NOW, THEREFORE, BE IT RESOLVED by the City Council of the City • of Richfield as follows: 1. There is hereby established a Citizens Advisory Committee on Cable Communications. 2. The committee shall serve in an advisory capacity to the city council. 3. The committee shall be comprised of seven to nine voting members representing a cross- section of the community, male and female, although no persons commercially involved in cable communications',activ ities or other communication media shall serve as members of the advisory body. 4. Non- voting and ex- officio members representing the city council and city staff shall also participate with and on this committee in accomplishing the assigned tasks. 5. Regular voting members shall be appointed in April, 1979, with service to begin immediately. Termina- tion of service shall occur at such time as the committee forwards a recommendation to the city council regarding the means of satisfying theicommuni- cation needs of Richfield residents. 6. The purpose of this committee shall be to review and make recommendations to the Richfield City Council regarding the provision of cable television services within Richfield This task may include, but not be limited to, the following activities: a) Review published information, including state and federal statutes, and rules and regulations, regarding cable communications b) Survey other area municipalities to determine what they are doing, or what their experience has been, with regard to cable communications; c) Assess the communication needs of Richfield residents, and make publicly available the procedures and results of such assessments; d) Make recommendations to the city council re- garding cable communication needs and desirability for Richfield. 7. Any of the following shall cause the position of a regular member to become vacated: a) Death b) Disability or failure to serve, shown by failure to attend three consecutive meetings • of the committee without prior notice or per- mission of the committee to be excused; c) Removal of legal residence from the city; d) Resignation in writing; e) Removal by the city council; f) Election or appointment to a public office. RESOLUTION AMENDING RESOLUTION NO. 4735, POLICY FOR STORM SEWER ASSESSMENTS ON 1979 STORM SEWER CONSTRUCTION CITY PROJECT NO. 738 WHEREAS, Resolution No. 4735 established a policy for assessing storm sewers .constructed after 1973, and WHEREAS, this policy stipulates that the total cost of construction will be specially assessed to benefited properties, and WHEREAS, the City has been experiencing certain drainage inadequacies _ during exceptional rain storms and it appears desirable to make improvements to the existing storm drainage system to alleviate certain problems that occur during these exceptional periods, and WHEREAS, it appears desirable to change the existing storm sewer assessment policy to more accurately charge the special benefit received by the benefited • properties with the cost of providing the improvement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, that the City adopt the following policy for assessing 1979 storm sewer improve- ments, City Project No. 738: 1. That the total cost of a storm sewer improvement include material, manpower, equipment, financing and administrative overhead required for the special assessment procedure and performance of this work. 2. That it is hereby determined that 70% of the preliminary estimated. cost of the project, $967,000, is the direct benefit to be specially assessed against the benefited properties , $751,0003 based on a square footage rate ( 2.8G ). I 3. That the actual rate of assessment will be based on actual total cost according to the policy established in Section 2 above when'the project is completed and actual costs are known. 4. That the assessment be spread over a 20 year period at 8% interest with the privilege of prepaying the storm sewer at any time without additional interest. 5. That the policies contained in this resolution shall be subject to modification if necessary in individual cases if the council determines that the assessment or assessments resulting from the application of the policies will exceed the benefits received. Moran City Clerk 9 RESOLUTION NO. 4735 RESOLUTION ON POLICY FOR STORM SEWER - ASSESSMENTS WHEREAS`, the, city has been constructing storm sewers throughout the city according to a master plan prepared in 1953 and WHEREAS`, the city council has had -a policy of assessing this storm sewer construction at a maximum assessment of $.0355 per square foot, and WHEREAS, the construction of these storm sewers throughout the city has been sub- stantially completed, and WHEREAS, the cost of constructing these storm sewers has increased considerably over the years, and WHEREAS, it appears desirable to change the existing storm sewer assessments policies to more accurately charge the benefited properties with the cost of providing the improvement. NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Richfield that the City adopt the following general policies for storm sewer assessments: 1. That all remaining storm sewers constructed in 1974 and future years, should there be any, be assessed at its full cost of construction. 2. That the assessment be spread over a 20 year period at 8% interest with the privilege of prepaying the storm sewer assessment at any time without additional interest. 3. That the above policies begin with the storm sewer hearings held in 1973. 4. The public works director, pub 1ic.£safety director, and environmental health director also represented tYe city at this bid opening. The minutes and bid tabulations are attached for city council review. The 16arbon. dioxide unit would replace, the current need to dioxide' burn natural gas under water, by injecting the carbon directly into the treated water. This will lower our ependence on natural.- gas:while also minimizing repairs'to the po t- softening equipment in the water treatment process'. Two bids were received for this carbon dioxide un't, from Lee Richert Plumbing and Heating, Inc. and Shank Mecha ical, Inc. The low .bid was ;submitted by Shank Mechanical, Inc.., Minneapolis, in the amount of $96,90.0. .'Both bids significantly exc eded the engineer's original estimate of cost and the - budgeted mount of $60,.000. The public works director and water superintenden have re- vewed these bids with the city's consulting engineers. The existing building has a floor area of 2,030 square feet which would mean that 203 daily trips are generated by the existing use.. Proposed Use: The proposed use will not generate a signi- ficant amount of additional traffic. The seating area will primarily serve existing customers. ; Impact: The building fronts on "a major street (66th Street) which has sufficient capacity to handle any increase in traffic due to the proposed use. Revenue Recreational Facilities Bonds of 1979, as advertised for sale. The City Clerk - Treasurer presented', affidavits showing publication of notice of sale in the official newspaper and in Commercial West, a financial paper published in Minneapolis, Minnesota, which affidavits were examined and found satisfactory and ordered placed on file. The City Clerk - Treasurer presented the tabulation of bids which had been received prior to the time specified in the notice of i sale, which had been opened and tabulated in the office of the City Manager with the assistance of T.G. Evensen & Associates; Inc., • financial advisors to the City. No. RESOLUTION AWARDING THE SALE OF $1,,300,000 GROSS REVENUE RECREATIONAL FACILITIES BONDS OF 1979 BE IT RESOLVED By the City Council of the City of Richfield, Minnesota, as follows 1.. The bid of to purchase $1,300,000 Gross Revenue Recreational Facilities Bonds of 1979 of the City described in the notice of sale thereof is hereby found and determined to be the highest and best bid received pursuant to duly advertised notice of sale and shall be and is hereby accepted, such bid being to purchase such bonds at a price of $ plus accrued interest to date of delivery, such bonds to bear interest as follows: The sum of $ , being the amount bid in excess of $1,275,000 shall be credited to the Capital Expenditure Account in ',the Golf Course Fund of the City created by Section 2 of Resolution No., authorizing the Bonds. At that. ..time, the council was informed that the existing - vehicles would `be disposed of through Hennepin County auction after the replace- F ment,vehi.cles were received. The new automobiles will be arriving soon, and;. itAs, therefore, recommended that the°city council authorize the sale of the eight existing vehicles through Hennepin „ Couii_ty auction. All of these vehicles are fully depreciated. Council.authorization is also 'requested to dispose ofthei. following four additional pieces of equipment: one 1974 Plymouth..
