A copy of that agreement was distributed at the November 18, 1974. HRA meeting, and discussed at that time. The agreement of which a copy is attached would providethe City of Richfield with the following services: 1. Assist in the preparation of a .Richfield Housing Assistance Plan 2. Assist in the preparation of a grant application. 3. Assist in implementing housing assistance program 4. Assist the staff in working wish citizen groups, city commissions, and the Richfield HRA. These services would be provided by the staff of the Metropolitan Council on anon-continuous basis for a maximum of $6, 000. It is recommended that the proposed agreement be approved and that the Chairman and. Executive Director be authorized to execute-the agreement. RICHFIELD TECHNICAL ASSISTANCE AGREEMENT This Agreement, entered into as of this, the day of by the Richfield Housing and Redevelopment .Authority hereinafter referred to as. the RHRA), and the Metropolitan Council (hereinafter referred. to as the Council), WITNESSETH WHEREAS, the City of Richfield and the Richfield Housing and Redevelopment Authority desire the provision of certain technical assistance services in organizing and establishing a housing assistance program, and WHEREAS, the RHRA desires that the Council through its staff provide such assistance, and WHEREAS, the Council is authorized to provide such assistance pursuant to Session LAWS of 1974, ,Chapter 359, Section 3., Subdivision 2, NOW, THEREFORE in consideration of the mutual covenents.and promises contained herein, the parties agree as follows: I: SCOPE OF SERVICES: The. RHRA agrees to engage the Council and the Council hereby. agrees to do, perform and carry out in a satisfactory and proper manner as deter- mined by the Executive Director and in general accord with the attached work. • program,. the following tasks and. services: A. Assistance in the preparation of a Housing Assistance Plan, including: 1. draft outline and detail format for a Richfield Housing Assistance Plan; 2. provision and analysis of census data, other published statistics and data provided by the RHRA as necessary to identify housing needs in the. community in relation to metropolitan area needs; 3. specific advice and assistance on methods and programs for meeting housing needs, involving citizens and clients and implementation strategies. B. Assistance in preparation of Application for Housing Program Funds to .the Department of Housing and Urban Development (HUD) and other appropriate federal and state agencies, including: 1. .preparation of necessary forms and supporting documentation as required by HUD; 2. presentation before HUD outlining provisions of the Application, and assistance to the Executive Director for presentations to citizen groups, Planning Commission, the RHRA and City Council. C. Assistance in implementing Housing Assistance Program after HUD approval, including: -2- 1. assistance in preparing management policies, plan and programs; IL. 2. assistance in developing and securing leasing agreements; 3. assistance in preparing annual contributions contract budget; 4. assistance, if necessary, in developing contractual arrangements arith a housing developer. A. The RHRA agrees to pay, subject to provisions of Section III of this agree - ment, the Council an amount not to exceed $6,000 for provision of the above services and assistance. The maximum $6,000 payment. is based on the RHRA agreeing-to pay $15.00 per hour for each hour of Council staff member time devoted to this project and to reimburse the Council for its staff member's actual costs and expenses, including among others,. printing, duplicating and travel., incurred in the provision of project services and in accord with Cauneil paliey. However, pay~Sent does not include time spent or material costs. incurred in gathering information which is generally avail- able to other municipalities. D. Assistance. to the Executive Director in presentations of Pland and Program before the citizen. groups, City Council and-HUD Area Office during planning, application preparation, and implementation periods of the process... COMPENSATION: METHOD OF PAYMENT B. Within ten (10) days following the end of each month of performance, the. Council shall submit to the RHRA a statement detailing staff hours devoted- . to the project and costs .and expenses incurred in connection therewith. On the RHRA Executive Director's verification and acceptance of the above statements.,- the RHRA agrees to pay the Council 100% of each stated amount. III. GENERAL PROVISIONS A. Time of Performance. The Council shall commence the technical assistance services on the execution of this Agreement and shall complete such services on or before the following: 1. Housing Assistance Plan: February 1, 1975, or as needed relative to HUD deadlines; 2. Housing Program Application: March 1, 1975, or as needed relative to HUD deadlines; 3. Implementation Assistance: June 1, 1975,- or as needed relative to HUD. deadlines. B. Audits and Inspection. The Council agrees to: 1. keep and maintain during the performance of this agreement and for a period of one (1) year following its completion, records and files relating to: a. the financial aspects of this agreement including payrolls, time records, statements, receipts and vouchers, and • • b. the services per-Pormeu hereunder; -3- 2. allow the City of Richfield,. the RHRA or designated City, federal or state personnel to enter on Council's permises and to: a. inspect, copy-and audit the above records and files, and b. inspect and review equal employment opportunity and affirmative act?on programs of the Council. C. Changes.. The terms of this agreement may be changed or modified. by mutua l agreement of the parties hereto. Such changes or modifications shall be effective only on the execution of written amendment(s) signed by the Council and the RHRA. D. Termination of Agreement. The RHRA and the Council shall have the right to terminate this agreement at any time by submitting written notice of the intention to do so to the other party at least thirty (30) days prior to the specified effective date of termination. On the. termination of this agreement, all finished. and unfinished documents, and work papers. prepared by the Council pursuant to this. agreement shall, at the option of the City or the RHRA, become the RHRA's property, and the Council will be paid for services performed up to the date of the agreement termination on the basis set forth in Section II above. It is further understood and agreed that the. RHRA Executive Director will review the progress and content of each phase (A, B, C, Section I) and' that. the suceeding phase will not be started until approval is-given by the Executive Director. • E. Affirmative Action Clause. 1. .Council- agrees to submit a signed statement signifying that the Council fully intends to comply with the standards of equal employment and anti- .discrimination as cited in .the Civil Rights Act of 1964 as amended in 1972 by the Equal Employment Opportunity Act, said statement to be submitted on a form provided by the City of Richfield. 2. Council agrees to submit a completed Equal Employment Opportunity Report as required by the City's affirmative action program. 3. In accordance with the City's affirmative action policy, no person shall, on the ground of race, creed, color,~sex, age,. disability, or national origin be excluded from full employment rights in, participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program, service, or activity for which the parties received, or will receive financial assistance under the provision of any and all applicable federal and state laws against .discrimination. The Council will furnish all information and reports required by the City or Executive Order number 11246, and Revised Order number 4, and by the rules and regulations and, orders of the Secretary of Labor or the State of Minnesota for purposes of investigation to ascertain compliance with such rules, regulations, and orders. 4. 1972 Minnesota Statutes 181.59 is made a part of this. agreement with .the same force and effect as if it were here set forth verbatim. -4- IN 6dITNESS WHEREOF, the parties_ hereto have caused this Agreement to be executed. by their duly authorized representatives on this day and year first above written.
