Issue Statement•
Administration of the Oath of Office to newly hired Police
Officers.
Background:
All new Police Officers hired by the Richfield Department of
Public Safety are administered .the Oath of Office. Beginning in
1987, all new Police Officers were introduced to the Council and
administered their Oath of Office by the. City Clerk at regularly
scheduled Council meetings.
Two new officers were recently. appointed to the Public Safety
Department. They have been scheduled to take their Oath of
Office at the July 9, 1990, City Council meeting.
Recommended Motion:
Have the City Clerk administer the Oath of Office to the
following Police Officers:
Jay Henthorne, appointed April 9, 1990
Margaret Monsaas, appointed March 19, 1990
Basis of Recommendation:
1. This process will allow for the formal-recording and
notarizing procedures required of all new officers.
2. The public swearing-in of new Police Officers is a necessary
and very important process and affords members of the City
Council the opportunity of meeting new officers.
Alternatisae Recommendation:
1. Appoint officers without administering a formal Oath of
Office at a City Council meeting.
2. Have all new officers report to the City Clerk on the date of
hire to receive their Oath of Office.
Decision/Discussion .Mode:
This item is scheduled under the Presentation Section of the July
9, 1990 City Council meeting.

Issue Statement:
Administration of the Oath of Office and the presentation of
badges to three Firefighters.
Background•
Three Firefighters have been hired since the first of the year.
They are:
• Dawn Nilsen was hired in January, 1990. She is
Richfield's first female Firefighter.
• Timothy Wrobbel was hired in February, 1990. He has a
two-year Fire Science degree.
• Hunter Hackbarth was hired in April, 1990. He was
previously a Richfield 911 Dispatcher.
These hires were made to fill vacancies created when Lieutenant
Gary Kottke resigned in May, 1989, after 20 years of Service;
William Cusack retired in October, 1989, after 20 years of
service; and Captain John McGraw retired in January, 1990, after
27 yea~cs of service.
The new Firefighters have completed orientation, including live
fire training and heart-saver defibrillation training. They are
now responding as qualified Rescue and Fire crew members. Their
skills and knowledge will surely increase during their careers.
Recommended Motion:
Have the City~Clerk administer the Oath of Office to the
following Firefighters:
Dawn Nilsen
Timothy Wrobbel
Hunter Hackbarth
Basis for Recommendation:

Issue Statement:
Consideration of a resolution authorizing Hennepin County to
research data regarding Cert~.ficates of Correction and report
such results to the City of Richfield.
Background•
In 1851, the territorial government of Minnesota enacted
legislation to permit filing of lots and blocks for building
sites in the form of subdivision plats. Since that time, over
12,000 plats, representing hundreds of thousands of lots, have
been filed in Hennepin County.
As in any human endeavor, errors and/or omissions creep into
projects. The subdivision plat is no exception. In the 1950's,
the legislature provided the Surveyor a means to put the public
on notice. that there was an error in a plat and to state the
correct data. Over the years, numerous Certificates of
Correction have been filed. In 1976, the legislature provided
that the. municipality as well as a surveyor had to sign the
Certificate of Correction before the County Recorder could accept
the document for filing. This action provides the municipality
with notice but few are able to tell if the new data is better
than the old.
Recently the Iennepin County Surveyor's office offered to provide
the sertrice of checking data on Certificates of Correction for
each municipality in the County. After completing their check of
the data, the County Surveyor would sign the certificate stating
the information has been verified.
The service is offered to the City of Richfield at no cost.
However, in order to put the system into place, a resolution of
the City Council requesting the County Surveyor's assistance in
this matter would be necessary.
Recommended Motion:
Adopt the attached resolution inviting the County Surveyor to
check Certificates of Correction filed in Richfield.
Basis for Recommendation:
1. As Certificates of Correction are filed, the City currently
has no method of checking corrected data.
2. The Hennepin County Surveyors have indicated their
willingness to perform the checking service to the City free
of charge.

Alternate Recommendation:
1. The City Council could decide not to authorize the County
Surveyors to provide their free service, insofar as
Certificates of Correction are extremely infrequent.
Discussion/Decision Mode:
There is no deadline for action on this issue. However, at this
point, the services are offered free, and it is unknown as to how
long such an offer will be available.

RESOLUTION NO.
RESOLUTION REQUESTING
HENNEPIN COUNTY SURVEYORS TO
REVIEW CERTIFICATES OF CORRECTIONS FOR RICHFIELD
WHEREAS, the legislature has provided a means to put the
public on notice of errors which may have occurred in the filing
of subdi~risior3 plats; and
WHEREAS, such notifs.cation is provided through various
Certificates of Correction; ands
WHEREAS, state statutes provide that a municipality as well
as a surveyor must sign off on such Certificates of Correction;
and
WHEREAS, municipalities such as Richfield have no way to
verify the data submitted on such Certificate of Correction to
ensure that the data is accurate; and
WHEREAS, the Hennepin County Surveyor has offered to perform
such verifications for cities in Hennepin County free of charge.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Richfield that the County Surveyor be requested to
perform data verifications for Certificates of Correction filed
in Richfield.

The purpose of this letter is to offer the service of this office to provide your
municipality with assurance that the data on a Certificate of Correction is in fact
correct. We could check the data provided by the surveyor by comparing the new
data against the old. If correct we would sign the certificate stating the
information has been checked. We would conduct our review before the certificate
is submitted to the municipality so that passage through your system would be as
expeditious as possible.
If this proposal is acceptable a resolution by your governing body requesting our
participation would be appropriate. This would give us authorization to do the
work as part of the County's continuing service to the municipalities and to
contact the surveyors about the change in procedure. If you have any questions

Issue Statement:
Consideration of a resolution to increase the pay of election
judges.
Background•
Minnesota Statute 204H.31(d) provides that compensation to
election judges serving in any city is to be determined by the
governing body of the city and that election judges shall receive
at least the prevailing Minnesota minimum wage for each hour
spent carrying out their duties at the polling places and in
attending training sessions. The City of Richfield currently
compensates election judges at the following rates:

$4.50 per hour
$4.25 per hour

Basis for Recommendation:
1. The pay scale for election judges in Richfield is
substantially below that of other Hennepin County
communities. This increase would make the pay scale
comparable with what other communities in the area are
paying election judges.
2. Maintaining a comparable wage will assist in retaining
experienced judges and recruiting new judges.
3. Election judges fulfill an essential role in the conduct and
integrity of the election process.
4. Election judge compensation was last adjusted in 1987.
5. The 1990 Election Division budget includes funding for the
proposed adjustment.
6. Recent federal and state legislation has substantially
increased the minimum wage.

Alternative .Recommendation:
1. Reject an increase for election judge pay.
2. Adjust election judge pay to different rates than what is
recommended.
Discussion/Decision Lode:
This matter has been scheduled for consideration on July 9, 1990
to enable the City to incorporate the new pay structure into the
election judge recruitment and training process for the fall 1990
elections.

RESOLUTION APPROVING PAY RATE
ADJUSTMENT FOR ELECTION JUDGES
WHEREAS, Minnesota Statutes 2048.31(d) provides that
compensation to election judges serving in any city is to be
determined by the governing body of the city and that election
judges shall receive at least the prevailing Minnesota minimum
wage for each hour spent carrying out their duties at the polling
places aid in attending training sessions, and,
WHEREAS, the Richfield City Council recognizes the
importance of the role oaf election judges in the conduct of
elections.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby
establishes the following pay rates for election judges effective
the date of passing this resolution:
Chairperson $6.00 per hour
Co-Chairperson $5.50 per hour
Judge $5.25 per hour

Issue Statement:
Public hearing on consideration of an amendment to the off-street
parking permit at 1420 East 78th Street.
Backaround•
P.C.~Express, Inc. is requesting an ,amendment to the off-street
parking permit at 1420 East 78th Street in order to construct a
2600 square foot addition and, at the same .time, reduce parking
by 12 stalls. The property is zoned for general commercial use
and the retail, office., service and warehouse use is consistent.
The .existing off-street parking permit was granted in August,
1989 for 69 spaces which was in excess of the City requirements.
A stipulation of approval regarding landscaping has yet to be
.complied with.. The proposed construction would reduce the
parking, as configured, to 57 spaces which is two short of that
required. In addition, Public Safety has requested a second fire
access point.
Recommended Motion:
Approve the off-street parking permit amendment for 1420 East
78th Street with the following stipulations:
1. That the parking area be reconfigured to provide 59 parking
stalls, including the required handicap parking.
2. That a second access with a locked gate, and without
pedestrian access, be provided at the northerly end of the
parking lot.
3. That the prior stipulation regarding landscaping be complied
with before a building permit is issued for the addition.
Basis of Recommendation:
1. The parking lot may be reconfigured to meet the City's
requirements (59 stalls) for this type of operation. The
staff has some reservations about the adequacy of parking,
however, because of the number of employees (40 to 50) that
work out of or within this building. As a result, staff
considers it important to prevent overflow parking in the
residential neighborhood. The north end of the parking lot
should be closed off to prevent walking to cars parked north
of 77th Street.
2. The second access will provide an additional point of entry
for emergency vehicles. Staff recommends against open access
to 77th Street prior to its reconstruction which will provide
limited access and buffering for the residential area.
3. The landscaping required in August, 1989 has not been done nor
has the. escrow been returned.

Alternative Recommendation:
The City Council may deny this off-street parking permit
amendment if a finding of fact determines that the request would
have an adverse impact on the surrounding properties.
Discussion/Decision Mode:
A public hearing is .scheduled at 7:00 P.M. on Monday, July 9,
1990. The hearing will be held in the City Council Chambers of
Richfield City Hall, 6700 Portland Avenue South. Notice of
public hearing was mailed to property owners within 350 feet of
the property.

Issue Statement•
Consideration of First Reading of an ordinance amendment to
incorporate into Section 416 provisions of state law regarding
the regulation of noncommercial signs in state general election
years.
Hackground•
The Minnesota State Legislature passed the following statute
amendment. during the 1990 Legislative Session:
Sec. 30.(211H.045) NONCOMMERCIAL SIGNS EXEMPTION.
In any municipality with an ordinance that regulates the size
of noncommercial signs, notwithstanding the provisions of
that ordinance, all noncommercial signs of any size may be
posted from August 1 in a state general election year until
ten days following the state election.
This section will supersede certain provisions of Section 416 of
the Richfield City Code in state general election years.
Therefore, the City Attorney has drafted the attached ordinance
amendment for incorporation into the Richfield City Code.
Recommended Motion:
Approve First Reading of an ordinance amendment to Chapter IV
Section 416, "Regulation of Signs", adding Section 416.13 "Effect
of State Law" and schedule Second Reading and Public Hearing for
July 23, 1990.
Basis for Recommendation:
1. The Minnesota State legislature adopted a statute which
supersedes local ordinances at certain times.
2. The City Attorney has drafted an ordinance amendment
regarding this statute for incorporation into the Richfield
City Code.
Alternative Recommendation:
1. Do not approve First Reading of this ordinance amendment.
2. Ask the City Attorney to prepare a different draft ordinance
amendment.

First Reading approval is requested at the July 9, 1990 City
Council Meeting, with the Second Reading and Public Hearing to be
scheduled for the July 23, 1990 City Council Meeting. Timing is
important because of upcoming local elections.

AMENDMENT TO CHAPTER IV,
SECTION 416 OF THE RICHFIELD
CITY CODE OF 1987
City of Richfield does ordain:
Section 416 of the Code entitled "Regulation of Signs" is
hereby amended by adding thereto the following new
subsection:
416.13. Effect of State Law The provisions of this
section shall have rxo force and effect during the times and
to the extent that such provisions are superseded by state
law.
Passed by the City Council of the City of Richfield, Minnesota
this 9th day of July, 1990.
