hereby reserved to call another service to perform the work. If, at any time, it becomes necessary for the City to request the services of another towing service for the reasons detailed above, the City retains the right to hold the Contractor retained under this contract responsible for any additional charges over and above the fee schedule recorded in this bid proposal. Such charges shall be assessed only if the response time is due to negligence or laxity on the part of the contractor, which negligence might include equipment failure. 16. The Contractor performing under this contract shall operate and maintain its parking and storage facility in compliance with the terms of this contract and all State and City applicable laws, ordinances, and rules and regulations that are presently in effect, or which may hereafter be adopted. 17. No alterations or modifications of the terms of this contract shall be valid unless made in writing and signed by authorized representatives of both parties hereto. ~~~~i 18. In the event of a breach by the Contractor of any terms or conditions of this agreement, the City shall have, in addition to any other legal recourse, the right to terminate this agreement forthwith. 19. Either party may terminate this contract upon the serving of such termination notice to the other, in writing, (6) six months prior to the intended termination date. 20.A copy of this contract, along with the authorized fee schedule, shall be posted in a conspicuous place in the Contractor's place of business. INSURANCE: The successful Contractor shall not commence work under this contract until the specified insurance coverages have been obtained. The Contractor shall file, with the Richfield City Clerk, all certificates of insurance or documentation thereof indicating that all specified insurance have been obtained and are in full force. The City of Richfield shall be named as an additional insured on said comprehensive general liability policy. The following coverages are required as minimums: 1. Public Liability Insurance: $1,000,000 Comprehensive General Liability (including assault and battery). 2. Business Auto Policy with all coverages (all vehicles), with $1,000,000 limits. 3. Garage Keepers' Legal Liability. 4. Workers' Compensation Insurance covering all employees of the Contractor, or his agents, working under this contract in accordance with the Minnesota Workers Compensation Law. The Contractor shall agree to provide to the Richfield City Clerk, 25 days prior written notice in the event any policy is canceled or a material change is effected and each policy must contain a provision that the insurer notify the Richfield City Clerk immediately if a policy is canceled or a material change has been effected. As they exist now, the property lines of Heredia Park include half of the existing City Hall building and the entire parking lot. This led to an error in classification of the property in the Comprehensive Plan. The area covered by the building and parking lot should have been designated as Public/Quasi-Public, rather than Park. The proposed amendment will correct this error. Currently the properties located at 6734, 6754 and 6758 Portland Avenue are designated as Low Density Residential in the Comprehensive Plan. 6754 and 6758 Portland Avenue are the two single-family homes located at the southern end of the block. 6734 Portland Avenue is aseparately-addressed parcel that is currently part of the City Hall parking lot. BACKGROUND In 2004 the City Council created the City Hall Advisory Task Force (CHAT) to study the feasibility of remodeling the existing City Hall Facility versus constructing a new facility. Lack of office and meeting space, dated technology, rising maintenance costs and failure to meet Americans with Disabilities Act (ADA) requirements were just a few of the reasons CHAT recommended construction of a new facility. A second Council-appointed task force (CHAT II) examined potential locations for the new facility as well as preliminary site plans. A third iteration of CHAT has continued to provide resident input regarding the details of the project. The Council will be able to review all of details as part of the approval of contract documents. III. BASIS OF RECOMMENDATION A. POLICY • Site Plan approval is required for the construction of a building. • There are a number of currently separate parcels that make up the future site of City Hall and Heredia Park. The Council will consider the combination (platting) of these parcels as a separate agenda item. • The proposed site plan assumes that the Council will approve the combination of the involved parcels. • In evaluating a site plan, the Planning Commission and City Council consider its compliance with the following: a) Consistency with the elements and objective of the City's development guides, including the Comprehensive Plan and any redevelopment plans established for the area; , The proposed site plan is consistent with the proposed amendment to the Comprehensive Plan for these properties. b) Consistency with the requirements of the Zoning Ordinance; The proposed site plan is consistent with all but two requirements of the Zoning Ordinance. The following variances are required: • The Zoning Ordinance requires 179 parking spaces. The proposed plan provides 157 spaces. The current City Hall includes 147 spaces. • The Zoning Ordinance requires non-residential buildings to be set back 30 feet from the property line. At its southern- most point, the building will be 19.39 feet from the property line, but is still 80 feet from the nearest residential property line. From that point, the building gradually pulls back to meet the setback requirements at the southeast corner. • Variances may be granted if four specific criteria are met. The criteria and the ways in which they are met are detailed below: • There is an undue hardship that denies a reasonable use of the property if the regulations of the Code are enforced. o It is reasonable to allow a new and up-to-date City Hall to be constructed on the existing site while minimizing impact to the adjacent Park amenity. It is also reasonable that the new Fire Facility include the pull-through truck bays that encroach into the setback. Not only are these bays considered "best practices" when constructing a fire facility, but with parking allowed in the fire truck drive aisle (due to limited parking elsewhere), it is unsafe to have fire trucks backing .into the bays. There are unusual or unique circumstances that apply to the property which do not apply generally to other properties in the same zone or vicinity. o Construction of a City Hall without variances would involve use of the adjacent Park property. The Park is a community amenity and recreational asset that is unique to this site and ,that deserves protection. The variance will not alter the character of the neighborhood. o The majority of this site has been used as a government facility for over 50 years and is already part of the neighborhood character. The proposed plan minimizes impact to the Park. Further, the reduced setback is along aright-of- way as opposed to being adjacent to another lot line or structure. Finally; the proposed overall on- site parking will increase from what is currently . available. The variance is the minimum necessary to alleviate the undue hardship. o The proposed design accommodates the needs of a shared City Hall Facility and increases the overall available .parking while protecting as much of Heredia Park as possible. c) Creation of a design for structures and site features that promote the following: • An internal sense of order among the buildings and uses; This requirement is met. • The adequacy of vehicular and pedestrian circulation, including walkways, interior drives and parking in terms of location and number of access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking; This requirement is met. • Energy conservation through the design of structures and the use of landscape materials and site grading; This requirement is met. • The minimization of adverse environmental effects on persons using the development and adjacent properties. This requirement is met. B. CRITICAL ISSUES • The proposed plans provide the necessary City Hall space with as little encroachment on the Park as possible. • Final Park plans must be approved by the Recreation Services Director. • A preliminary tree protection plan has been included. Final staff approval is required prior to any clearing. • Final landscaping and lighting plans must be approved by the Community Development Director. • Plans for the replacement telecommunication tower will be evaluated separately. • The requested variance to reduce required parking was of concern to some members of the Planning Commission. • The Planning Commission voted 8-0 to recommend approval of the proposed plan. C. FINANCIAL • It has been administrative policy to waive local permit fees for City applications. D. LEGAL • A public hearing was held before the Planning Commission on September 28, 2009. • Mailed notice was sent to all property owners and residents within 350 feet of the subject properties. E. ENVIRONMENTAL CONSIDERATIONS • The following are environmentally-friendly components of the proposed plan: o Re-use of a previously developed site; o Utilization of native and low-maintenance plants; o Day lighting and light controls; o Energy-efficient building shell; o High-performance lighting and electrical systems; o High-performance mechanical/ventilation. systems; o Environmentally-sensitive building products and materials; o Indoor air quality; o Acoustical, thermal and visual comfort; and o Water conservation/storm water management. RESOLUTION GRANTING APPROVAL OF A SITE PLAN FOR 6700 - 6758 PORTLAND AVENUE WHEREAS, an application has been filed with the City of Richfield which requests approval of site plan for the parcel of land located at 6700 - 6758 Portland Avenue (the "Property"), which is proposed to be platted as: Lot 1, Block 1, RICHFIELD CITY HALL, Hennepin County, Minnesota; and WHEREAS, the proposed site plan includes 157 parking stalls rather than the required 179 parking stalls, and provides a 19.39-foot side setback along the southern property boundary as opposed to the required 30-foot setback; and WHEREAS, Minnesota Statutes Section 462.357, Subdivision 6, provides for the granting of variances to the literal provisions of the zoning regulations in instances where their enforcement would cause undue hardship to the owners of the property under consideration; and. The Property is zoned R single family residential. b. The majority of the Property has been in use as governmental building and associated parking for over 50 years. The proposed use of the Property is for a governmental building and associated parking, which is a permitted use in the R zoning district. c. The Property is owned by the City. The City owns additional land abutting the Property that is used as a public park. The site plan proposes minimal reduction to the public park area. d. The existing parking lot provides parking for 147 vehicles. e. The proposed parking lot will provide structured parking for 29 vehicles and surface parking for 128 vehicles, for a total of 157 parking stalls. This is 22 less spaces than required by Richfield City Code Subsection 544.13 but 10 more spaces than have historically been available on the Property. A variance. from the provisions of Subsection 544.13 is required. f. The proposed development will provide at least 24 bicycle parking spaces for use by employees to commute. The existing development provides seven bicycle parking spaces. g. The proposed site plan shows that the building will encroach 10.61 feet into the required 30-foot sideyard setback from the .south property line, which abuts 68t" Street. In order to comply with the 30-foot sideyard setback the City would have to eliminate pull-through truck bays for the Fire Department. 101309 -City Hall Site Plan ,~o -a. Pull-through truck bays would eliminate the need to back fire trucks into the bays, which presents a traffic safety concern on Portland Avenue. A variance from the provisions of Richfield City Code Subsection 514.13 is required. 2. With respect to the application for variance from the parking requirements and sideyard setback requirements, the City Council makes the following findings: a. Strict enforcement of Richfield Zoning Code Subsections 544.13 and 514.13 would cause an undue hardship. The development of the Property for a city hall is a reasonable use that cannot be reasonably accomplished with strict enforcement of those subsections. It is reasonable and a matter of safety that the new Fire Facility should include the pull-through truck bays and will encroach into the sideyard setback. The proposed parking increases by 10 the number of available stalls. b. Unique circumstances affect the Property that were not created by the land owner. Construction of a city hall that would adequately meet the current physical needs of the City, without variances, would involve use of adjacent park property. The adjoining public park is a community amenity and significant recreational asset that is unique to this site and that deserves protection. c. Granting the requested variances will not alter the essential character of the neighborhood. The majority of the Property has been in use as a government building for over 50 years and is part of the neighborhood character. The proposed plan minimizes impact to the adjacent Heredia Park, and the reduced setback is adjacent to a street as opposed to another property or structure. d. The variances requested are the minimum necessary to alleviate the undue hardship. The proposed plans protect Heredia Park while providing the minimum requirements necessary for the City Hall/Police/Fire Facility. 3. With respect to the proposed site plan, the City Council makes the following findings: a. The proposed site plan is consistent with the elements and objectives of the .City's development guides, including the Comprehensive Plan and any redevelopment plans established for the area. b. Development of the site as a city hall is consistent with the purposes of the Code, which allows government buildings in residential areas, and the plan attempts to minimize impacts on adjacent park and residential uses. c. The plan attempts to preserve the adjacent park property in its natural state. Most of the Property has been fully developed for decades. Except for the entrance to underground police parking, there will not be significant changes in grade from the existing. The underground police parking entrance will be landscaped to minimize impact from the adjacent park and residences. d. The plan creates a harmonious relationship of buildings and open spaces with the terrain. The plaza serves as a transitional public space between the Park and the City Hall building. e. The proposed site plan promotes an internal sense of order among buildings and uses, provides adequate vehicular and pedestrian circulation, promotes energy conservation, and minimizes any adverse environmental effects. f. The proposed design, impervious surface limitations and a storm water management plan will protect adjacent properties from runoff. The emergency generator will be screened from view and to lessen any noise. o ~~ The building has been designed architecturally with many smaller walls so as to seem more in scale with the surrounding residential homes. g. The proposed plan conserves energy through the re-use of a previously developed site; use of low-maintenance, native plants; day lighting; energy- efficient building materials; high-performance lighting, mechanical and electrical building systems and .more. 4. Based upon the above findings, a variance is hereby approved to reduce the requirement for off-street parking spaces from 179 to 157. 5. Based upon the above findings, a variance is hereby approved to reduce the sideyard setback from the south property line from 30 feet to 19.39 feet. 6. Based upon the above findings and variances, the proposed site plan is hereby approved according to the terms of Richfield City Code Subsection 547.13, Subdivision 9, with the following additional stipulations: a) That final landscaping, tree protection, lighting, and screening plans be approved by the Community Development Director prior to the issuance of any permits; b) That final grading, erosion control, storm water management, utility, ingress/egress and boulevard plans be approved by the Public Works Director prior to the issuance of any permits; and c) That final Heredia Park plans be approved by the Recreation Services Director prior to the issuance of any permits. II. BACKGROUND _ During June of 2008 a severe storm came through Richfield that included damaging winds and hail. The City of Richfield's insurance representative, Allied Adjusters, determined that the roof was damaged from the hail which set in motion a claim to replace it. The notice of bids for the roof replacement was published in the Richfield Sun- Current on September 17, 2009 and a formal bid opening was held on September 28, 2009. Each bidder was instructed to itemize separate pricing for the following: • Install 35-year fiberglass asphalt shingles on Rink 1 roof. • Install 35-year asphalt shingles on the existing Rink 1 cupola. • Install metal fascia on the existing cupola. 1013 Arena Roof Bid • Install insulation over the existing decking so completed roof assembly reaches an insulated "R" rating of R23. The City Building Inspector reviewed the project and determined that because there was already a small amount of insulation installed on the decking of the original roof, code requires that new insulation be installed so the completed roof assembly achieves a R23 value. The Insurance Representative approved to cover the claim for "like for like replacement" of the roof which includes shingles only, in the amount of $98,230. The insurance claim will not cover the cost of installing the additional insulation. III. BASIS OF RECOMMENDATION A. POLICY • City expenditures exceeding $100,000 require advertising of sealed bids through public notice and three bids were received. B. CRITICAL ISSUES • Approval at the October 13, 2009 Council Meeting will facilitate completed roof replacement before the winter settles in. • The Insurance Representative approved to cover the claim for "like for like replacement" of the roof which included shingles only. The . insurance claim will not cover the cost of installing added insulation to achieve an R23 of completed roof assembly. The building official has determined that code requires the installation of added insulation to achieve an R23 rating of completed roof assembly. 1013 Arena Roof Bid C. FINANCIAL • Funding for this project will come from the insurance settlement in the amount of $98,230 which covers the cost of shingles only. Funding for the added insulation will be funded out of the accumulated fund balance of the recreation budget in the amount of $47,605.. • The return on investment for added insulation in energy savings is six years at an estimated annual energy savings of $8,000 per year by Excel Energy. . D. LEGAL • The bid opening held on September 28, 2009, was in accordance with legal requirements. ` E. ENVIRONMENTAL CONSIDERATIONS • None IV. ALTERNATIVE RECOMMENDATION~S~ • Accept the complete bid and authorize QT Commercial Roofing to install metal fascia and on the cupola in addition to installing shingles and insulation on the remaining area of the Rink 1 roof for an added cost of $14,325.00. II. BACKGROUND . In order to allow for the current City Hall building to remain operational during the construction of the new Police/Fire/City Hall facility, critical site preparation work must be done yet this fall. This initial site preparation work includes: 1) Earthwork, concrete barrier placement and paving for two temporary parking lots -one east of the building along Portland Avenue and the second lot in the location of the tennis courts in Heredia Park; 2) Electrical work to light the temporary parking lots and to provide electrical service to the construction staging area; 3) Relocation of the City Hall monument sign and the flagpole; and 4) Demolition of the two homes south of the current parking lot. The City's construction management firm, Stahl Construction, solicited quotes for the preliminary work outlined above. Quotes were received by Stahl Construction on October 7, 2009 and reviewed by Dale Sonnichsen, Project Manager. Mr. Sonnichsen is familiar with each of the proposed contractors and their quality of work. The proposals being recommended by Mr. Sonnichsen for each item of site work are attached. None of the proposals being recommended exceeds $30,000. The total amount for all the site prep work being awarded at the October 13, 2009 meeting is $105,191. Once the City Council approves the final project plans and specifications at the November 8, 2009 regular meeting, the main building construction work will be bid out in one base bid package with a proposed bid opening date of December 8, 2009. III. BASIS OF RECOMMENDATION A. POLICY • Quotes for each element of site preparation work (with the exception of the concrete barrier work and sign relocation service) were requested from at least three qualified contractors with a submittal date of October 7, 2009. • All of the recommended contractors are the lowest responsible bidders and are established contractors that meet all of the City's requirements. • Under the City's Purchasing and Spending Authority policy, contracts estimated to have a value between $25,000 and $100,000 may be made by direct negotiation based on multiple quotations. For each of the contracts proposed, none is valued at more than $29,800. • Although quotes were requested from all three earthwork contractors for the house demolition work, only one contractor (Imperial Developers) ultimately submitted a quote with a value of $29,800. This amount is well within the budgeted amount for demolition and the construction manager is recommending we proceed with this work. This amount also includes an asbestos abatement survey and a $10,000 allowance for any necessary abatement work. • The nature of the concrete safety barrier work and sign relocation service is somewhat unique or specialized, and a quote was requested from only one provider that was familiar to the construction manager for each of these services. The amount of each of these contract awards is significantly under $5,000. B. CRITICAL ISSUES • Approval of the contracts at the October 13,'2009 meeting will allow site preparation work to begin the week of October 19, 2009 and possibly as early as October 16, 2009. • It is critical that paving work for the two temporary parking lots be done as soon as possible because the black top plants typically close the end of October for the season. • Until the site prep work is accomplished, building construction cannot begin. C. FINANCIAL • The project budget had an estimated amount of $115,000 allocated for site preparation work. The total amount of contracts recommended to be awarded at the October 13, 2009 meeting is well within that budget. D. LEGAL • All contracts or purchases in excess of $25,000 require Council approval. E. ENVIRONMENTAL CONSIDERATIONS • Stahl Construction has developed a tree protection plan and soil erosion plan for the site. IV.
