Issue Statement:
Consideration of a resolution approving special legislation
concerning the Interstate/Lyndale/Nicollet tax increment
financing district.
Background:
According to State law, a portion of "new" tax value in tax
increment financing districts which were established after 1979
must contribute to the fiscal disparities pool. As the
Interstate/Lyndale/Nicollet (ILN) district is currently
established, the fiscal disparities contributions are to be made
from the ILN district. That initial election was based on the
CDR project that was then under consideration. Since that
initial election, significant changes in the finances of this
district have occurred. These changes include the loss of seven
years of debt amortization and the unlikelihood of a high value
development. Therefore, it may be appropriate to consider a
change in the way fiscal disparities contributions are made with
respect to the ILN district.
During the past legislative session, special legislation was
introduced on behalf of the City which would allow Richfield to
• change its election of the way tax increment receipts for the ILN
tax increment financing district are treated under the provisions
of the Minnesota Fiscal Disparities Law. Under this special
legislation the City would be permitted, though not required, to
transfer the fiscal disparities contribution from the ILN
district specifically to a Citywide contribution. Making such an
election would provide more available tax increment for
redevelopment within the ILN district.
In anticipation of this legislation and at the direction of the
HRA, City staff has developed a process to set criteria for data
analysis, public information meetings and the necessity for any
proposed change in the formula in the fiscal disparities
contribution formula. The City would have the option to make an
election regarding the source of fiscal disparities contributions
for the ILN district at the time a redevelopment project is
proposed.
In order for the City of Richfield to take advantage of this
special legislation which makes it possible to choose a different
methodology of contributing fiscal disparities, the City must
approve, by resolution, the special legislation before the start
of the new legislative session. If the City fails to do so, the
special legislation would not become effective and the City of
Richfield would have no choice with respect to how it would elect
• to make the fiscal disparities contributions on behalf of the ILN
district.

Recommended Motion:
It is recommended that the City Council adopt the attached
resolution approving special legislation concerning the
Interstate/Nicollet/Lyndale tax increment financing district and
forward a copy of the resolution to the Secretary of State's
office.
Basis of Recommendation:
1. The special legislation has been passed by the legislature
in the past session which would allow the City of Richfield
to make an election concerning its fiscal disparities
contributions for the ILN district.
2. In order for the special law to become effective, the City of
Richfield must on or before the start of the new legislative
session approve the special legislation by Council action.
3. Further analysis may indicate a need to switch the fiscal
disparities.contributions from the ILN Specific to a
Citywide basis.
4. Acceptance of this legislation makes no changes in the ILN
district now. It only allows the City the option to
authorize changes at a later date.
Alternative Recommendation:
. 1. The City Council could decide not to ratify or approve the
special legislation; thereby rendering the legislation
invalid once the new legislative session begins.
Discussion/Decision Mode:
The City Council may wish to consider this action at the
September 28, 1992 meeting in ensure ample time to submit
necessary documentation back to the Secretary of State's office
regarding action on this piece of special legislation.

Issue Statement:
Consideration of a resolution approving special legislation
concerning advance funding for 77th Street project.
Background:
During the past legislative session, special legislation was
passed which would permit the City of Richfield to issue general
obligation bonds in order to advance funds to the Commissioner of
the Minnesota Department of Transportation (MnDOT) for the 77th
Street project. It was anticipated that bonds might be issued to
advance 77th Street construction. The bonds would be payable
from State and Federal grants and MSA funds. These bonds, which
are not to exceed $35 million, would not require an election or
be included in the net debt allowable for the City within the
meaning of the State Statute. The bond proceeds advanced to
MnDOT would enable the project to be completed before normal
--funding-for the-frontage-road improvements would allow.
Under the legislation, MnDOT is required to make annual payments
over 10 years to the City of Richfield to repay the amount of
funds advanced by the City for the 77th Street project. MnDOT is
not required to pay interest on the money advanced unless it is
• demonstrated that the cost of the project is less than the cost
to build a frontage road immediately adjacent to 1494. In this
case, MnDOT may reimburse the City up to 100% of the City's costs
of the project.
The timing of construction of the project and repayment of the
bond funds are to be spelled out in an agreement between MnDOT
and the City.
The City may use the payments from MnDOT to retire the bonds,
both principal and interest, and to cover other related costs to
issue the bonds. In addition, municipal state aid street funds
may be pledged by the City for interest on the bonds.
The action taken here does not authorize the sale of the bonds,
instead it approves the permissive special legislation which
would enable the City to use such an advance funding for the 77th
Street project in the future.
Recommended Motion:
Approve the attached resolution giving approval to the special
legislation concerning advance funding for the 77th Street
project.
Basis of Recommendation:
1. From the City's perspective, it would be desirable to
S expedite the construction of 77th Street as a remote
frontage road.

2. Special legislation was passed in the last legislative
session which would allow the City of Richfield to issue up
to $35 million in bonds for advance funding.to be used by
MnDOT for the expedited construction of 77th Street.
3. In order for the City to take advantage of this permissive
legislation, the City Council must approve the special
legislation before the start of the next legislative
session.
Alternative Recommendation:
The City Council could decide not to approve the legislation.
This would mean that the bill- would not become effective and
would become void after the beginning of the next legislative
session.
Discussion/Decision Mode:
It is recommended that the City Council take action to approve
this matter at the September 28, 1992 City Council meeting in
order.to provides-ample,-time:to_notify the Secretary of State's
Office of this action before the next legislative session.

Issue Statement:
Request for a conditional use permit to allow a pizza carryout
and delivery business at 6401 Lyndale Avenue.
Background
Pizza Hut Delivery is requesting a conditional use permit to
allow a carryout and delivery business at Woodlake Plaza Shopping
Center. The business would not provide dine-in service; however,
because the use is restaurant related, a conditional use permit
is required. The business would be located in the small detached
building on the northwest corner of the property, which is also
occupied by the A-1 Vacuum Cleaner Company.
The building alterations consist of interior remodeling and
installation of kitchen equipment. The exterior changes include
new landscaping along 64th Street and new business signage.
The hours of operation would be Sunday through Thursday from 11
a.m. to 12 midnight, and Friday through Saturday from 11 a.m. to
1 a.m. The business would employ eight to ten drivers during
peak times (e.g., Friday evenings from 5 p.m. to 8 p.m.), and two
to four drivers during non-peak times. Woodlake Plaza has two
access points from Lyndale Avenue and one from 64th Street.
One adjacent property owner appeared at the Planning Commission's
review to voice concerns about high traffic volume and speeding
on 64th Street. Subsequent traffic counts and speed monitoring
on 64th Street in this area appear to be within normal
parameters.
Recommended Motion:
Approve the conditional use permit for Pizza Hut Delivery at 6401
Lyndale Avenue with the following stipulations:
1. That a hose bib be provided for the dumpster area per
health code requirements.
2. That a cash escrow be provided for the proposed landscape
improvements.
Basis of Recommendation:
1. On August 25, 1992, the Planning Commission voted unanimously
to recommend approval of the conditional use permit.
2. The proposed use is consistent with the shopping center and
with the City's comprehensive plan.
• 3. The handicap parking requirement would be met on the site.

4. The additional landscaping will buffer and soften the
• appearance of the building.
5. On-site parking is adequate for the proposed use. The City
Council approved additional parking for the shopping center
on September 14, 1992.
Alternative Recommendation:
Deny the conditional use permit for Pizza Hut Delivery with a
finding of fact that the proposal would have an adverse impact on
adjacent properties or the City as a whole.
Discussion/Decision Mode:
A public hearing is scheduled at 7:00 p.m. on Monday, September
28, 1992. The hearing will be held in the City Council Chambers
of Richfield City Hall, 6700 Portland Avenue. Notice of hearing
was published in the Sun-Current and mailed to property owners
within 350 feet of the subject property.

Issue Statement:
Purchase in excess of $5,000 for Arena boiler repair.
Background:
The City Council policy resolution on purchasing provides that
when the purchase of merchandise, materials, equipment or .
construction exceeds the amount of $5,000, authority to purchase
shall be submitted to the City Council for consideration.
During the second week of shutdown at the Arena, the boiler is
opened and inspected. This is the only time during the year that
it can be inspected. It was discovered that one section of the
insulation material on the front door had broken off, and the
metal holding the insulation had deteriorated. The upper half of
the back door insulation was beginning to separate. The Packaged
Boiler Burner Service (PBBS) Equipment Company was contacted. A
sample of.the;insulation>material was taken and found to be
asbestos. Therefore, all the insulation on both doors needed to

Issue Statement:
Purchase of approximately 670 square yards blacktop in excess of
$5,000 for street patches over sewer and water service disconnects
for the 77th Street project.
Background:
The City Council policy resolution on purchasing provides that when
the purchase of merchandise, materials, equipment or construction
exceeds the amount of $5,000, authority to purchase shall be
submitted to the City Council for consideration.
As part of the building demolition process, approximately 77
service line disconnect holes (8' X 8') will need to be dug in
conjunction with the 77th Street project. Approximately 670 square
yards of blacktop will be needed to repair the street once the
disconnections are completed. The service lines must be
disconnected prior to demolition and/or removal. The new road
construction is not expected to begin until some time after
structure removal. Staff obtained quotes for the repair work from
two suppliers as follows:
Plehal Blacktopping $10.00/sq. yd.
Bituminous Roadways, Inc. $13.25/sq. yd.
Recommended Motion:
Approve a purchase order to Plehal Blacktopping for approximately
670 sq. yds. of blacktop work at $10.00/sq. yd. for an estimated
total of $6,700.
Basis for Recommendation:
1. The work is required for the 77th Street project.
2. Plehal Blacktop submitted the low quote.
3. The cost is eligible for federal reimbursement. Therefore, it
is necessary to make temporary road repair after service line
disconnection.
Alternative Recommendation:
None.

Issue'Statement:
Award of contract for construction and installation of fairway
irrigation system upgrade at Rich Acres Golf Course.
Background:
The 1992 Capital Budget includes $60,000 for upgrading fairway
irrigation on the regulation course at Rich Acres Golf Course.
The completion of the irrigation upgrade on the regulation course
is proposed in the 1993 Capital Budget.
To keep disruption of play to a minimum, the work is to be
performed in the fall of 1992 with start up of the system in 1993
also a part of the contract specifications. To provide the
greatest latitude, the specifications were prepared with
regulation holes #1 through #9 as the base bid and alternates
were written for regulation holes #10 and #11. The irrigation
upgrade is-to•connect to an existing control of the system and
provide additional flexibility in the operation and repair of the
system; i.e., additional zoning will permit one hole to be
started up or shut down rather than a whole section of the
course.
• Plans and specifications were picked up by four companies. One
bid was received at a formal bid opening held September 15, 1992.
Two companies were from out of state and did not feel they had
sufficient time to prepare bids meeting Minnesota requirements.-
Staff has not heard from the fourth company. A copy of the bid
minutes and tabulation is attached. Staff has reviewed the bid
and finds Northern Irrigation Systems, Inc. submitted a bid close
to the estimate for the base bid. Because alternates #1 and #2
for the base bid seem high, staff does not recommend awarding
them.
Recommended Motion:
Accept the bid minutes/tabulation and award a contract for the
base bid to Northern Irrigation Systems, Inc. in the amount of
$64,195 for fairway irrigation upgrade of regulation holes #1
through #9 at Rich Acres Golf Course.
Basis of Recommendation:
1. The project is included in the 1992 and 1993 Capital Budget.
2. The project will greatly improve the flexibility of operating
and maintaining the irrigation system at Rich Acres Golf
Course.
3. Northern Irrigation Systems, Inc. submitted the lowest bid by
• a responsible bidder meeting specifications.
4. There is sufficient funding available.

• Alternative Recommendation:
1. Reject all bids.and do not do the project. However, it is
becoming more difficult to operate and maintain the current
irrigation system.
2. Reject all bids and authorize staff to pursue the project at
a later date. However, staff feels the bids received were
reasonable and better prices would not be received at a later
date.

This item is scheduled for consideration at the September 28
Council meeting. Action is requested at this time.

Issue Statement:
Approval of Change Order No. 1 for the Lyndale Avenue Overlay
Project, C.P. 879.
Background:
The City Council policy resolution on purchasing provides that
when the purchase of merchandise, materials, equipment or
construction exceeds the amount of $5,000, authority to purchase
shall be submitted to the City Council for consideration.
The wires for the traffic signal loop detectors were installed in
the concrete beneath the blacktop overlay on Lyndale Avenue
during a 1982 street construction project. Staff believed that
the wires would be unaffected by the blacktop replacement work
now under contract. However, since construction started, staff
has discovered that many of the loops were buried just below the
surface,.:and-.have consequently.been-unavoidably destroyed during
the milling process. Staff has also been notified that many of
the loops that visually appear to be undamaged are not working
properly. Staff obtained quotations from three companies who are
qualified to perform the repair work as follows:

Basis for Recommendation:
1. The loop detectors assure an even flow of. traffic through the
area.
2. Repair of the detectors at this time would prevent cutting
open the new overlay at a later date.
3. This is a Municipal State Aid (MSA) on-system expense and,
therefore, is reimbursable through Richfield's MSA
construction account.

Adoption of resolution establishing just compensation and
authorizing the purchase of 7645 12th Avenue for the 77th Street
project.
Background:
The owner of the property in Phase II of the 77th Street (east of
Portland Avenue) is experiencing a hardship. The sale of the
property at this time would help relieve that hardship.
Recommended Motion:
Adopt the attached resolution which does the following:
1. Sets just compensation at $71,000 and authorizes staff to
negotiate and purchase the properties at the indicated
values; and
2. Authorizes the City Manager and Mayor to execute purchase
agreements in the amounts of just compensation.
Basis of Recommendation:
• 1. MnDOT and FHWA appraisal procedures were followed.
2. Project funds are available from MnDOT and FHWA.
Alternative Recommendation:
Do not set the purchase price and authorize purchase.
Discussion/Decision Mode:
Approval will make it possible to help relieve the owner's

RESOLUTION ESTABLISHING JUST COMPENSATION,
AUTHORIZING PURCHASE OF REAL PROPERTY
WHEREAS, the City of Richfield, Minnesota desires to
purchase certain real property pursuant to and in furtherance of
the 77th Street Project (Project) heretofore adopted by the City
of Richfield (City) said real property being described as;
Lot 9, Block 4 South Murray Lane Addn, aka 7645 12th Avenue
South
WHEREAS, the City has adopted an official map for
improvements to 77th Street; and
WHEREAS, the improvements to 77th Street necessitate the
purchase of real property; and
WHEREAS, the City is authorized by Minnesota Statutes to
acquire real property within its jurisdiction; and
• WHEREAS, Minnesota Department of Transportation (MnDOT) and
Federal Highway Administration (FHWA) are funding this project;
and
WHEREAS, the City has caused appraisals of the subject
property to be made by qualified independent professional real
estate appraisers to determine fair market value; and
WHEREAS, a qualified review appraiser has certified the
appraisal report as to conformity with appraisal standards and
has certified same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Richfield, Minnesota as follows:
1. That just compensation is determined to be $71,000.
2. That the City Manager is authorized and directed to
commence negotiations for the purchase of said real
property.
3. That the City Manager and Mayor are authorized to
execute a purchase agreement for the amount of just
compensation set forth in this resolution.

possible that the City intends to acquire his/her

Resolution providing for polling places and designating election
judges for the November 3, 1992 State General Election.
Background:
Minnesota Statute 204B.21, Subd. 2 provides that election judges
for precincts in a municipality shall be appointed by the
governing.body of the municipality and that the appointments be
made at least 25 days before the election at which the election
judges will serve. The State General Election will be conducted
on Tuesday, November 3, 1992. Therefore, the City Council must
appoint election judges to serve at this election.
Recommended Motion:
Adopt the attached resolution designating polling places and
appointing election judges for the State General Election to be
held..on._Tuesday,-:November 3, 1992.
Basis for Recommendation:
1. Compliance with Minnesota Statute 2048.21, Subd. 2
2. The proposed resolution contains names of those who have
indicated a willingness and ability to serve as an election
judge for the November 3, 1992 State General Election. The
names come from a pool of people who have indicated their
interest in serving as an election judge to the County
Auditor pursuant to the provisions of M.S. 204B.21 subd.l and
those who have previously served or indicated interest in
serving.
Alternative Recommendation:
1. The City Council could chose to appoint others who are not
named in the resolution.
2. If the City Council does not appoint election judges, the
conduct of the election would not be valid.
Discussion/Decision Mode:
The City Council is required by state statute to make election
judge appointments at least 25 days prior to the election.
Therefore, it is recommended the City Council pass the attached
resolution at this meeting.
