L RECOMMENDED ACTION: By Motion: Accept bid minutes/tabulation and recommend an award of contract for the construction of the Penn Avenue Bridge, City Project 401-30-521, to Johnson Brothers Corp. in the amount of $20,247,391.56. And Support City staff efforts to secure additional funds for the project. II. BACKGROUND Council approved plans for the Replacement of the Penn Avenue Bridge over I-494 on June 11, 2001. Project Plans The Penn Avenue Bridge Project involves: • Removal of the existing Penn Avenue Bridge; • Construction of a new single-point diamond bridge including a signal on the bridge; • Construction of retaining walls and new ramps to I-494; 0917-Penn Bridge Award • New signalized intersection on Penn Avenue at the entrance to the Best Buy • campus; • Reconstruction of 78th Street frontage road west of Penn Avenue to connect to this new intersection • Widening of Penn Avenue from about 130 feet north of 77th Street in Richfield to about 125 feet south of the Southtown entrance drive in Bloomington; • .Modifications to the signal and intersection at the Southtown entrance drive • Realignment. of I-494 mainlines to place the new Penn Avenue Bridge pier in its permanent location relative to the future reconstruction of I-494; • Relocation of utilities along Penn Avenue; • .Construction of a new stormwater lift station in the southeast corner of the interchange; • Construction of a temporary exit ramp from eastbound 1-494 to Xerxes Avenue including a temporary traffic signal on Xerxes Avenue to serve traffic while the Penn Avenue Bridge is closed; and, • Provision of an extensive traffic control plan to divert traffic while the current Penn Avenue Bridge is removed. Cooperative Agreement • On September 10, 2001 the Council approved a Cooperative Construction Agreement with the Minnesota Department of Transportation (MnDOT) where the City shall recommend award to the low bidder before the State will award, approve, execute and administer the contract. • Additional Funding The low bid exceeded the Engineer's Cost Estimate by $974,000. The Minnesota Dept. of Transportation has suggested reserving additional Federal High Priority Project Funds for the Penn Avenue Bridge Project to anticipate cost, increases based on possible change orders during construction. MnDOT staff will explore qualifying other project costs for federal HPP funds to provide the City with the flexibility to use local funds for costs that clearly will be ineligible for Federal funds. Since project inception City staff have contacted the other participating governmental units .involved in the Penn Avenue Bridge Project to secure their financial support for this project. Bloomington, Hennepin County and the Minnesota. Department of Transportation have repeatedly insisted that they could not provide additional funds for this project. III. BASIS OF RECOMMENDATION A. POLICY The Replacement of the Penn Avenue Bridge over I-494 is consistent with the proposed reconstruction of I-494 and has been identified as a high priority capital improvement in the City's Comprehensive. Plan. • The Developer's Agreement between Richfield and Best Buy contains language that commits the City to replace Penn Avenue Bridge over I- 494. The Best Buy Environmental Impact Statement (EIS) identifies the existing Penn Avenue Bridge over I-494 as deficient and in need of .replacement. The work contained in this plan mitigates the negative traffic impacts identified in the Best Buy EIS. The ad for bid for the construction of the Penn Avenue Bridge was published in the Richfield Sun-Current on August 22 and August 29, 2001 and in the Construction Bulletin on August 17,24 and 31, 2001. B. CRITICAL ISSUES • The Richfield City Council must recommend award of contract prior to MnDOT awarding and executing the contract. C. FINANCIAL • The project is contained in the adopted 2001 Capital Improvement Budget. • An Engineer's estimate for construction costs only was calculated at .$19,273,186. The low bid exceeded the Engineer's Estimate. • City staff is recommending using an additional $2.6 million in Federal High Priority funds to cover these increased costs and to provide an adequate contingency during construction. • MnDOT will explore qualifying some of the project costs for federal funding to provide the City with additional flexibility to use its local funds for costs that clearly will be ineligible for Federal funds. • D. LEGAL • The City Attorney will be present at the Council Meeting to answer questions. IV. ALTERNATIVE RECOMMENDATION(S~ • The .Council may choose not to award the contract and ask to rebid the contract. This could delay the completion of the Penn Avenue Bridge. City staff does not believe that a better contract price would be received by rebidding and the lowest responsible bid is within 5% of the Engineer's estimate. V.
