APPROVING LAWS OF MINNESOTA 2017, 1ST SPECIAL
SESSION, CHAPTER 1, ARTICLE 6, SECTION 19, RELATING
TO THE LYNDALE GARDENS TAX INCREMENT FINANCING
DISTRICT
WHEREAS, the City of Richfield, Minnesota (the "City") has duly established the Lyndale
Gardens Tax Increment Financing District (the "TIF District"), a redevelopment tax increment
financing district, pursuant to Minnesota Statutes, Sections 469.174 through 469.1794, as
amended (the "TIF Act"), and the Housing and Redevelopment Authority in and for the City of
Richfield, Minnesota administers such TIF District; and
WHEREAS, the Legislature of the State of Minnesota passed a special law providing
that the conditions set forth in Section 469.1763, subdivision 3 of the TIF Act shall be
considered met if the activities are undertaken within seven (7) years from the date of
certification of the TIF District, all as provided in Laws of Minnesota 2017,. 1st Special Session,
Chapter 1, Article 6, Section 19 (the "Special Law"); and
WHEREAS, pursuant to the Special Law, the City, Hennepin County, Minnesota (the
"County"), and Independent School District No. 280 (the "School District") are required to
approve the Special Law; and
WHEREAS, pursuant to Minnesota Statutes, Section 645.021, subdivisions 2 and 3, the
Special Law is effective upon approval by a majority vote of the governing body of the City and
the filing of a certificate, including a copy of this resolution, in the form prescribed by the
Minnesota Attorney General with the Minnesota Secretary of State; and
WHEREAS, the City Council of the City has determined that it is in the best interest of
the City and its residents to approve the Special Law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield,
Minnesota, as follows:
1. The Special Law is approved contingent upon the approval of the Special Law by the
governing bodies of the County and the School District.
2. The City Clerk, as the chief clerical officer of the City, is hereby authorized and
directed to file the certificate and a copy of this resolution, as approved, with the
Minnesota Secretary of State as required by Minnesota Statutes, Section 645.021,
subdivision 3.
3. City staff are authorized and directed to take any additional action necessary to
implement the Special Law.
