RESOLUTION NO. 5881
RESOLUTION ESTABLISHING A CITIZENS
ENERGY AWARENESS COMMITTEE
WHEREAS, the City Council is of the opinion that all citizens should take
an active role in promoting and encouraging the wisest and most efficient
use of our natural energy resources; and
WHEREAS, the State Energy Agency has established a program entitled
the Minnesota Energy Agency Outreach Program for the purpose of conserving
and preserving these energy resources; and
WHEREAS, the establishment of an Energy Awareness Committee to act
as a forum for public and private employed individuals concerned with
promoting, preserving, and fostering the efficient use of these resources
is an integral component of this program; and
WHEREAS, the City Council wishes to cooperate with the intent and
purpose of this program;
BE IT RESOLVED, THEREFORE, by this City Council of the City of
Richfield, Minnesota, as follows;
A. There shall hereby be created a Citizens Energy Awareness
Committee for the City of Richfield, Minnesota.
B. The Committee shall serve in an advisory capacity to the
city council.
C. The Committee shall be comprised of no more than fifteen
members who shall reside or own property in the City.
Members will be selected, appointed and removed with
or without cause by majority vote of the City Council
members.
D.. In selecting candidates for appointment to the Committee;,
the City Council shall give due consideration to individuals
employed in capacities listed below or as spokespersons
for the following industries, institutions, or professions;
1 . Finance, banking, or lending institutions;
2. Heavy industry, manufacturing, or commerce enterprise;
3. Residential homemaking, home economics, or household
services;

4. Agriculture, farming, or land conservation;
5. Scientists, physists , engineers, architects, or
computer systems,
6. Building code administrators, construction contractors,
builders, or land developers;
7. Educators, primary or secondary teachers, professors or
college instructors;
8. Promotion, advertising, communications, broadcasting,
or public relations executives;
9. Labor officials, building trade or manufacturing union
repres entatives;
10. Environmentalists, special interests representatives,
conservationists, or naturalists;
11. Low and moderate income representatives or senior citizens;
12. Energy supplier, utility official or petroleum product distributor;
13. City staff member or energy coordinator;
14. Transportation representative; bus, air, or railroad official,
land planner, regional transportation coordinator;
15. City council member and /or Mayor.
E. Members from the above categories shall be appointed to serve
staggered terms of one, two, or three years or as determined by
city council.
F. Committee members shall be called to order by the city council
member and /or Mayor for their initial meeting. Subsequent meetings
shall be scheduled and conducted by the chairman, who shall be
elected from the members of the committee. All actions shall be in
resolution form and must receive majority vote approval of the members
present.
G. The purpose of the Committee is to advise the city council on all matters
relating to conserving and preserving natural energy resources. Specific
goals would include:

1. To assist in helping the public become more aware of
the reasons and needs to extend and optimize energy.
2. To aid in the establishment of a comprehensive' citywide
energy reduction program
3. To promote, stimulate, and motivate energy conservation
efforts .
4. To act as liason between the State Energy Agency and the
city council.
5. . To help inform and educate the public on energy issues.
6. To collect information on energy consumption levels, to
quantify energy conservation efforts, and to appraise
energy reduction results
7. To carry out other energy conservation studies on efforts
requested by the city council.
H. Staff support, materials, and facilities shall be provided by the
city at the direction of the city manager. Requests for reports,
statistics, studies, etc., requiring excessive or lengthy amounts
of time and effort by staff personnel shall be made in writing to
the city manager.
I. Any of the following shall cause the office of a regular member to
become vacated:
1. Death.
2. Disability or failure to serve, shown by failure to attend
three consecutive regular meetings of the commission.
3. Removal of legal residence or property ownership from the
city.
4. Resignation in writing.
5. Removal by the council.
6. Election or appointment to a public office.

Heyman Addition Improvements
Pursuant to requirements of Resolution No. 1015, a meeting of the Administrative
Staff was called by Thomas J. Moran, City Clerk, who announced that the purpose
of the meeting was to receive, open and read aloud, sealed bids for City Project
No. 742, Heyman Addition Improvements, as advertised in the official newspaper
on April 11, 18, and 25, 1979.

Building, 6700 Portland Avenue South, on Monday,
May 21, 1979, at 7 p.m.

The purpose of this meeting will be to discuss
the merits and associated benefits of improving
the Richfield city drainage system in your
neighborhood. The city council has directed the
staff to prepare preliminary engineering drawings
which could lead to the eventual improvement of
Norby and Wilson Ponds. These ponds are.currently '
used to accumulate and retain storm water that flows
from your property into the street and the storm
sewer system. It is our belief that deepening

would improve drainage in your area as well',as
improving the general appearance of both pon ding

RESOLUTION NO. 4735
RESOLUTION ON POLICY FOR STORM SEWER ASSESSMENTS
WHEREAS, the city has been constructing storm sewers throughout the city according
to a master plan prepared in 1953, and
WHEREAS, the city council has had a policy of assessing this storm sewer construction
at a maximum assessment of $ .0355 per square foot, and
WHEREAS, the construction of these storm sewers throughout the city has been sub-
stantially completed, and
WHEREAS, the cost of constructing these storm sewers has increased considerably
over the years, and
WHEREAS, it appears desirable to change the existing storm sewer assessments
policies to more accurately charge the benefited properties with the cost of providing
the improvement.
NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Richfield that
the City adopt the following general policies for storm sewer assessments:
1. That all remaining storm sewers constructed in 1974 and future years,
should there be any, be assessed at its full cost of construction.
2. That the assessment be spread over a 20 year period at 8% interest
with the privilege of prepaying the storm sewer assessment at any
time without additional interest.
3. That the above policies begin with the storm sewer hearings held, in 1973.
4. That the policies contained in this resolution shall be subject t&
modification if necessary in individual cases if the council determines
that the assessment or assessments resulting from the application of
the policies will exceed the benefits received.

RESOLUTION ORDERING IMPROVEMENT AND PREPARATION OF PLANS
AND SPECIFICATIONS-FOR DRAINAGE AND RELATED IMPROVEMENTS
TO PONDING AREA NO. 5 (NORBY'S POND), PONDING AREA NO. 10,
(WILS'ON'S POND), AND TO VARIOUS LOCATIONS IN THE PUBLIC
RIGHT -OF -WAY
CITY PROJECT NO. 738
WHEREAS, a resolution of the city council, adopted on the 9th
day of April, 1979, fixed a date for a hearing on the
proposed improvement of ponding area No. 5 (Norby's Pond),
ponding area No. 10 (Wilson's Pond) and to various locations
in.the public right -of -way where improvements are of
benefit to storm drainage, and
WHEREAS, all property owners whose property is liable to
be assessed for the making of these improvements were given
proper legal notice through weekly publication in the designated
legal newspaper for the city, and mailed notice required by
law, and
WHEREAS, the hearing was held thereon on the 25th day of
September, 1976.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Richfield, Minnesota:
1. That such improvement is hereby ordered as proposed
in Council Resolution No. adopted on the 9th day
of April, 1979.
2. That Orr- Schelen- Mayeron & Associates, Inc. are hereby
designated as the Engineers for this improvement.' They
shall prepare plans and specifications for -the making of
such improvement.

assessment for seventy percent of the actual cost of said

RESOLUTION ESTABLISHING JUST COMPENSATION
FOR THE PURCHASE OF TEtIPORARY EASEMENTS,
LYNDALE AVENUE
WHEREAS, the Richfield City Council (City) desires to make certain
improvements-to Lyndale Avenue in the area of the LHN Redevelopment Project;
and,
WHEREAS, these improvements will provide for increased pedestrian and
motor vehicular safety as well as enchancement of the visual image of the areas;
"and,
WHEREAS, the improvements will provide expanded roadway areas to accomo-
date medians and turning lanes and for the installation of landscape elements
such as sidewalks, plant materials and street furniture; and,
WHEREAS, to install these improvements it is necessary to obtain temporary
construction easements from private property owners; and,
WHEREAS, the City has caused appraisals of the affected property to be
made, has carefully considered such appraisals, and believes the work of such
appraisers was performed in a competent manner and in accordance with applicable
law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHFIELD:
1. That it is necessary to acquire temporary construction easements begin -
ning June 1, 1980, and expiring November 1, 1980, over, under, across and through
the following described areas with Just Compensation set as indicated.

Earlier this year, the city council authorized the staff to
advertise for bids to seal coat the portion of 12th Avenue be-
tween 73rd Street and`78th Street.

Pursuant to requirements of Resolution No. 1015, a meeting of the Administrative
Staff was called by Joyce L. Wilde, Acting City Manager, who announced that the
purpose of the meeting was to receive, open and read aloud, sealed bids for 12th
Avenue Seal Coat, 73rd to 78th Street, as advertised in the official newspaper
on May 16 and 23, 1979.

At your request, and on behalf of Summit State Bank of Richfield, we hereby
undertake to.provide to you the following:
1. Letter of credit in the amount of 10% of total project costs of
the Summit State Bank of Richfield improvements as shown in the
• final development plans submitted to you by Summit State Bank of
Richfield. The letter of credit will secure performance of completion
of the improvements.
2. Temporary driveway easement for egress in a northerly direction in favor
of the public along the easterly line of Summit State Bank property
between new 65th Street and the portion of old 65th Street which has
not been vacated to date. The easement will terminate upon vacation of
that now- unvacated portion of 65th Street.
3. A 10 -foot wide utility easement along the easterly line of the property
lying between the two previously discussed portions of 65th Street, provided
that the easement shall permit Summit State Bank of Richfield to install
pneumatic tubes and related items to service drive -in banking facilities.
Based on this undertaking, Summit State Bank of Richfield requests approval of
final development plans and conditional'use permit.

RESOLUTION RELATING TO RELEASE OF BOND ON OFF -
STREET PARKING
Dayton Development Company
4005 West 65th Street
Location: 2904 to 3020 W. 66th Street
Use: Shopping Center (Southdale Square)
WHEREAS, the Dayton Development Company, 4005 West 65th Street,
Minneapolis, Minnesota, had an Off - Street Parking Agreement with the City
r of Richfield relating to 2904 to 3020 West 66th Street (Southdale
Square), which contract bears the designation of Contract No. 504,. and
which contract was guaranteed by a bond of the St. Paul Fire and
Marine Insurance Company of St. Paul, Minnesota, in the'sum of
Three Thousand ($3,000) Dollars, and
WHEREAS, said Dayton Development Company has substantially complied
with the provisions of said agreement and the St. Paul Fire and Marine
Insurance Company now seeks to be relieved of any further obligation
under said bond, and
WHEREAS, there appears to be no justification for requiring said
Dayton Development Company to continue to provide a bond for security
on the performance of said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

Richfield, Minnesota, as follows:
That the City Manager is hereby authorized and directed to release
the St. Paul Fire and Marine Insurance Company for any and all acts of
Dayton Development Company, committed or incurred in violation of said
Contract No. 504, on and after the 25th day of June, 1979.

Minnesota State Statute 69.011;, subdivision 4 (a) requires
that a community have 'a designated fire chief and assistant
fire
chief to qualify for reimbursement of certain fire insurance`"
prem-
iums..-This premium reimbursement program provides funding
for part

of the,,' local f -ire pension program cost and is a_sub
tantial asset
to Richfeld.in meeting our fire pension program obli
ations. It
is the opinion of the city attorney that adoption of
the proposed

AN ORDINANCE RELATING TO THE
FIRE DIVISION OF THE PUBLIC
SAFETY DEPARTMENT, AMENDING
SECTION 2.19, SUBDIVISION 3,
OF THE CITY OF RICHFIELD.
CITY OF RICHFIELD DOES ORDAIN:
Section 2.19, Subdivision 3 of the Ordinance Code of
the City of Richfield., relating to the fire division of the
city, is hereby amended to read:
"Subd. 3. Fire Division. The fire division is supervised
by the [fire chief who is responsible to the] director of public
safety who is the chief of the division. There shall be one or
more assistant chiefs in the division."

RESOLUTION AUTHORIZING REIMBURSEMENT OF POLICE
TRAINING FUNDS FROM THE MINNESOTA PEACE OFFICERS
TRAINING BOARD
WHEREAS, the City of Richfield, Minnesota as a legally incorporated
municipality within the County of Hennepin and the State of Minnesota,
and
WHEREAS, the city council is impowered by the city charter to employ
the acting city manager, and
WHEREAS, the acting city manager is authorized to conduct the adminis-
trative functions of the city,
NOW, THEREFORE, BE IT RESOLVED, that the acting city manager of
Richfield, Minnesota, is authorized to apply for reimbursement of police
training funds authorized by state statute from the Minnesota Peace
Officer Training Board.
