09-18 HRA Resolution No. 1268 HRA RESOLUTION NO. 1268 RESOLUTION APPROVING AN AMENDMENT TO PURCHASE AGREEMENT FOR PROPERTY LOCATED AT 6409 16TH AVENUE SOUTH WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota (the "Authority") and Daniel E. Schertner (the "Seller") entered into a Purchase Agreement, dated August 21, 2017 (the "Original Agreement"), pursuant to which the Authority agreed to purchase property from the Seller located at 6409 16th Avenue South in the City of Richfield, Minnesota, and legally described as Lots 2, Block 2, Iverson's Second Addition (the "Property"); and WHEREAS, Section 2 of the Original Agreement provided that no earnest money would be paid by the Authority to the Seller; and WHEREAS, the Authority and the Seller wish to amend the terms of the Purchase Agreement so that the Authority is required to pay earnest money to the Seller in the amount of $3,500 for the purchase of the Property; and WHEREAS, there has been presented before this Board a form of Amendment to Purchase Agreement (the "Amendment") proposed to be entered into between the Authority and the Seller,which amends the amount of earnest money set forth in the Original Agreement; and NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota as follows: 1. The Amendment is hereby in all respects authorized, approved, and confirmed, and the Chair and the Executive Director are hereby authorized and directed to execute the Amendment for and on behalf of the Authority in substantially the form now on file with the Community Development Director but with such modifications as shall be deemed necessary, desirable, or appropriate, the execution thereof to constitute conclusive evidence of their approval of any and all modifications therein. 2. The Authority shall pay to the Seller earnest money for the purchase of the Property in the amount of$3,500. 3. The Chair and the Executive Director are hereby authorized to execute and deliver any and all documents deemed necessary to carry out the intentions of this resolution.
