RESOLUTION APPROVING REVISED RICHFIELD PARKWAY INFRASTRUCTURE
CONSTRUCTION AGREEMENT AND MAINTENANCE PARCEL AGREEMENT
BETWEEN THE CITY OF RICHFIELD AND CHAMBERLAIN APARTMENTS, LLC
WHEREAS, in coordination with the construction of the Chamberlain Apartment
project, the first two blocks of the extension of Richfield Parkway (from 66th Street to
68th Street) will be constructed by Chamberlain Apartments, LLC (Developer); and
WHEREAS, City and Developer are entering into an Infrastructure Agreement
with Developer for construction of the roadway, as well as a Maintenance Agreement
pertaining to Developer's obligation to maintain the parcel along Richfield Parkway north
of the Plaza 66 driveway (collectively "Agreements"); and
WHEREAS, the Council initially approved the Agreements at its meeting on April
24, 2018; and
WHEREAS, the Housing and Urban Development agency required certain
amendments to the Agreements due to its participation in funding of the project; and
WHEREAS, the City Attorney, Developer's attorneys, and City staff have
reviewed and approved of the revised Agreements; and
WHEREAS, Council approval of the revised Agreements is now necessary.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield,
Minnesota as follows:
1. The revised Richfield Parkway Infrastructure Construction Agreement and
Maintenance Parcel Agreement are approved and supersede the prior
approvals on April 24, 2018.
2. The Mayor and City Manager are authorized to execute and deliver to the
Developer any and all documents necessary to carry out the intentions of this
resolution and the agreements.
Adopted by the City Council of the City of Richfield, Minnesota this 26th day of June,
2018.
