Issue Statement:"
First reading consideration of an ordinance to rezone the
property at 7312 Lyndale Avenue from single-family residential
"R" district to multiple residence "MR-1" district.
Background:
Mr. and Mrs. C. W. Smith have requested the rezoning of 7312
Lyndale Avenue from "R" single family residence district to "MR-
2" multiple residence district, in order to allow the
construction of seven townhomes in two structures. The existing
building is in poor condition.
Petitions in favor of the rezoning have been submitted; however,
a number of property owners have also expressed opposition to the
rezoning.
The Planning Commission reviewed Mr. and Mrs. Smith's request on
June 28, 1988 in a public hearing. The motion was to deny the
request, in a split vote of 5 to 3.
Recommended Motion:
Approve first reading of an ordinance to rezone the property at
7312 Lyndale Avenue from "R" single family residence to "MR-2"
multiple family residence district, and schedule the public
hearing and second reading for the July 25, 1988 City Council
meeting.

1. The above table indicates that the proposal meets all City
regulations for a MR-2 district except that the sideyard
setback would be less than the required 25 feet if the deck
extends 12 feet from the main structure.
2. There are 42 mature trees on the site in variable condition.
The application proposes to maintain 14 trees (which would
indicate that 28 trees would not be replaced). The site
plan indicates some additional plantings and shrubs on all
sides of the property. The landscaping plan is adequate.
3. The abutting properties are zoned "R" district except one lot
to the west which is zoned for (MR-1) two family dwellings.
.The site plan indicates a 6 foot privacy fence along the
westerly property line extending 32 feet along the northerly
and southerly property line.
It is staff's opinion that the proposed screening is
adequate.
4. The proposal meets the regulations for townhomes except for
the sideyard setback from the deck. If the applicant
proposes to build the deck as proposed, it would require a
• sideyard setback variance.
5. The Comprehensive Development Plan designates the property as
medium density buffer, MR-2 (multi-family) zoning. The use
would be consistent with the Comprehensive Development Plan.
Alternative Recommendation:
Do not give first reading consideration to the proposed rezoning
ordinance. The denial would be based on the fact that most of the
properties on the block are single family residential uses.
Therefore, the proposal would be incompatible with the
neighborhood.
Decision Mode:
The City Council is scheduled to give first reading consideration
to an ordinance amendment to rezone the property at 7312 Lyndale
Avenue on July 11, 1988. Mailed or published notice is not
required for first reading consideration.

OF THE RICHFIELD CITY CODE
OF 1987
City of Richfield Does Ordain:
Appendix I of The Richfield City Code of 1987 delineating
the precise boundaries of zoning districts by legal description
is hereby amended by adding to Section 12 thereof the following
new paragraph:
(36) Lots 3, 41 5 and 6 and the north 15 feet of Lot 7
all---in--Block 1j__Irwin_Shores?No._ 2.
The effect of such amendment shall be to rezone such lands
to multiple Family Residential (MR-2).

Issue Statement:
Award of Contract for 1988 Concrete Sidewalk, Curb and Gutter
Repair
Background:
On June 24, 1988, bids were opened from seven contractors for the
1988 Concrete Sidewalk and Curb and Gutter Repair. The bids were
as follows:
Ad Con, Inc. $18,342.80
Halvorson Construction 19,997.88
R.C. Construction 20,865.35
Gunderson Brothers 21,595.35
Northern N 25,706.50
Victor Carlson & Sons 31,041.05
Ron Graves Landscaping 52,335.30
This maintenance program consists of removal and replacement of
deteriorated concrete sidewalk sections and curb and gutter in
various areas of the City. The work is performed each year as a
safety precaution.
Recommended Motion:
Authorize the award of contract to Ad Con, Inc. in the sum of
• $18,342.80.
Basis of Recommendation:
1. The bid from Ad Con, Inc. is the lowest submitted by a
responsible vendor meeting specifications.
2. The 1988 street maintenance budget contains $26,500 for this
work.
Alternative Recommendation:
The City Council may choose to reject all bids and direct staff
to obtain new bids. However, the bids received are in line with
the amount of work which needs to be completed and staff does not
believe we could obtain a better price from a reputable
contractor.
Discussion/Decision Mode:
The Council may choose to delay award of this contract, keeping
in mind that the contract documents allow the bidders to withdraw
their bids in thirty days which means the bid prices now being
considered would no longer be valid after July 24, 1988.

Issue Statement:
Release of contract retainage to Trucker Construction Company for
construction of sludge dewatering building, project no. 703-1574.
Background:
Trucker Construction Company and the City of Richfield entered
into Contract No. 2452 on February 23, 1987. Based on contract
specifications, the City is currently retaining $5,000 of the
$320,912.50 total contract.
There has been some discussion about whether the City or the
contractor was responsible for damages to the building and
equipment during the July 1987 flood. That issue is yet
unresolved but original contract work appears to be met.
The contract specifications indicate lien waivers, consent of
surety, affidavit for obtaining final settlement from the State
of Minnesota and its political subdivisions are among the items
to be submitted by the contractor prior to final payment by the
City. Because these items are anticipated to be submitted by the
contractor on July 12, 1988, City staff and the City Attorney are
recommending authorization at this time to release the retainage
pending receipt of all documents needed for final payment.
• Recommended Motion:
Authorize final payment, which consists of releasing the $5,000
held in retainage, to Trucker Construction Company upon receipt
of all required documents.
Basis of Recommendation:
1. The work has been completed.
2. Required documentation is expected to be submitted by Trucker
Construction Company on July 12, 1988.
3. If all required documentation is not submitted, final payment
will be held until such time as these items are received by
the City.
Alternative Recommendation:
1. Do not pay the $5,000 retainage to Trucker Construction Co.
2. Withhold authorization to make final payment until the City
Council meeting following receipt of the required documents.
Discussion/Decision Mode:
Because the final payment application was prepared for the period
through September 30, 1987 and because receipt of all required
documentation is anticipated for July 12, 1988, this item has
been placed on the July 11, 1988 City Council agenda.

Agenda July 11, 1988
Issue Statement:
Presentation of certification for Certified Municipal Clerk
status from the International Institute of Municipal Clerks for
City Clerk, Thomas Ferber.
Background:
The International Institute of Municipal Clerks (IIMC) and the
Municipal Clerks and Finance Officers Association of Minnesota
(MCFOA) are both sponsors of a certification program for
Municipal Clerks who have attained specified standards of
education, experience and service.
City Clerk, Thomas Ferber, has met the necessary requirements for
both programs. The requirements include completion of a City
Clerk Institute Program at the University of Minnesota, three
years' service as a full-time Municipal Clerk, a Bachelor's
Degree in Public Administration, and attendance at various MCFOA
and IIMC conferences and programs.
On April 11, 1988, the City Council presented Thomas Ferber with
the MCFOA Certified City Clerk award and was presented with a
plaque from that organization. The award being presented this
evening is a similar designation, however, it is an international
• designation rather than limited to Minnesota.
Recommended Motion:
Present the IIMC Certified City Clerk designation to City Clerk,
Thomas P. Ferber, recognizing his achievement in attaining that
status.
Basis of Recommendation:
1. The IIMC has certified Thomas P. Ferber as an internationally
certified Municipal Clerk.
2. The City Council wishes to take opportunities to recognize
achievements of City staff, especially in public form, such
as City Council meetings.
Alternative Recommendation:
1. City Council could choose not to make this public
presentation.
Discussion/Decision Mode:
Action on this item is suggested for July, 1988.
