Background: The City Council regularly conducts a Study Session on the first Monday of each month. However, any business can be carried over to the January 5, 1998 Special City Council meeting. Recommended Motion: Cancel the City Council Study Session regularly scheduled for December 1 and carry any business over. to the January 5, 1998 Special City Council. meeting. Basis of Recommendation: Any Study Session business can be carried over to the January 5, 1998 Special City Council meeting. Alternative Recommendation: 1. Respectfully submitted, Jam .Prosser City Manager JDP:cak • g CITY OF RICHFIELD, MINNESOTA • Council Letter No. 293 Agenda November 24, 1997 Issue Statement: Public hearing and second reading of a transitory ordinance to authorize the sale of City-owned property at 300 West 78th Street (former Lampert Lumber Site) for redevelopment. Background: The City purchased the former Lampert Lumber site at 300 West 78th Street to temporarily house certain Public Work functions and for future redevelopment. The $450,000 to purchase the property were drawn from the City's capital projects fund. On October 27, 1997, the City Council undertook. a first reading of the transitory ordinance for the sale of the subject property and set a public hearing on the matter. During this time period, offers for the purchase of the property were received from several buyers representing the hotel industry. On November 10, 1997, the City Council identified Candlewood Hotel Company as the preferred buyer of the site and directed staff to negotiate a final purchase agreement with the company. Staff is currently finalizing the purchase agreement for the sale of the property and proposed redevelopment of the site for a new hotel. Aland sale closing will take place sometime during the first half of 1998. Recommended Motion: Following the public hearing, the City Council is requested to (a) adopt the transitory ordinance which authorizes the sale of the City-owned property described in the attached ordinance; and (b) direct appropriate staff to undertake the publication of the transitory ordinance in order to effectuate the sale of the property; and (c) adopt the attached resolution which. designates the use of the sale proceeds for the new City garage. Basis of Recommendation: 1. The City purchased the former Lampert Lumber site in 1992. 2. A first reading of the transitory ordinance for the sale of the property was undertaken by the City Council on October 27, 1997. 3. On November 10, 1997, the City Council approved Candlewood Hotel Company as the buyer of the site for a proposed hotel and directed staff to finalize a purchase agreement. The sale price is $1,599,000. • g-~ 4. In accordance, with the City Charter Section .13.04 since no indebtedness was created by the purchase of this property and since there is no indebtedness against the other City garage sites, the proceeds of sale may be designated by resolution for any public use the Council desires. Alternative Recommendation: The City Council may choose not to undertake the second reading of a transitory ordinance for the land sale at this time. Discussion/Decision Mode: Publication of the transitory ordinance will occur as soon as possible. The effective date of the ordinance will be 30 days after publication. RESOLUTION AUTHORIZING USE OF PROCEEDS FROM SALE OF LAMPERT LUMBER SITE AT 300 WEST 78TH STREET FOR NEW CITY GARAGE FACILITY ON PORTLAND AVENUE WHEREAS, on November 12, 1992, the City purchased the former Lampert Lumber Site located at 300 West 78th Street, legally described as: The West 239 feet of the East 330 feet of the Southeast 1 /4 of the Southwest 1 /4 of the Southwest 1 /4, Section 34, Township 28, Range 24, except part taken for State Highway respectively (the "Property"); and WHEREAS, Section 13.04 of the City Charter addresses Sale of Real Property; and WHEREAS, the revenue source used to purchase the. Property was the City's Capital Projects Fund and no debt was incurred for the purchase of the Property; and WHEREAS, the Property was used as a Public Works Garage facility; and WHEREAS, none of the Public Works Garage facilities have debt; and i WHEREAS, the City has approved the sale of the Property in accordance with a transitory ordinance; and WHEREAS, the Council may by resolution designate a public use for proceeds received for the sale of the Property. Ferber, Cit Clerk Y 8 CITY OF RICHFIELD, MINNESOTA Council Letter No. 292 Agenda November 24, 1997 Issue Statement: Public hearing and second reading of an ordinance amendment rezoning land at 300 West 78th Street from C-3 (high density commercial) to C-2 (general commercial). Background: Staff is recommending that the property at 300 West 78th Street, the Lampert Lumber site, be rezoned from C-3 (high density commercial) to C-2 (general commercial). The rezoning would also include the 50 foot wide parcel of land to the east of the Lampert site that is owned by the Soo Line railroad. The C-3 zoning district was created in 1987 as a means of encouraging higher density development and restricting development that is inconsistent with the goals for the Interstate-Lyndale-Nicollet (ILN) area. The C-3 district has strict setback, floor area ratio, and use regulations that restrict the type of development that can occur. The strict zoning regulations and the three month length of time it takes to complete a rezoning of property can be a disincentive to developers seeking to purchase the property. Rezoning the property at this time gives the City more flexibility in its sale of the site. Recommended Motion: Conduct a public hearing and hold second reading of an ordinance rezoning land at 300 West 78th Street from C-3 to C-2. Basis. of Recommendation: 1. Rezoning the property would provide the City with greater flexibility in its sale of the property. 2. The City, as owner of the property, has control beyond its zoning powers over the type of development that can occur on the property. 3. The proposed zoning is consistent with the City's Comprehensive Plan. 4. Notice of the proposed rezoning was published in the Sun Current and mailed to property owners and occupants within 350 feet of the subject property. 5. On October 14, 1997 the Planning Commission voted unanimously to recommend approval of the rezoning. Alternative Recommendation: Deny this rezoning. ~- Discussion/Decision Mode: Rezoning applications require an affirmative vote by four of the members. Background: City staff are recommending that the allowable height in the C-2 district be increased to 100 feet for properties located along I-494 (east of I-35W, west of Trunk Highway 77, south of 77th Street and north of 78th Street). The Zoning Ordinance currently limits building height in the C-2 (general commercial) district to 40 feet. Several buildings along I-494 have been constructed at heights over 40 feet (Minnesota School of Business, Hampton Inn, Meridian Crossings, Richfield Towers), and those developers have had to obtain a variance or rezone the property to a planned district. The Comprehensive Plan encourages regional commercial and office development along I-494; however, this type of development typically exceeds 40 feet in height. The reconstruction of 77th Street creates a separation between the commercial area along 1-494 and the residential areas. This separation minimizes any negative impact of increased commercial building height on the residential neighborhood. Recommended Motion: Conduct a public hearing and hold second reading of an amendment to the Zoning Ordinance, Section 526.31 allowing a principal building height of 100 feet in the C-2 district for properties located east of I-35W, west of Trunk Highway 77 and south of 77th Street. Basis of Recommendation: 1. The proposed 100 foot height limit (9-10 stories) is comparable to the height of existing buildings along the freeway corridor. 2. The Comprehensive Plan encourages higher density development along 1-494 which makes it appropriate to allow taller buildings in this area. 3. 77th Street provides a separation between the commercial area along 1-494 and the residential area to the north. 4. Buildings taller than 40 feet have been approved along the corridor in the past. It is inappropriate, however, to utilize the variance process to authorize taller • ~-i heights. It is also cumbersome to require that a building be developed as a planned unit development in order to build at a taller height. 5. Historically, height limits were placed on buildings because a city's fire department only had equipment to service a limited height. Today's built-in fire protection systems make height limitations for this reason unnecessary. 6. Notice of the proposed amendment was published in the Sun-Current. 7. On October 14, 1997 the Planning Commission voted unanimously to recommend approval of the amendment. Alternative Recommendation: 1. Approve the amendment with a different height limitation. 2. Deny this amendment. Discussion/Decision Mode: Rezoning applications require atwo-thirds majority vote of the City Council for approval. Section 526 of Appendix B to the Richfield City Code entitled "Zoning: Commercial Districts" is amended to read as follows: I. Subsection 526.31, subd. 7 is hereby amended to read as follows: Subd. 7. Story limitations. Principal buildings shall not exceed three stories in height, and accessory buildings shall not exceed one story in height, except as provided in subd. 8. II. Subsection 526.31, subd. 8 is hereby added to read as follows: Subd. 8. Maximum height exception: principal buildings. The maximum height of principal buildings may be increased to 100 feet in the case of property located within the I-494 Corridor, defined as that area. east of I-35W, west of Trunk Highway 77, south of 77th Street and north of 78th Street. Background: The City Council policy resolution on purchasing provides that when the purchase of merchandise, materials, equipment or construction exceeds the amount of $25,000, authority to purchase shall be submitted to the City Council for consideration. Each year, the City purchases rock salt, which is usually mixed with sand, to control. ice on road surfaces during the winter season. Recommended Motion: Approve the purchase of an estimated 1,700 ton of rock salt for the 1997/98 winter season from North American Salt Company, Overland Park, Kansas, at a unit price of $27.69/ton/delivered for an estimated total purchase price of $47,073.00. Basis of Recommendation: 1. The City participates in a joint purchasing agreement with the State of Minnesota. 2. The State of Minnesota solicited bids for all the participants in the joint purchase agreement. 3. Under this particular joint purchase agreement, the City of Richfield has an obligation to purchase from the low bidder. 4. North American Salt Company was the lowest responsible bidder for rock salt. ~~/~ Alternative Recommendation: None. The paperwork from the State arrived later than usual. November 24 was the first Council meeting available to obtain Council approval. Depending on the weather, there is a chance staff will have to .order salt before formal Council approval. Background: Each year, the Dewatering Plant must dispose of approximately 4,500 cubic yards of lime by-product. This material is in a solid form which is dropped from presses into waiting trucks. Typically the work has performed under a two year contract, an estimated 9,000 cubic yards total. The 1996-1.997 price was $89,010. A formal bid opening was held on Wednesday, November 12, 1997 for the disposal of lime by-product for the two year period of 1998 and 1999. The contract may be extended two years with mutual agreement by the City and Contractor.. Basis of Recommendation: 1. It is necessary to remove and dispose the lime by-product from the dewatering presses. 2. Rehbein, Inc. was the lowest responsible bidder and is an established contractor that meets all requirements. 3. There are sufficient funds in the 1998 Water Maintenance budget for lime by-product disposal Alternative Recommendation: 1. Council may reject all bids and direct staff to readvertise; however, staff does not believe a better price can be obtained from a reputable contractor. 2. Council may award a contract to another bidder; however, Rehbein, Inc., an .established contractor, submitted the lowest responsible bid. Background: Hennepin County will be making appointments to two MCWD Manager positions which will open March 8, 1998. Carver County will be making one appointment. In addition to individuals who may apply for the position(s), cities within the district have the right to submit names of nominees for Watershed Managers to the county. If the cities wish to submit names, they can submit them directly to their county. Nominations must be to the County Board 60 days before the MCWD Manager terms expire on March 8, 1998. Applications or nominations, therefore, would need to be submitted or about January 1, 1998. The Statute indicates that cities. can act jointly. To that end the Steering Committee for the Cities of the Minnehaha Creek Watershed District is willing to serve as the clearing house for nominees. The Steering Committee can also make recommendations if the City or the nominee(s) request endorsement. Richfield Public Works Director Michael Eastling is a member of the Steering Committee and could carry any nomination from the Richfield City Council to the Steering Committee. Ronald Baumbach, 6633-12th Avenue, has expressed interest in appointment as a MCWD Manager. Mr. Baumbach is interested in surface water issues and in working out any problems of duplication between the district and cities. Recommended Motion: Nominate Ronald Baumbach, a Richfield resident, as a Minnehaha Creek Watershed District Manager, direct the Richfield Public Works Director to carry the nomination to the Steering Committee for the Cities of the Minnehaha Creek Watershed District for endorsement and to submit the nomination to Hennepin County with or without Steering Committee endorsement. Basis of Recommendation: 1. Two Minnehaha Creek Watershed District Manager positions will open March 8, 1998. 2. The City may submit names of nominees to the county for a Minnehaha Creek Watershed District Manager position. 3. Background: Richfield Rediscovered is considered one of four of the best community development programs in the nation for 1997, according to the National Association of Housing and Redevelopment Officials (NAHRO). On October 29, the City of Richfield and Richfield HRA were recognized by NAHRO with a National Award of Excellence. Richfield was one of 17 locations, including Los Angeles and Houston, which were so recognized. A National Award of Excellence is the highest achievement possible in the field of housing and redevelopment through this 9,000 member professional organization. The. Mayor, Council and HRA have all played a role in the success of the program. Key staff persons responsible for the development and implementation of the program include Bruce Nordquist, Pam Bookhout, Katia Medvetski and Bruce Palmborg. Recommended Motion: Accept the 1997 National Award of Excellence for the Richfield Rediscovered Program. Basis of Recommendation: 1. Richfield has actively pursued redevelopment and new investment in the housing stock. 2.
