11-16-81 agendah CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 396 Agenda November 16, 1981 The Honorable riayor and Members o~f the City City of Richfield Council Members: Subject: Council Resolution Approving Plans and Specifications for CP 757 (Lyndale Avenue Improvements from Lake Shore Drive to 74th Street) The city council approved the preliminary report for CP 757, the improvement of Lyndale Avenue from Lake Shore Drive to 74th Street at the April 27, 1981 city council meeting. A neighborhood meeting to discuss the project was held on May 12, 1981, and the city council conducted a public hearing for the project on May 26, 1981. At the close of the public hearing on May 26, 1981, the city council passed a resolution ordering the project and the preparation of plans and specifications. • Orr-Schelen-Mayeron Associates has prepared the plans and specifications as proposed in the preliminary report; additionally traffic signals at 70th Street and 73rd Streetihave an excellent chance of being approved. The improvements will consist of con- struction of a 47-foot wide bituminous pavement and concrete curb and gutter section, and driveway aprons, street lighting, and sidewalks. In accordance with state statutes, the proposed acquisition of two small triangular pieces of land at the Lyndale Avenue/70th Street intersection were referred to the planning commission for their re- view and recommendation on whether the acquisition would be consis- tent with the comprehensive plan. The planning commission found that the acquisitions were not consistent with the comprehensive plan. It is the staff's opinion, however, the proposed acquisitions are consistent with the comprehensive plan. The comprehensive plan indicates that a policy of the city will be to improve and main- tain streets according to their functional classification. Lyndale Avenue south of 67th Street has not been constructed to the stand- ards for an arterial roadway and, therefore, the land acquisitions and the street improvement project are necessary to carry out the comprehensive plan, and are consistent with the provisions of the plan. It was necessary to obtain a variance to deviate from the state aid standard width of 52 feet for this project. The hearing process before the State Aid Variance Committee has been completed . Council Letter No. 396 -2- November 16, 1981 but the final notice on the variance request has not been received. If approved, the majority of the project cost (900) will be funded • with Municipal State Aid Money. _All property abutting Lyndale Avenue from Lake Shore Drive to 74th Street will be assessed for a portion of the cost of the improvement (sidewalks, curbs and gutters, street lighting and driveway aprons). The estimated project cost is as follows: Bituminous pavement $542,500 Concrete curb and gutter (including driveways) 65,000 Sidewalk 75,000 Street lights 16,000 Signals: 7'Oth Street 40,000 73rd Street 30,000 Estimated Construction costs $?68,500 Administration, legal, engin- eering, and insurance (25°s) 192,125 Estimated project cost $960,625 The estimated special assessment to abutting property owners is as follows: Curb and gutter $8.00 foot Sidewalk (west side only) 3.00 foot Street lighting 2.00 foot West $13.00 foot East $10.00 foot Plus driveway apron $150.00 It is anticipated that the variance request will be determined by the Commissioner of Highways prior to the taking of bids by the city. The plans-and specifications anticipate the construction of a 47-fooot wide roadway as requested in the variance process. The staff recommends that the council adopt the attached resolution approving these plans and specifications, and order the placement of an advertisement for bids. Bid opening is scheduled for Decem- ber 11, 1981, with city council award of the contract scheduled for December 14, 1981. The completion date for the project will be September 1, 1982. NOW THEREFORE, Be it resolved by the City Council of Richfield, Minnesota: 1. Such plans and specifications are hereby approved. 2, The city clerk shall prepare and cause to be inserted in the Richfield Sun and the Construction Bulletin an advertisement for bids upon making such improvement under such approved plans and specifications. The advertisement shall be published in the Richfield Sun on November 18, 1981 and November 25, 1981 and in the Construction Bulletin on November 20, 1981. The advertisement shall specify the • work to be done and shall state that bids will be received at the City Clerk's office until 10:00 A.M. on the 11th day of December, 1981, at which time they will be publically opened and read aloud in the council chambers of the Richfield City Hall, will then be tabu- lated and will be considered by the council at 7:00 p.m. on December 14, 1981, in the council chambers, and that no bids will be considered unless sealed and filed with the clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check, payable to the city clerk of Richfield for five percent (50) of the amount of such bid. The meeting was widely advertised so that people with diverse vier,-s could attend. Present were people not only from t'~:e Lyndale/Oal: Grove neighborhood but also from East and [lest Richfield. Several business owners from the South Lyndale area also spoke. A vari~t}' of points of view and arguments were heard. There was almost unan_Tous agreement on the following: --Them should be no sidewalk on the west side of Lyndale. --The tra-sic light on 73rd street should be retained and additional • lights (e.g., 7Cth street) may be helpful. --Lti~no_e _lvenue between 67th and 74th streets should not be widened to four la.:~. --A co---o~;ise should be achieved and that compromise could include an improves treet (resurfacing, curbs) with turning lanes. Such a com- promise cr~.:_~., what can be visualised as a three lane width. He has problems with stipulations becoming unenforceable. He indicated the ordinance change should be first. Commissioner ICamprud disagreed stating that this is a good plan a:;d would be a good vehicle for an ordinance change. Commissioner Russell questioned the enforceability of stipulations. Motion carried 8-1 with Commissioner Kamprud voting no. The Planning Commission adjourned for a five-minute break. (9:05 PM) Items 4, 5, ,'and 7 were tabled until after Item a8. ITEM 78, INFORMATION LETTER 129, FINDINGS THAT THE ACQUISITION OF TWO PARCELS OF LAND ADJACENT TO LYNDALE AVENUE AT 70TH STREET FOR STREET IL'1PROVEMENT PUR?'OSES TO BE IN CONFO'?tiLANCE WITH THE COMPREHENSIVE PLAN Rick Jopke presented the staff report to the Planning Commission. Commissioner Blevins decided to step down from the commission because of a conflict of interest being on the church board of Oak Grove Lutheran Church. Commissioner Blevins did ask why no notices were sent to the church and the school board. The City Planner indicated that this did not require a public hearing and that notices are sent in regard to public hearings only. Chairperson Ertman indicated that the Planning Commission should give staff direction in sending out notices in situations other than public hearings. Commissioner Russell stated that in this case staff should have approached the Planning Commission Chairperson and asked for a recommendation on sending notices out. Conunissioner Ahlquist stated that this is not.a public hearing and that the Planning Commission can request staff to send out notices. Chairperson Ertman indicated that this item could be tabled and staff could send out notices. The City Planner suggested that the Planning Conunission formulate a policy on notification. Chairperson Ertman informed the Planning Commission that an amendment to the bylaws requires that the change be entered into the minutes one month and the ne:~t month the P1ar.ning Commission will take action on it. Commissioner Ketcham asked staff if the proposed acquisitions were based on a 47-f_oot wide street. Steve Lindgren, 7141 Oak Grove Boulevard, appeared asking why the Planning Commission is considering these acquisitions when no deci- sion has been made 6n the variance to the street width. He suggested that the Planning Commission defer this item until after that decision, is made. Chairperson Ertman asked Mr. Lindgren if he was appearing as a resi- dent or a State Senator. Mr. Lindgren indicated he was appearing as a resident. Chairperson Ertman asked why Mr. Lindgren supported the project when he was on the Planning Commission. Mr. Lindgren indicated he had some concerns about the project at that time and questioned whether he had cast a vote in support of this project. • Mr. Lindgren asked what the position is of the Planning Commission on this project. Richard Blevins, 7539 Washburn Avenue South, appearing as a resident, indicated he was a member of Oak Grove Lutheran Church but did not speak for the church, appeared stating there are objections by the church to this acquisition. He also indicated that the church and others should have been formally notified of this meeting. He requested deferral of this item until after the variance hearing is held. Barbara Amram, 7026 Lyndale Avenue South, appeared opposed, indicating that they were told that the street needed to be improved because of developments to the north and south which would support increased traffic. She indicated that she could not see the improvements to the north and south increasing traffic to warrant four lanes. Chairperson Ertman reviewed the developments which have occurred to the north in the LHN. He also asked if there was an acceptable alter- native that Mrs. Amram would li};e to discuss. She indicated she would be willing to look at alternatives. She also stated that per- manent street and curb with something less than four lanes would be acceptable. She also stated that four lanes will be dangerous for left-hand turns onto Lyndale. Ed Enquist, 7036 Lyndale Avenue South, appeared stating that if the four lane is approved, the residents will ask for on-street parking. Commissioner Ketcham asked if the taking of these properties was to straighten out the curve. Rich Jopke indicated that the reason for the acquisition was to get the required width and to soften the curve. Council Liaison Ludeman stated that softening of the curve has been looked at because of the danger when it is slippery. He indicated complaints have been received about cars sliding into the residential yards not being able to make that curve. He also indicated that these acquisitions will soften the curve regardless of what happens with the Lyndale Avenue project. Commissioner Kamprud suggested that a slower speed limit on Lyndale • might alleviate some of the problem. Consideration of the residents should be taken. Council Liaison stated that the assessment to these residents will be the same that Richfield residents have paid for their permanent streets. M/Russell, S/Hoverson to recommend to the City Council that these acquisitions do not conform to the Comprehensive Plan (Resolution 40) . Commissioner Russell stated that the primary objective of the Compre- hensive Plan is to preserve the residential neighborhood character and that on balance the Comprehensive Plan Traffic objectives were not sufficiently fostered by this projects substantial impact on neighborhood environment. Commissioner Ketcham stated that there should be continuity of roadways with lower Lyndale. And, that the city should work with the residents. This should be passed on to the City Council. Commissioner Hoverson stated that the wrong things are being put first and that there are alternatives that would be satisfactory to everyone. Chairperson Ertman indicated he will vote no Lecause there is a problem on Lyndale Avenue; , the citizens should be worl~:ed :ti~ith on this but continuity of roadways is very import,~nt .ahc~n mayor devel- opments are occurring. The issue here is two small parcels and it is not the Planning Commission's charge to redesign streets and he feels that it does comply with the Comprehensive Plan. Motion carried 5-3 with Chairperson Ertman, Commissioners Ahlquist and Anderson voting no. The residents informed the Planning Commission that they are having an information meeting in the Council Chambers on October 6th and that they are invited. ITEM rt4, PARK AND RECREATION COMMISSION LIAISON REPORT Commissioner Kamprud said there was not a report because the meeting was cancelled. ITEM ~5, HRA LIAISON REPORT Commissioner McDermott gave the report. ITEM #6, SCHOOL BOARD LIAISON REPORT . Commissioner Hoverson gave the report. Chairperson Ertman asked for an update on the Residential Zoning Ordinance. The City Planner stated that the draft is being typed and will be sent to the City Attorneys office this week. Next week he will meet with the City Attorney and the ordinance will go to the City Council on October 12th. Chairperson Ertman asked that a copy of the draft ordinance after it is typed be sent to the members of the Residential"Zoning Ordinance Subcommittee, Commissioners Ahlquist, Ketcham, Russell and Blevins. Staff indicated they would do so. ITEM #9, DISCUSSION OF JOINT MEETING WITH BLOOMINGTON PLANNING COMMISSION Chairperson Ertman stated he had met with the Chairman of the Bloom- ington Planning Commission and two specific things came of the meet- ing 1) Our staff is forwarding a full pacl~:et to the chairman and they are sending one to us. 2) At their suggestion a joint :~ieetiny at their facilities has been set for October Sth.
