Recommendation related to Phase I right of way clearance for the
77th Street improvement project.

Background.
Because it is important that the contract award(s) be processed
as quickly as possible, a Special City Council Meeting has been
scheduled for 6:00 p.m. on Thursday, April 15, 1993 for the
purpose of making recommendation related to Phase I right of way
clearance for the 77th Street improvement project.
Bids will be opened Monday, April 12, 1993, under direction of
the Minnesota Department of Transportation, for 77th Street right
of way clearance. It is necessary for the City of Richfield to
make a recommendation for action on the award of contract(s);
i.e., reject bids or favor award to apparent low bidder.
Information on the bid opening will be provided to Council
Members as quickly as possible. However, it may be that the
details will not be available until the Special Council Meeting.
Recommended Motion:
Make recommendation(s) for award of contract(s) related to the
• right of way clearance for Phase I of the 77th Street improvement
project.
Basis of Recommendation:
1. The 77th Street improvement project is important to the City.
2. Bids for right of way clearance of Phase I, I-35W to Portland
Avenue, will be opened April 12, 1993.
3. The City must make recommendation for action on the award of
contract(s) as part of the process.
4. Because timing of the process is critical, Council is holding
a special meeting on April 15 for purposes of making
recommendation on the award of contract(s).
Alternative Recommendation:
None.

Council is asked to make a recommendation at this time.

Issue Statement:
Recommendation to award Phase I right of way clearance contract
for the 77th Street improvement project.
Background:
Bids were opened Monday, April 12, 1993, under direction of the
Minnesota Department of Transportation (MnDOT), for 77th Street
right of way clearance. This Phase I contract includes the
demolition of the remaining homes west of Portland, removal of
foundations and garage slabs, tree removal, abandoning wells and
removal of various poles, fences, etc. Although the contract is
with MnDOT and not the City, it,is necessary for the City of
Richfield to make a recommendation for action on the award of
contract(s); i.e., reject bids or favor award to apparent low
bidder. The attached bid tabulation summary shows TCM
Construction, Inc. to have submitted the lowest responsible bid
in keeping with state specifications, at $176,628.83. MnDOT
officials have reviewed all the bids submitted and confirmed TCM
Construction, Inc. as the lowest bidder. There appears to be no
cause to reject the bid. The contractor is a Disadvantaged
Business Enterprise which helps MnDOT and our project reach our
Equal Employment Opportunity goals for the project.
Recommended Motion:
Make recommendation for award of contract for right of way
clearance for Phase I of the 77th Street improvement project to
TCM Construction, Inc. for $176,628.83
Basis of Recommendation:
1. The City of Richfield must make recommendation for action on
the award of contract(s) as part of the process.
2. TCM Construction, Inc. has submitted the lowest responsible
bid and a review by MnDOT of their bid gives no cause to
reject it.
3. The total amount specified by TCM Construction, Inc. to
complete the right-of-way clearance work is in keeping with
the engineer's estimate, being only .7% over that estimate.
Alternative Recommendation:
None.
Discussion/Decision Mode:
Council is asked to make a recommendation at this time.
