HOUSING AND REDEVELOPMENT AUTHORITY HRA Letter No. 6~ Agenda October 16, 1995 Issue Statement: Work in cooperation with the Metropolitan Council and City Council to participate in "Metropolitan Livable Community Act" programs. Background: The Minnesota Legislature created the "Metropolitan Livable Communities Act" in June, 1995. The Act designates the Metropolitan Council to develop an improved regional framework for: • housing revitalization and redevelopment; • affordable and lifecycle housing; • greater financial support for pollution clean-up. If Richfield chooses to participate in the program, access is provided on a competitive basis to three funds starting in 1996: 1. The Livable Communities Demonstration Account provides approximately $4 million annually as grants and loans-. A greater diversity in housing stock and improved transit and job access to that housing is a priority. 2. The Tax Base Revitalization Account provides approximately $6.5 million annually as grants to cleanup polluted sites. 3. The Local Housing Incentives Account provides $1 million annually as grants to help communities achieve locally developed housing goals. The Metropolitan Council finds Richfield to be a very affordable place to live. The Metropolitan Council seeks numerical goals in Richfield that: • Continue to emphasize single family market rate new construction and remodeling. • Create a greater variety of apartment choices. • Provide affordable housing opportunities such as Vo-Tech or Habitat. Thus, the goals that are developed will be consistent with HRA programs already underway. Recommended Motion: Recommend to the City Council that Richfield elect to participate in the Local Housing Incentive Account Program by November 15, 1995. Further, the HRA requests the Council to authorize the HRA to formulate housing goals by January 15, 1996 and prepare an action plan to meet those goals by June 30, 1996. Basis of Recommendation: 1. The HRA is an advisor to the City Council concerning housing policies. It is appropriate for the HRA to formulate a position and present it to the City Council as a recommendation. 2. The Metropolitan Livable Communities Act requires a city to take an action to participate or not. A sample resolution which the City Council must act on is attached. 3. Richfield participation provides greater access to state resources than not participating. 4. Participation is based on locally decided goals, plans, and programs. Alternative Recommendation: Take no action. In effect, Richfield chooses not to participate in the Livable Communities Act programs. Discussion/Decision Mode: If the HRA recommends participation and the City Council concurs: The Metropolitan Council must be notified of Richfield's intent by November 15, 1995. 2. By January 15, 1996, housing goals must be finalized with the Metropolitan Council. Staff would recommend goals. 3. By June 30, 1996, an action plan would be developed in support of achieving the goals. Respectf Ily submitted, Jame rosser Execu ' Director JDP:cak ~V ~O CALENDAR YEAR 1996 WHEREAS, the Metropolitan Livable Communities Act (1995 Minnesota Laws Chapter 255) establishes a Metropolitan Livable Communities Fund which is intended to address housing and other development issues facing the metropolitan azea defined by Minnesota Statutes section 473.121; and WHEREAS, the Metropolitan Livable Communities Fund, comprising the Tax Base Revitalization Account, the Livable Communities Demonstration Account and the Local Housing Incentives Account, is intended to provide certain funding and other assistance to metropolitan azea municipalities; and WHEREAS, a metropolitan azea municipality is not eligible to receive grants or loans under the Metropolitan Livable Communities Fund or eligible to receive certain polluted sites cleanup finding from the Minnesota Department of Trade and Economic Development unless the municipality is participating in the Local Housing Incentives Account Program under Minnesota Statutes section 473.254; and WHEREAS, the Metropolitan Livable Communities Act requires the Metropolitan Council to negotiate with each munici- pality to establish affordable and life-cycle housing goals for that municipality that are consistent with and promote the policies of the Metropolitan Council as provided in the adopted Metropolitan Development Guide; and WHEREAS, by June 30, 1996, each municipality must identify to the Metropolitan Council the actions the municipality plans to take to meet the established housing goals; and- WHEREAS, the Metropolitan Council must adopt, by resolution after a public hearing, the negotiated affordable and life- cycle housing goals for each municipality by January 15, 1996; and WHEREAS, a metropolitan azea municipality which elects to participate in the Local Housing Incentives Account Fro- gram must do so by November 15 of each year; and WHEREAS, for calendaz yeaz 1996, a metropolitan azea municipality can participate under Minnesota Statutes section 473.254 only if: (a) the municipality elects to participate in the Local Housing Incentives Account Program by November 15,1995; (b) the Metropolitan Council and the municipality successfully negotiate affordable and life-cycle housing goals for the municipality; and (c) by January 15, 1996 the Metropolitan Council adopts by resolution the negotiated affordable and life-cycle housing goals for each municipality; NOW, THEREFORE, BE IT RESOLVED THAT the [specific municipality] hereby elects to participate in the Local Housing Incentives Program under the Metropolitan Livable Communities Act during calendaz yeaz 1996. RESOLUTION ELECTING TO PARTICIPATE IN THE LOCAL HOUSING INCENTIVES ACCOUNT PROGRAM UNDER THE METROPOLITAN LIVABLE COMMUNITIES ACT By: Clerk HOUSING AND REDEVELOPMENT AUTHORITY HRA Letter No. 66 Agenda October 16, 1995 Issue Statement: Cancellation of public hearing for the sale of 6933 Queen Avenue; continuation of public hearing on 7200 Third Avenue to the November meeting. Background: In June 1995, the HRA authorized the purchase of 6933 Queen Avenue. This is a substandard property which the owner used as rental property. The owner has withdrawn his offer to sell to explore other market options. In August 1995, the HRA authorized the purchase of 7200 Third Avenue. A New Ford Town buyer reserved the lot with a builder in mind. Recently, the buyer secured a different builder and therefore requires additional time to finalize building plans with the new builder. Recommended Motion: Cancel the public hearing for the sale of 6933 Queen Avenue. Continue the public hearing for the sale of 7200 Third Avenue to the November 20 meeting. Basis of Recommendation: 1. The HRA previously authorized the purchase of both properties. 2. The owner of 6933 Queen Avenue is not currently interested in selling the property. 3. The buyers of 7200 Third Avenue require some time to develop building plans with their selected builder. 4. Notice of public hearing was published in the Sun Current on September 27, 1995. Alternative .Recommendation: Proceed with public hearings; however, sale of the properties by the HRA is not possible at this time. Discussion/Decision Mode: Staff will keep the option open to purchase 6933 Queen Avenue. Buyers of 7200 Third Avenue are motivated to move ahead. Respectf submitted, James rosser Executi a irector JDP:cak HOUSING AND REDEVELOPMENT AUTHORITY HRA Letter No. 65 Agenda October 16, 1995 Issue Statement: Public hearing and sale of 7021 Nicollet Avenue and 7537 Girard Avenue. Background: The construction project at 7021 Nicollet Avenue was authorized by the HRA in April 1994; the project at 7537 Girard was authorized in August 1994; both were cooperative projects with Hennepin Technical College. The projects are completed and sales are anticipated by the end of the year. The selected buyer for the home on Nicollet is a three member, income-qualified family, currently renting an apartment in Burnsville. The selected buyer for the home on Girard is a six member family, currently renting a townhome in Edina. Both families meet the requirements stated in Attachment A. HRA authorization and a public hearing authorizing the sale of the properties are required prior to final processing. Both homes are being sold for $105,000. Buyers are each making a down payment of $4,500. They will apply for a mortgage in the amount of $85,500 (one FHA, one conventional, respectively). The difference between the estimated market value and the initial purchase price, $15,000, is provided by the HRA in the form of a second mortgage. Project costs are covered by the buyers' down payment and first mortgages. The second mortgage accomplishes the following: 1. Makes the initial purchase price affordable. 2. Prevents a speculative purchase in which the buyer might benefit from selling the home quickly. The HRA will .pay up to 2 points for mortgage discounting per property (approximately $1,710). and the cost of title insurance (approximately $200) at closing. After closing, the HTC contracts will be paid. These costs have been anticipated in-the budget and will be paid from the proceeds of sale. If during final processing the families are found ineligible by the lender, the purchase agreements are void and earnest money will be released. At this time however, the lender has qualified the purchasers through the preliminary processing. The HRA had an opportunity to inspect the completed work during an open house that was held August 21, 1995. Recommended Motion: It is recommended that following the public hearing, the HRA adopt the attached resolution which authorizes the disposition of the HRA owned properties at 7021 Nicollet and 7537 Girard Avenues. Basis of Recommendation: 1. Two qualified families have been identified as purchasers and meet program requirements. 2. Purchase agreements cannot be processed further by the lender without HRA authorization of sale. 3. A public hearing notice has been published in the Sun-Current which allows the HRA to consider the sale at the October 16, 1995 meeting. 4. The Planning Commission has determined that the sale for residential purposes is consistent with the Comprehensive Plan. Alternative Recommendation: Do not adopt the resolution. However, this would cause a delay in the sale of the property, be confusing to the buyer, and would increase HRA holding costs. Discussion/Decision Mode: Authorization of the sale is required at the October 16, 1995 meeting so that the buyers can finalize mortgage financing for a prompt closing. RESOLUTION AUTHORIZING SALE OF REAL PROPERTY LOCATED AT 7021 NICOLLET AVENUE AND 7537 GIRARD AVENUE WHEREAS, the Housing and Redevelopment Authority (HRA), owns certain real property located at 7021 Nicollet Avenue, legally described as attached; and 7537 Girard Avenue, legally described as Lot 15, Block 19, Irwin Shores Addition; and WHEREAS, the HRA acquired the property so that Hennepin Technical College (HTC) could construct two new single family homes to be sold by the HRA to moderate income families; and WHEREAS, the Bright and Elrashidi families have been identified as qualified purchasers for 7021 Nicollet and 7537 Girard Avenues, respectively; and WHEREAS, the conditions of sale include a total sales price of $105,000 per property; a first mortgage each of $85,500 payable to the lender; a lien of $15,000 per property, payable to the HRA and $4,500 downpayment per property; and WHEREAS, the sale of 7021 Nicollet and 7537 Girard Avenues may be authorized by the HRA following a public hearing which considers the disposition of the properties; and WHEREAS, that hearing has been held following proper publication of notice. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota that the HRA Chairperson and Executive Director are authorized to execute the Purchase Agreement and other required documents so that the disposition of HRA owned properties at 7021 Nicollet and 7537 Girard Avenues occurs as presented herein. ATTACHMENT A 7021 NICOLLET AND 7537 GIRARD AVENUES NEW HOME PROGRAM ELIGIBILITY REQUIREMENTS FOR HOME BUYERS • Have a 3 to 6 member family (a family is defined as persons related by blood, marriage or operation of law). • Be a first-time home buyer (or have not owned in 3 years). • Have the following maximum annual income depending upon family size: Family Size Maximum Income 3 $36,200 4 $40,200 5 $43,400 g $46,600 This income is 80% of the metropolitan area median income - an accepted CDBG program income level. • Have the ability to make monthly payments on a $85,500 mortgage, pay $4,500 down, and pay closing costs required of the buyer. • Agree to be subject to a lien by the HRA for the difference between the initial sales price and the actual value. HOUSING AND REDEVELOPMENT AUTHORITY HRA Letter No. 64 Agenda October 16, 1995 Issue Statement: Authorization to acquire 6320 Oliver and 6432-15th Avenues with New Home Program/CDBG funds. Background: The HRA utilizes the New Home Program to clear substandard, blighted housing and to initiate first time home buying opportunities. It is proposed that CDBG funds be used to purchase the properties listed above. The property at 6320 Oliver Avenue was identified last year as a potential candidate for purchase, but the owner changed his mind. The owner has since passed away and the property is vacant. The heirs wish to sell. BCL Appraisals has valued it at $53,000.00. The HRA has already authorized the purchase of 6432-15th Avenue in June 1995 for $55,000. The property is owner-occupied. It is requested that CDBG funds be available for the purchase to allow flexibility with a site that has characteristics which may make it less desirable in the market. Recommended Motion: Authorize the Chairperson and Executive Director to enter into a purchase agreement and take those actions necessary to acquire 6320 Oliver Avenue for $53,000 and 6432- 15th Avenue for $55,000 with CDBG funds. Basis of Recommendation: 1. Both properties have been voluntarily offered for sale and meet voluntary acquisition program requirements for condition and usage. 2. Both properties are uniquely suited to support affordable home initiatives. The property at 6320 Oliver Avenue is 40'x126' (5,040 square feet). The property at 6432-15th Avenue is 48'x134' (6,439 square feet). The Richfield Rediscovered market responds much more slowly to sites of this size. 3. CDBG funds are budgeted for these acquisitions. 4. Properties will be available for development initiatives in 1996. Development proposals would be brought to the HRA at the appropriate time. Alternative Recommendation: Do not acquire the properties at this time with CDBG funds. Discussion/Decision Mode: With authorization at this time, completion of environmental clearances can occur, allowing site acquisitions in November or December 1995. RESOLUTION AUTHORIZING THE ACQUISITION OF 6320 OLIVER AND 6432-15TH AVENUES WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota (HRA), acquires property and builds and rehabilitates structures for residential purposes; and WHEREAS, the HRA desires to acquire the real property at 6320 Oliver Avenue, legally described as: Lot 7, Block 12, Ray's Lynnhurst Addition, based on an appraised fair market value of $53,000; and WHEREAS, the HRA desires to acquire the real property at 6432-15th Avenue, legally described as: Lot 9, Block 2, Nokomis Gardens Rearrangement of Blocks 1, 2, 3, 4, and 5, Girard Parkview Addition, based on an appraised fair market value of $55,000; and WHEREAS, the owners of these properties have volunteered to sell in accordance with New Home Program guidelines; and WHEREAS, Community Development Block Grant (CDBG) funds will finance the acquisition of these parcels; and WHEREAS, the Planning Commission has made a finding that the acquisition and disposition of these parcels for residential purposes is consistent with the Comprehensive Plan; and WHEREAS, the acquisitions are also contingent on CDBG procedures for an environmental review. Background: The HRA authorized development of the above referenced properties in 1995. The development agreements provide for the issuance of a certificate of completion when construction is completed. (A sample certificate is attached.) All homes have been completed and occupied. The builders have requested the release of the letters of credit and the completion certificates upon completion and closing. Staff is anticipating this request and wants to respond in a timely manner upon verification of completion. Recommended Motion: Authorize the Chair and Executive Director to execute completion certificates in accordance with the attached resolution. Basis of Recommendation: 1. Construction has been completed and certificates of occupancy have been issued by the Inspection Division. 2.
