09-10235rCITY OF RICHFIELD STATE OF MINNESOTA RESOLUTION NO. 10235 A RESOLUTION CONCERNING THE MORATORIUM ON DEVELOPMENT WITHIN THE PENN AVENUE CORRIDOR BETWEEN HIGHWAY 62 AND 68TH STREET WHEREAS, in September 2008 the City Council adopted Ordinance No. 2008- 19, establishing a moratorium on development for a portion of the City ("Moratorium Area") while planning studies were conducted to determine the appropriate land use controls that should apply to properties that met certain characteristics; and WHEREAS, the purpose of the studies to be conducted included, but were not limited to determining appropriate land use and development standards that should apply to such property and determining the changes, if any that should be made to the City's official land use controls, including. but not limited to the City's Zoning Ordinance, Comprehensive Plan and Capital Improvement Plan; and WHEREAS, said planning studies have been completed and subsequent changes have been made to the City's official land use controls, including but not limited to the City's Zoning Ordinance, Comprehensive Plan and Capital Improvement Plan; and WHEREAS the City Council finds the reasons for establishing the moratorium no longer exist; and WHEREAS, the City Council has approved first reading of an ordinance to repeal Ordinance No. 2008-19 and desires to allow applications to proceed pending final adoption of the ordinance to repeal the moratorium. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota that City staff is directed to accept and process applications for development within the Moratorium Area, .pending formal repeal of Ordinance No. 2008- 19.
