2005-11 BILL NO. 2005-11 AMENDMENT TO RICHFIELD CITY CODE SECTION 500.05; SECTION 500.13; AND SECTION 500.25, SUBDIVISION 1 THE CITY OF RICHFIELD DOES ORDAIN: Sec. 2 Section 500.05 Subdivision 1 of the Richfield City Code is amended to read as follows: 500.05. Conveyances by metes and bounds. Subdivision 1. Conveyances prohibited. No_conveyance of land in ,,:hich the land con'.'eyed is described metes and bounds or by ref-erence to a plat made after M::lrch 11,1940, which is not approved by council resolution, shall be made or recorded if the p::lrcel described in the conveyance is less than five acres in area and 300 feet in width unless such parcel was a separate parcel of record as of March 11, 1940, or unless an agreement to convey such smaller parcel was entered into prior to that time and the instrument showing the agreement to convey is recorded in the office of the register of deeds within one year thereafter or 'Nas a separate parcel of not 'less than t\vo and one half acres in area and 150 feet in width on January 1, 1966, or is a single parcel of land not less than five acres and having a 'Nidth of not less than 300 feet that constitutes a subdivision within the meanina of this section mav be filed or recorded. if the land is described in the convevance bv metes and bounds or bv reference to an approved reaistered land survev made after April 21. 1961 or to an unapproved plat. Section 500.05 of the Richfield City Code is amended by adding a new subdivision 1 a as follows: Section 1 Subd. 1 a. Subdivision 1 does not applv to a convevance if the land described: " a. was a separate parcel of record April 1. 1945 or the date of adoption of subdivision reaulations under Laws 1945. Chapter 287. whichever is the later. or of the adoption of subdivision reaulations pursuant to a home rule charter. or b. was the subiect of a written aareement to convev entered into prior to such time. or c. was a separate parcel of not less than 2-1/2 acres in area and 150 feet in width on January 1. 1966. or d. was a separate parcel of not less than five acres in area and 300 feet in width on Julv 1. 1980. or e. is a sinale parcel of commercial or industrial land of not less than five acres and havina a width of not less than 300 feet and its convevance does not result in the division of the parcel into two or more lots or parcels. anv one of which is less than five acres in area or 300 feet in width. or f. is a sinale parcel of residential or aariculturalland of not less than 20 acres and havina a width of not less than 500 feet and its convevance does not result in the division of the parcel into two or more lots or parcels. anyone of which is less than 20 acres in area or 500 feet in width: or g: is an adiustment of a lot line bv the relocation of a common boundary. where the conveyance does not create an additional lot or space sufficient to construct an additional residence thereon. Sec. 3. Section 500.05, subdivision 5 of the Richfield City Code is repealed. Section 500.13 of the Richfield City Code is amended to read as follows: 500.13. Minimum lot area. The minimum area and minimum width of any lots in a plat or subdivision shall be 8,000 square feet, and the standard width of such a lot shall be at least 75 feet, except ':.:hen any other standard f-or minimum lot area or minimum lot width is specified for such a lot elsewhere in this code, in 'Nhich case such other standard shall apply conform to the standards of the zoninQ district in which the parcel falls. Where corner lots rear upon lots facing the side street, the corner lots shall have extra width sufficient to permit the establishment of front building lines on both the front and side of the lots adjoining the streets. Extra width shall be provided on all corner lots irrespective of whether they rear upon lots facing the side streets. Section 500.25 Subdivision 1 of the Richfield City Code is amended to read as follows: 500.25. Final approval of plats. Subdivision 1. Submission to council. The final plan on mylar or tracing cloth and foof two prints thereof, together with foof two copies of any deed restrictions when such are too lengthy to be shown on the plat or plan, and tRfee two prints of the certified plans showing the improvements as built or as they are to be built within the subdivisions shall be submitted to the council. Before approving the final plat or plan of all or part of a proposed subdivision, the council will require proof that the improvements and revisions thereof required have been satisfactorily completed or their construction secured by contract and bond. The final plat accepted shall cover only that part of the subdivision upon which all improvements have been completed or secured. This ordinance is effective in accordance with Section 3.09 of the Richfield City Charter. Sec. 4 Sec. 5 Sec. 6. Passed by the City Council of the City of Richfield, Minnesota this 13th da 2005. SUBDIVISION 1 The City Gouncil has adopted Ordinance No; 2005-11, an ordinance entitled "Amendment to Richfield City Code, Subsection 500.05, Subsection 500.13 and Subsection 500.25, Subdivision 1." This summary of the ordinance is published pursuant to Section 3.12 of the Richfield City Charter. . The ordinance makes technical amendments to the City's subdivision regulations. Subsection 500.05 is amended. to contormto state law with respect to land di- visions that do not require city approval. Subsection 500.~3 is amended to provide consistency with City zon- ing regulations with respect to lot size. The amendment to Subsection 500.25 reduces the number of plat mylars required to be submitted to the City.
