94-8160r22 RESOLUTION NO. 8160 RESOLUTION AUTHORIZING SUBDIVISION WAIVER (7717 NICOLLET AVENUE) WHEREAS, an application has been filed which requests approval of a subdivision waiver for the division of a certain parcel of land generally located at 7717 Nicollet Avenue, legally described on Attachment One, attached hereto and hereby made a part hereof (hereafter the subject property); and WHEREAS, the proposed division of land for which the subdivision waiver is sought is as legally described on Attachment Two, attached hereto and hereby made a part hereof; and WHEREAS, the proposed division of the subject property would facilitate the upgrade of 77th Street; and WHEREAS, the City has fully considered the request for approval of the subdivision waiver; and WHEREAS, the Council finds that compliance with City Code Section 500.05, Subd. 1 would result in unnecessary hardship and that failure to comply therewith will not interfere with the purposes of platting regulations of Section 500.01. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Minnesota as follows: 1. A waiver for the subdivision of property legally described on Attachment One is hereby approved subject to the following condition: a. All future transfer of any of the property described in Attachment One shall be by parcel or parcels described in Attachment Two. 2. Upon compliance with such condition, City staff is authorized and directed to take any action necessary to effectuate this resolution and to authorize the recording of conveyances complying with the request of this resolution. Ferber, City Cler Resolution No. 8160 ATTACHMENT ONE PROPERTY DESCRIPTION That part of the west 315.00 feet of the Southeast Quarter of Section 34, Township 28, Range 24, lying south of East 77th Street and north of Interstate Highway No. 494, except roads, being part of Government Lot 8, according to the United States Government Survey thereof in and for the County of Hennepin and State of Minnesota. Resolution No. 8160 ATTACHMENT TWO PROPERTY DESCRIPTIONS PARCEL A That part of the west 315.00 feet of the Southeast Quarter of Section 34, Township 28, Range 24, lying south of East 77th Street and north of Interstate Highway No. 494, except roads, being part of Government Lot 8, according to the United States Government Survey thereof in and for the County of Hennepin and State of Minnesota. Except that part of the foregoing tract which lies easterly of the east right of way line of Nicollet Avenue and which lies southerly of the south right of way line of East 77th Street and which lies northwesterly of a curve concave to the southeast having a radius of 19.50 feet. The east right of way line of Nicollet Avenue and the south right of way line of East 77th Street are tangent to said curve. PARCEL B That part of the west 315.00 feet of the Southwest Quarter of the Southwest Quarter of the Southeast Quarter of Section 34, Township 28, Range 24, Hennepin County, Minnesota, which lies easterly of the east right of way line of Nicollet Avenue and which lies southerly of the south right of way line of East 77th Street and which lies northwesterly of a curve concave to the southeast having a radius of 19.50 feet. The east right of way line of Nicollet Avenue and the south right of way line of East 77th Street are tangent to said curve.
