Issue Statement:
Stormwater alternatives to the Academy of Holy Angels pond at 66th Street and
Pillsbury Avenue.
Background:
In response to a Council Member inquiry, City staff directed Pete Willenbring, WSB and
Associates, the City's stormwater consultant, to prepare the attached memorandum.
The 66th Street/PillsburyRvenue intersection was identified in the City's
Comprehensive Surface Water Management Plan as a flooding problem area because
of regular street flooding. Staff seeks to improve drainage in street flooding areas as
opportunities, such as street reconstruction or redevelopment, present themselves.
In summary, the alternatives are:
1. Continue to pursue shared use/shared cost pond with the Academy of Holy Angels
(AHA).
2. Construct a pond in the HUB shopping center.
3. Construct an additional storm pipe to Richfield Lake.
4. Construct an additional storm pipe to Wood Lake.
5. Condemn AHA property for a City pond.
6. Do nothing except require the AHA to construct a pond to National Urban Runoff
Program (NURP) standards.
City staff is continuing to work with AHA staff to construct a shared pond on AHA
property. Pete Willenbring states in the memorandum that this course of action
continues to be the most cost effective from the City's perspective.
In addition, there is another issue pertaining to the inability of AHA to grant the City a
perpetual easement for the use of the drainage pond. The attached letter from
Winthrop and Weinstine, attorneys for the AHA, addresses that particular issue.
Recommended Motion:
Discuss this drainage pond issue in order to provide staff with direction on how to
proceed.
Basis of Recommendation:
1. The City and AHA have discussed this drainage pond issue for several months.
2. The drainage pond issue at 66th Street/PillsburyRvenue must be addressed in
some fashion with or without direct City participation.
• 3. This is a point in these discussions that requires City Council feedback for future
direction.
Alternative Recommendation:
. 1. None. This issue must be addressed in some manner.
Discussion/Decision Mode:
This Special City Council Study Session has been called by the Mayor to provide an
opportunity to provide a timely review of this issue prior to taking any additional action.

As a follow-up to our telephone conversation eazlier this week, we have reviewed the
options that are available to manage Stormwater runoff generated from the Holy Angels
Academy site as well as azeas that are generally tributary to the low point in 66th Street in
the vicinity of its intersection with Pillsbury Avenue extended. As you aware, the Holy
Angels Academy has submitted plans outlining vazious proposed improvements to the site
and the City has been working with the Academy to accommodate the runoff from these
improvements as well as attempt to manage stormwater runoff that may overflow into an
existing depression on the Holy Angel Academy site immediately south of 66th Street.
A review of the alternatives available to manage stormwater runoff in this general azea
include the following:
Continue to work with Holy Angels Academy to jointly accommodate both
Stormwater runoff generated from their site as well as accept Stormwater runoff
directed from 66th Street into a pond that is located on the Holy Angels site
immediately south of 66th Street. Utilization of this pond is one of the most cost-
effective ways to accommodate Stormwater runoff for both sites. The ponding azea
on the Holy Angels Academy site is in the one-hundred yeaz flood plain and could
not be utilized for other activities.

2. Construct additional stormwater storage area(s) in the vicinity of the Hub Shopping
Center or Rainbow Foods parking lot. Stormwater storage in this location would
relieve some of the pressure on the 30-inch RCP storm sewer that carries water from
the 66~' Street storm sewer system as it carries water from this low-point intersection
north and then west to Richfield Lake.

3. Construct additional storm sewer capacity to carry water from the 66th Street low
point to Richfield Lake. This would involve the construction of over 2000 lineal feet
of storm sewer which would need to be installed north from 66th Street to the
intersection of 65th Street and Pillsbury Avenue and then west along 65th Street,
crossing Lyndale Avenue and eventually draining into Richfield Lake. This is an
extremely expensive alternative that would require significant portions of 65th Street
to be reconstructed. We estimate the cost for this improvement to exceed $400,000.
If this is an alternative you wish to further consider, please advise and we will
provide additional refinement to this cost estimate.
4. Construct additional storm sewer to carry water from the 66th Street low point
westerly to Woodlake along the 67th Street alignment. The cost for this alternative
would be similar to Alternative #3.
5. Condemn the floodplain property in the vicinity of Holy Angels Academy and
construct a formal stormwater storage area in this location specifically for the
.purpose of accommodating stormwater runoff from areas within the City of
Richfield. It is anticipated a significant stormwater storage area could be constructed
for under $150,000 plus the cost for land acquisition.
6. Construct no-public improvement projects but simply require the Holy Angels
Academy to provide on-site stormwater storage and treatment for stormwater runoff
generated from its site. Base on an analysis of the 20~ acre site, it is estimated that
7.5 acre-feet of live stormwater storage would be required to accommodate runoff
from this site, and 2.5 acre-feet of dead water storage should also be incorporated
into the site to address treatment to Nation Wide Urban Runoff Program Standards.
In summary, a number of alternatives are available to address the problems of street
flooding in the vicinity of 66~' Street and Pillsbury Avenue. They include increasing the
stormwater storage in the area by either constructing ponding areas on the Holy Angels
Academy site, on the Hub Shopping Center site. They also include increasing the storm
sewer capacity carrying water to Richfield Lake or Woodlake. The most cost-effective
solution is to utilize the existing depression on the Holy Angels Academy site for both
stormwater runoff from the Holy Angels Academy as well as to manage some of the street
flooding and safety issues occurring on 66~' Street at its low point.
If an agreement cannot be reached with the Holy Angels Academy for the dual use of this
property, then it is recommended that the Holy Angels Academy be required to meet
stormwater storage and treatment requirements for the entire parcel in conformance with

City standards. Furthermore, since this is an existing floodplain area, no filling or
additional development could take place that would increase the volume of runoff generated
from the parcel to this low point and no filling could take place on any property that is
below the elevation of the low point in 66`'' Street which is at approximately elevation
836.5.

This lettzr is to confirm ~n writing that the Academy is not able to ~Tant the City of Richfield a perpetual easement
for use of tht: drainagC pond to be IocatCd on the Noah end of the Academy property since the praper[y where the
pond is to be located is based to [he Academy by the Sisters of St. Joseph of Carondelet, St. Paul Province (thC
"Sisters"}. The Academy can only lease the pond area to the City under the game term remaining on its Lease with
the Sisters, which expires on July 31, 2026- Accordingly, the term of the Pond Lease betwCen the City and
Academy nt:eds to expire on July 31, 2026. The Academy will not agree to an automatic renewal term of the Pond.
LeasC in the event chat tht: Lease with the Sisters is extended for two reasons: (1) The Academy does not [kink that it
i~ in the bCSt interests ot'the Academy to bind future Boards to an automatic renewal of the Pond Leasz since the
present Board is unable to predict 2S years into the future what the use of this property will be at that time; and (2)
the Academy has only received approval from tht; Sisters for the currently proposed Pond Leasz without an
automatic renewal tCtm. However, tht: Academy will egret: that in the event that the Lease with the Si~tt;rs is
extended its then current Boacd will negotiate in good faith with the City for a renewal of the Pond Leak.
