Subject: Authorization to Submit Grant Application
The Civic Marker Committee has requested that the city make
an application to the National Endowment for the Arts (NEA) for
grant assistance to construct the civic plaza monument area. The
NEA provides grants for art in public places. The;.- proposed grant
application would be in the amount of $12,000. If.;approved, it
would be necessary for the_.city to provide an equal amount of
matching funds.' The civic marker committee is presently

engaged in raising funds for the marker project.'

It is recommended that the city council authorize the City

.Manager to submit a letter'of intent to „.submit a> grant application
to the NEA for the Civic Plaza Monument.

Subject: Acquisition of Tax Forfeited Lands
'At the June 25, 1979 city council ineeting, the... city council
approved Hennepin. County's classification of tax forfeited lands
as non - conservation land, and authorized the count,y to put the
subject properties up for sale. At <the,'same time,; it was! noted
by the council that three of the parcels are adjacent toy existing;
city park properties, and referred the question regarding possible
acquisition of these lots to the planning commission, for their
review and recommendation. Maps showing locations of these three
properties'are attached.
The planning commission reviewed these property acquisitions
at their June 25,'1979 meeting, and determined that th,
acquisitions
were in conformance with the city's: - comprehensive plan,
and recomm-
ended that the city acquire these properties as additions'
to the
existing adjacent park areas.
It is the recommendation of, the; staff that the - cit
acquire
deeds to these lots through private sale, thus eli -ping
ing any
future involvement of the state in requiring that we sl,.ow
proof
that the properties are being used for public purposes

Subject: Authorization to Submit Grant Application
There is an item on the July 9 , 19 7 9 c ity council agenda provd-
ing for. city council authorization to file an aid application with
the State Aid Office of the Minnesota Department ;;of Transportation.
This application would request reimbursement ',to the city for
the cost of retaining a consultant to survey, inventory, and recommend
a program to repair, replace, or update existing traffic. sign fac-
ilities in Richfield. The total cost of the inventory would be paid
for by state and federal funds.
The application would also request the state ,to reimburse the
•
city for costs of repairing and upgrading our traffc
sign system.
The grant would compensate the city for 90 percent of!the
cost to
replace poles, delineators, object markers, and mount'ng
supports,
as well as 90 percent of the city's labor costs to br
ng these
signs into conformance.with the consultant's.inventor
.
It is estimated the cost of the inventory would be
$3,500, and
that the cost of labor, equipment, and material to update
the signs
will amount of $19,000. Over the past two years, the
street division'
has.upgraded 400 signs to bring them into conformance
with the
Minnesota Manual on Uniform Traffic Control Devices.'
The city has
budgeted monies to replace an additional 200 signs over
the next year
and will need to appropriate a like amount for the following
three
to four years. There are over 2,700 regulatory signs
in the city:
It is the recommendation of the public works dire
tor, in which
I' concur, that the city council authorize submission
of this grant
application and hiring of a consultant to conduct the
sign survey'
as required 'by the Municipal State Aid Office.

Staff Findings
The staff has reviewed the request for variance against the
three conditions which _must be' met , before granting a variance
and .found the -following
1. That there are special circumstances or conditions affect -
ing the particular land, not common to other Properties
in this or similar districts.
It is the opinion of the staff that there are special
conditions on the site not common to other sites in
similar zoning` districts. The subject lot is substandard
and non- conforming. Substandard, non - conforming lots, are
not common in the city's MR zoning districts,and, therefore,
this lot represents a special condition. The lot would
also not meet the minimum lot area requirements for single
family dwelling.
2 That the granting of the application is necessary for the
preservation and end o_yment of substantial property rights.
It is the opinion of the staff that the variance is
necessary to protect substantial property rights. A variance
would be necessary to allow any use of the land except, for
open space and is thus necessary to protect the property
• owner's right to use the land productively.
3. That the granting of the application would not materially
and adversely affect the health or safety of persons
residing or working in the neighborhood and willl not be
materially detrimental to the public welfare or injurious
to the property or improvements in the nei hbo hood.
The proposal would not be detrimental to the public welfare
if strong buffering between.the proposed structure and the
adjacent commercial uses is provided. The pro osed two-
family dwelling would buffer the single family use to the
east from the commercial uses along the west side of Penn
Avenue.
The staff has also found that the proposed building would
not meet building code requirements for separation from
surrounding buildings, or for wall opening protection,
because it is located in fire zone 1.
In summary, the staff has found that all conditions for granting
the variance would be met if the strong buffering is provided along
the rear of the lot, and if the building is constructed in compli-
ance with city building codes.
Staff Recommendation:

approve the request. for variance subject to the following stipu-
lation:

% That a six foot high solid wood fence and landscaping
be' provided along the rear (west) property line to
buffer the 'property from adjacent commercial uses'.

This property had been used for parking camping trailers
previous to my purchasing it from Landey's Camping Center.
I sold the front portion off a year ago and retained this
lot myself for the corporation. The best use for this
land is a duplex. We are applying for a variance and a
plan is included that will work very well on this piece
of property and still be in compliance with present zoning.
Subject plan was used at property at 6723 and 6721 Penn Ave.
S. Our lot is wider in front and has more square footage.
We will tie in to the grades at the property owners to the
north and terrace to the south property line.

ORDINANCE CODE OF THE CITY OF
RICHFIELD, MINNESOTA
CITY OF RICHFIELD DOES ORDAIN:
Appendix C of the Ordinance Code of the City of Richfield,
Minnesota defining the boundaries of the various zoning dis-
tricts of the city, enumerated in Chapter III, Part IV, Section
3.28, Subdivision 2 of such code, is hereby amended in the
following respect:
1. Appendix C, Section 4 is amended by adding after
(123) the following new paragraph
"(124) Those parts of Lots 1 and 2, Block 1, Christian's
Addition, according to the recorded plat thereof, des-
cribed as follows: Beginning at the Southeast corner
of said Lot 2; thence North along the East line of said
Lots 2 and 1 a distance of 114.34 feet; thence along a
tangent curve to the left, having a radius of 6.61 feet
and a central angle of 114 degrees and .06 minutes a
distance of 13.16 feet; thence Southwesterly along a
curve concave to the North, having a radius of 1370.0
• feet to a point on the West line of said Lot 2 distant
71.22 feet North of the Southwest corner of said Lot 2;
thence South along the West line of said Lot 2, a distance
