RESOLUTION PROPOSING TO SPECIALLY ASSESS FOR THE COSTS OF CURRENT
SERVICES PROVIDED WITHIN THE 77TH STREET PROJECT AREA FOR THE
PERIOD JANUARY 1, 2017 THROUGH DECEMBER 31, 2017
WHEREAS, at the Regular City Council Meeting on September 13, 2016, Richfield
City Council adopted Resolution No. 11239 setting a public hearing for October 11, 2016;
and,
WHEREAS, notice of a public hearing is required in the official newspaper at least
two weeks prior to the hearing; and,
WHEREAS, notice of the hearing on the proposed assessment was not published in
the official newspaper at least two weeks prior to the October 11, 2016 public hearing; and,
WHEREAS, affected property owners will be provided notification of the cancelled
October 11, 2016 public hearing and new October 25, 2016 public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield,
Minnesota as follows:
1. Resolution No. 11239, setting a public hearing for October 11, 2016, is hereby
rescinded and superseded by this Resolution.
2. There is hereby established a special assessment district, the boundaries of which are
east of I-35W and west of Cedar Avenue, for the purposes of assessing for current
services provided by the City.
3. The following current services of the City are hereby proposed to be undertaken by the
City in the District with the cost of such services to be specially assessed against
benefited property within the District;
• The trimming and care of trees and shrubs and the removal of any unsound trees
from any street;
• The repair of sidewalks;
• The maintenance of landscaped areas and other public amenities on or adjacent to
street rights-of-way;
• Trash and litter removal.
4. The area proposed to be specially assessed for such current services consists of each
and every commercial lot and parcel of land within the District. It is proposed that the
special assessments on the commercial property be made on the basis of area.
5. The City Clerk is hereby authorized and directed to publish notice of a hearing by this
Council at which the Council will consider the undertaking of such current services and
the levying of special assessments to bear the costs thereof. Such notice shall be
published in the official newspaper at least once, at least two weeks prior to the date of
hearing. The City Clerk shall also give mailed notice of such hearing as required by
law. Such hearing shall be held Tuesday, October 25, 2016, commencing at 7:00 p.m.
or as soon thereafter as the matter can be reached on the agenda.
6. It is hereby proposed that the project consist of the aforementioned services for the
period from January 1, 2017 through December 31, 2017. The estimated cost of
providing all of the aforementioned services during that period is $80,000.
