The specialized pay plan for the City of Richfield provides for com- pensation for avast number of positions in the Community Services Department and positions in the Public Safety Department, and one position in the liquor operation. U~hile there is only position in the liquor operation, the vast majority of the personnel which we have in liquor operations are part time, so there are very many persons who occupy that one classification. The city has approx- imately 35d employees who work on a seasonal and part time basis, which is the equivalent of over 50 full time positions. The specialized pay-plan for 1981 has been redone slightly similar to the reclassification effort done for the city's full time pay plan. The pay plan is attached to this memorandum for council consideration. The cost of the pay plan in 1981 over the 1980 costs are 9.5 percent. This is the same net increase which the city utilized in the general services and management area. Funds are budgeted in the contingency budget to provide for this increase. In the event the city council approves this resolution, a resolution transferring monies from the contingency account to the Community Services and Public Safety budgets will be presented at the January 26, 1981 city council meeting. RESOLUTION RELATING TO THE 1981 SPECIALIZED PAY PLAN WHEREAS, Section 2.33 of the Ordinance Code of the City of Richfield provides that the assignment of classes to pay grades, the number of steps in each grade, the bi-weekly rates in each grade, the method of normal progression through the pay grade and the work week in hours for each class be established by council resolution; and WHEREAS, the city administration has prepared a 1981 pay plan for the positions for which there are no essentially similar position classifications in other regular pay plans. A discussion of this item has been placed on the January 12, 1981 city council agenda. Advisory Board of Health The by-laws of the Advisory Board of Health stipulate that if a member misses three consecutive meetings in one year with- out an excuse, the advisory board may request the city council to appoint a replacement. During 1980, the Advisory Board of Health held five meet- ings. Two members were absent twice, and one member was absent once. The remaining members attended every meeting. Civil Service Commission The Civil Service Commission met three times during 1980. One member was absent for two of these meetings. However, that member no longer resides in the City of Richfield and has been replaced by a new member. The remaining members attended each meeting. Energy Conunission - Neither the by-laws or the resolution establishing the commission address commission member attendance. During 1980 the Energy Commission met 6 times. Two members were absent twice, and three members were absent once. Human Rights Commission The by-laws of the commission stipulate that if a member misses three consecutive, or 1/4 of the meetings in any 12 month period, the commission may request the city council to replace that member. Council Letter No. 20 -2- January 12, 1981 During 1980, the commission held 12 meetings. One member had three excused absences, one member had two excused absences, and one member had one excused absences. The remaining members attended every meeting. An "excused" absence indicates that the member had a good reason and notified the commission before the meeting of the anticipated absence. Park and Recreation Advisory Commission The resolution establishing this commission stipulates that failure to attend three consecutive meetings of the commission without written permission of the commission to be excused, may be reason for that member to be replaced by the city council. The Park and Recreation Advisory Commission held ten meet- ings during 1980. Oise member was absent 7 times, one member twice, and two members were each absent one time. The remaining members attended every meeting. Planning Commission The by-laws stipulate that a member may be replaced for missing three consecutive meetings of the commission. During 1980 the mission held 17 meetings. One member was absent six times, one. member three times, and two members missed two meetings each. The remaining members attended every meeting. Senior Citizens~andica~ped Commission The resolution establishing this commission stipulates that failure to attend three consecutive meetings of the commission may be reason for that member to be replaced by the city council. During 1980, the commission met nine times. OrYe member was absent four times, one member three times, one member twice, and two members were absent one time each. Summary As can be noted, most of the by-laws or resolutions estab- lishing the various boards and commissions do have provisions for replacing members with poor attendance records. Meeting attendance by commission members seemed to be very good for the most part, with only-three exceptions. One member of the dark and Recreation Advisory Commission was absent for 70 per- cent of the meetings; one planning commissioner missed 35 per- ,~ent of the meetings, and one member of the senior citizens;' l~:~ndicapped commission missed 44 percent of the meetings. I would like to point out to council members that the attendance records pertain only to those persons still on city t commissions, and does not include any persons whose terms ex- pired in 1981, or who resigned during 1980. Council Letter No. 20 -3- January 12, 1981 If council members are desirous of pursuing this matter, it would be my recommendation that the city council request each commission/board to include in their by-laws, the stipula- tion that commission members will attend at least 67 percent of all commission meetings within a 12-month period. It should also stipulate that the various boards and commissions are re- quired to report attendance records to the city council at the end of each year. The city council should also be notified immed- iately whenever a commission member falls below the 67 percent attendance requirement. Council Members: Subject: Resolution Amending 1980 Budget - There is an item on the January 12, 1981 city council agenda, providing for council consideration of a resolution which would amend the city's 1980 General Fund Budget. The City Charter pro- vides that the city council must appropriate monies for operations of the city on a department level basis. During the course of the year, the city council usually amends the operating budget at least once, in the form of approving a revised budget proposal in conjunction with approving the next year's proposed budget. How- ever, during the course of 1980, specialized circumstances arose which meant that in two activities of the city, 1980 expenditures exceeded the appropriations contained in the revised 1980 budget. These expenditures occurred in the Legal Department budget and the Other Agencies budget. The average in the Legal Department equalled $6,000, which is the cost of the legal services relating to the Cedar Industries lawsuit. The Other Agencies budget was also overspent by $6,000, which is entirely costs associated with the cable television fran- chising process. These costs will eventually be reimbursed to the city by the successful franchisee. .a It is recommended that the city council adopt the attached resolution, authorizing the transfer of appropriations from the Community Services Department budget to the Legal Department bud- get and the Other Agencies budget, as described. RESOLUTION AUTHORIZING REVISIONS OF 1980 BUDGET OF VARIOUS DEPARTMENTS WHEREAS, Resolution Number 6130 appropriated funds for personal services, and other expenses and capital outlays for each department of the City for the year 1980; and WHEREAS, the City Charter, Chapter 7, Section 7.09 gives the council authority to transfer unencumbered appropriation balances from one office, department or agency to another within .the ,same fund at~the request of the City Manager; and WHEREAS, the City Manager has requested a revision of the 1980 budget appropriations in accordance with Charter revisions. On the January 12, 1981 city .council agenda is an item providing for coun- - cil approval of the 1981 contract agreement which established pay rates for city employees covered by the Local 49 union contract. In order to finance provisions of these 1981 pay plans, it is nec- essary for the city council to formally transfer monies from the 1981 unappropriated contingency account to the specific operating departments of the city. Attached to this council letter is the appropriate resolution to provide for transfer from the contingency account to the de- partmental budgets of the necessary funds to implement the provi- sions of the 1981 pay plans which the city council has approved. It is recommended that the city council adopt the attached resolution, making these transfers from the contingency account for purposes of implementing 1981 salaries for municipal employees. The changes included in the contract are as follows: 1. Wa e - 80~ per hour increase for both years, for all fob classifications covered by the contract. This ranges from a 9.33% to a 9.85% increase in 1981, and an 8.54% to an 8.97% increase in 1982. 2. .Insurance - $10.00 increase in 1981 on the city's contribution for health and life insurance, bring- ing the maximum city contribution per month to $95., Additional $10 increase in city's contribu- tion for insurance purposes in 1982, bringing the maximum city contribution to $105 per month. In addition, in 1982, the bargaining unit will have the option= of applying the $10 increase in the city's contribution for insurance toward a dental health insurance program. This is something that the city will negotiate with the bargaining unit sometime closer to the implementation date. All other contract items are unchanged for 1981 and 1982. It is recommended that the city council approve execution of this contract agreement with Local 49, and authorize the city manager to implement the provisions of this contract. The necessary transfer of funds from the contingency account to the affected departments will be accomplished through the transfer resolution which will be presented to the council on January 12. There are two such items on the city council agenda of January 12, 1981. Vehicle The adopted 1981 budget includes an appropriation of $12,000 for a vehicle to provide transportation for programs offered through the Community Center. In searching for such a vehicle, a slightly used 1974 Cadette Mini-Van was located at Tillson Bus and Equipment Company. The Cadette Mini-Van is a small version of school bus and offers many features and program advantages: 1. It is a 22 passenger vehicle. The original budget proposal was for a maxi-van, which would be somewhat smaller, with capability of handling 15 passengers. Cooperative purchasing through Hennepin County indi- cates that a Dodge 15 passenger maxi-van would cost $10,000. 2. The majority of passengers can board the Cadette Mini-Van independently. With the present vehicle, as with the maxi-van, the driver must leave the driver's seat to open a side door and assist people into the vehicle with the aid of a foot stool and physical support. The Cadette Mini-Van has a door opener from the driver's seat, an adapted step and hand bars for easy entrance and standing room to walk to a seat. 3. The larger capacity vehicle will potentially offer transportation opportunities to more people, as well as potentially reducing route and planning time. Used vans are extremely difficult to find. The one available through Tillson Bus and Equipment Company has been examined by the city's mechanics and found tc be in good working order. New vans-are available from Tillson Bus and Equipment Company, which has a 1980 Cadette Mini-Van for $24;000. Minnesota Body and Equipment has a 1980, 22-24 passenger vehicle available for $26,000-$28,000. It is recommended that the city council approve the purchase of the 1974 Cadette Mini-Van from Tillson Bus and Equipment Company in the amount of $9,780. Ice Control Rock During the winter season, 600 ton of ice control rock is typi- cally used on city streets. Rock is heavier than sand and will, therefore, tend to stay where placed and provide better traction. It also means a lesser quantity will be used than with sand. 1~1ost vendors will have wash or ice control sand available, but only one vendor has been located that will provide the ice control rock. It is recommended that the city council approve the purchase of an estimated 600 ton of ice control rock on a master purchase order at a delivered unit price of $3.55 per ton, for a total estimated purchase price of $2,130. Notice of this public hearing was mailed to all owners of property in the area, and published in the official newspaper. If the estimate turns out to be ex- actly correct and all properties of the redevelopment area are as- sessed on a square footage basis, the assessment would be 1.07 per square foot. For example, the total K-Mart property would be assessed about $2,400, the former Clark Station, at 66th Street and Pillsbury Avenue, would be assessed about $260. I think it would be appropriate for the council to consider each of these license requests and the related investigative reports independently. One issue of general information regarding all three reports relates to the analysis of financial data required of the applicants. The purpose of obtaining this information is that state statute requires that the serving of food be a principle part of the busi- ness of a restaurant which has an on-sale liquor license. The city attorney has advised that "principle part of business" may be inter- preted to refer to percent of gross sales; but also to such things as amount of investment necessary to serve food compared to the serving of beverages, or the number of employees engaged in the preparations and serving of food compared with beverages, or the amount of space provided for the preparation and serving of food as compared with beverages. In short, the statute could be defined in a number of ways and in no way infers that the definition must be limited to a percent of gross retail sales. I believe the reports of the Public Safety Department cover all of the ordinance related issues with regard to the requests for license renewals. I concur with the findings of the Public Safety Director in the recommendations he has made. In summary, I recommend that the council take the following action with regard to the license requests: ~ The Godfather, Incorporated The requested license renewals be approved, and the licenses be issued. Of these criminal incidents a total of eighteen involved disorderly conduct related problems which the management of the business re- quested public safety .assistance in resolving.• While there has been a significant increase in reported public safety incidents at the business, it should be noted that this increase corresponds to a higher level of activity generally experienced by the Department of Public Safety during the past year. The increase in incidents also reflects a higher level of requests for service by the manage- ment of the establishment itself. In each instance in which a problem did occur, the establishment was very cooperative with the Department of Public Safety in attempting to resolve the matter. All of the incidents involved the business or customers as victims. There have been no ordinance violations which have been recorded against the Godfather, Inc., within the past year. The application for this license was submitted on behalf of the corporation by Mr. Marno McDermott, President and Treasurer, and Mr. William Max McGee, Vice-President and Secretary. All necessary information, including an accountant's statement of the gross liquor and food sales, surety bond, insurance certificate, political con- tributions statement, and license fees have been filed with the application. The present license's effectively expire December 31, 1980, but have been continued to January 12, 1981, by action taken by the city council on December 22, 1980. Both officers of the corporation who also wholly own all of the out- standing stock, are still maintaining permanent residence in the State of Arizona. Mr. McDermott does maintain a summer residence in Minnesota and both officers periodically travel to Minnesota to monitor the operation of their business establishment. The change in residence of officers occurred in 1979, and at the time the license hearing was conducted for the 1980 licenses the Public Safety Department reported that the move to Arizona did not appear to have any impact on the operation of the business. During the past year there have been several issues, which will be outlined in this memorandum, which have raised a concern about the level of ~S ;~ Left Guard,Inc. - 2 - January 6, 1981 monitoring currently provided by the owners. The Public Safety Department has verified that all of the insurance and bonding requirements have been met and are presently in force. Additionally, the Public Safety Department has verified that all federal, state, and local tax obligations have been met. During the past year, the Public Safety Department has responded to a total of ninety-four incidents. occurring at this establish- ment. This compares to only thirty-one incidents occurring daxring 1979. Of the ninety-four incidents reported, forty-three involved criminal matters, twenty-seven involved traffic related matters, and twenty-four involved miscellaneous service responses to the business. In analyzing this data, the thirty-one incidents reported during 1979 all involved criminal matters and this figure moss closely relates to the forty-three criminal incidents which occurred during the past year. There are two other areas which have developed during the past year involving public safety activity at the business which is of concern. The first of these relates to the twenty-seven traffic incidents re- ported during the past year. Most of these incidents involved gross violations of the fire lanes which have been established around the property. While a large number of tags have been issued for fire lane violations, the twenty-seven incidents reported in this report relate directly to major police actions, primarily involving the towing of violators automobiles to clear fire lanes. This problem ryas been particularly serious since there have been twp ;reported fires at the establishment during the past year. On one occasion during evening hours,. when a working fire occurred in the kitchen area, fire equipment could not reach the building because of the blocked fire lanes. This resulted. in a great delay in laying hose to the building to deal with the fire problem. Unfortunately, we have recieved something less than enthusiastic cooperation from the resident manager in assisting us to deal with this problem. In order to obtain compliance with orders by the Fire Division for adequate posting of fire lanes, the Public Safety Department in early 1980 notified the manager that license revocation proceedings would be initiated unless the required posting was completed. Following this process the fire lanes were posted as required, but the management has done little to assist the r:partment of Public Safety in prevent- ing customers from parking in these areas. The large number of requests for miscellaneous service to the business generally involves assisting customers who have inadvertantly locked their keys in their cars. In reviewing all of these incidents, it must be noted that a large number of the problems occur in the park- ing of area and not within the business itseiL. Of one forty-three criminal incidents reported, fifteen involved domestic assaults or disorderly conduct. The remainder of the criminal incidents involve a variety of miscellaneous matters, mostly involving damage or theft from automobiles. From the increase in problems which has occurred Left Guard, Inc. - 3 - January 6, 1981 during the past year, particularly in parking lot area, it does not appear that the business is maintaining the level of monitor- ing control in the parking lot area that has existed in the past. The reported incidents all involved customers or the business as victims. There have been no ordinance violations which have been recorded against either Chi- Chi's or Maximillians within the past year. During the past year, we have experienced a number of health related problems which are developing to a point of very real concern. In December of 1980, our food service inspection did notify the resident manager of numerous deficiencies with regard to the health codes. The manager has been given sixty days to correct these problems. The property is free from major violations of the uniform fire code. As a result of some internal structural renovations, we did order some modifications to the fire sprinkler system. These problems have now been corrected. Earlier in this report I did indicate a problem we were experiencing in attempting to maintain open fire lanes. This problem is of particular concern since the establishment has had .two reported fires during the past year. While the establishment does have an internal fire protection sprinkling system, which extin- guished or effectively controlled the fire problems until the arrival of the Public Safety Department, we are concerned about major house- keeping problems which contributed to these fire incidents. Again, we have not received the type of cooperation we would hope for from f Left Guard, Inc. - 4 - January 6, 1981 the resident manager in dealing with this potentially serious problem. We have found fire exits blocked on numerous occasions and large accumulations of combustible paper cartons scattered throughout the kitchen storage areas. While the problems have generally been corrected as a result of our inspection activity, we are becoming concerned about the fact that they seem to reoccur. Miscellaneous Info,-mation The applicant has filed the necessary political contribution declara- tion indicating that there were no such contributions made during the past year. The license applicant does not own the building or prop- erty upon which the business operates. The applicant is continuing to operate under the same lease arrangements which have existed in the past. The property owners have no interest in the business operation itself. The Howard Johnson Company is a Maryland corporation licensed to do business within the State of Minnesota. The corporation does business in Richfield under the name of the Ground Round Restaurant. The application for the license was submitted on behalf of the corporation by Mr. Walter W. Curcio, Vice-President of the parent corporation, the Howard Johnson Company. The city has received a current surety bond, insurance certificate, politi- cal contributions statement, and license fees have been filed with the application. The present license's effecti~~e1y expired on December 31, 1980, but have been continued to January 12, 1981, by action taken by the city council on December 22, 1980. Application Investigation It should be noted initially that business establishment has been operating in the City of Richfield for only 4z months. While the liquor license was originally approved by the city council on March 12, 1979, at the time the corporation pur- chased the property in our city for their r~~~~~sed restaurant business, the license was not actually issued until July 24, 1980, just prior to opening for business. The establishment formally initiated this business within our city on August 10, 1980. In accordance with city ordinance requirements, the Public Safety Director has initiated the investigation of information required by the Richfield City Ordinance Code 11.06 (Subd.4), which relates to the control of on-sale liquor estab- lishments. Prior to the issuance of the liquor license a comp- rehensive investigation was conducted by the Department of Public Safety. At that time, all pertinent affairs of the corporation were found to be in order. The Public Safety Department has :~ Ground Round Restaurant -- 2 - JanuarX 6~ 181 determined that there has been no ownership change in the corporation since they started business last fall, nor has the resident manager changed during this period of time. The Department of Public Safety has verified that all of the insurance and bonding requirements have been met and are presently in force. Additionally, the Publi,c.Safety Depart - ment has verified that all pertinent federal, state and local tax obligations have been met. During the 42 months the business has been in operation in our city there have been only five recorded requests for public safety service. They all involve criminal incidents. Four of the incidents involved requests by the business management to assist in dealing with disorderly patrons. This type of problem can certainly be anticipated based upon the nature of the business. Generally, we would anticipate a higher level of this type of incident from a new business of this nature than what we have actually experienced. The fifth incident did involve an arrest initiated by the Department of Public Safety for a minor who obtained liquor service at the restau^ rant. The manager was informed of the problem and has since made a responsible effort to prevent this type of a situation from occurring in the future. It is our opinion that this particular incident occurred because of a large- number of new employees working in a new restaurant establishment and the related confusion with initiating the business venture. We have scur~d the local management of this business establishment to be very cooperative and responsive to concerns raised by the Department of Public Safety. There have been no ordinance violations which have been recorded against the Ground Round Restaurant since the time it has opened for business. Accountant's Report The on-sale liquor ordinance requires that the applicant file with the city a statement by a certified public accountant which shows the gross sales and total food-sales of the preced- ing twelve month period. Since the establishment has not been in operation for a full twelve month period, we have requested the required financial statement for the period they have been licensed to do business within our community. The provision in the ordinance code requiring this financial data relates directly to the requirement in Chapter 11.06, Subd.l2(_15), whic}1 requires that, "a restaurant shall be conducted in such a manner that the principle part of the bus_nesa for a license year is the serving of foods". We have been informed that the corporate account- ant office located in Braintree, Massachusetts, is in the process of preparing the necessary statement. Chapter 11.06 (Subd. 7), of our city ordinance code specifically requires the statement by the certified public accountant, "at the earliest practicable time after application is made for a renewal of an on-sale license, and in any event prior to~the time that the application is approved by the council". Health and Safety Regulations Both the Health and Fire Divisions of the Department of Public Safety have been actively involved in the development of the related safety systems during the remodeling of the present structure prior to initiating business last August. There presently are no problems related to environmental health issues or issues related to the uniform fire code. The resident manager readily accepted suggestions made by the Department of Public Safety in both of these areas. Miscellaneous Information The applicant has filed the necessary political contribution declarations indicating that there were no such contributions made during the past 1-~ar. The license applicant does own the building and property upon which the business operates. The city assessor reports the following information concerning market value and taxes paid as appears on city records, based upon the most current information available. It should be noted that this information does not fully yet reflect the value of the property as it has presently been developed. However, based upon the provision in the ordinance code, as noted in the accountant's report section of this memoran- dum, the provision of a financial statement is mandatory, "prior to the time the application is approved by the council". There- fore, my recommendation would be that the council conduct the 5 Ground Round Restaurant - 4 - January 6, 1981 hearing as scheduled on January 12, 1981, receive any test- imony which may be presented, and continue the hearing on this particular license application until the regularly scheduled council meeting of January 26, 1981. I think that it is appropriate to point out that in all of the many dealings we have had with the parent corporation during the development stages of their business establishment in our community we have enjoyed a exceptionally cooperative relationship. The only handicapp that we have had encountered simply relates to the fact that the corporate headquarters, and all records relating to the local business establishment, are maintained at the corporate headquarters in Braintree, Massachusetts. The corporation is aware of our requirement of this financial statement prior to approving the requested 1981 license's. They have indicated that they would expedite the processing of this request. A public hearing has been scheduled for consideration of this matter as a part of the regular council meeting on January 12, 1.981. In my January 6, 1981 investigative report I noted that the city had not, at that time, received the accountant's statement required as a part of this license renewal consideration as specified i_n Richfield City Ordinance 11.06 (Subd. 7). I also noted .in the original investigative report that all other pertinent data had been submitted by the applicant and had been verified by the Department of Public Safety. Chapter 1]..06, Subd. 12 (15) of the Richfield City Ordinance Code requires that "a restaurant shall be conducted in such a manner that the principle part of the business for a license year is the serving of foods". This is the basis for the required statement by a certified public accountant showing the relationship of gross food sales and gross liquor sales as a percentage of the total sales of the establishment. On January 8, 1981 the Department of Public Safety did receive a financial statement from a certified public accountant employed by the applicant providing the required financial data for the period of August 17, 1980, when the restaurant first opened, through November 28, 1980. A copy of that report is attached to this memorandum for your con sider.ation. The financial statement reflects that the food sales amounted to 59.1° of gross sales. The .liquor sales for the period involved amounted to 40.90 of the gross sales for the accounting period involved. In my opinion, the financial statement appears to be in order and to meet all of the requirements set forth in our city ordinance code. The firm of Richard Schwartz/Neil Weber, Inc. were the architects used for the several phases of remodeling at the Community Center. This firm is very familiar with the building structure and programming of the Community Center. A tentative agreement has been drawn for architectural services for remodel- ing work, specifically the elevator, at the Richfield Community Center. This agreement would provide for the following: 1. Preliminary drawings and estimates of construction cost. 2. Construction documents. 3. Bidding period services. 4. Contract preparation and review. 5. Follow up inspections at six months and one year following completion. For these and related services, the contract amount would be $5,800. This lump sum fee is based on typical percentage rates used by most or all architectural firms. It provides the city with the advantage of knowing that fees for these services will be no more than $5,800, regardless of what contract bids might be or regardless of other variables in the project. The existing building houses, and its pro- posed replacement will house, used car sales offices. The proposed structure will be constructed of aluminum siding and will color match the existing buildings. The existing liquified petroleum gas tank and a portion of a sign will be removed. Three display parking spaces will also be removed in order to facilitate the new struc- ture. The property is zoned "C-2" general commercial. History In 1950, a commercial building permit was issued to construct a poultry building and offices on the property. In 1961, a com- mercial building permit was issued for the construction of a 207 square foot building to be used for car sales. In Council Letter NO. 10 -2- January 12, 1981 1964, the city council granted a variance to allow the construc- tion of an addition to the existing buildings. Various other building permits were issued over the years; however, no special use permits were obtained, and the use is thus non-conforming. Staff Findings Car Sales Lot: The staff reviewed the special use permit requirement allowing car sales lots, and found that the use is in general compliance with the regulations relating to car sales lots, and that the business has existed-for 20 years at this location. Also, historically, the applicant has acted to correct any prob- lems and to eliminate any detrimental effects this use may have posed to the public welfare. The use is in compliance with the off-street parking contract for this property. Proposed Building: The proposed 42.18' by 40.17' building to be used as a used car sales office is in substantial compliance with regulations related to car sales lots. The proposal neces- sitates that the existing LP gas tank be removed. The tank is in violation of fire codes and its removal will eliminate this viola- tion. The portion of the sign to be removed will not violate the sign permits issued for this property. The proposal will not ad- versely affect traffic circulation in the area, and sufficient parking exists on the site. On October 27, 1980 the city council adopted a schedule for construction of the sidewalk system, which includes an allocation in 1981 of $185,000. At that time, the council also initiated the first sidewalk construction project, for 1981 for 76th Street. At the public hearing for the 76th Street side- walk construction project on December 8, 1980, the council deleted the sidewalk on the south side of the street. This resulted in $115,250 of the 1981 sidewalk construction allocation being unencumbered. The Penn Avenue sidewalk is high on the priority list of side- walks to be constructed and it was, therefore, given additional consideration. The sections of Penn Avenue which currently do not have sidewalks are as follows: East Side: 62nd South approximately 300 feet 66th South to 67th West Side: 62nd South to 68th (except for two small sections) 70Z South to 76th The engineer's estimate indicates that the Penn Avenue sidewalk could be constructed in 1981 for about $92,000. The project would include both sidewalks and handicap ramps. Handicap ramps will be installed at all the intersections where no-ramps presently exist. The sidewalk one block north and south of 66th Street will be left out at this time, in anticipation of reconstruction of the Penn Avenue and 66th Street intersection in 1983 or 1984. Other possibilities for inclusion in the 1981 sidewalk pro- gram include Lyndale Avenue north of 64th Street and Xerxes Avenue (east side) north of 66th Street. Both of those projects are of high priority but have some special problems which will necessi- tate a greater amount of leadtime than Penn Avenue. In both cases, the city does not own adequate right-of-way to build a regular sidewalk. It will be necessary to acquire that right-of-way in order to proceed with a project. If we start the 1982 program this fall, adequate time can be given to resolve that problem. Council Letter 8 -2- Y. January 12, 1981 In addition to these arterial sidewalk construction projects, the city has $10,000 budgeted from special revenue funds for other sidewalk construction. I anticipate using those funds in 1981, with the city councils concurrence, to construct the sidewalk along the north edge of Nicollet Park from Stevens Avenue to Nicollet Avenue and to provide sidewalk access from Grand Avenue and Harriet Avenue across Little Bob's Park to 67th Street. Both of these projects have been requested by the citizens in these areas, and the council members for a period of time. . It is proposed that the same assessment policy as established for 76th Street be followed. One and two family residences will be assessed for 20 percent of the cost of the abutting sidewalk con- struction, while other properties will be assessed at a 50 percent rate. State Aid Road Funds (gas tax) will finance the nonassessed portion of the construction cost. It is recommended that the city council initiate the Penn Avenue sidewalk project by passing the attached resolution, accept- ing the preliminary engineering report on the project, and schedul- ing the public hearing for February 9, 1981. The City Council finds that it appears necessary and desirable that the City make the assessable public improvement of. sidewalk construction on Penn Aw--~_~ue. 2. A preliminary engineering report on such proposed assess- able public improvement is required by law in the event that said improvement or any part thereof is especially assessed against benefited property with the City. The city engineer is, therefore, authorized and directed to prepare a preliminary report on such proposed improvement and to submit the same to the City Council at the earliest convenient time. 3. Such report shall indicate the estimated cost of such proposed improvement, shall indicate whether such proposed improvement is feasible and whether it should best be made as proposed or in connection with some other improvement. 4. CITY OF RICHFIELD, MINNESOTA Office of City I~lanager Council Letter No. 7 Agenda January 12, 1981 The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Assessment Policies for Church-owned Properties During the council's recent discussion of sidewalk assessment and alley assessment policies, questions were raised regarding the applica- tion of the assessment policies for tax exempt properties including those owned by churches. The staff has conducted research on past sidewalk and street assessment practices in Richfield. There have been no alley improvement projects of this nature being considered so there are no comparables in that area. In summary, it was found that in most instances tax exempt properties, including properties owned by churches, were considered the same as commercial properties for either sidewalk or street improvements. In the implementation of a permanent street program, the city as- sessed tax exempt properties at the same rate as commercial properties ._ '{The last sidewalk project in the city was done on Cedar Avenue, in conjunction with the permanent street program. In that project, the sidewalk was assessed at 50 percent of the total cost with all proper- ties assessed at the same rate.) On sidewalk projects done between 1961 and 1964, single family and duplex residential properties were assessed at the rate of 20 percent, while apartment buildings, churches, schools and commercial property were all assessed at 50 percent. Al- though the assessment policy does not specifically address what was done for the remaining sidewalk projects up to the time of the perman- ent street program, it appears as though this same assessment policy was maintained. In the late 1950's there were two sidewalk projects which were assessed at the rate of 20 percent. For all contiguous properties, however, there are no records which indicate this practice was followed after 1959. The assessment of tax exempt property, including properties owned by churches, at the same rate as commercial properties appears to be a reasonable practice which has been followed numerous times in the past. On sidewalks, this would mean an assessment at a 50% rate while the alley policy assesses commercial properties for three fourth's of the cost of the alley adjacent to the property. It is recommended that this policy be used for the present sidewalk and alley assessment program. First Reading. There is an item on the January 12, 1981 city council agenda, providing for :city council consideration of an ordinance amendment'"' relating to the overtime pay and compensatory time-off policies of the city. A copy of the proposed ordinance amendment is attached to this letter. The attached ordinance is designed to make certain minor language changes in our ordinance code that will insure compliance with the most current state statutes relating to overtime pay and compensatory time, and to reflect past policy on overtime compensation at the fore- man level of supervision. The ordinance contains three changes. The first change adds a paragraph (3) to the section, which ex- empts certain employees from overtime pay, and is in accordance to M.S.A. 177.23 and 177.25. The second change relates to compensatory time off in lieu of overtime pay, and allows that such compensatory time off be granted on a time and one-half basis instead of on a straight time basis. This conforms to the rate of cash payment for overtime worked and is required by M.S.A. 177.25 Overtime. This change will also encourage the use of compensatory time for overtime, rather than overtime cash payments. The third change allows for the payment of overtime to foremen in the city as has been the past city practice when the new pay plan was adopted. The foremen were included on the management pay plan for the first time which has created the problem with overtime provisions. The existing practice is recommended for continuation due to unique characteristics of the position. It is recommended that the city council give first reading con- sideration to this ordinance amendment. Board and Commission Appointments There are a number of terms on the various city boards and commissions which will expire during the early part of 1981. These commissions and appointments are as follows: Advisory Board of Health 'The Advisory Board of Health is a nine-member committee. Five appointments, for 2-year terms expiring in January, 1983, should be made. The membership of the committee should include three licensed health professionals and three health consumers representing community organizations, to conform with the resol- ution establishing this committee. Dr. Bittick, and Charlene Swanell, a registered nurse, meet these qualifications. Both of these persons are incumbents and wish to be considered for reappointment. Helen Yates and Mildred Stake do not wish to be considered for reappointment. The other position on the board is currently vacant. Civil Service Commission The Civil Service Commission is composed of three civil ser- vice commissioners who meet on an as needed basis regarding police and fire department matters. One appointment should be made to this commission for a three year term which will expire in February, 1984. The incumbent, Vd. Robert Gordon, has expressed a desire to be reappointed to this commission. Housing and Redevelopment Authority There is a vacancy on the HRA created by Vern Luettinger's retirement from the Richfield City Council. Commissioner Luettinger's term was contingent upon his service as a Richfield City Council Member. It would be appropriate for Niayor Priebe to make an appointment to fill this unexpired term, which will expire in October, 1983 , subject to council confirmation. Council Letter No. 4 -2- January 5, 1981 Human Rights Commission There are presently two vacancies for unexpired three-year terms due to recent resignations from the commission. These terms will expire in May, 1982. Park and Recreation Commission Five appointments, including two youth members, should be made for terms which will expire in February, 1984. The resolution establishing the Park and Recreation Advisory Commission recommends that the commission membership represent a balance of various groups and interests within the community.
