Issue Statement:
Council consideration as to whether to hold a City Council Study
Session on July 4, 1994.
Background:
The City Council regularly conducts a Study Session on the first
Monday of each month. However, the first Monday in July 1994 is
a holiday (July 4) and City offices will be closed. Any business
can be carried over to the August 1 Study Session.
Recommended Motion:
Cancel the City Council Study Session regularly scheduled for
July 4, 1994.
Basis of Recommendation:
1. July 4 is a holiday and City offices will be closed.
2. The holiday may cause a problem with a quorum for the
Council.
3. Any business can be carried over to the August 1 regularly
• scheduled City Council Study Session.
Alternative Recommendation:
1. Do not cancel the Study Session.
2. Reschedule the Study Session.

Issue Statement:
Consideration of request for establishment of a Police Cadet
Program in the Public Safety Department.

Background:
For years, •staff has been attempting to recruit minorities,
women and young Richfield residents into the Police
Division. Because of certain obstacles; namely, the
Minnesota Peace Officers Standards and Training (P.O.S.T.)
and civil service procedures, this has been a difficult
After reviewing a number of programs tried by other
communities, staff believes the solution may be a Cadet
Program.
The concept is that an individual who desires to be a police
officer, yet lacks the education and training required for
their POST license, would be hired as a Police Cadet. Once
hired, the cadet would assist the Police Division with crime
prevention duties and other miscellaneous police tasks. At
the same time, they would be required to complete their
required college courses and ultimately attend skills
training by the Minnesota Department of Public Safety.
When all this is accomplished, they would be eligible to
become licensed as a peace officer. Public Safety would in
turn, as part of a Civil Service Commission promotional
process, be able to promote the cadet to a Police Officer.
Once a Police Officer, they would still be required to pass
the division's field training program, etc.
Recommended Motion:
Staff is recommending approval of the Police Cadet Program
as an additional position in Public Safety. It is
anticipated that due to attrition most of the costs
associated with this program can be absorbed in the existing
Public Safety Budget.
Basis of Recommendation:
1. Staff has been working diligently over the years to get
a cross representation of the community. The efforts,
to date, are marginal.
2. The Cadet Program has the potential of meeting community
expectations.
• Alternative Recommendation:
Do not approve the Cadet Program. The result would continue
to limit Public Safety's ability to recruit police
candidates that more closely represent the community.

This program is presented to the Council for discussion and
staff is recommending approval of one Police Cadet as an
additional full-time position in Public Safety.

• Issue Statement:
Consideration of stormwater plan based on newly adopted
Stormwater Capital Policy.
Background:
Several storm water problem areas were identified following the
July 1, 1993 storm and were used as examples during the policy
discussions. The projects which address these problem areas can
be separated into two groups:
A. Minor, less costly projects which can be addressed yet this
year within current utility fund balance.
? 6601 Stevens. A 150' storm sewer pipe can be placed under
the sidewalk south of 66th Street extending west of Second
Avenue at an estimated cost of $22.,000.
e 7632 Logan. A manhole can be placed on the storm sewer, a
storm sewer stubbed to the property line and the street
repaired for an estimated cost of $5,000.
? 6645 Queen. The alley apron can be raised in this area at an
estimated cost of $7,500.
B. Major, more costly projects which may require funding
considerations ouside the current utility fund balance.
? Richfield Lake Outlet. A pipe under Rae Drive to Wood Lake
at an estimated cost of $275,000.
? Wood Lake Dredging. Remove sediments in Wood Lake for an
estimated $250,000.
? 70th/Penn-Russell. Remove the seven single family homes in
the 6900 block of Penn Avenue, east side, and construct a
holding pond, perhaps with a coordinated HRA project for an
estimated $750,000.
There are projects.which need to be addressed on an ongoing
basis. Residents call the Community Services Department with
concerns about flooding and with requests for assistance.
Specific areas called to the City's attention in this manner will
be brought to the Council as the Stormwater Policy allows.
Specifically, the residents of the 6900 block of Columbus Avenue
are requesting attention to stormwater problems.
Details of a grant program are being prepared as part of the
budget process. The City Council will address funding and
scheduling options during the budget process. Funding options
include:
? Using the existing $639,000 balance in the stormwater
utility.
? Increasing the annual stormwater utility fee.

s Borrowing from internal funds.
? Issuing additional stormwater utility revenue bonds.
Council Members have expressed a concern for the residents of the
home at 6933 Penn. The buyout of this home is included with the
1994 projects. The Housing and Redevelopment Authority (HRA)
would formulate an overall plan to maximize the use of the
remainder area for housing. Initially, consideration would be
given to a townhouse development in response to a voiced demand
from New Ford Town and Rich Acres residents who are looking for
replacement housing. Land availability, timing, location on site
and size affect the type housing, ability to phase development
and the overall project return. The HRA has been successful in
maximizing return on investment in other housing projects and
major consideration would be given to ensuring maximum return for
the land at this location. Council may choose to authorize the
purchase of the remaining six homes on a priority basis once the
funding is determined.
Recommended Motion:
The newly adopted Stormwater Capital Policy could support the
following alternative approaches:
1. The Council could choose to immediately address the minor
projects noted in A. above and wait to address the major
projects noted in B. above during budget discussion of the
Capital Improvement Budgets. OR
• 2. The Council could choose to selectively address some major
projects now instead of awaiting the budget process. The
funding options listed above would also need to be addressed
now.
Basis of Recommendation:
1. Concern has been expressed about the level of stormwater
protection in the community.
2. A revised Stormwater Capital Policy has been adopted.
3. A plan, based on the policy, should be implemented.
Alternative Recommendation:
None.
Discussion/Decision Mode:
This item is on the June 27, 1994 Council agenda. A decision is
requested at this time so implementation of the Stormwater
Capital Policy may proceed.

Issue Statement:
Presentation of the City of Richfield Comprehensive Annual
Financial Report (CAFR) for the fiscal year ended December 31,
1993.
Background:
The City's. auditing firm of Deloitte & Touche completed the audit
of the City's fiscal year ended December 31, 1993 in June 1994.
The CAFR was subsequently submitted to the State of Minnesota as
required and to the Government Finance Officers Association for
compliance review.
At the June 27, 1994 City Council Study Session meeting,
representatives from Deloitte & Touche made a presentation of the
CAFR to the City Council and answered any questions concerning
the report. The action to be taken at the June 27, 1994 City
Council meeting is the official receipt of the CAFR by the City
Council.
Recommended Motion:
It is recommended that the City Council accept the Comprehensive
• Annual Financial Report of the City for the year ended December
31, 1993.
Basis of Recommendation:
1. The City's auditor has performed an audit of the City's
financial records for the year ended December 31, 1993 and
prepared reports to the City Council concerning legal
compliance and internal control.
Alternative Recommendation:
1. The City Council could ask the auditors for further
explanation of their findings.
Discussion/Decision Mode:
Action on this items is requested at the June 27, 1994 City
Council meeting. The CAFR has been previously submitted to the
State of Minnesota, pursuant to State law.

Issue Statement:
Continuation of public hearing for subdivision waiver at 7416
Fourth Avenue for division into two single family lots.
Background:
The City Council discussed this subdivision waiver request on
June 13, 1994 and continued the matter to June 27, 1994 to permit
a meeting with the neighbors. All of the adjoining neighbors on
all sides and across the street which included those at the
Council meeting were invited to a meeting on June 20, 1994 with
staff. A memorandum of that meeting setting forth the issues and
responses to those concerns is attached.
The subject property at 7416 Fourth Avenue is owned by Craig and
Julia Bennink. Craig has lived in this single family home for 16
1/2 years. The Bennink's desire to remain in Richfield but the
existing home is substandard and is not cost effective to
remodel. They approached the Richfield HRA for evaluation of the
house under the Richfield Rediscovered program and it qualified.
As a result, the Bennink's and the HRA are requesting the City to
consider a subdivision waiver of their 100' X 134.22' site so
• that the site could be split into two 50' X 134' sites. Marlin
Grant Homes Inc. is proposing to build a new home for the
Bennink's on the north half of the site. The south half of the
site would also be developed by Marlin Grant Homes Inc., targeted
as a relocation site for a family from New Ford Town/Rich Acres.
Mr. and Mrs. Bennink and Mr. Grant are planning to attend the
Council meeting.
On June 21, 1994 the Hearing Officer held a variance hearing.
The subdivided lots would contain 6,721 square feet each (50' X
134.221). The zoning code requires lot subdivisions after
January 1, 1985 to contain at least 6,750 square feet and a 50
foot frontage. If the lots had been seven inches deeper, a
variance would not be necessary. Approval of the subdivision
waiver is conditional upon variance approval. The Hearing
Officer findings are in process.
Recommended Motion:
Adopt the attached resolution approving the subdivision waiver
for 7416 Fourth Avenue.
Basis of Recommendation: _
1. The proposed lot size and house plans have been evaluated
with the other lots and homes on the 74th Street and Fourth
Avenue shared block face. A summary of plat map and building
records indicate:

? The proposed home has a lot coverage of 816 sq. ft.
There are 14 larger homes, one the same size, and two
smaller homes on the shared block face.
? The proposed project has an attached double garage.
There are 11 double garages on the shared block face
(six larger and five smaller than the proposed) and
six single garages. Most garages are unattached on
the block face.
? The proposed project has a total building (house and
garage) coverage of 1,256 sq. ft. Ten lots have a
greater coverage. Seven lots have a lesser coverage.
The largest homes are on the narrower lots.
? The proposed house is a 1' story design with a height
of 22 feet. There are six homes with a similar height
• including one across the street at 7411 Fourth Avenue.
There are nine single (19 to 20 ft. high) and two-2
(28 to 29 ft. high) story homes.
? Most homes were built in the i9401s. A house built in
1968 at 7344 Fourth has an attached double garage, a
lot size of 47 X 135, and a building coverage of 1,704
sq. ft. A house built in 1985 at 7444 Fourth has a
detached garage, a lot size of 59 X 135, and a
building coverage of 2,232 sq. ft. The proposed
project is much more modest, being 400 sq. ft. and 900
sq. ft. smaller, respectively. The allowed 30' front
setback at 7444 Fourth was a neighborhood concern. In
response, the proposed front setback at 7412 Fourth
will be 36' feet.
2. Ten homes with a lot width of 50 feet or less have been built
under the Richfield Rediscovered program. The new homes at
7320 Fifth, 7129 First and 7128 First are the best examples
in terms of size and height in adjacent neighborhoods. In
each instance, alley access was available but the buyer
preferred an attached double garage with access from the
street. The proposed project on Fourth Avenue does not have
alley access.
• 3. On one occasion through Richfield Rediscovered, a 100 ft.
wide lot has been developed. However, the sale price for the
lot was approximately $60,000 and the finished property had a
-a
$289,000 value. It is unlikely that a similar development
would occur at this location to ensure an HRA return on
investment. Two homes valued in the $120,000 to $130,000
range are planned and are much more similar to homes in this
neighborhood.
4. Compliance with the regular platting requirements of Section
500.05, Subd. 1 of the City Code would result in an
unnecessary hardship to the applicant, Craig and Julia
Bennink.
5. This subdivision process does not interfere with the purposes
of platting regulations of Section 500 of the City Code.
6. Approval of the subdivision waiver would establish two
buildable lots for the construction of two new single family
homes in this residential neighborhood.
Alternative Recommendation:
The City Council may deny this subdivision waiver if a finding of
fact determines that the proposal would have an adverse impact on
adjacent properties. An adverse impact has not been determined.
Discussion/Decision Mode:
A public hearing is scheduled at 7:00 p.m. on Monday, June 27,
1994. The hearing will be held in the City Council Chambers of
• Richfield City Hall, 6700 Portland Avenue. Notice of the
original hearing was mailed to property owners within 350 feet of
the subject property. The property owners attending the original
Council meeting and the neighborhood meeting were informed of the
continuation date. The building corners for the new home have
been staked if any Council Member wants to stop and view the
siting. The report of the Hearing Officer is being prepared as a
result of the June 21 variance meeting. The subdivision waiver
finding is contingent on a favorable Hearing Officer finding.

RESOLUTION NO.
RESOLUTION AUTHORIZING SUBDIVISION WAIVER
(7416 FOURTH AVENUE)
WHEREAS, an application has been filed which requests
approval of a subdivision waiver for the division of a certain
parcel of land generally located at 7416 Fourth Avenue, legally
described on Attachment One, attached hereto and hereby made a
part hereof (hereafter the subject property); and
WHEREAS, the proposed division of land for which the
subdivision waiver is sought is as legally described on
Attachment Two, attached hereto and hereby made a part hereof;
and
WHEREAS, the proposed division of the subject property, in
conjunction with lot area variances, would establish two
buildable lots for the construction of two new homes; and
WHEREAS, the City has fully considered the request for
approval of the subdivision waiver; and
WHEREAS, the Council finds that compliance with City Code
Section 500.05, Subd. 1 would result in unnecessary hardship and
that failure to comply therewith will not interfere with the
• purposes of platting regulations of Section 500.01.
NOW, THEREFORE, BE.IT RESOLVED by the City Council of the
City of Richfield, Minnesota as follows:
1. A waiver for the subdivision of property legally described
on Attachment One is hereby approved subject to the
following conditions:
a. That all future transfers of any of the property
described in Attachment One shall be by parcel or
parcels described in Attachment Two.
b. That lot area variances for property described in
Attachment Two be approved by the City.
2. Upon compliance with such conditions, City staff is
authorized and directed to take any action necessary to
effectuate this resolution and to authorize the recording of
conveyances complying with the request of this resolution.
Passed and adopted by the City Council of the City of
Richfield, Minnesota this 27th day of June, 1994.

SUBJECT: A Discussion of Development.Impact 7412 Fourth Avenue
(Proposed) and 7410 Fourth Avenue (existing)
Jeff and Sue Pitzel live at 7410 Fourth Avenue which adjoins the
proposed development site at 7412 Fourth Avenue. At a
neighborhood meeting on June 20, 1994, Sue Pitzel expressed the
following concerns. Each concern is followed by a staff
response.
1. The pine tree must be saved. The pine tree will be saved.
The excavation will be shallow (two to three feet deep) and
10 feet away from the base of the tree for installing the
driveway and garage. The visible major tree roots which run
east and west from the base of the tree will not be affected.
The City forester has inspected the site and determined that
the excavation will not harm the tree. One tree branch may
be removed, as the neighbors may discuss amongst themselves.
2. How much fill and change in slope will occur at 7412 Fourth
Avenue. No fill or change in slope is needed. The final
grade around the perimeter of the new home foundation will
include sufficient back fill to create a positive slope
toward the lot line. However, the proposed site is already
lower than the Pitzel house and garage so that storm water
drainage will not be directed onto the adjoining side lot.
Further, no fill will be added to create transition problems
between the sites.
3. The street view is important. The street view is essentially
unchanged. The garage will start 36 feet back from the front
instead of the allowable 30 feet. As a result, the garage
starts at a lot depth similar to the depth of the pine tree
and the pine tree actually shields the view of the new garage
from the Pitzel's view from their house.
4. The house seems so big and close to our house. This lot has
always been vacant and any house could appear large and
close. However, the actual size comparisons demonstrate
similarity:

Upon completion, the new one story garage at 7412 Fourth will be
5 ft. from the lot line and 15 ft. from the Pitzel garage. The
Pitzel garage is the closest structure to the new development.
The new 1h story house will be 8 ft. from the lot line and 18 ft.
from the Pitzel garage.

Background:
Consideration of purchase in excess of $5,000 for asphalt overlay
of parking area at Penn Avenue municipal liquor store.
Background:
Last winter, the main parking area at the Penn Avenue municipal
liquor store, 6444 Penn Avenue, experienced a frost heave which
resulted in considerable damage. City street crews have
temporarily repaired the area to prevent damage and/or possible
injury to customers, although major work is needed. Other areas
have been repaired in the past, however, a complete resurfacing
of the asphalt surface is needed.
Two blacktopping companies submitted quotes on a total bituminous
pavement project. Alternate quotes were submitted by the two
contractors at half the cost of a total surface replacement. The
City has been assured that a fabric and overlay treatment will
serve as well as a total replacement.

Recommended Motion:

submitted by Plehal Blacktopping, Inc for a fabric and overlay
treatment of the Penn Avenue municipal liquor store parking area.
Basis of Recommendation:
1. A fabric and overlay treatment will serve as well as a total
surface replacement of the Penn Avenue municipal liquor
store parking area.
2. Work will be performed by a reputable contractor.
3. Approval of the lowest quote is requested.
4. Bituminous repair work for the parking area at the Penn
Liquor store is necessary.
Alternative Recommendation:
1. Continue to patch and repair the parking area on an as-needed
basis.

Issue Statement:
Award of contract for supply and installation of playground
equipment at Donaldson Park.
Background:
Donaldson Park is located in the vicinity of 74th Street and
Irving Avenue. The Capital Improvement Budget includes $60,000
for redevelopment of Donaldson Park playfeatures. The original
playfeatures, constructed in 1974 of wood products, no longer
meet Consumer Product Safety Commission guidelines nor ADA
requirements. The new design will meet or exceed those
guidelines and requirements. The equipment will be constructed
of primarily metal and plastic products similar to other
playfeatures installed in parks in the past four years.
Additional elements in the project include labor and equipment
costs for removal of existing play equipment and sand surface and
overlay of the basketball court adjacent to the equipment. If
there is sufficient funding left, diggers and spring animals will
be added to the smaller of the two play areas being replaced.
Bid packages were sent to four playground equipment sales
representatives. On June 16, 1994, two bids were received for
supply and installation of the Donaldson Park playfeature.
Recommended Motion:
Accept the bid minutes/tabulation and award a contract to Earl F.
Andersen, Inc. for $38,493.
Basis of Recommendation:
1. Earl F. Andersen, Inc. is a reputable supplier of playground
equipment.
2. Landscape Structures, the manufacturer whose equipment they
propose to supply and install, is highly regarded as one of
the finest in the world.
3. Earl F. Andersen, Inc. has supplied other play equipment in
the City and has been responsible and responsive to any staff
questions or concerns.
Alternative Recommendation:
1. Do not award any contract for playground equipment at
Donaldson Park.
2. Select different funding sources to be used in the award of
contract.

Frank Johnson.
Background:
The Richfield Human Rights Commission has selected a Citizen of
the Year since 1971. The award is presented to a person whose
actions demonstrate an awareness and commitment to the attitudes
and practices that foster human understanding, tolerance and the
spirit of human relations.
Recommended Motion:
The City Council, in cooperation with the Human Rights
Commission, should present the award to Frank Johnson.
Basis of Recommendation:
1. The Human Rights Commission has met to review nominations and
discuss the presentation of this award for 1993.
2. Based upon that meeting, Frank Johnson was selected as the
1993 award recipient.
• 3. Mr. Johnson has demonstrated a lifelong commitment to the
disabled and has served on the Richfield Senior
Citizen/Handicapped Commission, Richfield ADA Citizen Review
Committee, Advisory Council of Retired Senior Volunteer
