Subject: Request for Authorization to Amend Richfield
Housing Fund Guidelines and to Execute
Contract Agreement
The Richfield Housing and Redevelopment Authority has admin-
istered the Minnesota Housing Finance Agency's Rehabilitation Grant
Program in Richfield since 1976. To date, 41 grants from this pro-
gram have been disbursed to finance $88,763 in rehabilitation work
on local homes. This program provides up to $5,000 to low-income
homewor~ers to undertake energy-and-code-related home repairs. To
qualify, the annual income of the homeowner must adjust to less
than $5,000, and total assets must be less than $25,000.
During the last funding cycle (1978-79) the HRA participated
in the M.H.F.A. program through Hennepin County. The original con-
tract provided $31,734 to Richfield for disbursement. Since we had
distributed all of these funds, and the county still had funds re-
maining, Richfield received an additional $24,208. By the end of
the 1978-79 Program Year (III), Richfield will have disbursed $55,942.
Hennepin County has received an allocation from the M.HoF.A.
for next year in the same amount as last year, and is proposing to
disburse the funds according to the same formula. Therefore,
Richfield will again receive $3"I ,734 in grant funds for 1979-800
plus X1,024 in administrative funds. There is a possibility that the
Richfield HRA could receive an additional disbursement if excess
funds are available as in the past.
There have been some administrative changes in the grant program
which mean that some provisions of Richfield's administrative guide-
lines do not conform to the M.H.F.A. guidelines. In order to con-
tinue our participation in the program, it is necessary to make
the following changes in our administrative guidelines, a copy of
which is attached:
1. On page 4, Ownership, delete "Minimum occupancy of
ninety (9U) days for fee owners and twelve (12)
months for contract for deed purchasers is required."
2. Also on page 4, delete "c. Age of Pro erty"

3. On page 6, delete "b. Aqe of House". Ranking priority
may not be based on the age of the structure.
4. Also on page 6, delete "c. Neighborhood Suitability"
Ranking priority may not be based on visual appear-
ance.
5. On page 7, "g. Emergency Fundinq~' must be changed to
read:
Applicants requesting any repair which places them
in a situation of imminent danger shall receive highest
priority for the repair of that item. Examples of
items which cause a situation of imminent danger would
be: inoperable plumbing, leaking roof, hazardous furn-
ace. Any applicant requesting emergency funds would
receive sufficient funds from the Community Development
Block Grant Rehabilitiation funds to repair the critical
item. He would then be assigned points according to
his remaining work and be placed on the waiting list.
However, if he received a rehabilitation grant from
the Community Development Block Grant within five years
of the date of the emergency grant., his rehabilitation
grant and emergency grant would be considered as one
grant and could not total more than $5,000.
It is recommended that the HRA take the following actions:
1. Approve the described amendments in the Richfield
Housing Fund Administrative Guidelines;
2.. Authorize execution of a contract agreement with
Hennepin County to receive $32,758 in rehabilitiation
funds for 1979-1980.

THIS AGREEI4I13NT between the COUNTY OF HENNEPIN, hereinafter .
referred to as the "COUNTY", and the HOUSING AND REDEVELOP;IfENT
AUTHORITY OF RICHFIELD, MINNESOTA hereinafter referred to as the
"AUTHORITY";
W I T N E S S E T H:
WHEREAS, the COUNTY intends to undertake a program for
the disbursement of grants to improve residential proberty for
eligible families and individuals within the County; and
WHEREAS, the COUNTY has entered into an agreement with
the Minnesota Housing Finance Agency (A~IHFA) to act as an admini-
stering entity for the .utilization and disbursement of such grant
. funds pursuant to applicable statute; and

assist such individuals and families to improve their housing in
the City of Richfield
WHEREAS, the COUNTY desires to purchase certain necessary

ing out the program;
NOW, THEREFORE, in consideration of the mutual covenants
and promises contained herein, the parties agree as follows:
1. The COUNTY shall allocate grant funds in the aggregate sum of

(32,758.00) for the utilization by the AUTHORITY in accordance
with the provisions of this Agreement.
2. The AUTIORITY will apply to the COUNTY and the COUNTY will gr:lnt
• to the AUTIORITY up to, but not in etcess of, 3.1259 per cent of
the grant funds allocated to it, which amounts to X1,024.00, to
defray the cost of administering tiie grant program and providing
technical assistance to grant recipients. Thus, the amount of
funds actually available foi• home improvements is at least
$31,734.00.

3. The AUTHORITY agrees that in all aspects of carrying out the
rehabilitation grant program, it will comply with the provi-
sions of this Agreement and regulations set forth in the MHFA
Home Improvement Grant Program Procedural Guides, Year IV
(PROCEDURAL GUIDES), Appendix A attached hereto and hereby
incorporated as a part of this Agreement.
For the purpose of this Agreement, requirements, duties, obli-
gations and warranties of an ''administrative entity" established
by the aforesaid Procedural Guides shall constitute requirements
and duties of the AUTHORITY. Obligations and warranties of an
"administrative entity" to•the MHFA created by said Procedural
Guides shall constitute obligations and warranties of the
AUTHORITY to both the COUNTY and the MHFA,
4. The AUTHORITY shall promptly and diligently utilize the grant
funds allocated to it and shall utilize all grant funds allo-
cated to it by August 31, 1980. Funds not utilized by the
date of the last disbursement of funds with respect to all
approved grant applications shall be returned to MHFA.
5. The AUTHORITY shall commence to make grants complying with the
terms hereof from and after the date on which this Agreement
becomes effective by providing publicity about the program and
technical assistance to grant recipients in complying with the
terms and conditions of said Procedural Guides.
6. The COUNTY shall use its best efforts promptly and diligently
to provide training to AUTHORITY staff on procedures and tech-
niques for administering and providing technical assistance
to grant recipients and shall disburse grant funds allocated
to the AUTHORITY according to the terms and conditions of the.
Procedural Guides.
?. The COUNTY shall reimburse the AUTIORITY for the costs of admin-
istering and providing technical assistance to grant recipients
up to a maximum allowable pursuant to Paragraph 2 of this Agree-
ment. Such reimbursement shall be made upon request of the
AUTHORITY upon execution of this A#;reement and after ocle-half
all grant funds have been cocnrnitted. The AUTHORITY agrees to
provide itemized documentation as to the nature of the expendi-
tures.

8. This Agreement may be terminated at any time by either party
• upon ten (10) days prior written notice to the other party.
# In the event of such termination, the COUNTY shall thereafter
disburse grant funds with respect to all individual grant
applications which, prior to the effective date of said notice
of termination, shall have received MHFA approval and authori-
zation to commence work and each party shall be required to

carry out the terms of the Agreement with respect to each of

the COUNTY shall reimburse the AUTHORITY for costs expended

Subject: Request for Authorization to Purchase Property
On March 12, 1979, the Housing and Redevelopment Authority
established just compensation for the acquisition of eight__s~b-
standard residential properties. At this time, the staff is re-
questing authorization to purchase four of these__properties, The
other property owners were not interested in selling at the estab-
lished just compensation.
Purchase of the four properties is to be financed with the
Bonus Community Devel..opment. Block Grant of $ ~~ 62 , 50U from the U o S .
Departr~ieiit of Housing and Urban Development. This- grant is for
the New Home/Scattered Site Program. Under this program, the
four houses will be acquired, the occupants relocated, and the
houses demolished. The vacant lots, along with the lot at 7104
Second Avenue, will be sold to the developer for the construction
of five, single family rental homes for large, low-to-moderate
income families. One of the homes will also be accessible for the
handicapped.
Following is a description of each of the four properties
proposed for purchase. Since each of the four property owners
has signed an option-to-purchase with the developer, David Ames,
it will be necessary for the HRA to enter into a developer's
agreement with David Ames, Inc. in order that the purchase agree-
ments with each property owner may be executed.
1.,.~ 11 East 68th Street is owned by Mr. and Mrs. Leo
Boucher. Mr. and Mrs. Boucher are interested in
selling since they can no longer maintain the home.
They have also been accepted into the senior citizen
housing complex at 82nd and Knox in anticipation of
the HRA's purchase of their property. Just compen-
sation for this property was established at $26,500.
A purchase agreement has been signed by the owners
for that amount.
2. 6916 Queen Avenue is owned by Mr. and Mrs. Herman
L. Petrofska. This house is located at the rear of

and Mr. Tanner has signed a purchase agreement for that
amount.
It is recommended that the HRA authorize the purchase of

Subject: Request for Authorization to Sell Properties
In separate actions, the staff is requesting HRA authorization
to purchase four substandard homes in furtherance of the New Home/
Scattered Site Program, and to execute a developer's agreement
with Mr. David Ames. The third action necessary for the program
to proceed is the resale of the five properties to be included in
the program to the developer.
The five lots to be resold are as follows:
1. 11 East 68th Street
2. 6916- Queen Avenue
3. 7504 Colfax Avenue
4. 6530 Bloomington Avenue
5. 7104 Second Avenue
The property at 7104 Second Avenue is already owned by the HRA
and was purchased as part of the New Home Program. The remaining
four properties will be acquired as soon as possible. The lots
will not be resold to the developer until the property owners have
been relocated and the site has been cleared.
Mr. David Ames has proposed, and the HRA accepted in concept, to
pay ~50u toward the purchase of each lot, or an aggregate sum of
$2,500 for the five lots, and to build a low income rental home on
each lot. The estimated market value of each lot, according to
O.J. Janski's appraisal is:
1. $14,000 - 1"I East 68th Street
2. $12,750 - 6916 Queen Avenue
3. $13,750 -7504 Colfax Avenue
4. $15,000 - 6530 Bloomington Avenue
5. ~15,OOU - 7104 Second Avenue
While the offered purchase price for each lot is below the market
value, it is necessary for the HRA to write-down the cost to ensure
the financial feasibility of the New Home Project. This also allows
the developer to invest any additional money in property improvements.
David Ames is planning to construct homes on the lots which will be

valued at approximately $70,u00 eacn, including the value of the
land.
The purchase of the lots is being funded by a Bonus Community
Development Block Grant. This grant can be used only for this
project, so any unused funds must be returned to the U. S. Depart-
ment of Housing and Urban Development. Investment of all funds
available to the developer directly in the property will increase
the property value and Richfield will be directly benefited, both
in improved visual appearance of the neighborhoods surrounding
these properties as well as through an increase in the tax base.
Minnesota Statutes require that a public hearing be held before
the disposition of public property. Legal notice was published in
the Richfield Sun on August 1, 19/9 for the August 1~, 1y79 public
hearing on disposition of these five properties.
It is recommended that the HRA adopt the attached resolution
authorizing resale of each of the five lots to David Ames, as they
become available, in the amount of $500.00 each. This resale is
contingent upon successful execution of the developer's agreement
with David Ames.

Developer's Agreement
On April 9, ~197y, the Housing and Redevelopment Authority
authorized Mr. David Ames to submit a final application to the
Minnesota Housing Finance Agency for funding to develop five,
single family rental units. The HRA also authorized the Execu-
tive Director to negotiate a developer's agreement with David
Ames. Since that time the following events have occurred:
1'. David Ames has received preliminary approval of the
project from the Minnesota Housing Finance Agency;
2. Mr. Ames has received a commitment from the UaS.
Department of Housing and Urban Development to
subsidize the rent of five, single family units
under the Section 8 Construction Program;
3. David Ames has received options to purchase four of
the five properties to be included in the program;
4. The Richfield HRA has received a Bonus Community
Development Block Grant for the purchase of four,
substandard properties;
5. The HRA will be requesting on August 13, 19/9, author-
ization to purchase four substandard properties to be
included in this program.
Negotiations for a developer's agreement have been completed
and a copy of the proposed agreement is attached. In summary, the
agreement includes the following provisions:
1. The developer now holds options-to-purchase on each
of the four properties to be acquired;
2. The HRA will re-sell the five properties to the
developer for development;
3. The HRA will pay acquisition and relocation costs
to the property owners as well as demolition costs,

and will convey the cleared sites to the developer
in accordance with certain standards, which are
detailed in the agreement.
4. The developer shall receive financing from the
Minnesota Housing Finance Agency to construct
three and four bedroom, single family units to be
rented to large, low-to-moderate income families.
He will also receive a Section 8 set-aside from the
U.S. Department of Housing and Urban Development for
rent assistance.
5. If such financing is unavailable, the developer will
sell the houses under the Federal Housing Administra-
tion's 235 Program to large, low-to-moderate income
families.
The developer's preliminary plans provide that three of the
houses will have four bedrooms, two houses will have three bedrooms.
One of the three bedroom houses will be accessible for the handi-
capped.
It is recommended that the HRA authorize the Chairman and the
Executive Director to execute the developer's agreement with Mr.
David Ames.

Dear Mayor and Authority Members:
Attached are three sets of plans which will become part of
the Redevelopment Contract for the development of five single
family homes comprising Red Rox Run I. To date, the project has
proceeded very well, receiving support not only from your City
but also from the Metropolitan Council, Minnesota Housing Finance
Agency and Department of Housing and Urban Development of the
United States.
In addition to the grant of $162,500 received from HUD for
the land purchase, the Minnesota Housing Finance Agency is making
available a grant of up to $5,000 to apply toward the construction
costs of every four bedroom home that we build.
HUD has already allocated the project units for rental
assistance and. the Minnesota Housing Finance Agency has approved
our plans as attached. A firm commitment from the Agency is
anticipated in early September with an initial closing and con-
struction start in October.
Due to the land cost of $500 per lot (possible because of
the HUD grant) and the grant from the Minnesota Housing Finance
Agency, we are able to build an attractive home as the front
elevations of the plans demonstrate. Costs for each of the
homes are in excess of $50,000.
One of the reasons the project has received as much support
as it has is that the project represents a pilot program; single
family homes have not been built in conjunction with the Section
8 rental assistance program. Thus Red Fox Fun I is providing the
pattern for developments of this type in the future. Based upon
conversations I have had with other housing and redevelopment
authorities, other cities will be following Richfield in develop-
ments of this type of housing.

AND AUTHORIZING ITS RESALE PURSUANT

WHEREAS, the Housing and Redevelopment Authority has authorized
David Ames and Robert Dippen as developers for the New Home Scattered-
Site Program; and
WIiEREAS, the Executive Director has been authorized to negotiate
a developer's agreement with David Ames and Robert Dippen in furtherance
of the New Home Program heretofore adopted by the City of Richfield
and the Housing and Redevelopment Authority of the City of Richfield;
and
WHEREAS, the Executive Director has now presented a proposed
Developer's Agreement between the Housing and Redevelopment Authority
of Richfield, P~innesota, and the Ames Corporation which agreement
achieves the goals of the New Home Scattered-Site Program; and
WHEREAS, in furtherance of its intention to provide suitable

Subject: Modification to Developer's Agreement With
Financial Properties Developers, Inc., Related
to Taxes Due and Payable, 1979
The HRA attorney and the Planning and Redevelopment director
havebeen negotiating with Financial Properties Developers, Inc.,
to modify the provision in the Developer's Agreement which requires
that the HRA pay all of the real estate taxes payable in 1979 for
the K-Mart site. The 1979 tax due for that property is approximately
$56,526.82.
As a result of the negotiations, Financial Properties Devel-
opers, Inc. have agreed to pay $29,384.85 of the taxes due. This
figure is based upon the tax attributable to the land within the
area which the HRA sold to Financial Properties. This tax payment
by the developer represents a reduction in the HRA's tax obligation
from $56,526.82 to $27,241.97.
It is recommended that the Housing and Redevelopment Authority
approve this modification in the developer's agreement and authorize
the Executive Director to pay Financial Properties Developers
$27,241.97 in full settlement of the HRA's 1979 real estate tax
obligation related to the K-Mart property.

Subject: Minutes, Tabulation of Bids, Demolition and
Site Clearance for New Home/Scattered Site Program
The Executive Director of the HRA opened bids for demolition
of four homes to be purchased for the New Home Program/Scattered
Site Program on July 30, 1979, in accordance with previous HRA.
authorization. The Planning and Redevelopment Director, Relocation
Specialist, Acting Public Works Director, and City Clerk Secretary
were also present at this bid opening. A copy of the bid minutes
and tabulation is attached for HRA review.
The following sites are to be cleared under this contract:
11 East 68th Street, 6916 Queen Avenue South, 7504 Colfax Avenue
South, and 6530 Bloomington Avenue South. Each site will be cleared
as soon as the HRA acquisition and relocation of~the existing property
owners is completed. The cost of demolition of these properties will
be paid from the Bonus Community Development Block Grant.
One bid was received for this work, from Minnesota Lumber and
Wrecking Corporation. The gross bid amount is $11,650, with a $400
salvage credit allowed, making the total demolition bid equal to
$11,250. This bid is within the $12,000 budget for the demolition
costs for the New Home%Scattered Site Program.
It is recommended that the HRA authorize award of the contract
for the New Home/Scatter Site Program demolition to Minnesota Lumber
and Wrecking Corporation, in the total amount of $11,250.
