01-22-79 agendaIf u v a I r r Bill 1979 -1 AMENDMENT TO CHAPTER II, PART III, SECTION 2.34 OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD CITY OF RICHFIELD DOES ORDAIN: Chapter II, Part III, Section 2.34 of the Ordinance Code of the City of Richfield dealing with attendance and leaves is hereby amended by amending Subdivision 2, paragraphs (1) and (8) thereof to read as follows: "Subd. 2. Holidays, The following paid holidays will be observed by the City: New Year's Day on January 1st; Washington's and Lincoln's'Birthdays on the third - Monday in February; Memorial Day on the last Monday.in May; independence Day on July 4th; Labor Day on 'the first Monday in September; CO�uinTua Day on the second Monday in Octo er; Veteran's Day on November 11; Thanksgiving Day on the fourth Thursday of November; [and] Christmas Day and one floatmoat g 5 idI- ay. -� (1) Eliai.bility for Paid Hnl.,dav -,. All permanent em- ployees and rull time probationary employees, except police and fire personnel who are shift employees shall be eligible for the paid holidays listed above. Employees must be on pay status the work day immediately preceding and the work day immediately following a holiday to be eligible for such holiday. (8) Administration of Holiday Leave and Floating Holidays. In the case of shift employees, floating holidays and holiday leave taken at a time other than a holiday must be approved by the department head and shall be charged as used in amounts of not less than four hours." City herewith engages contractor to perform services, and contractor agrees to provide services to the city, consisting of the following: -2 - '• a A. Counseling and referral services to juvenile residents of the cit wh are referred to contractor by members of the city police j Y depart ent, representatives of the school district, the, Hennepin County Municipal Court, the Hennepin County District Court, social welfare agencies of Hennepin County, and parents, custodians, guardians or other persons having responsibility for such youthful residents of the city. A goal of contractor for the time in which this agreement is in effect shall be to work with 150 cases from city of which 80 % will be youth d verted from the criminal justice system as defined in goal 'A" of the YDP FY 76 grant application to the Governor's,Commission -on Crime Prevention and Control. B. In cases where persons referred to contractor have problems which cannot e fully or adequately dealt with through services by contractor, appropr ate referrals will be made by contractor to other persons or organiz tions . C. Primary emphasis in counseling will be on an individual diagnosis of the person.referred to determine his or her basic needs, but such diagnosis shall not include psychological or vocational testing. D. In appropriate cases such counseling shall include, as.an adjunct to the counseling of a juvenile, diagnostic counseling of other family embers or other persons in the household where he or she resides, 1� E. A follow -up on referrals will.be made by contractor, on all referrals from police, court services, and juvenile court, in order to determine the extent to which an individual client's problem or problems have been resolved through the efforts of the contractor or through the efforts of others to whom the contractor has referred the client. F. Contractor will consult with law enforcement officers of the city, officials of the school district and other appropriate persons to keep them advised of the nature of the services being provided under this agreement and to work out procedures which will facilitate the providing of contractor's services G. Contractor shall use its best efforts to coordinate the programs of various youth service organizations and agencies wi t hin and outside of the city which provide services to youthful residents of the city, with- • the object of improving upon the coordination and performance of such organizations and agencies in meeting the total needs of the client youth involved. H. Contractor shall hold itself available for consultation with juvenile authorities of the city so that such authorities are kept advised of the status of those situations which fall within their areas of responsi- bility. i 1. Contractor will undertake to identify any new or different kinds of services which should be made available to youthful residents of the city in order to meet their unmet needs in. personal development and -4- social adjustment. t ., j, Contractor will provide the equivalent of at least one full time youth worker to serve residents of the city referred for services. City will receive all services provided by The Storefront/ Youth Action, Inc. central staff, including the monitoring of agency budget, the maintenance of fiscal records, and program monitoring. and eva uation City will also receive support of the board of -directors of The Storefront /Youth Action, Inc. L. M. Residents of city will be eligible to participate in all programs offered y contractor. These currently include a chemical dependency orientat on program for families groups focusing on drug use for adolesc nts, a concerned persons group for parents concerned about drug Use of a child, and self- awareness groups for young women. 2. To assure proper coordination between the city and contractor, under this agreement, the contractor agrees to take the following measures: A. t will, at all times while this contract is in effect, keep a B. It will permit a member of the city's governing body, to be designated by the city, to attend, as an observer, all meetings of the board of. directors of contractor, and to participate in the discussions - and deliberations of such board, without the right to vote.' C. It will send copies of minutes of all meetings of its board of directors to those persons designated by the city, promptly after each board of directors meeting. D. It will send to all members of the city council a quarterly -t£y,; • statistical report summarizing the nature of the activities of contractor in providing the services described in this agreement. E. It will provide services to all persons without regard to race, color, creed, religion, national origin, sex, marital status, status with !i regard to public assistance or disability. F. It will defend, indemnify and hold harmless the City of Richfield, its employees and agents, from any and all claims, causes'; of action, lawsuits, damages, losses or expenses on account of bodily injury, sickness, disease, death or property.damage as a result, directly or indirectly, of any actions or omissions on the part of the contractor's personnel in connection with the provision of services in accordance with the terms of this contract. G. It will perform the counseling and referral services in a competent, professional manner and in compliance with all applicable laws,` ordinances, rules, regulations and policies which are now in effect or which may hereafter be adopted. 3. For the performance of the services described in Section No. 1 above, the city agrees to pay and the contractor agrees to accept payments on the following basis: A. The amount of direct city funds which the city shall be obligated to pay f or such services shall be the sum of $2 2, 000, which will be paid in 2 equal payments upon receipt of a monthly statement from contra ctor. . 4. This agreement will be terminated on the expiration date specified above. Thereafter the agreement may be renewed annually. Proposal 3, plans and specifications shall be available for the in- spection of prospective bidders at the office of the Department of Trans- portation, St. Paul, Minnesota 55155, and at the office of said City Clerk and the advertisement shall so state. The bids received in response to said advertisements for bids shall be opened for and on behalf of the Com- missioner by a istrict Director of the Department of Transportation or such other engi eer of the Department of Transportation as may be from time to time selecte by the Commissioner. After said bids shall have been opened, the City Council, shall first consider the same and thereupon transmit to the Commissioner al bids received together with its recommendation that the lowest bid sub itted by a .responsible bidder be accepted or that all S bids be rejected. Upon receipt of all said bids, the Commissioner shall duly cause all of said bids to be tabulated`in accordance with law and shall thereupon determine who is the lowest responsible bidder or shall reject all bids. (b) The Commissioner shall supervise and have charge of the construction of said projects after the same has been let. The City agrees to furnish its City Engineer or such other registered engineer and assign him to the active supervision and direction of the work to be performed under any contract let for the aforesaid projects, Said engineer so assigned shall LL act under the supervision and direction of the Commissioner. The City further agrees to furnish such other men, services, supplies and equipment as shall be necessary in order to properly supervise and carry on said work. (c) The Commissioner may make such changes in the plans or the 'character of the work as shall be recommended by the engineer in charge of the work. If he concurs in such recommendations, the Commissioner may enter into for and on behalf of the City supplemental agreements with the contractor for the performance of any extra work or work occasioned by any necessary, advantageous, or desirable change in plans or construction. It is understood by the City that the Commissioner cannot personally investigate and pass judgment on the various items of extra work and plan changes necessary and desirable during the construction of the projects but that he must delegate such duties to engineers under his supervision and control that are employed by the Department of Transportation. Page No. 4 7 0 or the city, t om time to time, auri.ng the progress of the work on said projects, to request the Commissioner to furnish for use on said projects specific engineering se vices to be performed by skilled employees of the Department of Transportation The Commissioner may but is not obligated to furnish the services so re uested. If the Commissioner in compliance with such request shall furnish for the use of the City on said projects the services of any Minnesota Dep rtment of Transportation employee, then and in that event, the t City agrees to reimburse the Trunk Highway Fund for the full cost and expense SF's of the furnishing of such services including all costs and expenses of any kind or nature whatsoever arising out of, connected with, or incidental to the furnishing of uch services. (e) The Commissioner shall receive the funds to be paid by the City and the funds to be paid by the United States as federal aid funds, for said projects and to pay therefrom when due any and all sums that may become due the contractor to whom the contract is awarded, and upon final completion and acceptance of the work, to pay from said funds the final estimate to said contractor for said work. (f) The Commissioner shall perform on behalf of the City all other acts and things necessary to cause said projects to be completed in a satisfactory manner. Page No. 4 7 0 (g) The Commissioner may enter into any agreement for and on behalf of the City with the United States or any officer or,agent thereof that may be required or necessary for the purpose of procuring and actually causing to be paid the federal aid funds available for said projects and to that end to bind and commit the City in such agreement to the performance of any and all things required by any law of the United States or of any rule and regulation issued by federal authority pertaining thereto necessary for the purpose of procuring and having paid the.federal aid available for said projects. (h) The Commissioner may perform on behalf of the City any other and further acts as may be necessary or required under any law of the United States or of any rule or regulation issued by proper federal authority in order to cause said projects to be completed and to obtain and receive the federal aid made available therefor. - 2 - The City agrees that it will from time to time, after the execution of this agreement, make such reports, keep such records and perform such work in such manner and time as the Commissioner shall from time to time request and direct so as to enable the Commissioner as its agent to collect for it the federal aid sought. Said records and reports shall be retained by the City in accordance with the Commissioner's record retentionischedule for federal aid projects. - 3 - It is anticipated that the Federal Government will pay toi the Commissioner as the agent of the City the federal aid funds available to said City toward the construction of said projects. Page No. 5 It is Page No. 6 further antici ated that the contracts to be let by the Commissioner as the ,y, agent of the City for the construction of said projects shall provide that the contractor, as the work progresses, shall, from time to time, be paid partial payments designated in said.contract as partial estimates and on the completion and acceptance of said work to be paidya final payment designated in 3aid contract as a final estimate for all work performed: The ity further agrees that any City funds and /or Municipal State Aid funds to be applied to any contract covered by this agreement shall be deposited with the Commissioner in accordance with 14 MCAR Section 1.5032. At regular monthly intervals after the contractors shall have started work u der the contracts let,by the Commissioner as agent for the City for the construction of said projects, the engineer assigned to and in charge 1 yh� of said work s all prepare a partial estimate in accordance with the terms of said contracts let for said projects and the procedures established by the Office of Construction, Department of Transportation. The said engineer in charge of Said work shall immediately after preparing each partial estimate, transmit the s me to the Commissioner in quintuplicate. Each such partial estimate, shal be certified by the engineer in charge and by the contractor performing such work. The said engineer assigned to and in charge of said work shall also prepare and submit to the Commissioner the final estimate data, together with the required project records in accordance with the terms of said contracts let for said projects. Quantities listed on said partial and final estimates shall be documented in accordance with the guidelines set forth in the applicable documentation manual.
