City of Richf ield Council Members: l 2.- Council Letter No. 63 Agenda February 11, 1980 Subject: Status Airport Pet Hospital /Cedar Industries, Inc. At the January 28, 1980 city council meeting, testimony was offered by Mr. Michael Scherling of Cedar Industries, Inc., on behalf of his pending petition for an ordinance amendment to in- crease the allowable rated capacity of punch press machines within an industrial zoning district. At that meeting, testimony was also offered by the attorney for Dr. William Blaine, of the Airport Pet Hospital, on behalf of his petition to the city council to deny the ordinance amendment requested by Cedar Industries. Prior to that meeting, we provided the city council with a rather lengthy back- ground summary of the issues in this matter which was contained in Council Letter No. 42, dated January 28, 1980. Very briefly, the council has deferred action on the request for an ordinance amend- ment and directed the city staff to attempt to facilitate an amicable resolution of the alleged nuisance dispute which seems to be occuring between the two parties involved in this matter. As of this writing, the city staff has not yet been successful in lengthy efforts to accomplish this objective. At the January 28, 1980 city council meeting, the council re- quested that the city attorney's office examine the rather complex issues surrounding this matter, particularly based on the length of time both parties have operated businesses within our community. The director of public safety and the assistant city attorney have re- viewed this matter. In opposing the ordinance amendment requested by Cedar Industries, Dr. William Blaine has alleged that the operation of Cedar Industries is creating a nuisance which extends onto his premises. Additionally, Dr. Blaine has alleged that punch press machines owned and operated by Cedar Industries are in violation of the maximum rated capacity for such machines as established in our zoning ordinance code. In response to this allegation, Cedar Industries has alleged that the.Airport Pet Hospital has created a nuisance in the form of unpleasant odors which extend onto their property. Furthermore, Cedar Industries claims that any alleged nuisance experienced by Dr. Blaine is directly related to his choice to live within a zoned industrial district of the city. Council Letter No. 63 -2- February 11, 1980 Both the public safety director and the assistant city attorn- ey are of the opinion that the nuisance claims made by the two parties do not constitute a public nuisance as defined in our city ordinance code. There is no evidence whatsoever that anyone else in the general area of these two businesses has been affected by either of the alleged nuisance claims involving the two disputing parties themselves. Therefore, any nuisance dispute would be a private matter left for the resolution of the parties themselves and not a matter in which the city should have any legitimate interest. The public safety director and the assistant city attorney are of the opinion that some of the punch press machines currently operating on the premises of. Cedar Industries are in violation of the existing maximum rated capacity allowable for such machines under our zoning ordinance code. Both the director of public safety and the assistant city attorney are also of the opinion that all reason- able efforts on the part of the city to facilitate an amicable resolu- tion of this dispute have been exhausted. Therefore, there does not seem to be any productive purpose in continuing this matter. Legal Discussion It appears that prosecution under Richfield's public nuisance ordinance against Cedar Industries would not be feasible because an appreciable number of members of the general public do not seem to be affected by the punch presses. Prosecution under the zoning or- dinance is appropriate, however, since Cedar Industries is in clear violation of that ordinance.. If the ordinance has been in force since 1954, the punch presses have been operating in violation of that ordinance for the entire length of the present owner's occupancy. The city appears to have three alternatives in this matter: 1. They can do nothing, thus allowing Cedar Industries to continue operating in violation of the ordinance. 2. They can prosecute under the misdemeanor zoning ordinance. 3. The council can amend the ordinance. Various legal and practical issues arise under each of these alternatives. Alternative one is for the city to take no action. It may be that in that case the city would be liable for non - enforcement of the ordinance. The general rule, however, subject to certain qualifications, is that in-the absence of statutory provision, a municipal corporation is not liable for failure to enact or enforce ordinances. It appears that, in the absence of statute, there is no mandatory duty upon the municipality to prosecute for an alleged violation of the zoning ordinance. The enforcement of ordinances is a governmental function, and in the absence of a statute imposing a liability, a'municipality.is not liable for a discretionary act of refusing to enforce ordinances which have been enacted. It is possible, of course, that a citizen may bring a writ of mandamus to review the authorities' refusal to exercise discretion to review an action enforcing or not enforcing an ordinance. Mandamus would not be appropriate, however, to compel a prosecutor to initiate a specific prosecution. . Council Letter No. 63 -3- February 11, 1980 Finally, the good faith of the council in keeping the ordin- ance on the books might be questioned if it was decided not to prosecute the ordinance at this time. There seems to be no good reason not to prosecute if the ordinance is to be unchanged, since Cedar Industries is clearly in violation of the ordinance as it now reads. An option under these circumstances might then be for the council to repeal the existing ordinance in question. Alternative two is to prosecute the zoning ordinance as a mis- demeanor in municipal court. The Richfield ordinance provides that the city manager shall be responsible for enforcement of the ordin- ance, and also provides in Section 1.10, subd. 1, that "unless another penalty is expressly provided in this code, any person violating any provision of this code..... shall upon conviction be subject to a fine of not more than three hundred dollars or imprisonment for a term not to exceed 90 days." Subd. 2 states that: "unless other- wise provided each act of violation on every day upon which the violation occurs or continues constitutes a separate offense." If this suit were brought by the city to enforce the ordinance in municipal court, a jury trial would be held. The proof necessary would be: (1) proof of the ordinance, and the date of its enactment. (2) proof of the tonnage weight of the presses. (3) proof of owner- ship of the presses. (4) proof that the presses were bought and brought into use after the ordinance was enacted in 1954. Proof problems may exist in that the only information as to when the punch presses were brought to Cedar Industries and their tonnage was provided-by Mike Scherling before he was aware that he might be subject to misdemeanor prosecution. The absence of the Miranda warnings does not seem to be a major problem, however, be- cause of the law that suspicion must be focusing on one individual before the warnings need be given. It has been held by the Minnesota Court that municipal ordinances are not precisely "criminal" statutes, and violations thereof are not technically "crimes" nor are such violations governed by the rules of criminal law save in specified exceptional cases. Minnesota has also held that the general statutes relating to confessions are inapplicable in ordinance prosecutions. It will be necessary to acquire records proving when each machine was brought to Cedar Industries and by whom it was brought. Expert witnesses may be needed to prove the weight of each press. Although the trial itself would not be a lengthy process, substantial time might be needed for prior discovery. In addition, there is a distinct possibility of time consuming appeals by Cedar Industries if they are convicted, particularly since a conviction under the mis- demeanor provision ci- the c:rdinance would, in effect, put them out of business. There are several possible defenses that Cedar Industries might use at trial or on appeal. The primary defense that Mr. Scherling seems to be arguing is the city's failure to enforce the ordinance over the 18 years that he has been in business. Minnesota Law is very • clear, however, that a city ordinance is not repealed, nor does it become unenforceable, by a failure to enforce it, by its wrongful enforcement, or by the fact that it is repeatedly violated. Other states concur in this rule. Council Letter No. 63 -4- February 11, 1980 Cedar Industries will probably claim that the delay of time in enforcing the ordinance has unfairly prejudiced them. The law, however, is that Cedar Industries has acquired no vested rights since they were in violation of the ordinance, which they were resumed to know, from the time they began to use the presses. The doctrine of laches or prejudicial delay of enforcement has no app - lication to enforcement of a municipality of its ordinances and cannot be raised as a defense against its enforcement. Continued violations of an ordinance cannot create a vested right to continue violating it, and prior violations do "not estop a city from enforc- ing the law in its present violations. If it is found that others violated the ordinance without being prosecuted during the same period, that fact is also immaterial to the prosecution of a clear violation. Cedar Industries may defend their violation of the ordinance by saying that the ordinance is unreasonable or unconstitutional on its face. They must show, however, that it is without any substantial relation to the public health, safety, morals, or general welfare. Obviously, ordinances should be designed to promote the general wel- fare and other objectives specified in the statutes rather tham to benefit individual property owners. Cedar Industries will probably attempt to show that the 20 ton limit ordinance was enacted in a period of time when Richfield was attempting to maintain the resident- ial nature of the community, and that the limitation is no longer a reasonable exercise for that purpose.. It may be a valid argument at this juncture for Cedar Industries to argue that an enforcement of the ordinance now would be for the benefit only of the owner of the veterinary hospital, and not for the general welfare of the community since there has been no -other complaint in the past 18 years. It would also be a strong argument that the present complain- ant has co- existed for 18 years with Cedar Industries with no appar- ent problems. It is possible that an ordinance which was reasonable and valid when enacted may have become unreasonable and invalid by a subsequent change of conditions in the community. Obviously, the exercise of police power by a municipal corporation must be directed towards and have a rational relation to the protection of the basic interest of society, rather than the mere advantage of an individual, and must be.reasonable and free from arbitrariness. An essential issue on an appeal of this case would be whether the 20 ton limit has any rational relationship to the promotion of the peace and welfare of the community. It seems that proof might be necessary to show the relationship between the weight of the presses and the amount of vibration and noise that they engender. An act is not necessarily a nuisance because it is a violation of the zoning law. The existence of a nuisance is dependent upon physical injury to another's property and the municipality will only become interested when that injury is substantial and the public interest is affected. The third alternative is a decision of the city council to amend the ordinance as requested by Cedar Industries. The fundamental justification for an amendatory ordinance is a change of conditions making the amendment reasonably necessary to protect the public in- terest or to correct previous defects or mistakes in the ordinance. Council Letter No. 63 -5- February 11, 1980 An amendment to accomodate a certain property owner when there has been no change of conditions since the enactment of a zoning ordin- ance would be invalid. An amendment would appear more reasonable if it contained a con- dition that the new use permitted should observe a mode of exercise which .would prevent it from being a nuisance. In the case of Cedar Industries a solution would have to be reached which would eliminate any existing problems from vibration and noise. Additional studies by the consulting engineer and a workable correction would be necessary before this type of amendment to the ordinance could be attempted. Conclusion It is the opinion of the assistant city attorney that unless the council anticipates an amendment to the ordinance, there is no good reason not to prosecute at this time. Although the problem is primarily one between the two parties, and the punch presses . do not constitute a public nuisance, Cedar Industries is in clear violation of the weight provisions of the zoning ordinance. If the council desires to amend the ordinance code, it would be the recomendation of the city staff that such amendment be based on permissable vibration transmissions of machinery rather than simply increasing the maximum rated capacity of such machines. If, on the . other hand, the city council wishes to authorize prosecution in this matter, it is the recommendation of the city staff that a ten -day formal notice of an intent to file criminal charges be given to Cedar Industries so that they might have an opportunity to order the install- ation of alternative shock reducing devices which might alleviate the apparent existing vibration transmission problem. If the vibration transmission problem could be satisfactorily resolved, the current bpposition to the requested ordinance amendment might be withdrawn by the petitioner. This notice of intent to file criminal charges would also provide time for Cedar Industries to retain an attorney to represent their interest in this matter. Both the assistant city attorney and the public safety director will be available to respond to questions on this matter. Addition- ally, both of the parties to this dispute will be informed that this item is again on the council agenda. First Reading. There is an item on the February 11, 1980 city council agenda providing for city council consideration of an ordinance amendment relating to the pay plan and compensation policies of the city. A copy of the proposed ordinance amendment is attached to this letter. The attached ordinance is designed to more specifically clari- fy which city employees are eligible for certain types of overtime compensation. The ordinance contains two substantive changes. The first major change appears in paragraph one, and provides that certain employees known as administrative employees shall be those employees who have managerial and supervisory responsibility and are designated as such administrative employees in the city's classification plan. This change was necessitated because the former ordinance specifically listed employee positions which were to be known as administrative employees. Over a period of time, and particularly in light of the reorganizational changes recently made in the city's administrative structure, the former language of this ordinance provision has become obsolete. The provision that these employees are exempt from overtime compensation, but may be granted reasonable time off by the city manager when he determines that such time off is warranted, is virtually unchanged from the previous ordinance provision. The second major substantive change appears in the attached ordinance's paragraph 5 and then again in subdivision 18, Section 2.33. The effect of each of these changes is to specify that overtime compensation to any employee eligible for such compensa- tion shall be either in the form of cash payment for overtime at the rate of time and one -half, or in the form of compensatory time off on a straight time basis, and that the city manager shall make the determination as to which form of compensation is granted to any such employee. The previous ordinance provision appeared to mandate that certain employees working overtime could only be paid in cash, and that it was the employee's choice if they elected to receive compensatory time rather than a cash overtime payment. I believe it is a significant management consideration as to whether low Council Letter No. 59 -2- February 11, 1980 employees working overtime are to be compensated in cash or by compensatory time off, and I believe the attached ordinance pro- visions clearly provide the necessary management authority to make those decisions rather than leaving such a decision wholly in the hands of the affected employee. It is recommended that the city council give first reading consideration to this.ordinance amendment. At the January 28, 1980 city council meeting, the city council received a petition from numerous residents in the area of the In- ternational Coin Company, 1302 East 66th Street. The petition re- quested the city's assistance in alleviating traffic congestion problems created by the large volume of customers doing business with the coin company, resulting from rapidly escalating silver prices. At the time, the petitioners indicated that major traffic congestion and parking problems were occuring on 13th Avenue, pri- marily between East 66th Street and East 64th Street. Following the discussion.on this matter, the city council directed the public safety department to investigate a potential violation of the off - street parking contract for the International Coin Company property. Additionally, the city staff and the city attorney were requested to facilitate meetings between the owners of International Coin, Inc., and the property owners of other comm- ercial establishments in the immediate vicinity, to attempt to arrange additional off - street parking resources for the coin company. The public safety department has found that a temporary steel utility shed has been erected on the rear parking area of the coin company property and has, in effect, rendered one of the off - street parking spaces unusable. The city attorney's office has taken action to direct the removal of this storage shed. Additionally, the city attorney's office has contacted Mr. Clarence Christian, owner of properties at 1208 and 1212 East 66th Street about possibly utilizing some unused parking space on that property for overflow parking from International Coin, Inc. Under terms of the existing lease between Mr. Christian and the leasee's of the property, such authorization can be given by the leasee's upon notification of such arrangements to Mr. Christian. Because of conditions of the off - street parking permit issued to 1208 and 1212 East 66th Street, a formal sublease of parking space would not be practical. However, there .are 88 parking spaces available on that property, which gen- erally � far exceeds the needs of the current leasee. Therefore, we have.been able to facilitate direct negotiations between Inter- national Coin, Inc., and the leasee of the Christian property for Council Letter No. 58 -2- February 11, 1980 an informal arrangement to provide additional off - street parking facilities for International Coin customers. International Coin has also made arrangements for 8 additional off - street parking spaces across East 66th Street and directly south of their present location. These parking spaces are used by employees of the company, thereby making all 13 off - street parking spaces on the International Coin property itself available for customers. During the past two weeks the public safety department has been monitoring on a regular daily basis, parking and traffic con- ditions on 13th Avenue between East 66th Street and East 64th Street. During this period of time, there has been a marked decline in the silver market, which has noticeably reduced the business activity of International Coin, Inc. It is the observation of the public safety department that there have been no traffic congestion prob- lems, and very few vehicles parked on the street during this period. .It appears that the congestion problem was only temporary in nature and that with the decline in the silver market, the problem seems to have been resolved. However, we believe the arrangements we have facilitated for additional off-street parking resources for International Coin, Inc. will resolve any future parking problems should there be an upsurge in the silver market and a corresponding increase again in the volume of customer traffic in the area. The public safety department will continue to monitor potential traffic problems in the area on a daily basis and work with International Coin, Inc. to prevent unnecessary inconvenience or traffic for the residents of the area. Second Reading. At the January 14, 1980 city council meeting, the city council gave first reading approval to an ordinance amendment which would eliminate the existing ordinance requirement that the manager of a licensed liquor establishment be a Richfield resident. A copy of this ordinance amendment is attached. The wine ordinance study committee appointed by the city council • in late .1979, have recommended that the provision relating to the liquor manager residency requirement be eliminated, on the basis that this requirement appears to bear little relationship to the actual operation of the liquor establishments or to the city's ability to gain cooperation in resolving any problems that occur at such licensed liquor establishments. This ordinance amendment is placed on the February 11, 1980 city council agenda for council consideration of second reading approval. The original fee schedule was based on the square footage . size of billboards. This fee was difficult for the city to monitor, since the size of billboards changes during the course of the year dependent upon the display format purchased by advertisers. It has been proposed that this annual mainten- ance fee be changed from a square footage charge to a flat rate charge per billboard structure. The attached ordinance amendment establishes such a flat rate fee. 0 It is the recommendation of the Public Safety Director, in which I concur, that the city council give second reading approval to this ordinance amendment. First Reading. In November, 1979, the city council requested that the liquor study committee, which had assisted in developing the city's on -sale liquor licensing process several years ago, be reactivated for purposes of examining a proposed on -sale wine licensing ordinance. The committee consisted of three citizen members: Mr. George Kenealey, Mr. Kermit Randall, and Mr. Wes Borgeson, The two members of the city council selected to work with the study committee are Mr. Vern Luettinger and Ms. Juanita Collins. The city manager, the director of public safety and assistant city attorney have served as staff resources to the . committee. The first meeting of this committee was held on January 10, 1980. At that time, the committee used as a basis for discuss- ion a draft wine licensing ordinance which had been developed by the city attorney's office in mid -1978. This draft ordinance had been discussed by the city council on several occasions, the most recent of which was September 25, 1978, when the council recommended several changes or additions to this draft ordinance. At their first meeting, the study committee concluded that an on -sale wine licensing ordinance would be appropriate for the City of Richfield. Based upon their discussion of the draft ordinance, the committee agreed on several modifications. At this first meeting, the committee established an annual wine license fee of $300 as a reasonable and fair rate for this type of license. The committee also recommended a minimum in- vestigative fee for license applications of $150. In determin- ing the type of establishments to qualify for wine licensing, the committee established the criteria of a restaurant business, with a special use permit for the sale of liquor. A qualifying restaurant should contain a seating capacity of at least 40 persons, with the principal part of the business being food service. The committee also decided that the maximum service size should be one liter, with wine service available only at tables for individuals who are ordering meals. Also during this first meeting, the committee established insurance re- quirements comparable to those of the city's liquor license ordinance to protect both the city and the patrons of potential wine service establishments. • 0 Council Letter No. 54 -2- February 11,1980 On January 24, 1980, the committee met again to review the completed revisions, as prepared by the city, attorney's office, to the proposed wine licensing ordinance. At this meeting,, the committee considered the results of a survey by the Chamber of Commerce regarding the number of potential businesses which might be expected to seek wine licenses. This survey indicated that the ordinance should provide for seven wine licenses, which is consistent with the number of authorized liquor licen- ses. The committee also agreed to extend licensing controls to managers of establishments who seek on -sale wine licenses, as well as the owners of such establishments. Finally, the committee, after much discussion, recommended that the originally proposed requirement that managers of on -sale wine licensing establishments be Richfield residents, be eliminated. Chapter XI of the Ordinance Code of the City of Richfield relating to liquor and intoxicating beverage control is hereby amended by adding after Section 11.07 therein, the following new Section: 11.08 ON -SALE WINE Subdivision 1. Definitions. The following terms have the meanings ascribed to them in this section: (1) The term "wine" means and includes all vinous beverages not exceeding 14 percent alcohol by volume. (2) "Sale" and "sell" and "sold" mean all barters and all manners of furnishing wine including such furnishing in violation or evasion of law. (3) The term "restaurant" means any establishment under the control of a single proprietor or manager where in consideration of payment therefor31, meals are regularly i served at tables to the general public and which employs an adequate staff for the usual and suitable service to its guests. (4) The term "on- sale" means the sale of wine by the glass, or by the drink for consumption on the premises only. (5) "Minor" means any person under the age of 19 years. Subd. 2. License Required. No person, except wholesalers or manufacturers, to the extent authorized under state license, shall directly or indirectly deal in, sell, or keep for sale wine for "on- sale" sale without first having received a license to do so as provided in this section, or as provided in section 11.06 of this code. "On -sale" wine licenses shall be issued only to restaurants. No more than 7 "on- sale" licenses may be issued to restaurants. Subd. 3. Applications for Licenses to be Verified. Every application for an "on- sale" license shall be verified and filed with the city clerk. E Subd. 4. Contents of Application. In addi- tion to information which may be required by the state liquor control commissioner, the application shall state: (1) Whether the applicant is a natural person, corporation, partnership, or other form of organization. (2) If the applicant is a natural person, the following information shall be furnished: (a) True name, place and date of birth, and street residence of applicant. (b) Whether applicant has ever used or been known by a name other than his true name, and, if so, what was such name, or names, and information concerning dates and places where used. (c) The name of the business if it is to be conducted under a designation, name or style other than the full individual name of the applicant. (d) Whether applicant is married, or single. If married, true name, place and date of birth and street residence address of applicant's present spouse. (e) Whether applicant and present spouse are registered voters, and, if so, where. (f) Street addresses at which applicant and present spouse have lived during the preceding ten years. (g) Whether the applicant in the case of a natural person, or his spouse, or the manager and all persons holding or posses- sing an interest in the business to be li- censed have ever been convicted for violation of any law of the United States, State of Minnesota, or any other state or territory or any municipal ordinance. (h) Whether applicant or his spouse has ever been engaged as an employee or in operating a saloon, hotel, restuarant, cafe, tavern or other business of a similar nature. If so, applicant shall furnish information as 'to the time, place and length of time. (i) Whether applicant has ever been in military service. If so, applicant shall, upon request, exhibit all discharges. (j) The name, address and business address of each person who is engaged in Minnesota in the business of selling, manu- facturing or distributing wine or intoxi- cating liquor and who is nearer of kin to the 3 applicant or his spouse than second counsin, whether of whole or half blood, or who is a brother -in -law or sister -in -law of the appli- cant or his spouse. (3) If the applicant is a partnership, the names and addresses of all partners and all information concerning each partner as is required of a single applicant in Paragraph (2) above. A managing partner, or partners, shall be designated. The interest of each partner in the business shall be disclosed. A true copy of the partnership agreement shall be submitted with the application. (4) If the applicant is a corporation or other organization and is applying for an "on- sale" license, the following information shall be furnished: (a) The name, and, if incorpora- ted, the state of incorporation. (b) A true copy of the certificate of incorporation, articles of incorporation or association agreement and bylaws. (c) The name of the manager or proprietor or other agent in charge of the premises 'to be licensed, giving all the information about said person as is required of single applicant in Paragraph (2) above. (d) A list of all natural persons who, singly or together with their spouse, or a parent, brother, sister or child of either of them, own or control an interest in said corporation of association, together with their addresses and all other information required of a single applicant in Paragraph (2) above. (5) The exact legal description of the premises to be licensed together with the locations of and distances to the nearest church building and school grounds. (6) The floor number and street number where the "on -sale" sale of wine is to be conducted and the rooms where wine is to be consumed. An applicant for an "on- sale" license shall submit a floor plan of the dining room, or dining rooms, which shall be open to the public, shall show dimensions and shall indicate the number of persons intended to be served in each of said rooms. (7) If a permit from the federal govern- . ment is required by the laws of the United States, whether or not such permit has been issued, and, if so required, in what name issued, and the nature of the permit. (8) The amount of the investment that the applicant has in the business, building, premises, fixtures, furniture, stock in trade, etc., and proof of the source of such money. (9) The names and addresses of all persons, other than the applicant, who have any financial interest in the business, buildings, premises, fixtures, furniture, stock in trade; the nature of such interest, amount thereof, terms for payment or other reimbursement. This shall include, but not be limited to, any lessees, lessors, mor- tgagees, mortgagors, lendors, lien holders, trustees, trustors and persons who have co- signed notes or otherwise loaned, pledged, or extended security for any indebtedness of the application. (10) The names, residences and business addresses of three persons, residents of Hennepin County, of good moral character, not related to the applicant or financially • interested in the premises of business, who may be referred to as to the applicant's character or in the case where information is required of a manager, the manager's char- acter. (11) Whether or not all real estate and personal property taxes for the premises to be licensed have been paid and, if not paid, the years for which delinquent. (12) Whenever the application for an "on- sale" license, or for a transfer thereof, is for premises either planned or under construction or undergoing substantial altera- tion, the application shall be accompanied by a set of preliminary plans showing the design of the proposed premises to be licensed. If the plans or design are on file with the city engineer, no plans need to be filed with the city clerk. (13) Such other information as the city council shall require. (14) Proof that the applicant has com- plied with all of the procedures required under the zoning regulations of the city to qualify the proposed licensed premises as an approved location. The council shall not act upon an application for a license until all • 5 such regulations have been complied with and final approval of site and building plans have been given by the council. Subd. 5. Execution of Application. If the application is by a natural person, by such person; if by a corporation, by an officer thereof; if by a partnership, by one of the partners; if by an unincorporated associa- tion, by the_ manager or managing officer thereof. If the applicant is a partnership, any license, bond and insurance policy issued shall be in the names of all partners. Subd. 6. Renewal Application. Applications for the renewal of an existing license shall be filed with the city clerk at least 60 days prior to the date of the expiration of the license and shall be made in such abbreviated form as the city council may approve. Subd. 8. License Fee. The following pro- visions control as to license fees and re- lated subjects: (1) The . annual license fee for an on -sale license shall be as established in Appendix D of this Code. (2) The entire license fee established in Appendix D shall be paid when the license application is filed. No application shall be accepted by the clerk which is not accom- panied by such fee. All license fees shall be paid into the general fund of the city. 0 Upon rejection or withdrawl of any appli- cation the license fee shall be refunded except where rejection or withdrawl is for a willful misstatement in the license appli- cation. (3) At the time of each application for a license, the applicant shall also pay an investigating fee as provided in Appendix D of this Code. The investigating fee shall not be subject to refund. If the expenses of the investigation relating to an application exceed the investigating fee paid with the application, the city manager shall notify the applicant of this fact and shall require the applicant to pay such additional investi- gating fees as the city manager deems neces- sary to complete the investigation of the application. The total investigating fee shall not exceed the limit established in Appendix D of this Code. The applicant shall pay such additional investigating fees within five (5) days of being so notified. If such additional investigating fee is not paid within that period, the City shall discon- tinue consideration of the application. (4) At any time that an additional investigation is required because of a change in the ownership, interest or control of a • partnership or a corporation, the licensee shall pay an additional investigating fee as provided in Appendix D of this Code. Subd. 9. License Year. The license year shall commence April 1 of each year and terminate on March 31 of the following year. When an original license is issued for a portion of the license year, the fee shall be prorated at the rate of one - twelfth of the annual license fee per month or portion of a month remaining in the license year. Subd. 10. Granting of Licenses. The follow- ing procedure shall be followed in processing applications for licenses under this section: (1) All applications for a license shall be referred to the public safety direc- tor, and to such. other city departments as the city manager shall deem necessary, for verification and investigation of the facts set forth in the application.. (2) Upon completion of the manager's preliminary report and within 20 days there- after, the manager may recommend to the council that a public hearing be held upon the application. The council shall then instruct the city clerk to cause to be pub - lished in the official newspaper 10 days in advance, a notice of the hearing to be held by the city council, setting forth the day, time and place when the hearing will be held, the name of the applicant, the premises where the business is to be conducted, and such other information as the council may direct. At the hearing opportunity shall be given to any person to be heard for or against the granting of the license. After the hearing the council may either grant or deny the license. If the license is granted, the council may withhold its issuance until the applicant has qualified in all respects for the license. If the premises to be licensed are not complete at the time that the hearing is conducted the council may grant the li- cense but shall withhold its issuance until the premises have been completed in accor- dance with the representations made by the applicant. If a license has been granted but its issuance has been withheld pending com- pletion of the premises to be licensed, and if the licensee does not proceed with reason- able dispatch to ready the premises, the council may rescind the action granting the license. Such action shall not be taken, however, without giving the licensee at least eight days' notice of the time and place of a hearing on the proposed rescession. (3) Each license shall be issued to the applicant only. Each license shall be issued only for the premises described in the appli- cation. (4) The clerk shall, within 10 days after the issuance of any license under this section, submit to the commissioner of public safety the full name and address of each person granted a license, the trade name, the effective license date, and the date of expiration of the license. He shall also submit to the commissioner any change of address, transfer, cancellation, or revoca- tion of any license by the council during the license period. Subd. 12. Ineligibility for License. Exis- tence of any of the following conditions render any applicant ineligible for receipt of a license: (1) No license shall be granted, or renewed, for operation on any premises, on which taxes, assessments or other financial claims of the city or of the state are due, Subd. 11. Person Ineligible for License. No license shall be granted to or held by any • person: (1) Who is ineligible under Minnesota Statutes, Chapter 340. (2) Who is a minor. (3) Who is not of good moral character and repute. (4) Who, if an individual, is an alien. (5) Who, within five years prior to the application for such license, has been con- victed of any willful violation of any law of the United States, the State of Minnesota, or any other state or territory, or of any local ordinance, with regard to the manufacture, sale, distribution, or possession for sale or distribution of intoxicating liquor, wine, or non - intoxicating malt liquor or whose liquor, wine, or non - intoxicating malt liquor license has been revoked for any willful violation of any such laws or ordinances. (6) Who is a manufacturer or wholesaler of intoxicating liquor. (7) Who is directly or indirectly interested in any other establishment in the city to which a license has been issued under this section or under Section 11.06 of this Code. The word "interested" as used in this • paragraph includes any pecuniary interest in the ownership, operation, management or profits of such an establishment. (8) Who, if a corporation, does not have a manager who is eligible pursuant to the provisions of this section or whose corporate stock is owned or subject to the beneficial interest of any person or the spouse of any person ineligible for licensure under paragraphs 2, 3, 4, 5 and 6 of this subdivision. (9) Who is the spouse of a person ineligible for a license under paragraphs 4, 5 or 6 of this subdivision and who, in the judgment of the city council, is not the real party in interest or beneficial owner of the business operated, or to be operated, under the license. Subd. 12. Ineligibility for License. Exis- tence of any of the following conditions render any applicant ineligible for receipt of a license: (1) No license shall be granted, or renewed, for operation on any premises, on which taxes, assessments or other financial claims of the city or of the state are due, A delinquent or unpaid. In the event any action has been commenced pursuant to the provisions of Minnesota Statutes, Chapter 278, questioning the amount of validity of taxes, the city council may, on application by the licensee, waive strict compliance with this provision; no waiver may be granted, however, for taxes r ax s on any portion thereof, which remain unpaid for a period exceeding one year after becoming due. (2) No license shall be granted for a foreign corporation. (3) No license shall be issued for the premises owned by a person to whom a license may not be granted under this section, except an owner who is a minor or an alien. (4) No "on- sale" license shall be granted for a restaurant as defined in sub- division (1) of this section which does not comply with the following quirements: (a) Have a in'ng room seating capacity of at least 40 persons. (b) Be permitted by special us - ermit as a restau- rant at which liquor will be sold. Subd. 13. Conditions Governing Issuance. • The following conditions govern issuance of a license pursuant to this section: (1) Every license shall be granted subject to the provisions of this section and of any other applicable ordinance or law. (2) The license shall be posted in a conspicuous place in the licensed premises at all times. (3) Every licensee shall be responsible for the conduct of his place of business and for the conditions of sobriety and order in the place of business and on the premises. (4) No "on -sale" license shall sell wine "off- sale" (5) No license shall be effective beyond the compact and contiguous space shown in the license application for such license. (6) No minor shall be employed in any rooms constituting the place in which wines are sold at retail "on- sale ", except that minors may be employed to perform the duties of a bus boy or dishwashing services in restaurants licensed under the provisions of this section. (7) No wine shall be sold or furnished or delivered to any intoxicated person, to any habitual drunkard, to a minor, or to any person to whom sale is prohibited by state law. 10 (8) No licensee or any of his employees shall keep, possess, operate, or permit the keeping, possession, or operation of any slot machine, dice, or any gambling device or apparatus on the licensed premises, or in any room adjoining the licensed premises, nor shall any such person permit any gambling therein. (9) No licensee or any of his employees shall knowingly permit the licensed premises or any room in those premises or any adjoin- ing building directly or indirectly under his control to be used �Ls a resort for prosti- tutes. o , fir^ GIL s_, (10) Any police officer, health officer, sanitarian, building inspector or any proper- ly designated officer or employee of the city shall have the unqualified right to enter, inspect and search the premises of the licen- see without a search warrant at any time during which the sale of wine is occurring therein. Acceptance by the licensee of the license shall be deemed as consent to such entry, search and inspection . (11) No "on- sale" wine establishment shall display wine to the public during hours when the sale of wine is prohibited by this ordinance. • (12) No licensee shall apply for or possess a federal wholesale or retail liquor dealer's special tax stamp or a federal gambling stamp. (13) Changes in the corporate or associa- tion officers, corporate charter, articles of incorporation, bylaws or partnership agree- ment, as the cases may be, shall be submitted to the city clerk not less than 30 days before such changes are to be made. In the case of a corporation, the licensee shall notify the city clerk when a person not listed in the original application acquires an interest which, together with that of his spouse, parent, brother, sister or child, exceeds 5%. Such notice shall be given not less than 30 days from the date of the pro- posed transfer. (14) At the time a licensee submits his application for renewal of a license, he shall state the nature and amount of any contribution he has made for campaign or political purposes, the person to whom the contribution was made and the person or organization for whom intended. 11 Subd. 14. Bond. (1) No license granted under this • section shall be issued until the licensee has filed with the city clerk a fidelity bond (15) A restaurant shall be conducted in such a manner that the principal part of the business for a license year is the serving of foods. (16) Restaurants shall display a sign calling attention to the open bottle law. (17) No licensee shall sell, offer for sale, or keep for sale, wine in any original package which has been refilled or partly refilled. No licensee shall directly or through any other person delete or in any manner tamper with the contents of any origi- nal package so as to change its composition or alcoholic content while in the original package. Possession on the premises by the licensee of any wine in the original package differing in the composition or alcoholic content in the wine when received from the manufacturer or wholesaler from whom it was purchased shall be prima facie evidence that the contents of the original package has been diluted, changed or tampered with. (18) The business records of the licen- see, including federal and state tax returns, shall be available for inspection by the city manager, or other duly authorized representa- tives of the city or the city council at all reasonable times. • (19) No person may serve as manager in any restaurant serving wine who does not satisfy all the criteria required under Subdivision 11 for the issuance of a license. All licensees which are required to designate a person to manage the licensed operation shall notify the city of any__proposed..change of" manager, from the person designated in the application. Such proposed susbtitute must qualify in the same manner as the original manager. Upon notice of such proposed substi- tution, the city manager shall conduct such investigation involving such departments as he deems necessary to determine the qualifi- cation of the proposed substitute to act as manager. The city manager shall report his investigation to the council which may either approve or disapprove of the proposed substi- tute. The fee for the investigation required under this paragraph shall be as provided in Appendis D of this Code. Subd. 14. Bond. (1) No license granted under this • section shall be issued until the licensee has filed with the city clerk a fidelity bond 12 in the amount of $5,000. At the time the • license is granted the council will designate whether such bond will be with corporate surety duly licensed to do business in the State of Minnesota; or with a personal surety who is a person of good credit and a property owner in the city. The licensee shall keep such bond or any substituted bond in the same amount and with the same terms in full force and effect throughout the license period. (2) The surety bond required by Para- graph (1) of this subdivision shall be sub- ject to the approval of the city attorney as to form and execution. (3) All such bonds shall be conditioned as follows: (a) The licensee will obey the law relating to the licensed business. (b) The licensee will pay to the city when due all taCges licensee fees, penalties and othera pro vided by law. (c) In th of violation of any law relating to the business for which the license has been granted for the sale of wine, the bond shall be forfeited to the city. (4) All such bonds shall provide that no cancellation for any cause can be made • either by the bonding company or the appli- cant, without said person first giving 30 days' written notice to the city, addressed to the city manager, of intention to cancel the bond. Subd. 15. Liability Insurance. (1) Prior to the issuance of an "on- sale" wine license, the applicant shall file with the city clerk (a) a public liability insurance policy providing coverage of at least $250,000 and $500,000 and (b) a liquor liability policy covering liabilities under the provisions of Minnesota Statutes 1979, Section 340.96 and providing coverage of at least $100,000 and $300,000. The city shall be named as an additional party insured on each of such policies. (2) Such policies shall provide that no cancellation for any cause shall be made by either the insured or the insurer without first giving written notice of such cancel- lation to the city at least 30 days prior to the effective date of the cancellation. • (3) Such policies of insurance shall further provide that subject to the limita- tions of paragraph (1) above, no payment of 13 any claim by the insurance company shall in any manner decrease the coverage provided for in respect to any other claim or claims brought against the insured or the insuring company. (4) Such policies shall be subject to approval of the city attorney as to form and execution and shall be issued by companies who are duly licensed to do business in the State of Minnesota. Such policies, when approved by the proper city officials, shall be deposited with the city clerk. Subd. 16. Hours and Days of Operation. The sale of wine in conjunction with the serving of food shall be permitted between 8:00 a.m. and 1:00 a.m. on weekdays and until 1:00 a.m. on Sunday morning, and between noon and midnight on Sunday, unless such Sunday sale is prohibited in the license. Sale of wine at times other than those permitted in this subdivision is unlawful. Wine shall not be sold at any establishment licensed hereunder between 1:00 a.m. and 8:00 p.m. on the day of any local or statewide election. • Subd. 17. Restrictions Involving Sale to Minors. (1) No licensee, its agent or employee shall serve or dispense upon the licensed premises any wine to a minor, nor shall such licensee, or its agent or employee permit a minor to be furnished or consume any such wines on the licensed premises; nor shall such licensee, or its agent or employee permit a minor to be present at any part of the licensed premises where wine is served if not accompanied by such child's parent or legal guardian. (2) Upon demand of the licensee, its agent or employee, any person present on the premises or seeking entrance thereto shall produce and permit the examinations of such persons driver's license or non - qualification certificate issued by the State of Minnesota. Subd. 18. Other Restrictions on Purchase or- Consumption. (1) No person shall give, sell, pro- cure or purchase wine for any person to whom • the sale of wine is forbidden by law. 14 (2) No person shall mix or prepare • wine for "on- sale" consumption in any public place not licensed in accordane with this code and the laws of the State of Minnesota. (3) Wine may not be sold or served in any bar or cocktail lounge area of the res- taurant but only at tables where meals are regularly served. (4) No person may be sold or served wine who does not order food to be consumed with the wine. (5) Wine may not be sold or served in containers larger in volume than one liter. (6) Patrons shall not be allowed or permitted to remove wine receptacles from the premises which contain wine whether or not the seal is broken. The licensee shall take such steps as are necessary to inform patrons of this prohibition prior to making any wine sale. Subd. 19. Revocation. The city council may suspend or revoke an "on- sale" license for the violation of any provision or condition of this section, Code section 10.24 or of any state law or federal law regulating intoxi- cating liquor or wine and shall revoke such • license for any willful violation which, under the laws of the state, is grounds for mandatory revocation. Subd. 20. Revocation Procedure. The li- censee shall be afforded an opportunity for a hearing pursuant to Minnesota Statutes, Section 15.0418 and 15.0426 before the city council may vote whether to revoke or to suspend its license. No suspension shall exceed 60 days. Subd. 21. Enlargement, Alterations or Exten- sion of Premises. Proposed enlargement, alteration or extension of premises previous- ly licensed shall be reported to the city clerk at or before the time application is made for a building permit for any such change and the licensee shall also give such information as is required by Subdivision 4. Subd. 22. Transfer of License. No transfer • of any license required under this section 15 • shall be permitted until all of the pro- visions of this section have been met includ- ing the filing of an original application, 'i the payment of all fees and the approval of the city council. A license transfer shall be deemed to have occurred when any of the following conditions exist: (1) Any expansion, material alteration or extension of the licensed premises in- tended to be used for the sale or consumption of wine, "on- sale ". (2) Any transfer of the license from person to person or from place to place. (3) Any change in the business struc- ture or organization of the licensee includ- ing, but not limited to, changes in the corporate or association officers, charter, articles of incorporation, bylaws or partner- ship agreement. (4) Any change in the legal or bene- ficial ownership of corporate stock which, together with the interest of a spouse, parent, brother, sister or child, involves 5% or more of the corporate stock. (5) The grant of any power of attorney, voting proxy, pledge or other assignment of the voting rights of corporate stock which will effect alone or in conjunction with any • other assignment to the same assignee, his spouse, p arent br other, sister or child, 5/ or more of the voting shares of stock. (6) The creation of any new pecuniary interest in the ownership operation manage- ment, or profits of the licensed business. (7) The existence of any other situa- tion whereby individuals other than those listed in the original license application acquire a role in the management, operation or profit of the license." 2. Bergh, Acting City Cler e CITY OF RICHFIELD, MINNESOTA 40 Office of City Manager Council Letter No. 53 February 11, 1980 Agenda The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Approval of 1980 -1981 Labor Contract Agreement with Richfield Police Officers Federation Bargaining Unit The purpose of this council letter is to submit for city council consideration and action a new 1980 -81 labor contract agreement which has been negotiated between the City of Richfield and the Richfield Police Officers Federation. This agreement has been approved by the federation, but implementation of the agree- ment is subject to approval by the city council. The Richfield Police Officers Federation represents a total of 37 positions in the city service. This total amount includes 20 police officer positions, 8 investigator /agent positions and 4 dispatchers. The negotiated contract provides for a number of changes in 1980, but limits the 1981 negotiations to items related to salary and insurance. The major changes in the contract include: 1. Contract language changes mandated by amendments to the Public Employment Labor Relations Act (PELRA) a. Provided for the option of the selection of one arbitrator, rather than three, for grievance or interest arbitration if either party so desires. b. Provided for the inclusion of disciplinary actions involving suspension or discharge as grievable actions. 2. Allow senior qualified employees to have preference in bidding for shifts provided job qualifications are equal. 3. Established a maximum amount of vacation leave that could be carried forward from one year to the next, at 240 hours. This change has the net effect of reducing the maximum allowable vacation that can be forward from year to year. 11 Council Letter No. 53 -2- February 11, 1980 4. Converted vacation accruals from days per year to hours per year for the sake of clarification. 5. Established an hourly limit on the number of holiday hours that could be accrued. 6. Established the maximum employer contribution for health insurance coverage at $83 per month for 1980, compared to a maximum of $76 per month employer contribution in 1979. (This will be reopen for negotiation in 1981.) 7. Increased-the maximum clothing allowance for police officers from $215 a year to $250 for 1980 -81 per year which is consistent with other police contracts. 8. For the first time, established the public safety dispatcher clothing allowance at a rate less than police officers. The employer contribution of $215 for 1980 -81 for public safety dispatchers remains unchanged from 1979. 9. Inserted an article items covered by the negotiatab'le as long remain in effect. 10. Wages in the contract stating that civil service rules are non - as the civil service rules a. Expanded the pay range for police officers hired after January 1, 1980. Officers hired after that date will recieve 75% (rather than 82 %) of the maximum rate of pay, with a four year progression to the maximum. Expansion of the pay range means that the city will pay a police officer hired after January 1, 1980 $2,928 less than a police officer hired before that date, over the four years it takes an officer to move from the entry - level step to the top step of the police officer pay scale. The top rate of pay for police officer is $1747 per month, which represents an 8.1% adjustment over 1979. b. Established a pay rate of $1873 per month for an investigator agent at top step. This increase represents an 8.1% adjustment over 1979. C. Expanded the pay range of new public safety dis- patchers so that the first step is 74% of maximum, rather than the current 79% of maximum. The top Council Letter No. 53 -3- February 11, 1980 step of this pay range (for employees with ten years of service) has also been eliminated. These changes in the pay range mean that the city will pay a dispatcher hired after January 1,.1980 (at 1980 pay rates) $1,644 less than a dispatcher hired before January 1, 1980 over the five years that the employee would take to reach the top step of the new pay range. If that dispatcher worked for the city for more than ten years, the annual city cost for that employee would be $2,112 less, since the additional pay step increase at ten years has been eliminated. The pay increase for dispatchers represents an 80 adjustment over 1979. d. The wage rates will be reopened for negotiation in 1 981 . It is recommended that the city council adopt the following two resolutions providing for implementation of this agreement: 1. A resolution approving this labor agreement for the years 1980 -81. 2. A resolution authorizing a transfer of $65,553 from the contingency fund to cover the 1980 costs of .. implementing this contract. COMMISSIONS. 12.23 ESTABLISHMENT OF HUMAN RIGHTS COMMISSION.. Subdivision 1. Scope of Section. It is hereby declared that it is the public policy of this city to fulfill its responsibilities as a partner of the State Department of Human Rights in securing for all citizens equal opportunity in housing, employment, public accommodations, public services and education, and to fully implement those goals set forth in Minnesota Statutes, Section 363.12, Subdivision 1, the Minnesota Human Rights Act. Subd. 2. Establishment of Commission. There is hereby established within-the City a Human Rights Commission. Subd. 3. Purpose of Commission. The purpose of the commission is to secure for all citizens equal opportunity in employment,-housing, public accommodations, public services and education and full participation in the affairs of this community and to take appropriate action consistent with the Minnesota Human Rights Act. The commission shall also advise the city council on long range programs to improve human relations in the City. Subd. 4. Composition of the Commission. The commission shall consist of 10 members to be appointed by the council. Members of the commission shall be appointed for terms of three (3) years, except that (1) any person appointed to fill a vacancy occurring prior to the expiration of the term for which his predecessor was appointed shall be appointed only for the remainder of such and (2) any person appointed as a "youth" member of the commission who is a high school student shall be appointed only for the remainder of any un- expired term for which he was appointed, or until he is graduated from high school, whichever occurs first. Upon the expiration of his term of office a member shall continue to serve until his successor is appointed and shall have qualified. The members of the commission shall serve without compensation and may be removed from office at any time by the council, after a public hearing if a hearing is requested by the member whose removal is being considered.' In addition, Mr. Gregg Njoes (Richfield Flowers), chairman of the Clean - Up Week Committee, was also in attendance with Don Fondrick, Director of Community Services. Mr. Little has been the chair- man of the Clean -Up Week in previous years here in the City of Richfield. The Richfield Chamber of Commerce is desirous of continuing the Spring Clean -Up Week program due to the positive public relations which is engendered both in the business community and city government. They share the city's concerns about the cost of the Clean -Up Week and its rapidly escalating activity over the past ten years. As a result, an option to the street by street clean up program used in 1979, was discussed and decided to be recomm- ended both to the Chamber of Commerce and the city council. Richfield Clean -Up Week would be suggested for the week of May 5 -10, 1980. The city's activity in the clean -up would be aimed mainly at a clean -up day on Saturday, May 10. On that day city crews would accept all refuse which would be brought to a central location at Legion Lake. The clean -up week committee would encourage clean -up during the entire week, leading up to the actual city involvement on Saturday. The dumping at Legion Lake in the ice arena parking lot, would be from 9:00 a.m. to 3:00 p.m., with the closing to be coordinated with the dump closings by the Mississippi River. The city would provide labor, vehicles and dumping fees to the program for that specific day. In addition there will be limitations similar to last year on what will be accepted at the dump site. No trees, building materials, cars or other materials of that nature will be accepted. Council Letter No. 51 -2- February 11, 1980 0 The dumping will be limited to pick -ups and automobile type traffic. The Clean -Up Week will be advertised in the Richfield Sun, our quarterly newsletter publication, and leaflets distributed in the community. It appears that the Clean -Up Week as outlined above would be a good compromise situation to move the expenditures for clean -up back into the nature of $5,000 or less. This is a program which the city could engage in on an annual basis without severely adjust- ing our budget situation. It includes both a level of.activity on the part of the citizens to .clean -up their property and make sure that it is taken to one central location, as well as a commitment on the part of the city to dispose of the property from there. With this type of program, Clear -Up Week could continue to be an annual program here in the city with the resultant positive results. I would recommend that the city council pass the enclosed proclama- tion declaring .. Clean -Up Week and authorize the city staff to engage in necessary activities to facilitate it. Mr. Bill Little, President of the Chamber of Commerce, will be present at the February 11, 1980 meeting to discuss this matter with the city council. Pntie e MARTR CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 50 Agenda February 11, 1980 The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Award of Contract - Motor Pool Equipment The City of Richfield participates in a joint purchasing agreement with numerous other municipalities and jurisdictions in Hennepin County. The advertising for bids for various vehicular and motor equipment has been conducted by Hennepin County, who has determined the lowest bid be from a responsible bidder and awarded contracts accordingly. Now each individual municipality included in the joint purchasing agreement must award contracts for those pieces of equipment they wish to purchase. • It is recommended that the city council award the following contracts: 1. The purchase of two 27,500 GVW trucks for use in our street division. The low bidder was Iten Chevrolet, at a unit cost of $19,281. The total award of this contract item is $38,562. 0 These are replacements for a 1968 Chevrolet truck and a 1970 Ford dump truck that are fully depreciated and scheduled for re- placement in 1980. The depreciated vehicles will be sold after the replacement vehicles are.received either by auction with Hennepin County or by receiving sealed bids, whichever appears to be of more benefit to the city.
