At that meeting, the city council closed the public hearing, but deferred action on adoption of the assessment roll until the special city council meeting of October 5, 1981. A copy of the resolution adopting assessment on City Project 763 is attached to this council letter for council consideration at the October 5, 1981 city council meeting. KN /eja Respectfully submitted, :'0 Karl Nollenberger City Manager RESOLUTION RESOLUTION ADOPTING ASSESSMENT ON CITY PROJECT 763 L /H /N MAINTENANCE FOR THE PERIOD JANUARY 1, 1981 - JUNE 30, 1981 WHEREAS, pursuant to proper notice duly given as required by law, the council has met and passed upon all objections to the proposed assessment for current services related to maintenance of the Lyndale /Hub /Nicollet (L /H /N) Redevelopment Area which is approximately bounded by 64th Street, First Avenue, 67th Street and Emerson Avenue in the City of Richfield. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Hennepin County, Minnesota, as follows: 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed current services in the amount of the assessment levied against it. 2. Such assessment shall be payable before or during 1982 and shall bear interest at the rate of nine percent from the date of adoption of this assessment resolution. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the • whole of the assessment on such property to the city treasurer and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which payment is made. Such payment must be made before November 15 or interest will be charged through December 31, of the succeeding year. 4. The city clerk shall forthwith transmit a certified duplicate of this assessment roll to the county auditor to be extended on the proper tax:_lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Minnesota as follows: 1. That the following examples of current services of the City shall be undertaken by the city within the Lyndale / Hub /Nicollet Development Project Area which area shall constitute the special assessment district with the ex- ception of single family, two family and multi- family residential properties, with the cost of such services to be specially assessed against benefited property within the District: Snow, ice, or rubbish removal from sidewalks; Weed elimination from streets and private property; Removal and elimination of public health and safety hazards from private property, excluding any structure included .under the provisions of Minnesota Statutes Sections 463.15 and 463.26; Installation and repair of water service lines; Street sprinkling and other dust treatment of streets; Tree trimming and care of trees and removal of unsound trees from any street The treatment and removal of insect infested or diseased trees on private property; The repair of sidewalks and alleys; The operation of the street lighting systems; The maintenance of landscaped areas and other public amenities on or adjacent to street right -of -way; Snow removal and other maintenance of streets in the commercial redevelopment area. 2. The work to be performed may be by day labor, by city force, by contract, or by any combination thereof. 3. At that time, the council continued matter to September 28, 1981. It is the understanding of the staff that the businesses in the L /H /N area have a special meeting on October 2, 1981 to discuss the concept of the city specially assessing current L /H /N maintenance services, and to develop a recommendation for the city council.on this issue. For that reason, it is recommended that final council action on this item be continued to October 5, 1981. Should the council decide to not establish special assessment projects for meeting the cost of providing the maintenance services the last six months of this year and for 1982, it will have a budgetary impact which should be considered in conjunction with the council's deliberations on the revised 1981 and proposed 1982 budgets. After closing the hearing, the city council requested additional information from the city staff concerning the proposed special assessments in the type of maintenance services provided in the area. This infor- mation was transmitted to the city council on September 17, 1981 in Council Memorandum No. 200. The cost information which was included in that memorandum was also submitted to the area's business representatives, who have scheduled a meeting for October 2, 1981, in conjunction with the Chamber of Commerce, for the purpose of formulating a recommendation on this matter for the city council. For that reason, it is recommended that the council again continue final action on this matter to October 5, 1981. The city council already has a budget meeting scheduled for October 5, 1981. If the city council decides to not specially assess these costs, that action has an impact on the revised 1981 budget. There is an October 9 deadline for certification of the special assessments, if any. Previous council actions regarding the development of this site are as follows: November 24, 1980 The council heard a preliminary Planned Unit Development prop- osal by Knutson Companies to construct a stepped 8 -12 story multi- family cooperative at this site. At the hearing the council approved the following items: 1. A variance to increase the floor area from 145,158 square feet to 217,937 square feet; 2. A special use permit allowing the proposed PUD /multi- family use; 3. First reading to rezone from "R" single family residential and "C -2" general commercial to "PMR" Planned Multiple Residential; 4. First Reading to vacate portions of Graham Avenue and the alley of block 4 Fairwood Park; 5. Finding that the disposition of city owned property is in compliance with the comprehensive plan. December 8, 1980 1. Second Reading of the rezoning of the site to "PMR" Planned Multiple Residential; 2. Disposition of city owned property. At that meeting, the city council deferred second reading of the vacation of a portion of Graham Avenue and the alley due to the Council Letter No. 334 -2- September 28, 1981 chronology of events that could have left the neighboring residents with restricted access to their properties if the project failed to proceed. August 24, 1981 The project subsequently progressed, however, and the council approved second reading of the vacations at their regular meeting on August 24, 1981. Minor technical amendments need to be made to the• transitory ordinances, and final approval of these amendments is scheduled for council action on September 28, 1981. Final PUD Plan The submitted final PUD plan is similar to the original proposal in that it calls for a high rise multiple family structure with a two tier parking ramp. The proposal is geriatrically designed to accomodate persons 55 years of age or older. The final PUD proposal does represent the following changes: 1. An increase in the number of dwelling units from 167 to 178; 2. An increase in the number of off - street parking spaces from 184 to 210; • 3. An additional egress /ingress point from Lake Shore Drive; 4. The main structure has been changed from an 8 - 12 story stepped building to an even height, 11 story building. The maximum height has, therefore, decreased from 110 feet to 104.5 feet; 5. An increase in the gross floor area from 217,937 square feet to 221,368 square feet, representing an increase of 3,431 square feet; 6. A reduction in the west sideyard setback from 125 feet to 32 feet; an increase in the front yard setback from 55 feet to 70 feet, and an increase in the east sideyard set- back from 80 feet to 125 feet; 7. A 53.8 square foot decrease in the ratio of off - street parking spaces to gross floor area. Zoning Ordinance Requirements 1. Section 3.31 and 3.37 sets standards for multiple family developments. 2. Section 3.34A sets standards for Planned Unit Development districts. Staff Findings The staff reviewed the resubmitted proposal and found the follow- x' ing : *z Council Letter No. 334 -3- September 28, 1981 1. That this proposal represents minor departures from the originally approved preliminary PUD proposal; 2. That this proposal is in compliance with Richfield's Comprehensive Plan; 3. That the proposal will help meet housing demands in the community by creating an alternative housing opportunity; 4. That the proposal is in compliance with the L /H /N redevel- opment project plan which calls for multi- family develop- ment on the site and with the L /H /N goal to provide a variety of housing types; 5. That the significant impact on the neighborhood will be the height of the structure and the added number of residents to the neighborhood resulting from this proposed develop - ment. In terms of the structure's 104 foot height, the neighborhood impacts will not be significantly different than from the 110 foot height of the approved preliminary proposal. The shadow cast will not affect any residential properties. The affected properties will be commercial uses and if solar access becomes desirable for any affected prop- erties, detached solar collectors could be utilized. The remaining single family residences on Lake Shore Drive and the Wood Lake Nature Center will not be affected by the shadow cast by the proposed structure. The area residents'primary view is Wood Lake Nature Center; therefore, while the residents will be able to view the structure from their respective properties, the primary view (toward Wood Lake Nature Center) will be unaffected. The influx of more people in the area will not adversely affect exisitng public utilities. The structure will have an inter- nal fire protection system including smoke detectors, sprinklers and would not require any additional fire fighting equipment for the public safety department. The proposal would improve the area relating to police protection and would probably require less patroling of the area. All water, gas, electrical, and telephone utilities are capable of servicing the development. 6. That the proposal indicates the exterior of the building and parking ramp to be brick of unspecified color, and that outdoor lighting is high pressure sodium lights mounted on 20 foot,standards. This information is insufficient to determine total compliance with the L /H /N Urban Design Elements. 8. That no landscape plans have been submitted; 9. That the proposal will not pose any storm water runoff problems in the area. The site is a low spot in the area, thus, runoff will not adversely affect surrounding properties. The existing storm sewer facilities are adequate to absorb the additional runoff created by this development. 10. The proposal indicates a concrete resident pedestrian system to be constructed linking up to existing public pedestrian systems. This is consistent with the Urban Design Element. Off - Street Parking The staff recommends that the city council approve the layout and design of the off - street parking ramp, and that the applicant enter into and execute an off - street parking contract. It is recommend- ed that the city council waive the requirement for an off - street parking performance bond because performance will be guaranteed by the PUD performance bond and the Developer's Agreement. Council Letter No. 334 -5- September 28, 1981 • Staff Recommendation - Final PUD Plan Because the proposal is not significantly different than the previously approved preliminary PUD plan, and that the proposal should have a positive impact on the area and the city, the staff recommends approval of this final planned unit development plan with following stipulations: 1. The proposed development is an improvement in the area and is necessary to implement and carry out the goals and objectives of the . L /H /N redevelopment plan. The variance, which would allow 3,449 square feet of additional floor space, should not be detrimental to the public welfare or improvements in the neighborhood. This report will identify any special considerations affecting construction, and what extra costs may be incurred because of these problems. It will also identify any areas where the proposed routes or sidewalk locations present construction problems, and investigate alternative routes. The applicant property abuts property which is zoned "MR" to the east. A six-foot solid redwood fence has been constructed on the rear property line for screening purposes. This fence is in disrepair. The northerly lot on Oliver Avenue, immediately east of the proposed addition, is presently vacant. The staff has been contacted by an abutting property owner who expressed strong concerns regarding the dilapidated fence, outside storage of equipment, late hours of operation and noise. Council Letter No. 307 2- September_ 14, 1981 ZONING ORDINANCE REQUIREMENTS Section 3.34, subdivision 5 of the zoning ordinance lists rear yard requirements for property in "I," Industrial districts. • Section, 3.34, subdivision 3 prohibits offensive uses by reason of noise or manner of operation. Section 3.40, subdivision 3 lists three conditions which must be met before a variance may be granted. STAFF REVIEW The staff reviewed the request against the three conditions which must be present before a variance is granted and found the following: 1. This lot is not similar to other lots in this district in that the property is bisected in a north /south direction by an approximate 9.4 foot difference in grade The staff feels that this is -a special condition.` 2. Denial of this application will not preclude reasonable use of the property. Alternative locations for con- structing additional space on the site do exist which would-- not.require, any variances. - 3 The proposed addition is an improvement to the applicant's property. However, the addition,which will be a_ service bay for trucks, will intensify the use of the property, and therefore intensify the nuisances associated with the principle use. Such nuisances as noise, odor and improper screening may intensify as a result of the proposed addition. The staff feels that any objectional or offensive nuisances could be minimized. To ensure that the proposal will not adversely affect persons or property in the neighborhood, the _fence on the east property line could be repaired and repainted, for effective screening, and debris and rubbish could be stoned in or near a designated trash bin. The noise levels are restricted by the recently adopted noise ordinance. STAFF RECOMMENDATION Because the proposal did not 'meet all three conditions for granting variances, the staff must recommend denial of the requested variance. Should the city council approve of this application, the staff recommends the following stipulations: 1. That the applicant repair the fence on the east property line to good condition. 2. That the applicant enter into and execute an off- street parking contract to provide for a safe and orderly flow of traffic to and from the property. The HRA will subsequently sell the parcels and others already owned by the HRA to Knutson Company, the developer. In 1977, the city purchased the Betty Crocker Pie Shop property. Of the three lots comprising that parcel, two were sold to the S &M Company to facilitate the Lyndale Hardware expansion. The third lot, knows as Lot 5, will be sold to the HRA for inclusion in the multi- family site. The sale of these lots is subject to a perpetual easement for the street improve- ments. Hennepin County recently acquired title to the Mobil Oil Station at 66th Street and Graham Avenue, lots 6, 7 and 8. That property was acquired because of the substantial taking necessary for the 66th Street project. The County Board has conveyed the property to the city, subject to an easement for ,the street project. It is proposed that this property also be .sold to the HRA for inclusion in the multi- family site. Brad Bjorklund, a professional fee appraiser frequently utilized by the city and the HRA, has recommended the following reuse values: $10,983 for Lot 5 (which was part of the larger pie shop property), and $55,246 for the former Mobil property. These values reflect the existence of easements, and the fact that these parcels are part of a larger property with land use controls imposed by the HRA. It is recommended that the city council give first reading approval to the transitory ordinance authorizing disposition of those properties. The public hearing and second reading con- sideration of this ordinance will be scheduled for October 12,1981. Since then, the owners have indicated a desire to add a 15 -foot by 40 -foot cooler at the rear of the building, to be used for storage of fruits and vegetables. The cooler would be six feet away from the building except for a connecting link approximately six feet by six feet in size. The exterior material on the cooler would be natural colored aluminum panels. The connecting link would have wood siding which matches other wood wood siding on the building. The cooler will not be visible from Lyndale Avenue. Section 3.34A, subdivision 7, paragraph 2 of the zoning ordinance requires that the Planning Director certify that the construction drawings are in substantial compliance with the PUD Plan, Final Development Plan and any other conditions imposed by the council. Section 3.34A, subdivision 7, paragraph 1 states that a proposal would not be in substantial compliance if the following occurs: 1. More than a ten percent change in the original separation of buildings. 2. Any change in the original approved setbacks from property lines. The cooler would be a new building and, therefore, the building separation would be changed by more than ten percent. The cooler would also change the building setback at the rear property line from 95 feet to 75 feet. It is recommended that the city council amend the Lyndale Garden Center Final Development Plan to allow for construction of the proposed cooler. The cooler addition will not be visible from Lyndale Avenue, will maintain adequate setbacks and will not adversely affect the general public welfare of persons working on the site, visiting the site or living on adjacent sites. Council Letter No. 326 -2- September 28, 1981 The council may want to refer this matter to the Planning Commission for a recommendation, if it feels that this change is of a substantial nature. It is the opinion of the staff that this change is not substantial and, therefore, does not require Planning Commission review. On August 24, 1981, the city council took action to reconsider that bid award, and rejected all bids received for said work. At that time, the staff was authorized to readvertise for bids for resurfacing of the beams at the ice arena. After consulting the city attorney, the work was again advertised for bids. The bid opening was Thursday, September 17, 1981. Present at the bid opening was a representative of the city manager, the city clerk, and a representative of the community services director. A copy of the bid minutes and tabulation is attached for council review. The engineering consultant for this project is Orr- Schelen- Mayeron and Associates, Inc. Mr. Gerald Corrick of OSM reviewed the one bid proposal received on September 17, 1981, and has recommended award of contract.
