Issue Statement:
Authorization to purchase Soo Line Railroad Company property;
77th Street project.
Background:
Three parcels of land are required from the Soo Line, two
permanent easements and one temporary easement. The Council set
just compensation on these parcels and with MnDOT/FHWA approval
on February 23, 1993, it was possible to make offers. The City
offers totaled $23,300 for the permanent easements (an average of
$3.70 s.f.) and $400 for the temporary easement.
The railroad countered with $66,000. This proposal was based on
a value of $9.45 per square foot which is the value placed by the
County on the railroad parcel between the railroad track and the
former Lampert Lumber site. The proposed settlement is $46,000
or approximately $6.60 per square foot.
Recommended Motion:
Adopt the resolution which authorizes the purchase of Soo Line
Railroad Company parcels 35A, 35A-TE and 36AR.
Basis of Recommendation:
1. The proposed purchase price is less than the estimated cost
of determining value through the condemnation process.
• 2. To maintain the project construction schedule there is not
time to acquire the property through condemnation.
3. MnDOT and FHWA funds are available for the purchase.
4. MnDOT and FHWA procedures were followed.
Alternative Recommendation:
1. Delay action.
2. Reject the proposal.
3. Propose an alternative.
Discussion/Decision Mode:
Approval would fulfill the expectation of Soo Line officials,
provide for their continued cooperation and help assure
maintaining the project time schedule.

RESOLUTION NO.
THE CITY OF RICHFIELD, MINNESOTA
RESOLUTION AUTHORIZING PURCHASE OF REAL PROPERTY
77TH STREET PROJECT
WHEREAS, the City of Richfield, Minnesota desires to
purchase certain real property pursuant to and in furtherance of
the 77th Street Project (Project) heretofore adopted by the City
of Richfield (City) said real property being described as follows
and depicted on the attached Exhibits A & B:
Permanent Easement (Parcel 35A): The North 30.00 feet of
the West 66.00 feet of the East 91.00 feet of the South Half of
the Southwest Quarter of the Southwest Quarter of Section 34,
Township 28, Range 24.
Temporary Easement (Parcel 35A-TE): The South 22.5 feet of
the North 52.5 feet of said West 66.00 feet of the South Half of
the Southwest Quarter of the Southwest Quarter of Section 34,
Township 28, Range 24.
Permanent Easement (Parcel 36 A-R): The North 100.00 feet
of the South 724.00 feet of the East 25.00 feet of the Southwest
Quarter of the Southwest Quarter of Section 34, Township 28,
Range 24, Hennepin County, Minnesota and the North 100.00 feet of
the South 724.00 feet of the West 25.00 feet of the Southeast
Quarter of the Southwest Quarter of said Section 34.
WHEREAS, the City did, on November 23, 1992, set just
compensation for parcel 35A at $9,000 and parcel 35A-TE at $400;
and
WHEREAS, on March 22, 1993, the City did set just
compensation for parcel 36 A-R at $14,300; and
WHEREAS, MnDOT and FHWA authorization to make offers on
these parcels was received on February 23, 1993; and
WHEREAS, the owners rejected these offers and claimed a
value substantially higher than just compensation; and
WHEREAS, the consequences of setting a price through the
condemnation process was considered along with the additional
time which would be consumed; and
WHEREAS, the owner has agreed to enter into agreements
selling the property for a total of $46,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Richfield, Minnesota as follows:
1. That just compensation is revised and set at $46,000.
0 2. That the Mayor and City Manager are authorized to execute
documents to effectuate the purchase at $46,000.
Adopted by the City Council of the City of Richfield, Minnesota
this 5th day of April, 1993.
