Issue Statement:
Consideration of a motion to adjourn the Special City Council meeting to a City Council
Closed Executive Session to discuss items related to airport litigation.
Background:
The Metropolitan Airports Commission is planning to construct a runway within two
blocks of Richfield homes. The Environmental Impact Statement prepared for this
project does not currently reflect the impact from the low frequency noise that will be
generated from the airport operations. The Federal Aviation Administration has
previously issued a Record of Decision which is the final environmental approval at the
federal level. The State Environmental Quality Board will be considering final state
approval on November 18.
Recommended Motion:
Council should consider discussing options including potential litigation during a closed
executive session.
Basis of Recommendation:
• State and federal law provide an opportunity to challenge adequacy of Environmental
Impact Statement through specific legal challenges. It is appropriate to consider this
strategy within a closed executive session.
Alternative Recommendation:
1. The Council may decide not to discuss this matter.
2. The Council may decide to discuss this matter in open session.
Discussion/Decision Mode:
This matter will be considered at a Special City Council meeting called for November 18
at 5:30 p.m.
