Subject: Special City Council Meeting, November 12, 1984
to Canvass Election
Council Members:
The requirement for a special city council meeting to
canvass the elections is found in Chapter 4 of the Charter,
Section 4.07. Section 4.07 reads:
"The council shall meet and canvass the election returns
at the next regular or special council meeting immediately
following an regular, primary or special election, but in
no event later than the Monday next following, and shall
make full declaration of the results as soon as possible,
and file a statment thereof with the city clerk. This
statement shall include: (a) the total number of good
ballots cast; (b) the total number of spoiled or
defective ballots; (c) the true vote for each candidate;
with an indication of those who were elected or nominated;
(d) a true copy of the ballots used; (e) the names of the
judges and clerks of election; and (f) such other informa-
tion as may seem pertinent. The city clerk shall forthwith
notify all persons elected or nominated of their election
or nomination. In case of a tie vote, the council shall
determine the result by lot. The city clerk shall be the
final custodian of the ballots."
The City Attorney's office has advised the City Manager that
it is their opinion the council meeting must be held by Monday,
November 12, 1984. Monday, November 12, 1984 is a national and
state holiday (Veteran's Day).
However, state statutes provide that if there is a case of
necessity, the council must meet as provided by law (city
charter). The act of canvassing the election results is a case
of necessity according to the City Attorney's office.
' At Monday's meeting, the city council at the beginning of
the meeting should make a finding of necessity to canvass the
election results at the special Novemer 12 meeting.

The charter provision, Section 4.07, is the cause for making
a finding of necessity.
The council may then proceed to canvass the election
results.

RESOLUTION DETERMINING RESULTS OF CITY GENERAL ELECTION
OF THE CITY FO RICHFIELD HELD ON TUESDAY, NOVEMBER 6, 1984
BE IT RESOLVED by the City Council of the City of Richfield that the council,
having received and considered the tally of votes by the judges of the general
election held November 6, 1984, the results are determined to be as follows:
Total number of ballots cast. . . 21,3 01
Votes cast for Council Members at Large:

Votes cast for amendment lengthening terms of mayor and council members
