Subject: Establishment of Just Compensation, LHN Property
owned by Arnos and Daniel Heilicher located at 708
West 66th Street on the "Godfather Block"
Dear Commissioners:
On March 26, 1984, the HRA and City Council met concurrently
to hear a presentation for the development of Market Plaza
and to authorize the initiation of Eminent Domain for the
acquisition of 708 West 66th Street property. Negotiations for
the acquisition of 708 West 66th Street had been initiated with
the owners, Amos and Daniel Heilicher, but because of a need to
assemble the site in a timely manner, the Eminent Domain
proceeding was authorized. The time required for an Eminent
Domain proceeding could be six to nine months. Thus, it is
desirable to have the court provide title and possession by the
condemnation "quick-take" proceeding.
Just compensation must be established on the Heilicher
property for purposes of the court hearing and to enable the HRA
to proceed with the "quick-take." Staff has reviewed appraisals
of the property and is of the opinion that just compensation at
this time should be set at $~ This money must be
deposited by the HRA with the Hennepin County Court
Administrator as part of the "quick-take" process. The money
will be drawn from the LHN Capital Improvement Fund
temporarily. A proposed bond issue in early summer will
replace the monies removed from the capital fund.

It is recommended that the HRA adopt the resolution which
will be presented to the HRA on 5-14-8~ authorizing Eminent
Domain by "quick-take" and setting just compensation at $~

this property are being analyzied by the city's Review
Appraiser. A recommendation on the just compensation will be
available Monday.
