94-8174rRESOLUTION NO. 8.74 RESOLUTION AUTHORIZING SUBDIVISION WAIVER (7015 and 7021 Penn Avenue) WHEREAS, an application has been filed with the City of Richfield which requests approval of a subdivision waiver for the division of certain parcels of land generally located at 7015 and 7021 Penn Avenue South, legally described on Attachment One, attached hereto and hereby made a part hereof (hereafter the subject property); and WHEREAS, the proposed division of land for which the subdivision wavier is sought is as legally described on Attachment Two, attached hereto and hereby made a part hereof; and WHEREAS, the three lots resulting from the subdivision waiver will comply with Section 515.09 of the City Code relating to lot area and width; and WHEREAS, the City has fully considered the request for approval of the subdivision waiver; and WHEREAS, the Council finds that compliance with the City Code Section 500.05, Subd 1 would result in unnecessary hardship and that failure to comply therewith will not interfere with the purposes of platting regulations of Section 500.01. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Minnesota, as follows: 1. A waiver for the subdivision of property legally described on Attachment One is hereby approved subject to the following conditions: a. That all future transfers of any of the property described in Attachment One shall be by parcel or parcels described in Attachment Two. b. That the minimum required front yard setback for the proposed lots be 47 feet. 2. Upon compliance with such conditions, City staff is authorized and directed to take any action necessary to effectuate this resolution and to authorize the recording of conveyances complying with the requests of this resolution.
