CLAIMS AND PAYROLL ADJOURNMENT HOUSING AND REDEVELOPMENT AUTHORITY HRA Letter No. 8 Agenda February 18, 1992 Issue Statement: Amending administrative plan for Section 8 Rent Assistance Program. Background: The HRA received 22 Section 8 vouchers from HUD in late 1991. Several documents were prepared and submitted in support of that allocation. HRA authorization for submittal of the documents was provided on November 18, 1991. HUD has approved the documents subject to a one paragraph revision to the program administrative plan. The documents submitted to HUD in November reserved 2 of 22 vouchers for the nonprofit Cornerstone Agency. Cornerstone assists Richfield families at risk of becoming homeless. The revision required by HUD clarifies the selection process for the issuance of vouchers to at risk families and removes references which provide an exclusive relationship with the Cornerstone Agency. The revisions: - indicate the selection process for homeless households is the same as for other Section 8 participants. - provide area agencies, including Cornerstone, a process for • trying to resolve transitional housing problems for families by using Section 8 vouchers. Recommended motion: Authorize, by resolution, the Executive Director to modify the administrative plan homeless program component in a manner acceptable to HUD". Basis of Recommendation: 1. HUD has approved 22 vouchers for Richfield pending homeless program component changes to the administrative plan. 2. HUD has approved the program component in a revised form. 3. The HRA must authorize the change by resolution. Alternative Recommendation: Do not change the program component as written. However, HUD will not accept the original draft approved by the HRA. Discussion/Decision Mode: HUD is awaiting the arrival of the resolution authorizing the revisions. Respe ly submitted, • James Prosser Execu e Director JDP:ds HRA RESOLUTION NO. • RESOLUTION AUTHORIZING ADMINISTRATIVE PLAN REVISIONS TO SECTION 8 HOUSING ASSISTANCE PAYMENTS PROGRAM WHEREAS, the HRA administers an independent Section 8 Rent Assistance Program; and WHEREAS, on November 18, 1991, the HRA authorized an administrative plan; and WHEREAS, HUD has reviewed the plan and requested that a revision be made to the homeless program component; and WHEREAS, it is proposed that two of the 22 vouchers received from HUD as of January 1, 1992 will be reserved to assist agencies in housing local families that risk being homeless without the stability provided by rent assistance resources; and WHEREAS, the plan revision has been reviewed by the HRA on February 18, 1992. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota as follows: The Executive Director is authorized to revise the Administrative Plan homeless program component in the manner acceptable to HUD and as reviewed by the HRA. Harms, Chairperson ATTEST: Joan Helmberger, Secretary 0 • HOUSING AND REDEVELOPMENT AUTHORITY HRA Letter No. 7 Agenda February 18, 1992 Issue Statement: Public hearing and authorization of the sale of a Richfield Rediscovered property at 6407 15th Avenue to Wakely Construction Company. Background: Wakely Construction Company of Burnsville, MN., has secured a contingent purchase agreement from a buyer for the lot at 6407 15th Avenue. The sale price of the lot would be $22,500. The new house will be valued at $92,500. A development agreement very similar to those used previously requires Wakely Construction Company to: - pay the stated lot value upon completion of the home; - provide financial security during the construction period with a Letter of Credit, or similar security, that has a value of $37,876; - complete the home and pay for the lot by July 28, 1992; and 0 - meet design and insurance requirement which are specified. Wakely Construction Company builds about 12 homes a.year, primarily in the Savage and Lakeville area. Their homes average $100,000 in price. Their building inspection and supplier references indicate they build a good product. Building officials in Lakeville and Savage stress the importance of communication and outlining clearly the Richfield building process for Wakely. Financial capability is required to be demonstrated prior to closing and no problems are anticipated since Wakely understands the Richfield Rediscovered program requirements. Recommended Motion: Following the public hearing, adopt the attached resolution which authorizes the Chairperson and Executive Director to execute agreements which sell 6407 15th Avenue to Wakely Construction Company for development of a new single family home. Basis of Recommendation: 1. A check of references indicates Wakely Construction Company is an experienced, capable, financially secure builder. 2. The HRA has the lot at 6407 15th Avenue available to sell. . 3. A development agreement has been negotiated and is in conformation with program guidelines. • 4. The participation fee of $500 has been paid. 5. Notice of public hearing has been published. 6. Previously the Planning Commission found the sale of the lot for development of a new home to be in conformance with the City's comprehensive plan. Alternative Recommendation: Do not proceed with a development agreement with Wakely Construction Company and direct staff to find another buyer. Discussion/Decision Mode: Wakely Construction Company would like to close by the end of February and start construction immediately thereafter. THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF RICHFIELD • RESOLUTION AUTHORIZING THE SALE OF REAL PROPERTY LOCATED AT 6407 15TH AVENUE TO WAKELY CONSTRUCTION COMPANY, IN ACCORDANCE WITH A DEVELOPMENT AGREEMENT WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota (HRA) desires to develop certain real property pursuant to and in furtherance of the Expanded New Home Program Redevelopment Project (Project) heretofore adopted by the City of Richfield (City) and the HRA, said real property being described as follows: Lot 19, Block 6 "Girard Parkview" and located at 6407 15th Avenue; and, WHEREAS, the HRA is authorized to sell real property within its area of operation after public hearing; and, WHEREAS, a developer, Wakely Construction Company of Burnsville has been identified as the purchaser of the described property, in accordance with a development agreement; and, WHEREAS, the public hearing has been held after proper public notice; and, WHEREAS, the Planning Commission has made a finding that the disposition of the property for residential purposes is consistent with the comprehensive plan. NOW, THEREFORE, BE IT RESOLVED by the Richfield Housing and Redevelopment Authority: 1. A public hearing has been held and 6407 15th Avenue is authorized to be sold to Wakely Construction Company for $22,500 in accordance with a development agreement with the HRA. 2. That the Chairperson and Executive Director are authorized to execute the Development Agreement and other agreements as required to effectuate the sale to Wakely Construction Company. (Deferred from the January 21, 1992 HRA meeting.) . Background: The bylaws of the Richfield Housing and Redevelopment Authority provide that the HRA hold an annual meeting in January of each year. The bylaws further provide that the Chair, Vice Chair and Secretary of the HRA be elected at this meeting. However, at the January meeting, the election of officers was deferred to the February meeting. The bylaws of the HRA regdlire that such an election be held at the annual meeting in January of each year. Alternative Recommendation: Do not hold the election. However, this would be in contradiction to the HRA bylaws. Discussion/Decision Mode: This item was originally scheduled for the January 21, 1992 HRA meeting in accordance with the HRA bylaws.
