2005-07 BILL NO. 2005-7 TRANSITORY ORDINANCE NO. 18.32 AN ORDINANCE AUTHORIZING AND PROVIDING FOR THE SALE, TRANSFER OR OTHER DISPOSITION AND CONVEYANCE OF CERTAIN CITY OWNED REAL PROPERTY LOCATED IN THE CITY OF RICHFIELD, COUNTY OF HENNEPIN, STATE OF MINNESOTA AT 6758 PORTLAND AVENUE The City of Richfield Does Ordain: Section 1. The following described real property (the "Property") located in the City of Richfield, County of Hennepin, State of Minnesota, is hereby authorized to be sold, transferred or otherwise disposed of and conveyed by the City as herein provided: 6758 Portland Avenue: The South 50 feet of that part of the Southeast % of the Northeast % of the Southeast % of Section 27, Township 28, North, Range 24 West of the Fourth Principal Meridian, described as follows: Beginning at a point 30 feet North of the Southeast corner of the Northeast % of the Southeast Quarter of said section; thence North long the East line of said section a distance of 100 feet; thence West parallel with the South line of said Northeast % of the Southeast % of said Section 27 a distance of 168 feet; thence South parallel with the East line of said Section 27 a distance of 100 feet; thence East parallel with the South line of said Northeast % of Southeast % of said Section 27 a distance of 168 feet to the point of beginning, Hennepin County, Minnesota Section 2. The Property is to be sold to the Housing and Redevelopment Authority in and for the City of Richfield (the "HRA") for the price of $200,000, but subject to a right of first refusal, condition and option in favor of the City of Richfield, under which the City shall have the right to repurchase the Property from the HRA within five years of the date of conveyance for the price of $200,000, and the HRA shall have the obligation to promptly notify the City of any purchase offers that it receives from third parties for the Property within that five year period. Section 3. The Council finds that the proposed sale of the property has no relationship to the Comprehensive Plan, because the sale will not result in a change in use from the current use (which is inconsistent with the Comprehensive Plan) and because the sale is conditioned upon the City's right to repurchase the Property within five years. Section 4. The Mayor and City Manager are hereby authorized to take all action as is required to sell, transfer, or otherwise dispose of and convey the real property described in the foregoing Section 1, including, by way of illustration and not limitation, the execution of all documents, purchase agreements, deeds of conveyance, and other instruments connected with such sale, transfer or disposition and conveyance.
