REQUESTS MUST BE MADE AT LEAST 96 HOURS IN ADVANCE TO THE ADMINISTRATIVE SERVICES DIRECTOR AT 861-9702. • n LJ CITY OF RICHFIELD, MINNESOTA Council Letter No.270 Agenda December 7, 1992 Issue Statement: Consideration for approval of a petition to the Board of Water and Soil Resources for removal of the area tributary to Wood Lake from the Minnehaha Creek Watershed District (MCWD) and Nine Mile Creek Watershed District (NMCWD) and attaching the area to the Richfield Bloomington Water Management Organization (RBWMO). Background: The storm sewer work necessary for the 77th Street project provides the City with an opportunity to solve a chronic drainage problem, with construction of an outlet to Wood Lake. This new outlet leads the City to a change in the watershed district boundaries. Wood Lake and the area around the lake that drains into it was included in the MCWD at the time the district was formed in 1967. There is no outlet to Wood Lake, and so the water in Wood Lake does not flow to Minnehaha Creek. Apparently it was assumed that a Wood Lake outlet to Minnehaha Creek would someday be provided in order to justify the inclusion of Wood Lake in the district. Now that an outlet is planned to be routed to the Minnesota River through the RBWMO, it is appropriate to redraw the legal watershed boundaries to more closely coincide with the hydrologic watershed boundaries. In addition, an area within the Nine Mile Creek Watershed District (NMCWD) bounded approximately by 74th and 77th Streets and Lyndale and Fremont Avenues will have its storm water diverted from an undersized pipe to Bloomington and the NMCWD to Wood Lake and the RBWMO. Recommended Motion: Approve the attached petition which requests the Minnesota Board of Water and Soil Resources to approve the boundary change identified in Exhibit Al. Basis of Recommendation: 1. The location of an outlet to Wood Lake has been determined to be through the 1494 piping system and 1494. 2. This new outlet removes any hydrologic reason for Wood Lake to be part of the Minnehaha Creek Watershed District. 3. Planning and permitting authority for the Wood Lake watershed will rest with the water management organization through which its waters flow. is Alternative Recommendation: • The Council could choose to delay the decision until a future date. However, the boundary change is needed in order to determine the appropriate permits needed to process the 77th Street construction plan. The spring 77th Street construction would likely be delayed. Prosser Ci Manager JDP:ds DEC 03 '92 14:01 OSM MPLS, MN 0 PETITION FOR CHANGE IN WATERSHED DISTRICT BOUNDARY TO: Secretary of the Minnesota Board of Water and Soil Resources P.2 Please consider this document as a formal petition to the Board of Water and Soil Resources to change a portion of the watershed boundary of the Minnehaha Creek District, the Nine Mile Creek Watershed District and the Richfield-Bloomington Water Management Organization. This request is made in accordance with MINNESOTA STATUES SECI"ION 103D.251. This request is made based on the following findings: 1. The Watershed Districts or Water Management Organization affected by the proposed boundary change includes the Minnehaba Creek Watershed District, the Nine Mile Creek Watershed District, and the Richfield-Bloomington Water Management Organization. 2. The property affected by the proposed boundary change includes areas tributary to Wood Lake and a limited area along 77th Street within the City of Richfield that would be directed to drain into Wood Lake instead of Nine Mile Creek as part of a 77th Street improvement project. As part of this improvement project, • the Wood Lake outlet would also be constructed. 3. The proposed boundary change will benefit the Richfield•Bloomington WMO by making its legal boundary consistent with both the actual existing watershed boundary and the actual watershed boundary which will exist with the construction of planned drainage. improvements. The proposed boundary change will benefit the Minnehaha Creek Watershed District and Nine Mile Creek Watershed District for the same reasons. 4. The drainage area tributary to Wood Lake as described in Exhibit A lies within the boundaries of the Minnehaha Creek 'W'atershed District, but does not have an outlet to Minnehaha Creek and has never contributed surface water runoff to Minnehaba Creek. 5. The area tributary to Wood Lake has not in the past, and will not in the future contribute runoff to Minnehaha Creek and has not received any benefits from the operation of the Watershed District that cannot be provided in the future by the Richfield-Bloomington WMO. All proposed future drainage improvement projects for the area involved by the proposed boundary change will affect only the Richfield-Bloomington Water management organization and the Nine Mile Creek Watershed District and will not affect or contribute drainage to the Minne nahorganizations Creek Watershed and watershed Therefore, all of the affected water manage districts will benefit by avoiding the administrative effort and expense which would be required in permitting and coordination of projects which will result if boundaries are not changed. 7. The Minnehaha Creek Watershed District can perform the functions for which it was established without the inclusion of this territory. NOW, THEREFORE, BE IT RESOLVED by the CITY OF RICHFIELD that the Minnesota Water Board of Water and Soil Resources is requested to approve the change in boundary described in Exhibit A.
