Issue Statement:
Purchase in excess of $5,000 for one Storm Sewer Lift Station
pump, placement at Adams Hill Park, 7200 Washburn Avenue.
Background:
The City Council policy resolution on purchasing provides that
when the purchase of merchandise, materials, equipment or
construction exceeds the amount of $5,000, authority to purchase
shall be submitted to the City Council for consideration.
When Adams Hill Park was redeveloped in the early 1980's,
Richfield entered into an agreement with Edina which requires the
City of Edina to install a pipe from Adams Hill Pond to the old
Hedberg site when the site is developed. In return, Richfield is
responsible for installing a second pump at the lift station.
Edina has been in the process of developing the Hedberg site, and
will be completing their work this fall. In order for this pump
to be in place and operational for the 1991 spring thaw and rain,
staff would like to purchase and install the pump this fall.
Purchase of the pump for Adams Hill Park would also add
additional pumping capacity for the lift station to better
"" protect the neighborhood from flooding due to heavy rains.
Proposals for the pump were received by one vendor, Waldor Pump
and Equipment, the only supplier that sells the brand of
equipment needed. The lift station was designed and built for
the Flyght Pump. Waldor Pump and Equipment submitted a quotation
of $11,256 for the pump.
Recommended Motion:
Approve a 1990 Purchase Order to Waldor Pump and Equipment for
the purchase of one Flyght Lift Station Pump~for $11,256.
Basis of Recommendation:
1. The Flyght Lift Station Pump is compatible with existing
pumping equipment, eliminating the need for refitting slide
rails and discharge piping.
2. Waldor Pump and Equipment is the only supplier of the
Flyght Pump that meets the needed specifications.
3. The 1990 Storm Sewer budget will be revised to reflect the
$11,256 purchase.

Alternative Recommendation:
Council may choose not to accept any of the quotations and
instruct staff to obtain new quotes. However, staff does not
believe better prices for the pump can be obtained at this time,
and allow for timely receipt and installation.
Discussion/Decision Mode:
Staff is requesting approval at the August 27, 1990 Council
meeting.

Issue Statement•
Purchase of vehicles for use by Public Safety Department.
Background•
Four full size sedans being used by the Public Safety Department
are scheduled to be replaced in 1991. Purchase of new vehicles
has been coordinated with Hennepin County's bid process. All
four of the cars are currently in use. These Ford Crown Victoria
squad cars were purchased in 1989 and will be fully depreciated
in 1991. The extent and nature of the use of these cars
indicates a two year replacement schedule.
The lowest responsible bid for the type of vehicle required was
submitted by Grossman Chevrolet Company, Inc. (Hastings Auto) at
a total cost of $51,786. The proposed 1991 Central Garage
Capital Outlay budget includes money for these purchases.
Actual cost per marked squad car in 1990 was $13,091.
Estimated cost for a 1991 car was $14,000. The actual bid price
per car in 1991 came to $12,946.50. Staff does not believe we
can obtain a better price than through the Hennepin County bid
process.
Recommended Motion:
Authorize the purchase, with 1991 funds, of four Ford Crown
Victoria full-sized police sedans through the point Hennepin
County purchasing agreement, from Grossman Chevrolet Co., Inc.
(Hastings Auto) for a total purchase price of $51,786.
Basis of Recommendation:
1. Several manufacturers of full size cars were requested to
submit bids following predetermined specifications. Of the
bids submitted, Grossman Chevrolet Co., Inc. (Hastings Auto)
was the lowest responsible bidder for the type of car
requested..
2. The City of Richfield is in need of replacing four fully
depreciated squad cars.
Alternative Recommendation:
Council may choose to reject this bid and request staff to obtain
bids from other sources in an attempt to receive a lower purchase
price. However, staff does not believe we can obtain a better
price from a responsible manufacturer.

Discussion/Decision Mode:
Time constraints dictated that in order to take advantage of the
bid price, the dealer required a letter of intent to purchase by
August 20, 1990. Staff is requesting approval of this purchase
at the August 27, 199D Council meeting.

Issue Statement•
Consider to accept a letter of memorandum of agreement between
the City of Richfield and Walser Automotive resolving the signage
issue.
Background
The City Council issued a conditional use permit on July 14, 1986
for Walser Automotive. One of the stipulations in that
conditional use permit is that the billboard signs be removed
within a one year period. The signs were not removed. The City
initiated action to enforce the conditional use permit. Walser
Automotive has responded that under a~state law the City would be
required to compensate Walser for the removal of these signs,
even in the case of a stipulation for a conditional use permit.
The City Council has authorized staff to discuss alternative ways
to achieve the results of the sign removal with Walser. The
result of this effort has been development of a memorandum of
agreement (attached) for Council review.
Recommended Motion:
Approve the memorandum of agreement.
Basis for Recommendation:
1. Under the proposed agreement the signs would be reduced in
height from fourteen feet to seven feet and the back of the
signs would be covered providing a more aesthetically
pleasing appearance.
2. The signs would be treated in the same manner other signs are
at the end of the amortization period under the current sign
ordinance.
Alternative Recommendation:
1. Do not approve the agreement. The City could initiate action
to enforce the conditional use permit. That action would
take the form of a declaratory judgement determining whether
or not the signs would fall into the state regulation
regarding these types of signs. If the law applies, the City
would be required to compensate the owner for the value of
the signs if they are removed. Recent decisions would
indicate that the City might receive favorable response from
the courts.
2. Delay action on this item until there is an opportunity for a
workshop session to review this item.

Dear Mr. Prosser:
This letter is intended to serve as a memorandum of agreement
involving the issues relating to the three large advertising
signs located on the Walser property. Based upon our discussions
over the past two months, Walser will proceed as follows:
1. The two large signs which face 78th Street will be reduced in
height (sign face) to seven feet with the bottom of the sign face
not higher than the bottom of the existing sign face. Remodeling
will be in accordance with the attatched exhibit A. There will be
no boards or other materials between the bottom of the sign face
and the parking lot surface (except the posts which support the
signs). The entire back of the sign structure will be given a
flat finished appearance by applying construction materials to be
approved by the building official of the City. The materials
will be applied to the outside of the support posts.
2. The back of the sign structure of the sign facing Penn Avenue
will be given the same finish treatment described in paragraph 1
above. No boards or other materials will be placed between the
bottom of the sign face and the parking lot surface.
3. .Except as amended by the terms of this letter and the conditional
use permit referred to in number 4 below, the three signs shall be
subject to the City's sign regulations.
4. Once this letter has been signed on behalf od Walser it will
be presented to the City Council together with the city .manager's
recommendation that the conditional use permit issued to Walser
on July 14, 1986, and thereafter amended on September 12, 1988,
and January 18, 1990, be modified to permit the location of the `-
signs described in this letter to remain subject to all of the
conditions cotained herein. If the conditional use permit is so
modified, this letter shall be binding upon the City and Walser

and the remodeling of the three signs shall be completed within 30 days of the
date of the council action. If the conditional use permit is not so modified,
this letter shall be of no force and effect.
5. Nothing in this letter shall be deemed to relieve Walser of its obligation
to obtain all permits required for the remodeling of the three signs.

Issue Statement•
Resolution to authorize a formal Sister City relationship with
Heredia, Costa Rica.
Background•
The Richfield Sister City Advisory Board has been working to
secure a foreign city with which to be Sister Cities. Efforts
have led to identifying Heredia, Costa Rica as a likely Sister
City. A profile of Heredia and the proposed relationship is
attached.
A formal invitation expressing the City's interest was forwarded
to Julio Ballestero, Presidents Municipal of Heredia. The City
received a formal response on August 14, 1990 indicating that
Richfield's interest in being a Sister City has been presented to
the Municipalidad de Heredia. (See attachment.) A subsequent
telephone call on August 23, 1990 verified that the Town Council
of Heredia, Costa Rica has unanimously voted to be a Sister City
to the City of Richfield, Minnesota.

Recommended Motion:
The Sister City committee recommends adoption of the attached
resolution authorizing the City of Richfield to enter into a
Sister City relationship with Heredia, Costa Rica by executing an
agreement.
Basis of Recommendation:
1. Many similarities exist between Richfield and Heredia.
2. The Sister City International Advisory Board fulfills its
.duty to the City Council by making the recommendation to
select Heredia, Costa Rica as its Sister City.
3. Both Cities have expressed interest in being Sister Cities.
4. The Town Council of Heredia has unanimously adopted a
resolution to be a Sister City to Richfield.
Alternative Recommendation:
1. The Council may choose not to approve the Sister City
relationship.
2. The Council may require additional contacts be made and
interest generated.

RESOLUTION AUTHORIZING THE

A SISTER CITY RELATIONSHIP
WHEREAS, the Richfield Sister City International Advisory
Board is charged with promoting understanding, friendship and
reciprocity on a continuing basis; and
WHEREAS, it is the Richfield Sister City International
Advisory Board's duty to recommend the selection of foreign
cities as Sister Cities; and
WHEREAS, Heredia, Costa Rica has been identified as a
potential Sister City because of its many similarities to the
City of Richfield; and
WHEREAS, both Cities have expressed interest in being Sister
Cities.
NOW, THEREFORE, BE IT RESOLVED, that the City Council does
hereby authorize the City of Richfield to enter into a Sister
City relationship with the Municipalidad de Heredia, Costa Rica,
to be made effective by the execution of an agreement, signed by
both Cities.

AND THE MUNICIPALIDAD DE HEREDIA

AND
JULIO BALLESTERO CAMPOS, PRESIDENTE MUNICIPAL DE HEREDIA, COSTA RICA
WHEREAS, a Sister City relationship is one of the fundamental
elements for better understanding between peoples, strengthens
friendships and promotes peace; and
WHEREAS, a Sister City relationship between cities of
different nations particularly benefits initiative to enhance and
promote cooperation among peoples; and
WHEREAS, there is mutual interest in creating a permanent
bond of cooperation and exchange to stimulate contacts among all
the individual sectors that form the civic, social and economic
fabric of cities; and
WHEREAS., a dynamic and concrete Sister City relationship
shall thus become a vital and permanent part of .our two cities;
THEREFORE
The Mayor of the City of Richfield and the Presidente Municipal
de Heredia warrant to strengthen the relationships between the
two city governments to insure a continuous and permanent
exchange of information, documentation and experience in matters
of mutual interest.
In particular, they agree to promote and develop the following in
the manner and at. the times deemed most suitable:
1. Cooperation and exchange in the field of education,
including student and teacher exchanges.
2. Development and coordination of cultural exchanges in the
areas of arts and music.
3. Stimulation of an interest in developing projects in mutual
service organizations.
4. Exploration of possibilities of exchanges in the areas of
horticulture, athletics, preventative medicine, and city
maintenance.
5. Continuation of fostering an understanding and friendship
between the two Sister Cities.

The Sister City relationship will be reexamined every five years
to insure that the intent of this agreement is being carried out
to the satisfaction of the Municipalidad de Heredia and the City
of Richfield.
This protocol shall become official at the signing thereof and
has been drafted in Spanish and English, both of which are the
official languages of this protocol.

Issue Statement•
Resolution regarding application for Hennepin County Yard Waste
Rebate.
Background•
State law prohibits the disposal of yard waste in sanitary
landfills. Prior to 1990, Hennepin County operated yard waste
compost sites, but discontinued the operation of such sites
earlier this year. The county opted last spring to permit cities
to independently develop and coordinate yard waste disposal
activities. The county established a yard waste rebate program
to reimburse cities for eligible yard waste management costs. In
1990, the City of Richfield should qualify for a rebate of
$33,045. The .county has requested that applications for the
rebate be submitted by September 1. County staff have given the.
strong indication that the yard waste rebate program will be
discontinued after this year.
The City Council discussed both a long and short-term solution
for yard waste management at the August 6 study session. Since
the study session, staff have met with haulers to discuss the
proposal(s). Changes in the staff recommendation are based on
~,
feedback obtained from haulers at a meeting on August 14.
Recommended Motion:
In the short-term (fall of 1990), staff recommends that the yard
waste rebate be returned to citizens via a credit on their
utility (water) bill. Staff will continue to discuss long-term
options for yard waste management with haulers.
Basis of Recommendation:
1. This solution is consistent with Richfield's position to
encourage volume-based competitive waste charges.
2. The proposal meets the needs of waste haulers. At the
August 14 meeting, haulers expressed strong reservations
about the feasibility of the long-term solution, and about
the impact that the short-term solution could have on their
existing volume-based pricing structures. The short-term
solution would involve paying haulers the rebate to pick up
yard waste from their customers, at no extra charge, for
several weeks in the fall. The long term solution would
require haulers to offer this service as a condition of
licensure. Haulers contend that:
• Such a system would undermine volume-based fee structures.
Several of the haulers expressed their belief that a large
reduction in yard waste volume has occurred this year as a
result of individual waste reduction efforts by residents.
Offering a free service, would curtail the incentive to

reduce volumes and abate wastes, and would send a
counterproductive message to residents.
• Full-service customers would be unfairly discriminated
against by the proposed system. Many residents have
already switched to full-service in order to take
advantage of the free yard waste collection option.
• Long-term costs are difficult to predict. Haulers are
reticent to agree to provide a free service without
knowing what disposal costs will be in the future, or if
disposal sites will be available.
An advantage of the utility rebate is that it returns the
yard waste rebate to residents while enabling the current
volume-based system to continue operating. It is a
relatively straightforward way of providing what appears to
be a onetime only rebate_from the county.
Alternative Recommendation:
Staff and haulers examined other options including:
• Establishing a drop-off site for yard waste, to be
hauled to a compost facility elsewhere.
• Siting a compost facility in Richfield for
residential use.
The major drawbacks of these options are:
1. The expectation on the part of residents that a program,
once begun, will continue each year.
2. The difficulty of locating sites.
Discussion/Decision Mode:
The City Council is being asked to approve the submission of
an application for the 1990 yard waste rebate from Hennepin
County.

RESOLUTION NO.
HENNEPIN COUNTY YARD WASTE REBATE APPLICATION
WHEREAS, Hennepin County is providing a onetime rebate to
cities whose yard waste has been handled this year at no extra
cost to the County; and
WHEREAS, The City of Richfield will be eligible for a rebate
of $33,045 (approximately $3.00 per household); and
WHEREAS, The City is committed to keeping solid waste
collection in the hands of the private sector; and
WHEREAS, Richfield residents will be expected to make their
own arrangements for yard waste disposal in the fall; and
WHEREAS, the method for returning the yard waste money to
residents that is the least disruptive to the current system is a
rebate on residential water bills.
BE IT RESOLVED, THEREFORE, That the City Council authorize
the City Manager and Mayor to sign and submit an application for
the yard waste rebate, to be distributed through residential
water bills, from Hennepin County. Said rebate will not exceed
$33,045, the amount specified by the County as the portion of the
solid waste tip fee paid by Richfield residents for yard waste
composting.

Issue Statement:
State-Aid variance request for 77th Street Reconstruction
Project.
Background•
The City of Richfield is proposing to widen 77th Street to a
four-lane divided roadway. To accomplish this the road will be
shifted to the north close to existing residential neighborhoods.
The planning process used to select the preferred alignment
recommended a screen wall, loop streets and landscaping to serve
as a barrier between the heavily travelled new road and the
adjacent residences immediately to the north.
Under Section 8820.3100 of the Minnesota State .Aid rules, cities
are not allowed to spend their state-aid funds on the
construction of barriers, loop streets and related landscaping
without requesting a variance from the State-Aid rules.
The City staff has prepared a request for a variance from the
State-Aid rules that would permit the City of Richfield to
finance the $2.5 million improvements using State-Aid funds.
_ Recommended Motion:
f Approve the attached resolution to submit a variance request to
the Minnesota State-Aid Office to permit the City of Richfield to
spend its Municipal State-Aid funds to build a screen wall, loop
streets and related landscaping as part of the 77th Street
Reconstruction Project.
Basis of Recommendation:
The City staff believes that Richfield is justified in requesting
a variance because the proposed screen wall and loop streets are
necessary to protect adjoining residential areas from the high
traffic volumes projected to use the new 77th Street.
The variance must be granted before any construction can begin.
Otherwise, the City will have to identify a different source of
financing for the $2.5 million worth of work described above.
Alternative Recommendation:
Postpone the variance request until a definite date has been set
for construction of 77th Street. Variance requests can be
submitted quarterly. The next submittal deadline is December 1,
1990. If delayed, scheduling of construction work in 1991 would
be very difficult.

Discussion/Decision Mode:
A decision is needed now in order to submit the variance request

RESOLUTION N0.
REQUEST FOR 77th STREET VARIANCE
WHEREAS, Under Minnesota State Aid Rules, certain activities
such as screen walls,. loop streets and landscaping are not
eligible for State Aid funds; and
WHEREAS, The City of Richfield has proposed widening 77th
Street in response to upgrading 494; and
WHEREAS, The City, through its planning process for the
widening of 77th Street, has determined that screen walls, loop
streets and landscaping are necessary to protect existing
residential areas to the north of the new 77th Street.
BE IT RESOLVED, THEREFORE, By the City Council of the City
of Richfield, that the City submit a variance request to the
Minnesota State Aid Office that will permit the use of Minnesota
State Aid funds to build screen walls, loop streets and
landscaping, as part of the reconstruction of 77th Street.

schedule a special council meeting for September 10.
Background:
At the August 13, 1990 council meeting, the council declined to
approve the repair of tennis court surfaces at .Augsburg Park
until they had had an opportunity to review other proposed park
improvements. The council also requested that a special council
meeting be scheduled to discuss this matter.
Recommended Motion:
Cancel the council study session scheduled for Tuesday, September
4, (Monday, September 3 is a holiday), and schedule a special
city council meeting for 5:15 p.m. on Monday, September 10, prior
to the regular council meeting.
Basis for Recommendation:
1. The council has requested this special meeting.
2. A decision should be made during this year's construction
season regarding tennis court repair.
Alternative Recommendation:
1. Schedule a meeting for some other date and time.

Issue Statement:
Approval of proposed.1991 budget and property tax levy for
payable year 1991 for certification to the Hennepin County
auditor and set dates for public budget hearings for the 1990
Revised/1991 Proposed budget and tax levy.
Background
As required by the Truth in Taxation legislation (M.S. 275.065)
each "taxing authority" must certify its proposed property tax.
levy for payable year 1991 to the county auditor on or before
September 1, 1990. "Taxing authority" includes all counties, all
school districts, all cities regardless of population, all towns
and all special taxing districts. No local units of government
are exempted from this requirement.
In addition, each "taxing authority" must certify to their county
auditor the dates that have been selected for their Truth in
Taxation hearing and for the continuation of this hearing by
September 1, 1990. The dates for these hearings must not
conflict with the hearing dates of the county or of the school
district in which the "taxing authority" is located. These
scheduled hearings must be held between November 15 and December
20, 1990. On or before December 28, 1990 the final adopted levy
must be certified to the county auditor.
Notice of the budget hearing will be published and posted in
accordance with both the State Statute and the City Charter. The
notice must also include an alternative date for a second budget
session if it is necessary. Thus, two dates must be selected
this evening.
Recommended Motion:
1. Adopt the attached resolution certifying a proposed property
tax levy and budget for 1991.
2. Set a public budget hearing for 7:00 p.m. November 28, 1990
with a reconvened date of 7:00 p.m. December 5, 1990 if
necessary.
Basis of Recommendation:
1. The Minnesota Truth in Taxation law requires a budget hearing
for each "taxing authority" prescribed by M.S. 275.065.
2. The recommended dates are available according to the Hennepin
County Auditor.
3. The budget and accompanying proposed levy are ready for
consideration. .
4. There is adequate time to meet publication requirements.

Alternative Recommendation:
1. The City Council could select other dates for the hearing,
provided they are available and publication requirements can
be satisfied.
2. The City Council could reduce the property tax levy, causing
the need for more severe service reductions.
Discussion/Decision Mode:
Action by the City Council on August 27 would make it possible to
certify the proposed 1991 tax levy .and set date for budget
hearings as required by law.

FOR THE YEAR 1991
WHEREAS, the Minnesota Truth in Taxation law provides for a
proposed tax levy to be certified to the County Auditor by
September 1, and then recertified before December 20.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Richfield, Minnesota as follows:
