Agenda May 12, 1997
Issue Statement:
Council consideration regarding conducting a City Council meeting on Tuesday, May
27, 1997.
Background:
The City Council regularly meets the second and fourth Monday evening of each
month. However, items for the May 27, 1997 Council meeting can be carried over to
June 9, 1997. It is suggested that the regular Council meetings scheduled for May 27,
1997 be canceled.
Recommended Motion:
Cancel the City Council meeting scheduled for May 27, 1997.
Basis of Recommendation:
1. The City Council business can be carried over to June 1997.
2. The May 27 meeting follows the Memorial Day holiday weekend.
Alternative Recommendation:
1. Do not cancel the May 27 City Council meeting.
2. Reschedule the Council meeting.
Discussion/Decision Mode:
This item has been placed on the May 12, 1997 City Council agenda so proper
notification can be made if the May 27 meeting is canceled or rescheduled.

Issue Statement:
Consideration of youth appointment to the Advisory Board of Health, Human Rights
Commission or Friendship City Commission.
Background:
The Advisory Board of Health, Human Rights Commission and Friendship City
Commission each have two youth vacancies. Advertisements were placed in the
Richfield Sun, Your City newsletter, and on Cable Channel 34. Notices were also sent
to Richfield High School and the Academy of Holy Angels. One- application was
received and that person was interviewed on April 30, 1997 at a Special City Council
meeting.
Recommended Motion:
Appoint a youth member to the Advisory Board of Health, Human Rights Commission or
Friendship City Commission for a one year term beginning June 1, 1997 and ending.
May 31, 1998.
Basis of Recommendation:
In order to ensure a quorum for future meetings, a youth appointment should be made
at this time.
Alternative Recommendation:
Defer the youth appointment to a later Council meeting.
Discussion/Decision Mode:
This item is placed on the May 12, 1997 agenda for Council consideration.

Issue Statement:
First reading of a transitory ordinance to authorize the sale of the City owned property
at 7600 Emerson Avenue to the Richfield Housing and Redevelopment Authority (HRA)
for Richfield .Rediscovered site development.
Background:
The City has finalized the replatting of the area affected by the 77th Street Project. Two
residual residential parcels are buildable and the City has expressed an interest in the
HRA developing-those parcels with new replacement housing. The smaller parcel (Lot
1, Block 1) was sold to the HRA for single family development which will be part of the
fall Parade of Homes (7625 Emerson Avenue). The larger parcel (Lot 1, Block 2) is
uniquely triangular in shape. The lot has approximately 19,600 square feet and was
appraised by BCL Appraisals at $50,000. A site map is attached. Staff has worked
with Rockport Homes, Inc. to develop a three unit attached home concept. Each. home
would be owner-occupied. The units would have between 1,500 and 1,900 square feet
each and would be valued in the range of $160,000 to $180,000. Each would also
have its own garage. Rockport Homes, Inc. has interested buyers in two of the units. A
neighborhood meeting was held on April 30, 1997 by Rockport Homes, Inc. with staff
present. Neighborhood feedback on the proposed development was favorable.
The City purchased this property for the 77th Street project using MSA funds which
may only be used for road related purposes. MSA rules require that land proceeds
reflect the "highest and best use", in this case, new housing. The 77th Street Project
cannot discount the sale price, and the project must be reimbursed at fair market value.
Recommended Motion:
Approve the first reading of the transitory ordinance to authorize the sale of the City
owned property at 7600 Emerson Avenue to the Richfield HRA for Richfield
Rediscovered site development and set a public hearing and second reading for June
9, 1997.
Basis of Recommendation:
1. Platting of the property has been completed.
2. The property is residentially zoned and faces single family residential development
on Emerson Avenue.
3. The HRA is working on a residential development concept ready for implementation
and has authorized the purchase from the City for $50,000.

4. The City purchased this property for the 77th Street Project using ,MSA funds. MSA
rules require that land proceeds reflect the "highest and best use". Thus, the 77th
Street Project cannot discount the sale price.
5. The land is zoned residential. Rockport Homes, Inc. will apply for a conditional use
permit for mulit-unit development.
6. In December 1995, the Planning Commission found residential development a
consistent use with the revised Comprehensive Plan.
7. Pending City Council authorization, development could begin in July 1997.
Alternative Recommendation:
The City Council can choose not to sell to the HRA at this time. However, the HRA will
develop a residential concept that utilizes the uniquely shaped site to its fullest extent,
while maintaining the use of the neighborhood.
Discussion/Decision Mode:
First reading is set for May 12, 1997. If approved, a public hearing and second reading
will be scheduled for June 9, 1997 to consider the sale.

AN ORDINANCE AUTHORIZING AND PROVIDING FOR THE SALE
AND CONVEYANCE OF CERTAIN CITY OWNED REAL PROPERTY
LOCATED IN THE CITY OF RICHFIELD, COUNTY OF HENNEPIN,
STATE OF MINNESOTA AT 7600 EMERSON AVENUE
The City of Richfield Does Ordain:
Section 1.
The following described real property located in the City of Richfield, County of
Hennepin, State of Minnesota, is hereby authorized to be sold, transferred or otherwise
disposed of, and conveyed by the City to the Housing and Redevelopment Authority in
and for the City of Richfield as herein provided:
Lot 1, Block 2, Cloverleaf Addition, Hennepin County, Minnesota, and having the
street address of 7600 Emerson Avenue South, Richfield, Minnesota.
Section 2.
The Mayor and City Manager are hereby authorized to take all action as is required to
sell, transfer, or otherwise dispose of and convey -the real property described in the
• foregoing Section 1, including, by way of illustration and not limitation, the execution of
all documents, purchase agreements, deeds of conveyance, and other instruments
connected with such sale, transfer or disposition and conveyance.

Issue Statement:
Approval of the 1996-97 Labor Agreement reopener provisions and 1998-99 Labor
Agreement with Richfield Police Supervisory Association.
Background:
City staff has completed negotiations on the reopener provisions of the labor agreement
for 1997 and on another labor agreement for the years 1998 and 1999 with the Richfield
Police Supervisory Association, subject to Council approval. The bargaining unit is
represented by Law Enforcement Labor Services (EELS), a statewide police labor union.
The Richfield Police Supervisory Association represents the positions of Police Captain,
Lieutenant, and Sergeant. There are presently eight employees represented within this
unit. The overall increases are 3.04%, 3.48% and 3.26% as reported on the BMS Uniform
Baseline Settlement Forms. The changes which have been negotiated for the 1996-97
reopener provisions are as follows:
• . A pay adjustment of 3% effective the first payroll in January 1997. This is identical to
other employee groups.
• A $20 increase in the City's contribution for dependent health insurance, for a maximum
of $365 per month. This is identical to other employee groups.
• No monthly increase in the City's contribution for single dental insurance, remaining at a
maximum of $24 per month.
• An equity adjustment of $500 for Police Lieutenants on May 1, 1997 and an equity
adjustment of $750 for Police Captain, effective May 1, 1997. The equity adjustments
are necessary to bring the City's wage rates closer to the labor market average pay.
The changes which have been negotiated for the 1998-99 contract areas follows:
• A pay adjustment of 3% effective January 1, 1998 and January 1, 1999. This is
anticipated to be similar to other employee groups.
Effective January 1, 1998, a $20 increase in the City's contribution for dependent health
insurance for a maximum of $385 per month; and whatever increase that
unrepresented Management employees get for calendar year 1999. The health
insurance increases for 1998 and 1999 are forecasted to be reasonable increases in
keeping with a level of contribution the City has provided in the past.
• A $15 per year increase in the clothing allowance to $540 per employee in 1998 and an
additional $20 per year increase to $560 per employee in 1999.

• Sergeants required to be on stand-by during off-duty time for felony level or other
County Attorney charged court cases shall receive $30 per occurrence in 1998 and $35
~' per occurrence in 1999.
• Effective January 1, 1998, employees beginning their 21st year of service shall earn
vacation at a rate of 176 hours per year.
• Effective January 1, 1999, a provision which increases the personal leave accrual cap
from 180 hours to 188 hours.
• An equity adjustment effective May 1 in each of the two years will be made to Police
Lieutenants and Police Captains. Effective May 1, 1998, the equity adjustment for
Police Lieutenants is $600 and the equity adjustment for Police Captains is $800.
Effective May 1, 1999, the equity adjustment for Police Lieutenants is $650 and the
equity adjustment for Police Captains is $850. The equity adjustments are necessary
to bring the City's wage rates closer to the labor market average pay.
Recommended Motion:
Adopt a resolution approving the labor agreement reopener provisions and the two year
labor agreement with the Richfield Police Supervisory Association for the years 1997 and
1998-99.
Basis for Recommendation:
1. Wage and benefits settlements are comparable to other City of Richfield employee
groups.
2. The union members have voted on the issues and have given their approval to the
settlements.
3. The settlement proposals appear to be an equitable resolution of the contract for
both parties.
Alternative Recommendation:
Do not approve the labor agreement requiring further negotiations and/or arbitration.
Discussion/Decision Mode:
In order to allow the City's accounting personnel to modify payroll records and enact the
new pay grades retroactive to January 1, 1997 as quickly as possible, it is recommended
that the City Council act on May 12, 1997 to adopt the attached resolutions providing for
the contracts' implementation effective January 1, 1997 and January 1, 1998.

WHEREAS the City Manager and the Richfield Police Supervisory Bargaining
Unit Local 162 have reached a complete understanding concerning the reopener
provisions fora 1997 labor agreement concerning rates of pay, health and dental
insurances; and
WHEREAS the human resources ordinance requires that contracts between the
City and the Exclusive Bargaining Representative of employees in an appropriate
bargaining unit shall be implemented by Council resolution.
NOW, THEREFORE BE IT RESOLVED that the. City. Council does hereby
approve the labor agreement between the City of Richfield and the Richfield Police
Supervisory Bargaining Unit for the year 1997 and orders the provisions of the labor
agreement to be implemented upon signature of the labor agreement referenced herein
by representatives of both the Richfield Police Supervisory Unit and the. City of Richfield
to be effective January 1, 1997.

Issue Statement:
Public hearing and second reading of anordinance amendment rezoning land at 6309-
11 Portland Avenue from MR-1 (two family residence) to R (single family residence).
Background:
The City purchased the duplex at 6309-11 Portland Avenue. This property was. the last
of the homes along the east side of Portland Avenue slated to be purchased and
incorporated as part of Veterans Memorial Park.
The property is currently zoned for a duplex. Rezoning the property to an R
classification would make the property's zoning consistent with the zoning of the
surrounding property. A government building, such as the proposed City
garage/recreation facility,. would be a permitted use in the R district.
Recommended Motion:
Conduct a public hearing and approve second reading of an ordinance amendment
rezoning land at 6309-11 Portland Avenue from MR-1 (two family residence) to R
• (single family residence) with the following stipulation:
1. That the existing duplex be removed from the property.
Basis of Recommendation:
1. Rezoning the property to the R classification would make the zoning of the
property consistent with that of the surrounding property.
2. The existing duplex would be removed from the property, hopefully through sale to
the highest bidder.
3. The proposed City garage/recreation facility would be a permitted use in the R
district.
4. Notice of the public hearing was published in the Sun-Current and mailed to
property owners and occupants within 350 feet of the property.
5. On March 25, 1997 the Planning Commission voted unanimously to recommend
approval of the rezoning.
Alternative Recommendation:
Deny this rezoning.

Issue Statement:
Consideration of award of contract for 1997 sidewalk, curb and gutter repair project.
Background:
Repair of concrete sidewalks, and concrete curb and gutter work is performed each
year as a safety precaution. The maintenance program consists of removal and
replacement of deteriorated concrete sidewalk sections and curb and gutter in various
areas of the City. Partial driveway replacement at Fire Station No. 1 is also needed this
year.
Bids from five contractors were opened on April 30, with the following results:
Ron Kassa Construction $40,087.50
Lindah and Carlson, Inc. $44,242.00
West Star Curb and Gutter $45,405.00
Gunderson Brothers Cement Contractors $61,112.50
S.M. Hentges & Sons $87,745.00
The adopted 1997 Street Maintenance budget includes $21,500 for the contractual
share of the sidewalk, curb and gutter repair project. Government Buildings has
$10,000 in its 1997 budget for concrete repair which is also included in this contract.
LHN will contribute $5,500 for sidewalk and crosswalk repairs. The balance of the
contract will come from the $12.,000 budget held for concrete panel repair and joint
sealing. This contract is based on estimated quantities, and payment made on actual
work performed
Recommended Motion:
Approve the bid minutes/tabulations and award the 1997 sidewalk, curb and gutter
repair project to Ron Kassa Construction in the sum of $40,087.50.
Basis of Recommendation:
1. Ron Kassa Construction submitted the lowest responsible bid.
2. Ron Kassa Construction has performed work for the City prior to this time and has
done acceptable work.
3. Funding for this project is available through the 1997 Street Maintenance Division
operating budget and Government Buildings budget.

Alternative Recommendation:
Council may choose to reject all bids and direct staff to obtain new bids; however, the
bids received are in line with the amount of work which needs to be completed, and
staff does not believe a better price could be obtained from a reputable contractor.
Discussion/Decision Mode:
This item is scheduled for the May 12, 1997 City Council .meeting. Staff is requesting
approval at this time in order to facilitate timely completion of this project.

Issue Statement:
Resolutions related to parking prohibitions on 77th Street from Cedar Avenue to the
intersection with 76th Street, on Lyndale Avenue from I-494 to 77th Street, and on 76th
Street from the intersection with 77th Street to Xerxes Avenue.
Background:
Improvements to 77th Street, congestion at Lyndale Avenue, and proposed
improvements for 76th Street west of Sheridan Avenue, as well as the traffic volumes
on these areas of roadways now and anticipated in the future, indicate it is in the best.
interest of the community to provide for the free flow of motorized traffic and safety of
pedestrian traffic. These roadways are also part of the City's designated Municipal
State Aid (MSA) system. Because of this, parking restrictions require Council approval
rather than Traffic Control Committee approval. Resurfacing of 76th Street west of
Sheridan Avenue will be financed using Municipal State Aid funds. Existing parking
restrictions, already in place, must be ratified for resurfacing of 76th Street to qualify for
State Aid funds, thus ensuring that the road will continue to function as a four-lane
roadway.
• Resolutions, reflecting existing conditions, have been prepared providing for "No
Parking Any Time" for the roadways indicated above with the following exceptions:
• No Parking Except Sunday on the north side of 76th Street from Sheridan Avenue to
Xerxes Avenue.
• No Parking Except Sunday on the south side of 76th Street from Sheridan Avenue
to just west of Vincent Avenue.
Recommended Motion:
Adopt the attached resolutions which provide for parking restrictions on 77th Street
from Cedar Avenue to the intersection with 76th Street, on Lyndale Avenue from I-494
to 77th Street, and on 76th Street from the intersection with 77th Street to Xerxes
Avenue.
Basis of Recommendation:
1. The City of Richfield is concerned about motorized and pedestrian traffic in the
immediate area and in the greater community which may be using City streets.
2. Improvements proposed on Lyndale Avenue at its intersection with 77th Street
• require a wider roadway for traffic that precludes the use of the street for on-street
parking.

. 3. The City's Municipal State Aid system includes 77th Street from its intersection
with 76th Street to Cedar Avenue, t_yndale Avenue from 1-494 to 77th Street, and
76th Street from Cedar Avenue to Xerxes Avenue. Resolutions related to parking
restrictions are needed to obtain MSA funds.
Alternative Recommendation:
1. Permit parking at any time. However, the City's major roadways generally have
some type of parking prohibition. The roadways for which parking restrictions are
proposed are heavily traveled. Parking restrictions facilitate flow of motorized
traffic and provide increased safety for pedestrian traffic.
2. Provide different levels of parking restrictions than those proposed, for example
allowing parking on Sundays. However, it is the opinion of staff that the parking
prohibitions outlined above and recommended in the attached resolution are
reasonable for the specified roadways, the roadway usage and location.
Discussion/Decision Mode:
This item is scheduled for action at the May 12, 1997 Council meeting. Council may
choose to delay action for further consideration or information from staff; however,
delay of action related to 76th Street from its intersection with 77th Street to Xerxes
Avenue will equally delay consideration by the Minnesota Department of Transportation
of plans related to resurfacing the roadway currently scheduled for resurfacing in early
July, 1997.

Issue Statement:
Consideration of a resolution requesting that the Commissioner of Transportation
transfer of $25,000 from Richfield's Municipal State Aid (MSA) .construction account to
Richfield's maintenance account for the overlay of the intersection at 66th Street and
Lyndale Avenue.
Background:
On April 14, 1997 the City Council approved a resolution requesting that the
Commissioner of Transportation transfer of $85,000 from Richfield's Municipal State Aid
(MSA) construction account to Richfield's maintenance account to finance the milling
and overlay of 65th Street from Xerxes Avenue. to Penn Avenue. The problems
described for the area of 65th Street from Xerxes Avenue to Penn Avenue are now also
being displayed in the intersection of 66th Street and Lyndale Avenue. As with the 65th
Street problem, staff has contacted Braun Intertec, a consulting firm that specializes in
pavement. Braun will do a study of the intersection at 66th Street and Lyndale Avenue
to determine what is causing this problem and what, if anything, can be done to limit or
prevent it in the future. Preliminary research has concentrated on the manner of
asphalt mix formulation and/or placement at the time Richfield streets were constructed
as well as the kind of winters recently experienced.

The intersection of 66th Street and Lyndale Avenue has continued to deteriorate to the
point where is has become so badly spalled as to create an emergency situation. Since
the 1997 Capital Improvement Budget and the 1997 Street Maintenance operating
budget do not allocate funds to mill and overlay this street, staff again contacted the
Municipal .State Aid office to see if emergency provisions may be used for the 66th
Street and Lyndale Avenue intersection as this area is experiencing the same problem
as 65th Street from Penn Avenue to Xerxes Avenue. MSA indicated the City again
needs to request moneys be transferred from the construction account to the
maintenance accounts to pay for this much needed repair.
Recommended Motion:
Approve the attached resolution requesting the transfer of $25,000 from Richfield's
Municipal State Aid construction account to the maintenance account to study, mill and
overlay the intersection at 66th Street and Lyndale Avenue.
Basis of Recommendation:
1. The existing street infrastructure is badly in need of repair.
2. Improvement of the intersection at 66th Street and Lyndale Avenue will be a
benefit to the neighborhood and the traveling public.

3. Funds are available for the needed repair from the City's MSA account.
Alternative Recommendation:
1. Council could choose to take no action; however, repair of this intersection is
already considered an emergency situation.
2. Council could consider an alternate source of funding. However, Municipal State

funding through the operating budget.

This item is scheduled for the May 12, 1997 City Council meeting. Staff is requesting

Issue Statement:
Reconvening of the 1997 Board of Equalization.
Background:
On May 5, 1997 the City of Richfield convened the 1997 Board of Equalization. The
Board considered 19 cases, deferring action on 6 of the cases to a reconvene date of
May 12, 1997 at 6:00 p.m. The continuance was provided,to give the appellants and
staff an opportunity to prepare data on these properties so that the Board could mike
an informed decision on each of them.
The appraisals and comparative grid data on the deferred cases will not be available
until noon on Monday, May 12. The physical inspection of some of the properties tfid
not take place until Thursday, May 8 and Friday, May 9, and one appellant had not
returned telephone calls to the Assessor's office to establish a review appointment as of
noon Friday, May 9. One of the six cases has been resolved between the Assessor's
office and the appellant after the inspection. Therefore, information on the properties
will be provided at the meeting of May 12.
Recommended Motion:
Reconvene the Board of Equalization at 6:00 p.m. May 12, 1997 and take action on the
six pending cases based on the information presented at the hearing.
Basis of Recommendation:
1. Reconvening of the Board has been scheduled publicly at the May 5 meeting.
2. Information needed for the Board to make a determination on the remaining appeals
will be available at or prior to the hearing.
3. The Board of Equalization must conclude its business within 20 days of May 5,
1997.
Alternative Recommendation:
None.
