Issue Statement:
Approve a lease agreement for Tom Price for ten feet on the north edge of Lincoln
Fields.
Background:
Tom Price has leased the northern ten feet of Lincoln Fields for his trailer court for
many years. The lease was rewritten this year based on the potential for ballfield
expansion and interest by the City Attorney to review the lease. The term has been
three years in the past, renewable on a three year basis. This lease is for the term of
two years; however, the first year began on July 1, 1997. Staff recommends a two year
lease at this time, because year one is almost complete. After this term expires in July
1999, the lease would be renewed on a year to year basis if the City has no need for
the land. The current lease provides for a 90 day notice should the City determine
there is a need to use that land for public purposes.
The financial terms have also increased. A market study indicated the leased land
should command $1,600 per year. Mr. Price has been paying in the neighborhood of
$300 per year with minor annual adjustments which have not kept pace with the
market. Because of the major difference, staff is recommending $700 each year, for a
total lease payment of $1,400.
Recommended Motion:
Approve the attached lease agreement for a period of two years in the amount of
$1,800 payable immediately.
Basis of Recommendation:
1. The City does not have immediate need of the land although that could change with
the possibility of ballfield replacement.
2. The City has leased the land to Mr. Price for many years with no problems.
Alternative Recommendation:
1. Reject the lease agreement and direct staff to develop a different agreement.
2. Do not renew the lease agreement.
3. Amend the terms of the agreement.
Discussion/Decision Mode:
This has been placed on the February 9 agenda at the request of Mr. Price. Action at
this time would allow staff to complete the lease agreement.

0 INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT (the "Agreement") is made
as of July 1, 1997 by and between the CITY OF RICHFIELD, a Minnesota municipal
corporation (the "City"), and THOMAS PRICE, an individual residing at 7421 Lyndale Avenue
South, Richfield, MN 55423 ("Price")
RECITALS
A. Price is the owner of a tract of land which is legally described in the Property ID number
34 028 24 32 0015. ADN UNPLATTED 34 028 24. METES/BOUNDS DESCRIPTION: THE S 5
ACRES OF THE N 10 ACRES OF NW 1&4 OF SW 1&4 AND THE N 4 FT THAT PART OF
THE NW 1&4 OF SW 1&4 LYING S OF THE N 10 ACRES THEREOF EX R R R&W AND THE
ROAD ("Price Property").
B. The City is the owner of a parcel of land which is legally described in the Property ID
number 34 028 24 32 0025. ADN UNPLATTED 34 028 24. METES/BOUNDS DESCRIPTION:
W 468 68/100 FT OF E 493 68/100 FT OF THAT PART OF THE S 20 ACRES OF N 30 ACRES

C. Price is desirous of obtaining permission from the City to utilize a portion of the City
Property in conjunction with the mobile home park which Price operates on the Price Property.
This portion consists of the northern ten feet of the City property from the east to west
boundaries, approximately 4690 square feet.
D. The City is willing to permit such use in return for Price's agreement to indemnify,
protect, defend, and hold harmless the City and to fulfill the other obligations contained herein
pursuant to this Agreement.
AGREEMENT
1. Offer and Acceptance of Agreement. Subject to the terms and conditions of This
Agreement, and in consideration of the covenants contained herein, the City and Price agree
that Price may use the City Property for the period commencing on August 1, 1997, and
terminating July 31, 1999 for a fee of $1,400.00 payable in two installments of $700.00.
Payment one is due immediately and payment two is due August 1, 1998.
2. Maintenance and Repair. Price shall, at his own cost and expense maintain and repair
City the Property and shall at all times keep it in compliance with regulations of the City. The
City shall have no responsibility for the maintenance or repair of the City Property.
Thomas. Price Lease Agreement
0 3. Indemnification and Insurance.
(a) Price shall at all times defend, protect, indemnify, and hold harmless the city and
its agents, officers, servants, and employees from any and all claims for damages and other
remedy, including but not limited to costs and attorney fees, arising from or by reason of the
maintenance, use, and repair of the City Property. Nothing in this Agreement shall be
construed as a waiver by the City of any immunities, defenses, or other limitations on liability to
which the City is entitled by law, including but not limited to the maximum monetary limits on
liability established by Minnesota Statutes, Chapter 466.
(b) Price, at his sole cost and expense, shall maintain in full force and effect during the
term of this Agreement general liability insurance in the minimum amounts of $1,000,000 bodily
injury, including death, per person; $1,000,000 bodily injury, including death, per occurrence;
and $500,000 property damage per occurrence. A certificate of insurance evidencing
compliance with this Agreement shall be provided to the City by Price. The City shall be named
as an additional insured on the insurance policy described herein, and such policy shall contain
a stipulation that Price's insurer will provide thirty (30) days prior written notice of cancellation of
such insurance to the City. The insurance shall be carried by solvent and responsible
insurance companies licensed to do business in the State of Minnesota.
4. Miscellaneous Provisions.
(a) Any titles of the several Paragraphs of the Agreement are inserted for convenience
of reference only and shall be disregarded in construing or interpreting any of its provisions.
(b) Any notice, demand, or other communication under this Agreement by either party
to the other shall be sufficiently given or delivered if it is dispatched by registered or certified
mail, postage prepaid, return receipt requested, or delivered personally; and
(i) in the case of Price, is addressed to or delivered personally to Price at 7421
Lyndale Avenue South, Richfield, MN 55423, and
(ii) in the case of the City, is addressed to or delivered personally to the City at
City of Richfield, 6700 Portland Avenue South, Richfield, MN 55423 or at such other address
with respect to either such party as that party may, from time to time, designate in writing and
forward to the other as provided in this Paragraph.
(c) This Agreement may be executed in any number of counterparts, each of which
shall constitute one and the same instrument.
(d) This Agreement constitutes the entire agreement between Price and the City with
respect to the City Property and supersedes any other written or oral agreements between the
parties on that subject. This Agreement can be modified only in a writing signed by the parties.
(e) The City may terminate this Agreement:
(i) if the termination is based upon health, safety or the need to make
modifications within the City Property or by Price's transfer or sale of the Price Property, by the
giving of 90 days written notice to Price; or

(ii) otherwise by the giving of 180 days written notice to Price. The termination
shall be effective at the end of such notice period, at which point neither party shall have any
further obligation hereunder, except that Price's obligations under paragraph 3 shall survive.
Price shall remove all structures from the City Property and restore the City Property to its
previous condition not later than the effective date of the notice.
(f) Price agrees to make no claim against the City for damages which Price may suffer
as a result of the City's termination of this Agreement.
(g) Except as specifically set forth herein, nothing in this Agreement shall be construed
to exempt Price from or waive the application of any federal, state, or local law, rule, or
regulation.
(h) Nothing in this Agreement shall be construed as abandonment of the City Property
by the City or as any relinquishment of any right the City may have with regard to the Property.
Price specifically acknowledges and agrees that its construction and maintenance of the
Property is at the sufferance of the City and subject to the City's right to terminate such use in
accordance with the provisions in paragraph 4(e) hereof.
(i) In the event that the use of the City Property under this Agreement renders the City
Property taxable, Price agrees to pay, before penalty attaches, all ad valorem property taxes or
other similar taxes levied against the City Property.
Q) This Agreement may be extended by the parties from time-to-time and
upon such terms as they shall mutually agree to.
(k) No new structure shall be erected on the City Property without the prior written
consent of the City; and, Price shall not use the City Property for any purpose other than in
connection with the mobile home park without the prior written consent of the City.
IN WITNESS WHEREOF, Price and the City have executed this Agreement this 9th day of
February, 1998.

Issue Statement:
Authorizing preparation of demolition specifications and solicitation of bids for the
demolition of buildings on the former Lampert Lumber site.
Background:
In November 1997 the City Council authorized staff to negotiate a purchase agreement
with the Candlewood Hotel Company for the purchase of the former Lampert Lumber
property at 300 West 78th Street. That agreement calls for the City to deliver to
Candlewood a cleared site. Because the estimated cost for site clearance exceeds
$25,000 competitive bids will be necessary. To seek bids on this work demolition
specifications must be prepared.
Recommended Motion:
Authorize the preparation of demolition specifications and the seeking of bids for the
demolition and clearance of the structures located at 300 West 78th Street.
Basis of Recommendation:
10 1. The work is estimated to exceed $25,000 requiring competitive bidding.
2. The purchase agreement stipulated that the City is responsible for site clearance.
Alternative Recommendation:
Do not authorize the preparation of demolition specifications and do not seek bids for
site work.
Discussion/Decision Mode:
The cost of preparing the specifications and undertaking the actual demolition and site
clearance will be paid for with proceeds from the pending sale of the property. The cost
of preparing the specifications and performing other associated work is estimated at
approximately $5,000. The actual cost of demolition and site clearance will not be
known until bids are received and evaluated. The City Council will be requested to
make an award to the lowest responsible bidder.

Issue Statement:
First reading of transitory ordinance providing funding for certain capital improvements
from the Special Revenue Fund.
Background:
City Charter Section 7.12, Subd. 2 requires that Special Revenue Funds used for
capital improvements must be authorized by ordinance.
At the December 8, 1997 City Council meeting, the City Council authorized $500,000 of
Special Revenue Funds for improvements to several City parks and other City capital
improvements in 1998. In addition, the 1998 Capital Improvement Budget provides for
expenditure for all types of funds contained in the budget document including county
funds, municipal state aid, user fees, federal grants and state grants, however,
authorization by ordinance is not required for these expenditures.
While the total 1998 Capital Improvements Budget (CIB) includes total budgeted
expenditures of $31,193,000 the portion of CIB concerning proposed funding from the
Special Revenue fund is $500,000 as shown below:

A transitory ordinance is necessary to finalize these appropriations pursuant to City
Charter.
Recommended Motion:
Approve first reading of the transitory ordinance providing for the expenditure of funds
from the Special Revenue Fund for certain capital improvements and schedule public
hearing and second reading for March 9, 1998.

Basis for Recommendation:
1. On December 8, 1997, the City Council approved the 1998 Capital Improvement
Budget, which includes an expenditure of $500,000 of Special Revenue Funds for
improvements to several City parks.
2. Under Section 3.09 of the City Charter, a transitory ordinance becomes effective
30 days after publication of the second hearing notice. The ordinance
requirements must be completed early enough in 1998 so that the capital projects
can be initiated on a timely basis, completed, and the fund expended.
3. In order for the timely start of the project under consideration in the Capital
Improvement Budget, it is suggested that the first reading of the transitory
ordinance take place on February 9 and the public hearing and second reading be
completed at the March 9, 1998 City Council meeting.
Alternative Recommendation:
1. The City Council could postpone the first reading of the transitory ordinance to a
future City Council meeting.
2. The City Council could decide to authorize none or only a portion of the
expenditures identified from special revenue in the CIB.
Discussion/Decision Mode:
In order to proceed with improvements approved on a timely basis, first reading
approval of this transitory ordinance would be desirable on February 9, 1998 so that
second reading and the public hearing could take place on March 9, 1998.

CITY OF RICHFIELD DOES ORDAIN:
Section 1: It is found and determined to be necessary and expedient for the City to
expend money from the Special Revenue Fund for the making of capital improvements
listed in Section 2 hereof, for which the City would be authorized to issue general
obligation bonds.
Section 2: The capital improvements and amounts of expenditures for such
improvements which are authorized to be paid from the Special Revenue Fund under
Section 7.12, Subdivision 2 of the City Charter, are as follows:

Issue Statement:
Public hearing regarding a conditional use permit to allow construction of three attached
townhome units at 7615 Nicollet Avenue.
Background:
Southridge Construction proposes to construct three townhome units on a triple lot at
7615 Nicollet Avenue. The property is zoned R (single family residential). The
proposed townhome project meets the definition of a cluster housing development, and
cluster housing developments are conditional uses in the R district.
Cluster housing is permitted in the R district if the project design is compatible with the
surrounding neighborhood. The following design features are present and make the
units compatible with the single family neighborhood:
• One-and-half story units
• Gable roofs
• Building materials of brick and siding
• Varied front setback for units and garages
• Different window treatments for each unit
The project must also meet the design guidelines of the Richfield Rediscovered
program (see attached), including main level laundry, garage offset, and landscaping.
The developer has agreed not to remove any trees from the site unless they affect the
placement of the townhomes. A clump of seven small tress and one medium sized tree
will need to removed to construct the units. The developer is also required to protect
existing tress during the construction process. Staff has received complaints about
some of the trees along the east property line growing into the power lines. Staff and
the developer will work with the neighbors to address this issue.
The Planning Commission asked that staff explore options for minimizing the number of
driveways to the project. In staffs opinion, combining driveways would result in a
significant loss of green space and increase in pavement. The Transportation Engineer
has reviewed the site plan and approved the number of driveways. Staff would suggest
however that a vehicle turnaround area be added to each driveway so drivers have the
option of not backing onto Nicollet Avenue. The design should be subject to staff
approval. These areas need to be sensitively designed to minimize the appearance of
the pavement.
is The Housing and Redevelopment Authority currently owns the property and is
scheduled to authorize the sale of the property on February 17. Construction of the
?_J
project would start in April. The units are expected to sell for around $140,000.
Marketing efforts have/will include articles in Your City, information in a mailing to the
Richfield Rediscovered mailing list about new home opportunities, information at the
Spring Preview Parade home, and an advertisement in the Sun-Current.
Southridge Construction originally approached Housing and Redevelopment Authority
staff on another project. Staff was impressed with their design skills and suggested
they present a concept for this property. Southridge, formerly Thomas Homes, has
housing construction experience primarily in the northern suburbs. More recently, they
have had experience in commercial construction.
A neighborhood meeting was held in December. The primary concern of the neighbors
was not with the townhome project but with the amount and speed of traffic along
Nicollet Avenue. The concerns were shared with the Transportation Engineer.
Recommended Motion:
Approve the conditional use permit to allow construction of three attached townhome
units at 7615 Nicollet Avenue with the following stipulations:
That the project comply with Richfield Rediscovered design guidelines.
. 2. That a Declaration of Covenants, Conditions and Restrictions be executed and
recorded as approved by the City Attorney.
3. That the property be replatted to reflect the townhome configuration.
4. That a grading plan be approved by the Public Works Director.
5. Driveway turnarounds are to be added to each driveway. Their design and
location shall be approved by the Community Development Director and revised
site and landscape plans shall be prepared and submitted to the Community
Development Director.
6. That the conditional use permit resolution be recorded with the County, pursuant
to Minnesota Statutes Section 462.36, Subdivision 1.
Basis of Recommendation:
1. The proposed attached housing is an appropriate land use along an arterial street.
2. The units are designed with a single family character which is compatible with the
existing neighborhood.
3. The proposed housing fills a need the City has identified in its Comprehensive
Plan and Livable Communities Goals for the development of more diverse housing
types. The Comprehensive Plan identifies properties along arterial and collector
streets as high density, single family attached housing.

4. A Declaration of Covenants, Conditions and Restrictions will be executed to
ensure that any changes made to the structures in the future are uniform (e.g.
same color roof shingles).
5. The project meets all setback requirements.
6. Notice of the hearing was published in the Sun-Current and mailed to property
owners and occupants within 350 feet of the subject property.
7. On January 27, the Planning Commission voted unanimously to recommend
approval of the conditional use permit.
Alternative Recommendation:
Deny the request with a finding that the proposal would have an adverse impact on
adjacent properties or the City as a whole.
Discussion/Decision Mode:
A public hearing is scheduled for 7:00 p.m. on Monday, February 9, 1998. The hearing
will be held in the City Council Chambers of Richfield City Hall, 6700 Portland Avenue.

RESOLUTION FOR APPROVING A CONDITIONAL USE PERMIT
7615 NICOLLET AVENUE
WHEREAS, an application has been filed with the City of Richfield which
requests approval of a conditional use permit for a cluster housing development on
land generally located at 7615 Nicollet Avenue South, legally described as:
WHEREAS, the City has fully considered the request for approval of the
conditional use permit; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, Minnesota, as follows:
1. A conditional use permit is issued for a three unit cluster housing
development, as described in City Council Letter No. , on the
Subject Property legally described above.
2. The conditional use permit is subject to completing the following
conditions before a building permit will be issued:
• That the project comply with Richfield Rediscovered design guidelines.
• That a Declaration of Covenants, Conditions and Restrictions be
executed and recorded as approved by the City Attorney.
• That the property be replatted to reflect the townhome configuration.
• That a grading plan be approved by the Public Works Director.
• Driveway turnarounds are to be added to each driveway. Their design
and location shall be approved by the Community Development
Director and revised site and landscape plans shall be prepared and
submitted to the Community Development Director.
• Any additional conditions required for cluster housing developments by
the Richfield Zoning Ordinance, Section 521.07.
• That this resolution be recorded with the County, pursuant to
Minnesota statutes section 462.36, subdivision 1.
3. The conditional use permit shall remain in effect for so long as conditions
regulating it are observed, and the conditional use permit shall expire if
normal operation of the use has been discontinued for 12 or more months,
as required by the Zoning Ordinance, Section 546.05, Subd. 9

for Owner-Occupied Multi-unit Development
Quality Considerations:
• The property design should blend in with adjoining properties to the extent possible. The
house building lines, roof lines, door and window placement use to minimize blank wall
mass, and building orientation to the street, must present a balanced and pleasing view from
all sides.
• All sites must be fully landscaped, which includes complete sod installation and
appropriately placed plants and shrubs.
• In addition, the final grade of the property must improve, or not have a detrimental impact
on, storm water drainage patterns in the neighborhood. Reworking the existing site grade to
improve neighborhood drainage may be requested of the developer.
• Mature trees existing on site must be retained to the extent possible.
Design Considerations:
• Each dwelling has a separate entrance.
• Provide separate areas for private leisure/outdoor living space.
• Garage offset for individuality as well as minimizing mass. Garages must be provided for
each living unit, attached or detached. The garage presence must be minimized in the overall
property appearance.
• Allow for future basement finishing for additional bedroom or living space.
• Main level laundry.
• Covered entry to dwelling and garage space.
• Separate service doors to garage, if possible.
• Appearance to blend with existing developments on block, whether single family, lower-
pitched roofs or other.
• Exterior materials should be low maintenance. Decorative brick is encouraged for character
and longevity. Hardboard siding materials are not acceptable.

Issue Statement:
Public hearing regarding a request for approval of a preliminary and final plat of
Cloverleaf Second Addition.
Background:
The Housing and Redevelopment Authority is requesting approval of the preliminary
and final plat of Cloverleaf Second Addition located at 7600 Emerson Avenue. In June
1997, the City Council approved a conditional use permit to allow construction of three
attached townhome units on this property. As a condition of the conditional use permit
approval, the City is requiring that the owner replat the property. The replat provides a
lot per dwelling so each unit can be sold separately.
The proposed plat divides the property into three separate lots with zero building
setbacks along the common lot lines. Each lot meets the minimum lot size of 4,000
square feet for cluster housing. Easements will be obtained for maintenance of the
77th Street sound wall and the public sidewalk that crosses the property.
. If the plat is approved, construction would be authorized to begin by the end of
February, weather permitting. The units will be priced between $160,000 and
$180,000.
Recommended Motion:
Conduct a public hearing and adopt a resolution approving the preliminary and final plat
of Cloverleaf Second Addition.
Basis of Recommendation:
1. Filing of the plat is required for the conditional use permit that was approved for
the proposed townhome development.
2. The HRA has agreed to sell the property to Rockport Homes. The developer's
financier requires that the plat be filed before Rockport can purchase the property.
3. A 10 foot maintenance easement is obtained to allow the City access to the 77th
Street sound wall.
4. An easement is obtained to allow the City to maintain the sidewalk located along
the north side of the property. The sidewalk crosses onto the property in order to
save two mature oak trees located in the boulevard.

SUBDIVISION FOR ROCKPORT HOMES
WHEREAS, Rockport Homes has requested preliminary and final approval to
combine and subdivide several tracts of land located generally northeast of 77th Street,
south of 76th Street and west of Emerson Avenue in the City of Richfield; and
WHEREAS, the proposed subdivision is to be known as CLOVERLEAF
SECOND ADDITION; and
WHEREAS, a 10 foot easement is obtained along the southwest side of the
property for maintenance of the 77th Street sound wall; and
WHEREAS, an easement is obtained along the north side of the property for
maintenance of the public sidewalk; and
WHEREAS, a public hearing on the proposed plat of CLOVERLEAF SECOND
ADDITION was held on February 9, 1998, at which all interested persons were given

Issue Statement:
Purchase of a truck chassis for use in the Stormwater Division of the Public Works
Department.
Background:
Unit #339, a 1989 Chevrolet one-ton truck is fully depreciated and scheduled for
replacement in 1998. The original vehicle was never adequate to pull lift station pumps,
manhole castings and heavy pipe end. As a result, it is being replaced with a heavier,
two-ton truck. The motor pool is purchasing the truck chassis, and the Stormwater
Division will be purchasing the dump box and crane for the vehicle. Purchase of new
vehicles has been coordinated with the Hennepin County Cooperative Purchasing Plan.
The lowest responsible bid for the cab chassis vehicle required was submitted by
Transport Truck Center. The approved 1998 Motor Pool budget contains $45,000 for
the purchase of this truck chassis.
The total purchase price would be $43,994, which includes two add-ons options of $360
• from a base price of $43,634. The options include a heavy-duty truck frame and a front
stabilizer for the vehicle. The stormwater fund contains $21,000 for the crane and
dump box. It now appears that an adequate crane will cost about $19,000, and the
dump box will be $9,500. In order to make up the difference and complete the vehicle,
the Stormwater Division will include an additional $8,000 in the 1998 Revised budget to
cover these increased costs.
Recommended Motion:
Authorize the purchase of a two-ton tilt cab chassis for use by the Public Works
Department Stormwater Division through the Hennepin County Purchasing Plan for a
total purchase price of $43,994.
Basis of Recommendation:
1. Transport Truck Center was the lowest responsible bidder for the type of truck
chassis required.
2. The City of Richfield is in need of replacing this vehicle.
3. If the cab chassis is ordered now, the delivery date will be in October 1998.
Alternative Recommendation:
Council may choose to reject this bid and request staff to obtain bids from other
• sources in an attempt to receive a lower purchase price. However, staff does not
believe a better price can be obtained from a responsible dealer.
• Discussion/Decision Mode:
Staff is requesting approval at the February 9, 1998 Council meeting in order to
facilitate delivery of this vehicle.

Issue Statement:
Purchase in excess of $25,000 for a new tow truck cab chassis and tilt-bed wrecker.
Background:
Unit 347, a 1989 Chevrolet model C-30 tow truck cab chassis and wheel lift wrecker is
fully depreciated and scheduled to be replaced in 1998. This truck has been a valuable
part of the motor pool fleet, and is used by the mechanics for emergency calls on
breakdowns, parts running and towing. The problem with the wheel lift style truck is
that it cannot be used to pull some of our all-wheel drive vehicles or hydrostatically-
driven vehicles, such as the large Toro mowers and the sidewalk tractors. These are
100 horsepower machines weighting over 5,000 lbs., and cannot be towed with the
wheel lift, without damaging the transmissions on these machines. A tilt-bed wrecker
would give staff this flexibility, in addition to handling the routine towing of squad cars,
pick-up trucks and other vehicles up to one-ton plow trucks. The approved 1998 Motor
Pool budget contains $30,000 for this purchase, and purchase of the cab chassis has
been coordinated with the Hennepin County Cooperative Purchasing Plan.
• The lowest responsible bid for a 15,000 lb. Gross Vehicle Weight (GMC 3500 HD) cab
chassis was submitted by Falls Automotive, Inc. out of Fergus Falls, Minnesota at a
base price of $21,773. Two optional add-ons of an 84" frame-length cab axle @ $155
plus low/mount wide mirrors @ $44 brings the total purchase price to $21,972.
Staff received quotes from two vendors for the tilt-bed wrecker unit with trade-in of Unit
#347 as follows:

The total unit amount would be $31,472, slightly over the budgeted amount. However,

Approve the purchase of a 15,000 lb. GVW cab chassis (GMC 3500 HD) from Falls
Automotive, Inc. for a total purchase price of $21,972; and approve a purchase order to
Twin Cities Wrecker Sales for a total purchase price of $9,500 (with trade-in).
Basis of Recommendation:
1. Falls Automotive, Inc. submitted the lowest bid through the Hennepin County
Cooperative Purchasing Program.

Issue Statement:
Proposal to create four additional promoted Sergeant positions within the Police
Division of the Public Safety Department.
Background:
The Police Division currently has four teams, each supervised by a promoted Sergeant.
Because of scheduled days off, vacation, training and sick days frequently no Sergeant
is available during some shifts. Alternate supervision, in the absence of the team
Sergeant, is by a Corporal that is chosen by the Sergeant at the beginning of each bid
period. The Corporal is chosen from the ranks of Police Officers, and has supervisory
responsibility only in the absence of the team Sergeant. When the Sergeant is present,
the Corporal returns to patrol duties and no longer has supervisory authority or
responsibility.
Recommended Motion:
Authorize four additional Sergeant positions.
Basis of Recommendation:
1. Under the current arrangement, the Corporal position is temporary, training is
inadequate, and supervisory responsibility and authority is diminished and
therefore less effective than a Sergeant.
. 2. Age and inexperience of work force requires experienced supervisors. More
experienced supervisors should help promote improved public safety service and
provide better support, mentorship and training of newer officers.
3. This will not increase overall personnel levels and the number of officers working
the street will not be reduced.
4. The cost to the City is small compared to the Division budget. The first year's cost
would be less than $5,000. The incremental cost would cap at about $27,400 in
four years, based on today's salaries. This compares to a total Police Division
budget of $3,144,840.
Alternative Recommendation:
1. The Council may direct staff to undertake a review of other options.
2. The Council may direct staff to continue staffing levels and provide feedback on
issues in the future.

This matter will be presented for discussion at the February 9 Council meeting.

Background:
Change order #1 for the Hat Trick Hockey expansion project represents several minor
changes, including:

3. Extension of conduit and wire. $ 354.72
4. Demolition of additional concrete block and face brick vestibule. $ 818.00
5. New 6" drain tile extension and connections 449.00
Total $5,193.72
These changes were incorporated into the project and have now been billed.
One additional change order in a similar amount for soil corrections is also expected in
the next several weeks.

1. The minor project changes were needed to meet contingencies that occurred

Consideration of resolution recommending that Hennepin County auction tax forfeited
land at 6639 Nicollet Avenue to adjacent owners.
Background:
The City has been notified by Hennepin County that a small parcel of land located at
6639 Nicollet Avenue has been forfeited to the State of Minnesota for the non-payment
of taxes. The Hennepin County Auditor is the Trustee/Administrator of Minnesota
owned tax-forfeited lands lying within Hennepin County, pursuant to laws providing for
the forfeiture of real property.
The parcel of land described on the tax forfeit listing from Hennepin County is a small 4-
foot by 134-foot strip of land located between 6635 and 6641 Nicollet Avenue (see
attached map). There is no advantage for the City to pursue purchasing this piece of
property. The most reasonable disposition of this land would be to offer it for sale to
adjacent property owners.
As required under M.S. 282.01, Hennepin County has requested that the City Council
formally recommend for either public auction, auction to adjacent owners, or request
conveyance to the City for an authorized public use.
Recommended Motion:
Approve the resolution recommending that Hennepin County auction the tax-forfeited
land at 6639 Nicollet Avenue to adjacent property owners.
Basis of Recommendation:
1. The City has no public use for this property.
2. The size and location of the land parcel suggests the best use would be for
adjacent owners.
Alternative Recommendation:
1. Determine a public auction of the parcel as being in the best interest of the public.

Issue Statement:
Appointment to the 1998 Board of Equalization (Board of Review).
Background:
City Charter provides that the Local Board of Equalization shall consist of all of the City
Council Members and two Richfield residents experienced in real estate matters. The
purpose of the Board is to hear appeals from the property owners concerning their
property values.
Mr. Larry Emond, 6325 Russell Avenue, has once again indicated his willingness to
serve as a residential representative to the Board. He has been an independent
property appraiser for over 25 years and has served on the Richfield Board of Review
since 1983. Mr. Emond holds a Federal Appraisers License and is working primarily in
conducting property appraisals for financial institutions. He is also experienced in
building construction and held a real estate license. Mr. Emond has been a Richfield
resident for well over 30 years and is very knowledgeable of the City. His previous
input on the Richfield Board of Equalization has been extremely valuable as
determinations and appeals presented by Richfield citizens were considered.
The second Richfield resident under consideration for appointment for the 1998 Board
of Equalization is Glenn Erickson, 7240 Bryant Avenue. Mr. Erickson has been a
resident of Richfield since 1950 and has been in the property appraisal business since
1951. He first served on the Richfield Board of Review in 1991. His business has
predominately included appraisal of single family residential, duplex and fourplex
properties. The appraisals have included those for a mortgage loan business and a
number of appraisal audits. Mr. Erickson currently holds both an appraisers and real
estate brokers license. Like Mr. Emond, Mr. Erickson's previous service on the
Richfield Board of Equalization has been very valuable.
It is recommended that the compensation for resident members be set at $50 per
session or $20 per hour per session, whichever is greater.
Recommended Motion:
Approve the attached resolution confirming the appointment of Mr. Emond and Mr.
Erickson to the 1998 Board of Equalization, at the proposed level of compensation
stated herein.
Basis for Recommendation:
1. Both Mr. Emond and Mr. Erickson are very knowledgeable and experienced in the
areas of real estate appraisals. They are also both licensed appraisers.

2. Mr. Emond and Mr. Erickson have served on the Richfield Board of Equalization in
the past and have done a very good job in that capacity.
3. It is required by City Charter that there be two resident representatives on the Board
of Equalization who are knowledgeable in real estate matters.
Alternative Recommendation:
1. The City Council could select other qualified individuals as expert resident
representatives on the Board of Equalization, in place of either Mr. Emond or Mr.
Erickson or both.
Discussion/Decision Mode:
It is requested that the City Council set the appointment of Mr. Emond and Mr. Erickson
at the City Council meeting of February 10. The Board of Equalization will meet at 7:00
p.m. Monday, May 4, 1998. The appointment at the City Council meeting of February
10 ensures that City staff has adequate time to establish appointments to the Board.

A RESOLUTION CONFIRMING CITY MANAGER'S APPOINTMENT OF
TWO RESIDENT MEMBERS TO THE BOARD OF EQUALIZATION
•
BE IT RESOLVED, that the City Council of the City of Richfield, Minnesota
hereby approves the City Manager's appointment of Mr. Lawrence Emond and Mr.
Glenn Erickson as 1998 resident members of the Board of Equalization as provided in
Chapter 7 of the City Charter.
BE IT FURTHER RESOLVED, that compensation for the two resident members
of the Board of Equalization be set at a minimum of $50 per session of the Board or
$20 per hour per session of the Board, whichever is greater.
Adopted by the City Council of the City of Richfield, Minnesota this 9th day of

Issue Statement:
Presentation of the video production Richfield... Housing for the Future.
Background:
The City Council has identified challenges and opportunities in anticipating Richfield's
housing future; greater housing choices -- townhomes, apartments, cooperatives and
condominiums -- are being discussed. The message about Richfield's housing future
has been prepared in three forms: a slide show, a video story and a printed handout.
The video was shown for the first time at the January 31 Remodeling Fair. Another
viewing opportunity on cable television will enable it to reach a larger community
audience. A copy of the printed handout is attached and is available to any resident
upon request. Additional copies of the video are being prepared to share with
residents.
Recommended Motion:
View the video, Richfield... Housing for the Future, at this time as part of the Council
meeting and simultaneously on cable television.
Basis of Recommendation:
1. Richfield's housing future is an important issue to share as broadly as possible with
the community.
2. Materials have been developed to better inform the community.
3. Sharing this information will provide additional feedback about the interest and
types of housing choices that should be considered.
Alternative Recommendation:
Schedule the showing of the video for another Council meeting.
Discussion/Decision Mode:
Arrangements have been made to show the video during the February 9 Council
meeting.

Issue Statement:
Consideration of a proposal to establish the Richfield Community Feedback Network.
Background:
The City Council has previously directed staff to expand ways of communication within
Richfield. The direction included special emphasis on receiving feedback from
residents regarding views on development proposals, capital improvements, general
community needs, adequacy of information about projects, requests for services,
feedback on staff performance, feedback on City services and other similar issues.
The concept of a community feedback network includes the following basic elements:
• Volunteers from the community would be requested to serve as members of the
Community Feedback Network. Special emphasis would be placed on including
individuals not previously involved with City government. Ideally, 50 to 100
individuals would be recruited for these positions.
• Community organizations, churches, civic groups, service clubs and representatives
from school organizations would be specifically solicited to participate in the
network.
• A mechanism would be established to assure that network members would receive
detailed information on community issues they identify as important.
• A mechanism would be established to report feedback received from network
members to the City Council and staff in order to shape public policy, improve
communication and service to the community. The information would also be used
to help identify priorities, future challenges, previously unidentified problems, service
enhancements and service refinements.
• Network members would be requested to meet with neighbors, friends and others
from the community as a basis for expanding feedback to the City. Support for this
expanded network would be provided as requested by the network members.
• The League of Women Voters will be requested to assist the City in establishing and
supporting the network.
Recommended Motion:
Authorize establishment of the Richfield Community Feedback Network.
Basis of Recommendation:
1. The Community Feedback Network would serve as an additional dimension of
communications within the community.

2. Development of feedback mechanisms provides an opportunity for the Council,
staff and commissions to receive important information from an expanded group of
individuals from within the City.
Alternative Recommendation:
The Council may decide to provide refinements to this concept.
Discussion/Decision Mode:
This matter will presented for consideration at the Council meeting of January 26.
