12-07-87 agenda CITY OF RICHFIELD, MINNESOTA Study Session.Letter No-29 Agenda December 7, 1987 Issue Statement: Discussion of an ordinance to require households to separate recyclable materials from mixed solid waste. Background: Hennepin County Ordinance Number 13, adopted October 30, 1986, states that municipalities shall "adopt an ordinance relating to the separation of recyclables within the boundaries of the municipality". Implementation and enforcement of this ordinance are to be the responsibility of each respective municipality. The purpose of this ordinance is to reduce the amount of solid waste disposed in landfills by at least 16% by 1991, in accordance with state legislation and the county master plan. Failure to adopt a source-separation ordinance or failure to meet the percentage level of source-separation during 1990 (160) may result in the county board substituting their version of a source-separation program in place of the city's. The county is then able to seek reimbursement from the city for all expenses incurred relating to adoption, implementation, administration, and enforcement of a source-separation ordinance. A copy of the proposed ordinance is attached for review. • Other subjects to be addressed include: -Hennepin County funding policy which currently provides 50-80% reimbursement for recycling expenditures. There is some concern about how long this funding will continue. -the Reuter technology of "recycling" which extracts and processes recyclables from mixed solid waste. Some cities in Hennepin County are seriously considering using Reuter as an alternative to adopting source-separation programs. These topics have been brought to a study session in order for staff and council to examine the complexities involved in adopting a source separation ordinance and to discuss how the Richfield Recycling Program will comply with the various mandates from the county. Recommended Motion: At this time, no formal action is recommended as this is a study session. However, staff is looking for direction from the council in regard to the specifics of the ordinance. Basis of Recommendation: Does not apply. Alternative Recommendation: • If the City Council does not choose to consider a source- separation ordinance, the alternative would be to allow the county to proceed and implement a source-separation program for the City. There has been apprehension on the part of other municipalities in the county to adopt source-separation ordinances. They have chosen instead to wait and see how the • county will respond. Discussion/Decision Mode: The subjects of source-separation and recycling have been brought to the study session for discussion purposes only. Prosser Cit pager JDP/eja L? n U • BILL NO. 1987 - AN ORDINANCE RELATING TO PUBLIC HEALTH AND WELFARE, ESTABLISHING A SOURCE SEPARATION PROGRAM FOR RECYCLABLE MATERIALS, AND AMENDING CHAPTER VI OF THE RICHFIELD CITY CODE BY ADDING A NEW SECTION TO THE CODE City of Richfield does ordain: Chapter VT_ of the Richfield city code is hereby amended by adding new Section 625 to read as follows: 625.01. Policy and purpose. The purpose of this section is to promote and protect the health and welfare of the resi- dents of the city by requiring the separation of recyclable materials from garbage and refuse by the implementation of a source-separation, program, and to comply with the goals and requirements established by Hennepin county in Ordinance No. Thirteen adopted on October 30, 1986. The city council finds that such a program is necessary in order to reduce the volume of solid waste and the need for landfills. 625.03. Definitions. Subdivision 1. When used in this section the following words and phrases shall have the • meanings given them in this subsection unless the context clearly indicates otherwise. Subd. 2. "Aluminum recyclables" means all disposable containers fabricated primarily of aluminum and commonly used for soda, beer, or other beverages. Subd. 3. "Collection".means the removal of waste from the place at which it is generated and includes all activi- ties up to the time when the waste is delivered to a waste facility. .,A Subd. 4. "Collector" means any person who owns, operates or leases vehicles for the purposes of collection and transportation of any type of mixed municipal solid waste, and/or recyclables. Subd. 5. "Compostible material" or "compostibles" mean organic material consisting of grass clippings, leaves and other forms of organic yard waste. Subd. 6. "Garbage" has the meaning given in subsection 600.01, subdivision 2 of this code. Subd. 7. "Generate" or "Generation" mean the act or process of producing waste as defined in Minnesota Statutes • section 115A.03, subdivision 11. Subd 8 "Generator" means any person who generates ection 115A 03 waste as defined in Minnesota Statutes s subdivision 12. Subd 9 "Glass recyclables" means jars, bottles and containers that are not plastic and are transparent or and bottling translucent and primarily used for packaging various matter. Subd 10. "Hauler" means a collector or transporter of recyclable materials. Subd 11 "Metal recyclables" means all disposable and excludes t in containers fabricated ri.maril of metal or aluminum recyclables. Subd 12 "Mixed solid waste" means garbage, refuse mercial indus- and other solid waste from residential, com h is generated and hi c trial and community activities w but does not include auto hulks collected in a re ate construction debris, mining waste, ash s i , , ng street sweep lud es tree and agricultural wastes, tires and other s materials collected, processed and disposed of,-as separate waste streams. Subd 13. "Paper recyclables" means paper of the type ressly excluded, E • xp commonly referred to as newsprint. however, are all magazines or similar periodicals Subd 14 "Recyclable materials" or "recyclables" mean lables aluminum recyclables, metal recyclables, glass recyc and paper recyclables._ Subd 15 "Recyclable materials processing facility" receiving th , e means a facility established and used for clable materials f rec y storage, preparing and/or processing o for sale or reuse. Subd 16 "Recycling" means the process of collecting the materials and preparing recyclable materials and reusing m in manufacturing th e in their original form or using processes. Subd 17 "Refuse" has the meaning given in subsection 600.01 subdivision 3 of this code. Subd 18 "Source separation" means the separation of f rec clable materials from mixed solid waste at the source o generation. Subd 19 "Solid waste" has the meaning given it in Minnesota Statutes section 116.06 subdivision 10. • Subd. 20. "Transfer station" means an intermediate is wactp facility in which waste collected from any source • temporarily deposited to await transportation to another waste facility. Subd. 21. Subd. 23 ing of grass garden waste. "Waste facility" "Yard waste" means organic material consist- clippings, leaves, and other forms of orqanic 625.05. Pre-collection and collection. Subdivision l.- Pre-collection. All persons who are owners, lessees, operators, or occupants of any single family residence, duplex, triplex, fourplex, or other residential` or commercial building within the city which generate mixed solid waste, shall separate from all solid waste the designated recyclable materials and yard waste before disposal,.removal or collection in the following manner: (a) Paper recyclables shall be bundled separately • and/or secured in such a manner as to prevent them from being blown or scattered, and shall be maintained in a dry condition free of any other substance and shall not be placed in plastic bags. (b) Aluminum recyclables shall be clean of all con- tents and such recyclables shall not be laced in plastic bags. (c) Glass recyclables shall be clean of all contents. Caps, lids and all metal and plastic shalom be removed prior to collection and such recyclables shall not be placed in plastic bags. (d) Metal recyclables shall be. clean of all contents and shall not be placed in plastic bags. (e) Yard waste compostibles shall be placed in sepa- rate containers. (f) All aluminum, glass and metal recyclables shall be placed into separate containers and not mixed with other forms of solid waste or mixed solid waste in a manner consistent with the rules, regulations and procedures adopted by the city. . Subd. 2. Container requirements.. Containers shall be provided by all persons who are owners, lessees, operators Subd. 22-. "Waste tire"-means a pneumatic tire or solid tire for motor vehicles as defined in Minnesota Statutes section 169.01 and included in the solid waste management plan pursuant to Minnesota Statutes section 115A.46. or occupants of any single family residence, duplex, tri- plex, fourplex, or other residential or commercial building within the city and shall be: (a) maintained in a clean and sanitary condition in accordance with all pertinent health statutes, ordinances, rules and regulations; (b) located in such a manner as to prevent them from being overturned or obstructi.ng pedestrian or motor vehicle traffic or being in violation of any statute, ordinance, rule or regulation; and (c) adequate and substantial enough to contain the recyclables or yard waste therein. Subd. 3. Collection. The collection of rec clables shall be supervised by the city manager, who shall have the power to establish the time, method and routes of service Special times for large item ick-up may also be estab- lished. Collection provisions shall include but not be limited to the following:. (a) Notice of dates and times of collection will be -published or otherwise made available to persons affected herein. • (b) The city manager may establish drop-off or collec- tion sites where any person may deposit recyclables and/or yard waste at such times and locations as determined. c_) It shall be unlawful for any person other than authorized persons, collectors or haulers to distribute collect remove or dispose of recycla- ble materials after said. materials and or yard waste have been placed or deposited for collec- tion. (d) Nothing in this section shall abridge the right of any person to give or sell their recyclable materials and/or yard waste to any recycling program lawfully operated for profit, non-profit or charitable purposes. (e) Nothing in this section shall abridge the right of any authorized recycling or composting program to lawfully.operate within the city, subject to such other licenses or other regulations as may be required by law. (f) It shall be unlawful for a person to collect, remove or dispose of mixed 'solid waste which consists of recyclables and/or yard waste combined with other forms of mixed solid waste. Please meet there. Background: The new building was built this summer. The facility has been operating for about two months. The tour will provide an opportunity for the council to see and learn how the by-products of the water treatment plant are handled and disposed. Recommended Motion: None. Basis of Recommendation: None. Alternative Recommendation: None. Discussion/Decision Mode: No decision is required. The staff at the water plant will be available to answer questions.
