Commissioner Hassenstab was appointed to the HRA in 1982 and is serving his second term. Under state law, the Mayor appoints HRA Commissioners subject to confirmation of the City Council. Mayor Quam has indicated that he will make an appointment to the HRA for a five-year term at the October 24, 1988 City Council meeting. Prosser City Manager JDP/eja ~/a CITY OF RICHFIELD, MINNESOTA Council Letter No. 264 Agenda October 24, 1988 Issue Statement- Offstreet parking permit amendment at 710 Lake Shore Drive (VFW, Richfield). Background- VFW Post 5555 has requested an amendment to its existing offstreet parking permit at 710 Lake Shore Drive. The amendment would allow the VFW to construct a 650 square foot addition on the east side of the existing building. This necessitates some realignment of the parking. The existing 161 parking spaces are in spaces for the dining, bar and banquet containing a service elevator, storage will not require parking to be added. applicant has agreed to reduce parking safety, circulation and space conflict apparent on-site parking deficit on big states their mutual agreement with the parking alleviates any problem. excess of the required 126 areas. Recommended Motion: Approve the amendment to the offstreet parking permit at 710 Lake Shore Drive with the following stipulations: 1. The parking spaces noted on the plan be deleted resulting in a net loss of three parking spaces. 2. The landscaping plan be approved by City staff. 3. The Lyndale and westerly Lake Shore Drive curb cuts be widened to 26 feet and the remaining curb cuts be made one way. ~~~y/ Basis of Recommendation: The proposed addition will have no adverse impact on the site. Improvements relating to the curb cuts and landscaping significantly update the 1.963 parking layout. On-site parking for bingo cannot be reasonably solved as part of this amendment. Alternative Recommendation: Deny the offstreet parking permit amendment at 710 Lake Shore Drive. Decision Mode• This item is scheduled for council consideration on October 24, 1988. Background- Sage Corporation has requested an amendment to its offstreet parking permit for 710 East 78th Street. The amendment would allow the construction of a .f_enced in play area at the northwest corner of the site. The proposed play area would eliminate approximately 12 parking spaces from the westerly parking area. However, rearrangement of the parking area would actually increase the parking available by a total of nine parking spaces. The property is zoned C-2, general commercial district. The existing apartment use is a permitted use with a conditional use permit in the district. There are 221 dwelling units in 13 structures on the site. Recommended Motion: Approve the offstreet parking permit amendment at 710 East 78th Street provided that the following stipulations are met: 1. The landscaping along the westerly and northwesterly part of the property be replaced or upgraded to meet staff's approval. 2. That the play area and all other improvements in the parking area meet the building and fire codes. 3. That the existing 24 foot curb cuts be increased to 26 feet. Basis of Recommendation: 1. The improvements proposed would, in fact, result in an increase in the available parking. At one and one-half spaces per dwelling unit, some 332 parking spaces would be required and the proposal includes 360 parking spaces. 2. The landscaping on the westerly and northwesterly portion of the property has deteriorated and does not conform with the previously approved plan. However, the applicant has indicated a desire to provide additional landscaping in the near future. It is staff's opinion that a detailed landscaping plan be submitted for staff's review and approval prior to the implementation of such plan. 3. The proposed plan indicates the required fire lanes and the dumpsters for garbage as was approved previously. The applicant has indicated a desire to work with the city staff regarding any safety issues in the playground area. ~9-/ Alternative Recommendation: The City Council could deny the amendment to the offstreet parking permit, however sufficient evidence must be found for such denial. Decision/Decision Mode: This item is on the agenda for October 24, 1988. No public hearing is required. One application .for deferral of payment of special assessments has been received. The request is for the 1987 alley paving assessment in the amount of $1,060.80. Staff has determined that the applicant is eligible according to the provisions contained in Resolution No. 7310. A resolution certifying the deferral of this special assessment for an owner occupied homestead property has been prepared for Council consideration. Recommended Motion: Approve the resolution approving eligible deferral of special assessments against an owner occupied homestead property. Basis for Recommendation: 1. Resolution No. 7310 provides that the City may grant such deferrals. 2. City staff .has determined that the applicant is eligible. for this deferral. Alternative Recommendation: 1. Do not approve the resolution deferring the special assessment. However, this may cause severe financial hardship for the applicant. Background: City ordinances currently regulate .the parking of vehicles for all commercial establishments by means of an offstreet parking permit process. From time to time the City has experienced difficulty with enforcing provisions of the offstreet parking permit. In order to simplify the enforcement procedure, an ordinance has been developed by the City Attorney. The ordinance would specifically indicate that motor vehicles being purchased or sold by the licensee and customer vehicles could not be parked on the boulevard adjacent to licensee's premises unless an agreement has been reached between the City and the licensee. An example of the agreement .referred to would be the offstreet parking permit. It is important to know that this is really not a new restriction for car dealership operations. Rather, it is a clarification of the existing intent of offstreet parking permits. Recommended Motion: Approve first reading of an ordinance amending Section 1155 of the Richfield City Code entitled Motor Vehicle Dealers, and schedule the public hearing and second reading of the ordinance as soon as practical. Basis for Recommendation: 1. To clarify the requirements to comply with offstreet parking permits. 2. Parking of vehicles on boulevards can cause the following problems: -Site obstruction make cause danger to other vehicles in the area. -Snow removal activities can be hindered. -Emergency access to businesses can be hindered. Alternative Recommendation: 1. The Council could choose not to enact this ordinance. In that case the City would be in the position of using more complex enforcement procedure, by seeking enforceme t pf thhe offstreet parking permit or a revocation of the conditional ~~ use permit. Discussion/Decision Mode: If the City Council approves first reading of the ordinance, second reading and the public hearing could be scheduled for the November 14 City Council meeting. If approved at that meeting, the ordinance would become effective 30 days after publication in the official newspaper. Background• St. David's School in Minnetonka has requested a conditional use permit for a day care center at The Lincoln Hills Center located at 7440 Penn Avenue. The conditional use permit would allow the operation of a day care center for approximately 35 handicapped and non-handicapped children. The children are within the ages of six months to seven years. A detailed explanation of the operation is attached for your information. The property is zoned 'R' single family residence district. A day care center is permitted with a conditional use permit in an 'R' district. Recommended Motion: Approve the conditional use permit for a day care center for 35 children at-7440 Penn Avenue provided all building and fire codes are met and a license for day care is obtained from the appropriate governmental authority. Basis of Recommendation: 1. The proposed day care facility for handicapped children has been encouraged by School District #287. The Lincoln Hills Center is used primarily for special education programs. Therefore, the proposed use would be compatible with other programs in the facility. 2. There is adequate parking on vacated 75th Street. The hours of operation are 7:00 a.m. to 6:00 p.m. Most of the staff members leave at 3:00 p.m. Therefore, dropping off children would not be i.n conflict with the existing parking situation. 3. Adequate play area for the children is available on the site. Alternative Recommendation: Deny the conditional use permit. Findings of fact must be established for such a denial. Discussion/Decision Mode: A public hearing is scheduled at 7:00 p.m. on Monday, October 24, 198$. Appropriate notices have been mailed. Legal notice was also published in the Richfield Sun Newspaper. Most of the handicapped children who will be attending the day care program also attend public school special education programs at the Lincoln Hills Center, we do not need any additional construction (except a dividing wall within the room), nor do we need any additional parking facilities. Background• The City contracts with outside vendors for the maintenance of its computer system hardware. During the fall of 1987 the City requested bids from several vendors for this service. Based on the proposals submitted, the Council awarded the 1988 contract to Financial Products Corporation (FPC), the low bidder. This contract expires on December 31, 1988. From time to time the City has modified the contract by adding and deleting pieces of equipment. The original contract was awarded for $15,778.00. The current value of the contract is approximately $20,000.00. The 1989 contract will begin at $32,797.00. The addition of several pieces of equipment this fall increased the maintenance cost for 1989. Equipment additions and deletions during the coming year will also affect the value of the contract. However, all changes to the dollar value of the contract are due to equipment modifications made by the City. FPC has guaranteed their prices through the end of 1990. Because of the dollar amount of this contract renewal, staff consulted with the City Attorney's office regarding whether or not new bids are required. In their opinion, this renewal is not a new and independent contract and therefore public bidding is not required at this time. Recommended Motion: That the City Manager be authorized to renew the City's contract with Financial Products Corporation for computer hardware maintenance for the period from January 1, 1989 through December 31, 1989. Basis for Recommendation: 1. FPC has provided competent and prompt service to the City during the past year. 2. FPC rates continue to be very competitive. Background: The City Council policy resolution on purchasing provides that when the purchase of merchandise, materials, equipment or construction exceeds the amount of $5,000, authority to purchase shall be submitted to the City Council for consideration. Each year the City purchases rock salt, which is usually mixed with sand, to control ice on road surfaces during the winter season. The purchase is made through a joint purchasing agreement. The low bid received by Hennepin County for the 1988/89 season was submitted by Cargill, Inc. in the amount of $24.96 per ton plus $1.43 per ton delivery cost for a total unit price of $26.39. Background• Since November 1986, Richfield has had a citywide curbside recycling program. The program divides recyclables into two categories: 1) newspapers and 2) glass, cans and cardboard. In the first category, volunteers collect and sell newspaper under a separate agreement negotiated by representatives of volunteer groups and paper buyers. For the second category, glass, cans and cardboard are collected under contract with the City. In the second category, the City is divided into three districts for collection purposes.. District 1 is that area roughly bounded by Xerxes Avenue and I35W. District 2 is that area roughly bounded by 135W and Portland Avenue. District 3 is that area roughly bounded by Portland Avenue and 23rd Avenue. The current contracts for the second category, recycling of glass, cans and cardboard, expired October 8, 1988. Hennepin County's funding policy is based on ~~-~-/ the percentage of recyclables recovered and Richfield has ;" achieved the 70~ funding level. Recommended Motion: Authorize the City Manager to enter into a curbside recycling contract with Eagle/Gopher Recycling, SuperCycle, Inc. and Center for Community Action (MERC). Basis of Recommendation: 1. SuperCycle and MERC were under renewed contracts to provide recycling services from November 1986 through October 1988. Both satisfactorily fulfilled their contract requirements. 2. Staff has checked references for Eagle/Gopher Recycling and has received satisfactory recommendations. 3. Costs for contractor services have been included in the Recycling Budgets for 1988 and 1989. Background: For the past five years, the City has rented various pavement profiler/milling machines to use in patching, crack sealing and overlaying operations for the controlled removal of blacktop. As our streets age, the necessity for this piece of equipment increases. Funds were provided in the approved 1988 Street Maintenance budget to rent a machine in 1988. The rental would be applied toward purchase of the machine if we decided, after the pavement management study, that purchase of a machine would be our best option, The 1988 capital outlay portion of the street division budget also included $57,000 to cover this purchase option. The pavement management study has, in fact, indicated our future need for this equipment will make continued renting more expensive than the purchase of the machine.. On October 7, 1988, a formal bid opening was held for the purchase of a pavement profiling/milling .machine. One bid was received from Ziegler, Inc. in the amount of $57,617.93. This bid took into consideration that $13,000 had been spent to rent the machine for two months this past summer. Base Price $70,617.93 Less 2 months rental (13,000.00) Total Amount of Bid $57,617.93 Recommended Motion: Approve the purchase of a Pavement Profiling/Milling Machine from Ziegler, Inc.. in the sum of $57,617.93. Ferber City Clerk ~~ CITY OF RICHFIELD, MINNESOTA Council Letter No. 255 Agenda, October 24, 1988 Issue Statement- Several employees from Public Safety have been awarded a Medal of Merit Commendation and we request that the presentation of these awards by made at the October, 24, 1988 Council Meeting. Background: On September 15, 1988, shortly after 8:00 P.M. our Public Safety Dispatch Center received a call of a bad accident with fire eastbound on 494 at Lyndale Avenue.. Although this occurred in the jurisdiction of the City of Bloomington, we sent police and fire officers to the scene of the accident in an emergency support capacity. Richfield police officers were the first to arrive at the scene and were able to ascertain that at least two vehicles involved were in flames and that a person was trapped in one of the burning vehicles. Officer Rich Flaten was met by a group of excited citizens who indicated that a woman driver was trapped in a burning car and attempts to free her had failed. Officer Flaten and off-duty Dispatcher Jeff Dickie, who happened upon the scene, could not get near the victim because of the searing heat and exploding canisters from the cargo of a burning ~~ truck. They attempted to knock the flames back with portable fire extinguishers, but made no headway until Richfield Firefighters Pasziewicz and Captain Olsen were able to advance a hose through the flames and clear the driver's side of the car. Flaten, Dickie, and a Bloomington Police Officer then approached the car and pried the door open and removed the victim. Although the victim later died at the hospital, the heroism and action beyond the call of duty by these Public Safety employees deserves recognition. What was apparent to another police officer on the scene can best describe their actions: "Both Flaten and Dickie assisted the trapped lady without regard to their own safety even when it was obvious that both of their lives and safety were in immediate peril. It was obvious that they were not going to be able to save the trapped lady but their efforts did minimize the extent of injuries the lady would have incurred had they done nothing. They brought a sense of order to a situation that was totally chaotic." Recommended Motion: It is recommended by the Public Safety Director and the City Manager, that these Public Safety employees be awarded Medals of Merit by the City at the October 24, 1988, City Council Meeting. ~~,~ Alternative Recommendation: The Council take an appropriate alternative action to recognize the heroic efforts of these Public Safety employees. The recommendations included construction of a new north/south runway, and purchasing land to construct a new airport in the future. Gertrude Ulrich, Richfield's representative to the Metropolitan Council, will be present at 5:30 p.m. on October 24 to report on the study. Recommended Motion: Receive the report, and request that the Metropolitan Council reject the recommendation of the task force. Basis for Recommendation: 1. The report did not consider the environmental capacity of the surrounding area to accept additional air traffic. 2. The report did not consider the safety aspects of additional runway operations at this airport. 3. The report did not adequately resolve the issue of the need for an additional runway. 4. The dual track approach would relegate the MSP to an interim airport status. As an interim airport, the City would be hard pressed to justify appropriate changes in land use to accommodate increased traffic. Alternative Recommendation: 1. Accept the recommendations as are. Discussion/Decision Mode: This item has been placed on the October 24 City Council agenda so that the City Council will have input to the full Metropolitan Council consideration of this item on October 31.
