16-11252r RESOLUTION NO. 11252 RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT FOR 77TH STREET MAINTENANCE FOR THE PERIOD JANUARY 1, 2015 THROUGH DECEMBER 31, 2015 WHEREAS, costs have been determined for the maintenance of the 77th Street Redevelopment Area the boundaries of which are approximately east of I-35W and west of Cedar Avenue in the City of Richfield and the expenses incurred or to be incurred for such maintenance amount to $59,557.56 for the period of January 1, 2015 through December 31, 2015; and, WHEREAS, at the Regular City Council Meeting on September 13, 2016, Richfield City Council adopted Resolution No. 11238 setting a public hearing for October 11, 2016; and, WHEREAS, notice of a public hearing is required in the official newspaper at least two weeks prior to the hearing; and, WHEREAS, notice of the hearing on the proposed assessment was not published in the official newspaper at least two weeks prior to the October 11, 2016 public hearing; and, WHEREAS, affected property owners will be provided notification of the cancelled October 11, 2016 public hearing and new October 25, 2016 public hearing. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Minnesota: 1. Resolution No. 11238, setting a public hearing for October 11, 2016, is hereby rescinded and superseded by this Resolution. 2. The portion of the cost to be assessed against benefited property owners is declared to be $59,557.56. 3. The City Clerk shall forthwith calculate the proper amount to be specially assessed for such maintenance against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and shall file a copy of such proposed assessment in his office for public inspection. 4. The City Clerk shall, upon the completion of such proposed assessment, notify the City Council thereof. 5. A hearing shall be held on the 25th day of October, 2016, in the Council Chambers of the City Hall at 7:00 p.m. or as soon thereafter as the matter can be reached on the agenda to pass upon such proposed assessment and at such time and place all persons owning property affected by said maintenance assessment will be given an opportunity to be heard in reference to such assessment. 6. The City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and shall state in the notice the total cost of the maintenance. The City Clerk shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing.
